APPLICATION SUMMARY FILE NAME: REGAL CINEMAS SIGN VARIANCE CASE NO: Sign Variance (VAR) VAR2005-00025 APPLICANT: TVA Architects OWNER: BV CentercV, LLC Attn: David Gellos 649 NW 121 Street 920 SW Sixth Avenue, Suite 1500 Gresham, OR 97030-5536 Portland, OR 97204 REQUEST: The applicant requests approval for a variance to the sign standards to allow a sign to project above the roof line. The sign will be mounted to an architectural feature approved by the City of Tualatin and will project approximately 15 feet above the roof line. The architectural feature projects approximately 20 feet above the roof line. LOCATION: 7329 SW Bridgeport Road, WCTM 2S113AC, Tax Lot 01200. ZONE: MUC-1: Mixed Use Commercial - 1. The MUC-1 zoning district, which is designed to apply to that portion of the Durham Quarry site within the City of Tigard, is a mixed-use commercial district bounded by 72nd Avenue, Findlay Street and the Tigard, Tualatin and Durham city limits. This site is the subject of an intergovernmental agreement between the cities of Tigard and Tualatin. Pursuant to that agreement the City of Tualatin shall furnish all planning, building and associated development review/permit services for the property with the exception of sign permits. This zoning district is intended to mirror the City of Tualatin's Mixed Use Commercial Overlay District (TDC, Chapter 57). It permits a wide range of uses including commercial lodging, general retail, offices and housing. Additional uses, including but not limited to major event entertainment and motor vehicle retail fuel sales, are permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.370, 18.385, 18.390, 18.520 and 18.780. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section V of this decision. VAR2005-00025 - REGAL CINEMAS SIGN ADJUSTMENT PAGE 1 OF 7 CONDITION OF APPROVAL THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO THE ISSUANCE OF SIGN PERMITS: 1. The applicant shall ensure that the following parameters are followed for any sign illumination: A. Surface brightness. The surface brightness of any sign shall not exceed that produced by the diffused output obtained from 800 milliampere fluorescent light sources spaced not closer than eight inches, center on center. B. No exposed incandescent lamps. Any exposed incandescent lamp which exceeds 25 watts shall not be used on the exterior surface of any sign so as to expose the face of such bulb or lamp to any public street or public right-of- way with the exception of electronic information signs. 2. Provide a copy of this decision with your sign permit application. SECTION Ill. BACKGROUND INFORMATION Site History: This site is part of the Durham Quarry special district. That district was established through amendments to the zoning map and comprehensive plan and ultimately designated as the MUC-1 zone. A predominant portion of the MUC-1 zone is in the City of Tualatin, with only a single parcel lying within Tigard. Through an intergovernmental agreement, the City of Tualatin is responsible for reviewing land use proposals for this district. The Bridgeport Village project was approved on an appeal to the Tualatin City Council. That decision is final. The intergovernmental agreement stated that following the initial review, subsequent approvals, including sign permits, would be the responsibility of the corresponding jurisdiction. When Tualatin reviewed the proposed design for the Regal Cinemas, the height of the tower element on the building was an issue, and through the decision was required to be lowered to 70 feet. That review did not consider the signage that was to be placed on the tower. While Tualatin's sign code would permit such a sign, Tigard's sign code prohibits signs above the roof line. Vicinity Information: The site is located on the west side of Interstate 5, at the intersection of SW Bridgeport Road and SW 72"d Avenue. To the south is City of Tualatin, to the west is the City of Durham. To the north are Tigard industrial uses and to the east are commercial retail uses. There are two single family homes to the northwest of the site that immediately are adjacent to this site. Proposal Description: The applicant is seeking to obtain a variance to the limitations against placement of wall signs above the roof line. This is in part due to the unusual placement of the building and its orientation to the site, as well as to accomplish a specific design theme that is intended to complement the architectural elements of the building. The sign will be placed on the tower element and extend approximately 15 feet above the roof line. Because the sign code exception criteria do not address this particular type of deviation from the sign standards, a standard variance is required. VAR2005-00025 - REGAL CINEMAS SIGN ADJUSTMENT PAGE 2 OF 7 SECTION IV. PUBLIC COMMENTS Several phone inquiries were received, generally having to do with the overall Bridgeport Project and not specifically the proposed sign. Some neighbors to the southwest worried that they would be able to see the sign. One owner of commercial property noted that the sign may direct people to park on his property and use the pedestrian cut through to get to the theatre. Three letters were received from Roland Signett (City Administrator for the City of Durham), Patricia Saab, and James Church. These letters raise the following general issues: 1) The neon sign projecting 20' to 30' above adjacent buildings is out of character with other signage and the architecture of the project. The building design and pylon, to which the sign is attached, was approved by the Tualatin Design Review Board. While Tualatin's Design Review Board did not approve the sign attached to the pylon, the drawings that they reviewed included this signage. There was no discussion regarding a need to limit or reduce the height of the proposed letters. The applicant further notes that both the owner and developer of the Bridgeport Village are in support of the proposed signage. 2) The sign appears to serve no purpose in attracting casual passersby as it is not clearly visible from either SW Bridgeport Road or SW 72"d Ave. The sign serves as an apex to the visual corridor in the Bridgeport Village design. Bridgeport Village is coined a "Lifestyle Center" with entertainment uses a cornerstone of this particular product. The Regal Cinemas building is emphasized by its placement at the end of the vista, with the sign pylon to signify the node. Similar to a clocktower, it draws the viewer's attention and helps identify a place to gather. Could this be achieved without signage? Indeed, but it loses its significance and ability to communicate the purpose of both the pylon and the main building to which it is attached without some sort of message as to what is contained in the building. 3) The largest concern is with light spillover to other immediate properties. If approved, there should be no reflective surface behind the letters or to the side that would cause additional light dispersal. If possible the light should be shielded so that it is only visible to the south driveway approach. Tigard's sign code contains the following restrictions with regard to lighting levels: Surface brightness. The applicant shall be so advised. VAR2005-00025 - REGAL CINEMAS SIGN ADJUSTMENT PAGE 3 OF 7 0 • 4) The livability and property values will be adversely impacted. How are residents going to be able to sleep or to have peaceful enjoyment of their homes? It is circumstances such as this that may be covered by Measure 37. It is important that the scope of this variance be considered. Between what is presently allowed, and what is proposed, the difference is the addition of three letters. It is beyond reason to assume that this will have any effect to property values. By requiring the lighting levels of the sign to meet the standards described previously, there should be no glare onto adjacent properties that would impact peaceful enjoyment of their homes. Also, Measure 37 only applies to limitations on uses of your own property, not what is permitted on an adjacent parcel. In fact, the opposite may be true; the applicant may have a Measure 37 claim against Tigard since the restrictions on signage were not put into effect until after the property was purchased. SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS VARIANCES AND ADJUSTMENTS: The Director shall approve, approve with conditions, or deny an application for a variance based on finding that the following criteria are satisfied: a. The proposed variance will not be materially detrimental to the purposes of this title, to any other applicable policies and standards, and to other properties in the same zoning district or vicinity; The applicant notes that the intent of the purpose for the signage code is to maintain reasonable slgnage size and prevent signs from exceeding the maximum building height in the zone. Staff adds that another aspect of the restriction on sips projecting above the roof line is to prevent the situation of each business attempting to overshadow the businesses in front or behind them. This was more common in the past, and the result was a clutter of roof signs extending ever higher along the skyline. In this particular case, the entire complex has been designed as a complementary array of styles and slgnage that were designed to work in concert with each other. The applicant states that the sign in this case is attached to an architectural pylon constructed under the City of Tualatin building permit and which met the final approved height through the architectural review board. The architectural pylon is integral to the design of the Cinema building and the greater Bridgeport Village. Other properties in the vicinity, most notably to the south (the direction the sign is oriented) are retail commercial properties and will not be impacted by the sign height. Residential properties are at a vantage point that from which the sign will not be visible. As a result, it is determined that this is an unusual case resulting from a design established through an agreed upon process and code. There is no evidence that granting the variance would be detrimental to other properties. This zone applies only to the Bridgeport Village project and likewise, these particular circumstances only apply to this project. b. There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; The special circumstance in this case is the fact that this project was approved throu h an intergovernmental agreement between Tigard and Tualatin. Following Tualatin's design approval (which did not approve signage) another intergovernmental agreement was signed to clarify what jurisdiction would be responsible for future land use and signage reviews. The applicant has submitted a letter from the City of Tualatin that explains that the signage as proposed would meet the City of Tualatin's sign code restrictions. Should the applicant been aware earlier on in the process, perhaps a completely different approach to the building element or design would have been proposed. Unfortunately, this VAR2005-00025 - REGAL CINEMAS SIGN ADJUSTMENT PAGE 4 OF 7 could not have been made apparent to the applicant since the controlling regulations for signage had not yet been assigned. The applicant had no control over the change in the requirements that occurred in the midst of the development approval process. While the change would affect all other properties in the same zoning district, this property is the only MUC-1 zoned parcel in the City. Other MUC-1 parcels are under the City of Tualatin's jurisdiction. c. The use proposed will be the same as permitted under this title and City standards will be maintained to the greatest extent that is reasonably possible while permitting reasonable economic use of the land; There is no exception to the proposed use. Indoor entertainment is an outright permitted use in the MUC-1 zone. City standards, apart from the limited exception affordedfor three of the five letters in the proposed sign, will continue to be met. The building height will not be exceeded. d. Existing physical and natural systems, such as but not limited to traffic drainage dramatic land forms or parks will not be adversely affected any more than would occur if the development were developed as speci ed in the title; and The installation of a sign in the proposed location will have no effect on traffic, since traffic will only see the sign once travelers enter the Bridgeport Village site. There will be no effect on drainage, since storm water will not be impeded by the signage and all runoff will be conveyed via the approved drainage system in the development. There are n4 dramatic land forms or parks identified nearby that would be influenced by this sign variance. e. The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. As discussed previously, the applicant is subject to this special circumstance due to a handoff of jurisdictional review from Tualatin to Tigard. This is not a self imposed hardship. The request will result in a sign that is the same as what was presented to the public during the Design Review for the cinemas. Although the sign was not approved during that review, the other elements of the building's design were created and the sign developed as an integrated package. The requested variance will allow a minor extension of the proposed sign above the roof line, that will be partially mitigated for by the fact that the sign is on one side of the pylon extension, faces interior to the project, and is below the uppermost part of the pylon. COMMERCIAL ZONE STANDARDS: Chapter lts.bZU specifies the base zone requirements for the MUC-1 Zone. The proposed use, indoor entertainment, is a permitted use in the MUC-1 zone, per Section 18.520.030. VAR2005-00025 - REGAL CINEMAS SIGN ADJUSTMENT PAGE 5 OF 7 The proposed sign is located toward the rear of the Bridgeport Village project, but in the front of the cinema building. The pinnacle of the building pylon is 70 feet tall. The sign, while not specifically subject to the building height limitations in the zone, will nevertheless be 5 feet shorter than the maximum height allowed for buildings in this zone. No other aspects of the site will be affected by the proposal. A large extensive front facade could have been created to increase the height of the roofline, and would permit such a sign, yet the design of such a conforming facade would have questionable aesthetic appeal. SIGNS: Ma__ ier 18.780 specifies the types of signs and the restrictions for their placement and design. Signs in the MUC-1 Zone are subject to the same sign requirements as siggns in the C-G zone. Section 18.780.130.8.2 permits wall signs subject to the foflowin standards: 2. Wall Tgns: (a) Wall signs, including illuminated reader-boards, maybe erected or maintained bout shall not exceed in gross area 15 percent of any building face on which the sign is to be mounted; 1b) Wall signs may not project more than 18 inches from the wall or extend above he wall to which they are attached; and (c) If it is determined under the development review process that the wall sign's visual appeal and overall design quality would be served, an additional 50% of the allowable sin area may be permitted. No copy will be permitted, however, in the additional area permitted. For purposes of this subsection, "copy" includes symbols, logos, and letters. The proposed sign and associated additional signs do not even approach the 15% of the wall area limitation. The letters on the sign will not project more than 6 Inches, but will extend above the wall to which it is attached. That particular provision is the subject of this variance. No additional sign area is being requested as part of this application. SECTION VI. OTHER STAFF COMMENTS No staff comments were received. SECTION VII. AGENCY COMMENTS No comments from other agencies were received. A letter from the City of Durham was received and is discussed under public comments at the beginning of this decision. SECTION VIII. I live within 500 feet of the proposed development area. Following are my concerns regarding potential negative impact of granting the sign code variance to Regal Cinemas. Light from the sign will be an annoyance to residents of multiple family dwellings located to the west of the cinemas. It appears the sign will be lighted on 3 sides. My understanding is that the adjacent property will continue to be multiple family dwelling, not rezoned to commercial. Extending a lighted sign above the roof line of the will not make the the cinema building more visible within the complex. I have driven around the Village and through it as much as is possible currently. Other buildings and architecture will block it from view. It will not be visible from Bridgeport Road. The Village is of a size that it will be easy to find the cinema. The top of the proposed sign will be a potential distraction to drivers on Upper Boones Ferry Road, an area of frequently congested traffic. The sign extending above the roof line would be visible from the north end of the Tiburon Office Park to the south end of the Durham Professional Office Bldg--unattractive and unnecessary and unreadable. The proposed sign does not seem in line with the architecture of Bridgeport Village and restrained signage now present. I am concerned the proposed cinema sign will appear out of place and ordinary on a very attractive building. recommend the Planning Commission carefully consider this application and its merits. I recommend the request be denied. The neon sign projecting 20' to 30' above adjacent buildings appears to be out of character with both the signage on other buildings in Bridgeport Village and with the architectural integrity of the Village project as a whole. 2. The sign appears to serve no purpose in attracting the casual passerby as it would not be clearly visible from either Bridgeport Rd. or 72"d Ave. 3. Of more concern for the residents of Durham is the potential light spill over to the apartment complex located on Findlay Rd, and to other immediate properties. As designed, it appears the face of the sign will be oriented to the south. However, as it would rise considerably above the parking garage on the west side it is likely that the side glow from the neon letters will be clearly visible from in the vicinity of Upper Boones Ferry Rd. and Findlay Rd. If the variance is approved, there should be no reflective surface behind the letters or to the side that would cause additional light dispersal. It is our concern that the additional sign height and size will adversely impact the livability for our residents. In turn the increased signage will negatively impact the value of our property and our income. In addition, the homes on the other side of Upper Boones Ferry Road will also be negatively impacted. Their livability and property values will also be adversely impacted. How are our residents going to be able to sleep or to have peaceful enjoyment of their homes? It is circumstances such as this that may be covered by Measure 37. We are requesting that the Community Development and the Planning Division please take the objections of the neighborhood and property owners into consideration and please deny this request.- There are certainly other options for the Cinema to promote, advertise and enhance their business. They should not be allowed to do this at the permanent expense of the neighborhood. City of Tigard staff, the Regal Cinemas architect and a representative of the Bridgeport Village developer discussed a variance application to allow a proposed sign on the south elevation of the Regal Cinema building currently under construction. The purpose of this letter is to provide information about the Architectural Review of the Regal Cinema building in respect to the architectural features approved and explain how Tualatin's sign regulations would apply to the proposed south elevation signage. A copy of the Regal Cinemas building south elevation with the signs to be addressed in the Regal Cinemas variance application is Attachment 1. As per Intergovernmental Agreement between the Cities of Tigard and Tualatin for planning and permitting in the Bridgeport Village project, the architectural features of the Regal Cinemas building and other Bridgeport Village buildings were reviewed and approved in Architectural Review AR-03-09 by the Architectural Review Board and affirmed upon appeal of certain other issues by the City of Tualatin City Council. The review and approved plans for the cinema building exterior included a tall, cylindrical pylon feature on the south building elevation above the marquee and ticket windows and facing the theater's central entry plaza. The pylon was viewed as an architectural feature of the building, functioning as a decorative element of the south building wall. With a condition limiting the pylon height, the cinema building design including the pylon element was deemed to be in compliance with the standards for building design that apply to the Bridgeport Village development. In compliance with AR-03-09, plans for the south elevation of the cinema building with the pylon feature were approved by the Tualatin Planning Division to be processed for final building plan review and permit for construction. (whether in the City of Tigard or the City of Tualatin) no sign copy, including lettering or graphic images, was approved in the Architectural Review for the Regal Cinema. As per the Intergovernmental Agreement, the authority for review and permitting of signs in Bridgeport Village remained with the city of jurisdiction. Tualatin and Tigard each have been handling the sign permit applications submitted for the portions of Bridgeport Village in their respective jurisdictions. In November of 2004, the City of Tualatin adopted new sign regulations for the Mixed Use Commercial Overlay District (MUCOD) that is the Tualatin planning designation for the properties within the Bridgeport Village development (Tualatin Development Code 38.225)(Attachment 2). The MUCOD sign regulations allow various kinds of signs including wall signs on the buildings in Bridgeport Village. At your request, I reviewed the proposed "REGAL 18" sign (Attachment 1). with respect to the sign regulations that apply to the portions of the Bridgeport Village development that lies within City of Tualatin. I determined that the proposed "REGAL 18" copy would be a wall sign based on the following considerations and sign standards: 1. The pylon and marquee features on the south elevation of the Regal Cinemas building were approved as architectural features in AR-03-09. The pylon extended from a position above the marquee to a point approximately 16 ft. taller the parapet wall. Because the pylon exists as an architectural feature and is considered part of the elevation wall, copy attached to it would not constitute a "roof sign" prohibited by TDC 38.130(15) and would not be considered a "Blade Sign" allowed by TDC 38.225(1)(e). 2. The pylon is an element of the building elevation and its surfaces are treated as part of the building wall. Sign copy attached to any part of the pylon feature would be subject to the Wall Sign provisions of TDC 38.225(1)(c) in regard to number of signs, sign location, sign face height, sign area and illumination. 3. As shown in the "Bridgeport Cinemas" Partial Exterior Elevations drawing (Attachment 1) the copy "REGAL 18" would be a wall sign. I hope this information proves to be of assistance. The proposed variance will not be materially detrimental to the purposes of this title, to any other applicable policies and standards, and to other properties in the same zoning district or vicinity. The proposed variance is in response to Section 18.780.130.C.2.b of Title 18 Chapter 18.780 Signs, which states "Wall signs may not project more than 18" from the wall or extend above the wall to which they are attached; and". It is our understanding that the intent of this section is to maintain reasonable signage size and prevent signs from extending above building maximum heights as dictated by other provisions of the code. The sign being addressed in this variance is attached to an architectural pylon constructed under the building permit as approved by the City of Tualatin. This building element is within the maximum building height allowed by the Mixed Use Commercial zone in which it is located and the signage attached to this face does not extend above this element. Therefore, we do not feel that the approval of this condition would be detrimental to the intent of Title 18 or to any other policy or standard of the City of Tigard. This architectural pylon element with signage is integral to the design of the Cinema building and the greater Bridgeport Village retail development as approved by the City of Tualatin. Both the Owner and the Developer of the Bridgeport Village are in support of the proposed signage as indicated by their approval of the overall building design as submitted to the City of Tualatin. Properties within the vicinity are primarily zoned for retail or commercial use and as such would not be detrimentally affected by granting of this variance. The limited residential properties within the vicinity of this project are located behind the property, at a vantage point from which the signage would not be visible. b. There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control and which are not applicable to other properties in the same zoning district. The design for the Regal Bridgeport Cinemas was approved by the City of Tualatin on July 21, 2003. The exterior building elevation drawings contained in the approval package included the pylon element and signage at the front facade. Conditions of approval included the reduction in height of the architectural pylon with "REGAL" signage to a 70'-0" maximum height. This revision was incorporated into the building permit documents which were approved for construction by the City of Tualatin in July 2004. Under City of Tigard Signage Code Chapter 18.780 of Title 18, wall signs are not permitted to extend above the wall to which they are attached. Therefore, by decision of the City of Tigard, this sign as represented on the building that was approved by the City of Tualatin, is no longer allowed except as may be permissible by variance. c. The use proposed will be the same as permitted under this title and City Standards will be maintained to the greatest extent that is reasonably possible while permitting reasonable economic use of the land. The Bridgeport Village property is zoned Mixed Use Commercial (MUC) and as such the Cinemas building is a permitted use within this zone. All zoning standards have been met including a maximum building height of 70'-0". The proposed variance is related only to the signage on the front of the building and more specifically three (3) of the (5) letters in the name "REGAL" which would extend above the adjacent wall. The letters are to be mounted to an architectural pylon element which is in full compliance with the City of Tualatin zoning standards and which does not exceed the building height standard. d. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were developed as specified in the title. The architectural pylon to which the signage would be attached is being constructed as permitted under the main building permit as approved by the City of Tualatin. Attaching the letters "REGAL 18" to this sign will not have an adverse affect on the existing natural or physical systems including traffic, drainage, land forms, or parks. The proposed sign is mounted on the front facade of the Cinemas building which is located in the greater Bridgeport Village retail development. The Cinemas building is surrounded on three sides by similar retail buildings and by surface and structured parking which are part of the Bridgeport Village development. An existing commercial property abuts the rear property line; however the letters of the sign would not be visible from that vantage point. e. The hardship is not self-imposed and the variance requested is the minimum which would alleviate the hardship. The design for the Regal Bridgeport Cinemas was approved by the City of Tualatin on July 21, 2003. The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. IMPACT STUDY 18.390 An impact study is required for all Type II applications. The impact study shall quantify the effect of the development on public facilities and services. The study shall address, at a minimum, the transportation system, including bikeways, the drainage system, the parks system, the water system, the sewer system, and the noise impacts of the development. For each public facility system and type of impact, the study shall propose improvements necessary to meet City standards and to minimize the impact of the development on the public at large, public facilities systems, and affected private property users. As we discussed earlier this week, the City of Tualatin provided design review for the Bridgeport Cinemas project and subsequently developed custom signage requirements for the entire development encompassing Bridgeport Village. REGAL letters mounted to the architectural feature will not be materially detrimental; rather, o will be consistent with the unique character of the Village and the custom sign provisions developed to reinforce the identity of the development. The originally d approved design documents illustrate the REGAL letters affixed to the architectural feature. ° ~o 0 5 Bridgeport Village is a unique development and the Cinemas is located to take maximum advantage of the Village master plan. The Cinemas functions as a terminus or focal point to the distant walking street that extends to the far reaches of the development. In this way, the REGAL identity reinforces the sense of place and W importance this focal creates. o 0 Certainly, there are other issues that may be cited as justification for allowing the letters to be installed on the architectural feature.
