APPLICATION SUMMARY FILE NAME: ATLANTA COMMERCIAL BUILDING SIDEWALK ADJUSTMENT CASE NO: Street Improvement Adjustment (VAR) VAR2004-00088 . PROPOSAL: The applicant is requesting approval to construct a six foot curb tight sidewalk along SW 68th Parkway instead of providing the required 13-foot sidewalk with tree wells. The location of the sidewalk is adjacent to the approved Atlanta Street Commercial Building (SDR2003-00009). APPLICANT: Malcolm & Sharon Eslinger, LLC. OWNER: Same 11575 SW Pacific Hwy, PMB 160 Tigard, OR 97223 DESIGNATION ZONING: MUE; Mixed Use Employment. The purpose of the MUE zoning district is to provide a wide range of uses including major retail goods and services, business/professional offices, civic uses and housing. LOCATION: 6830 SW Atlanta Street; WCTM 1 S136DD, Tax Lot 900. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.370, 18.390 18.520, 18.620, and 18.810. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section V of this decision. VAR2004-00088-ATLANTA COMMERCIAL BUILDING SIDEWALK ADJUSTMENT PAGE 1 OF 5 SECTION III. BACKGROUND INFORMATION Site History The subject property received Site Development Review approval with an Adjustment to the minimum spacing of driveways and streets in order to develop a .37 acre parcel with a two story 6,456 square foot office building and parking with access to SW Atlanta Street to the north and SW Baylor Street to the south. Vicinity Information The subject site is located on the south side of SW Atlanta Street and the west side of SW 68th Avenue. The site is bordered on all sides by property zoned Mixed Use Employment (MUE). The property to the west is currently developed with a single-family home. This building is currently utilized for commercial use without land use approval. Enforcement actions have begun. The property to the south is developed as a commercial office building under the same ownership as the subject parcel. Site Information and Proposal Description: The applicant is requesting approval to construct a six foot curb tight sidewalk along SW 68tH Parkway instead of providing the required 13-foot sidewalk with tree wells. The location of the sidewalk is adjacent to the approved Atlanta Street Commercial Building (SDR2003- 00009). SECTION IV. PUBLIC COMMENTS No public comments were received. SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS VARIANCES AND ADJUSTMENTS: Section 18.370.020.C.11 states that an application for a street improvement adjustment must meet the following criteria. Strict application of the standards will result in an unacceptably adverse impact on existing development, on the proposed development, or on natural features such as wetlands, steep slopes or existing mature trees. According to Chapter 18.620 (Tigard Triangle Design Standards) the Atlanta Commercial Building is required to provide either a nine-foot wide sidewalk with a four foot planter strip or a 13-foot sidewalk with street trees planted in tree wells separating the sidewalk from the street. The strict application of this standard will result in a sidewalk significantly closer to the approved Atlanta building. This will not allow the construction of a desirable ADA accessible building entrance from SW 68th Parkway. In addition, constructing a larger sidewalk will require increasing the on-site retaining wall height by approximately 3.5 feet (to 11.5 feet) and requiring a bearing wall to be constructed approximately two feet above the proposed second floor elevation. VAR2004-00088 ATLANTA COMMERCIAL BUILDING SIDEWALK ADJUSTMENT PAGE 2 OF 5 The adjacent property to the south, the Baylor Office Building, was approved in the year 2000 with a six-foot wide curb tight sidewalk along SW 68 Parkway to allow for the continuation of the existing curb tight sidewalk along the length of SW 68th Parkway. The application of the separated sidewalk standard will result in an unattractive streetscape that will not match the existing sidewalks along SW 68th Parkway. The applicant has included pictures in their application that show curb tight sidewalks along the entire frontage of SW 68th Parkway. FINDING: Based on the analysis above, staff finds that the strict application of the 13-foot wide sidewalk criteria creates an adverse impact to the proposed development. The application of the larger sidewalk would affect a proposed ADA entrance from SW 68th to the approved Atlanta building. Existing steep slopes would require a larger retaining wall to support the additional impervious area of the sidewalk, and a bearing wall, which would hinder ground floor window requirements. Therefore, the adjustment criteria have been met. MUE ZONING STANDARDS: Chapter 18.520 specifies the base zone requirements for the MUE zoning district. [2] Includes all buildings and impervious surfaces. [4] Notwithstanding the requirements of section 18.715.020, minimum and maximum density shall be determined for residential only projects using the number of residential units per acre shown in the above table. The provisions for density transfer described in section 18.715.030.b apply, using the minimum and maximum density shown in the above table. Any mixed-use or commercial only development does not have a minimum density requirement. [5] For purposes of determining floor area ratio and residential densities, the net development area shall be uses to establish the lot area, determined per section 18.715.020.a. [6] Adjustments to minimum density in the washington square regional center area subject to the standards set forth in section 18.630.020.e. [8] No setback shall be required except 20 feet shall be required where the zone abuts a residential zoning district. [11] There shall be no minimum front yard setback requirement; however, conditions in Chapters 18.745 and 18.795 must be met. VAR2004-00088-ATLANTA COMMERCIAL BUILDING SIDEWALK ADJUSTMENT PAGE 3 OF 5 • FINDING: As demonstrated in the table above, the requested adjustment will not alter the applicant's plans, which comply with the dimensional standards of the MUE zone. .Street And Utility Improvements Standards (Section 18.810): ec ion MUMMA; states a a planter strip separation of at least five feet between the curb and sidewalk shall be required in the design of streets, except where the following conditions exist: there is inadequate right-of-way, the curbside sidewalks already exist on predominant portions of the street; it would conflict with the utilities, there are significant natural features (large trees, water features, etc.) that would be destroyed if the sidewalk were located as required, or where there are existing structures in close proximity to the street (15 feet or less) Additional consideration for exempting the planter strip requirement may be given on a case by case basis if a property abuts more than one street frontage. The above standard allows exemptions to the planter strip requirement for treets that are developed predominantly with curb tight sidewalks. Southwest 68"' Parkway is ppredominantly developed with curb tight sidewalks. Therefore, the requested adjustment to continue the western sidewalk along SW 68 as a six foot curb tight sidewalk meets this criterion. FINDING: Based on the analysis above, the Street and Utility Improvements Standards have been met. SECTION VI. OTHER STAFF COMMENTS No objections were received. SECTION VII. AGENCY COMMENTS Owest has reviewed the proposed and has no objection to it. SECTION VIII. The Atlanta Commercial Building Site Development Review application (SDR 2003-00009) was approved on October 7, 2003. The Conditions of Approval (Condition 17) require the construction of a sidewalk separated from the curb with a planter strip along SW 68th Parkway. This application is requesting that Condition 17 be modified to allow the construction of a curb tight sidewalk along SW 68th Avenue because of the existing curb tight sidewalk locations adjacent to this site and topographic constraints (please see the Preliminary Development Plans and photos 1-4). The existing on-site slopes (exceeding 20%) and the Tigard Triangle design standards make constructing a planter strip impractical. The construction of a planter strip along SW 68th Avenue would place the sidewalk significantly closer to the building, which will not allow the construction of a desirable ADA accessible building entrance, and will create an unattractive streetscape that will not match the surrounding area. In addition, constructing a sidewalk with a planter strip will require increasing the on-site retaining wall height by approximately 3.5 feet (to 11.5 feet) and require a bearing wall to be constructed approximately 2 feet above the proposed second floor elevation. This same situation applied to the Baylor Court Office Building site located directly to the south of this project (see photo 4). This project (SDR2000-00024) was approved April 12, 2001 with a curb tight sidewalk along SW 68th Parkway to allow for the continuation of the existing curb tight sidewalk located south of the site. In addition, investigation of the surrounding areas has shown that none of the sites along SW 68th Parkway, south of the intersection with SW Atlanta Street, have planter strips. The attached map and photos show examples of the SW 68th Parkway frontage and the sidewalk locations. It is not in the City's best interest to require the construction of a sidewalk with a planter strip for 140 feet before the intersection with SW Atlanta Street because the entire street to the south contains curb tight sidewalk. Requiring this design standard will result in a substantial increase in construction cost • 0 for the proposed building (increases the bearing wall height by approximately three feet), an unattractive streetscape (front windows at ground level and a planter strip that does not conform with the remaining SW 68th Parkway frontage), an undesirable ADA accessible building entrance, and a dangerously tall retaining wall adjacent to a busy street. The strict application of this design standard, requiring a sidewalk separated by a planter strip, will result in an unacceptably adverse impact on the proposed Atlanta Commercial Building development. SW Atlanta Street will be improved to current City standards. These improvements will include widening the street to a half-width of 22 feet from centerline to face of curb, with a planter strip and sidewalk. The site will be accessed from SW Atlanta Street. SW 68`h Parkway is currently improved with 22 feet of travel surface and curb. Frontage improvements to SW 68th Parkway will include adding a six foot wide curb tight sidewalk along the projects frontage and re-constructing the curb return between SW 68th Parkway and SW Atlanta Street. DRAINAGE SYSTEM: Stormwater from the offsite street improvements for SW 68`h Parkway will continue to be routed into the existing storm system. The requested adjustment will not affect the existing or proposed stormwater system. Stormwater runoff from SW Atlanta Street will be routed to a catch basin and then into the existing storm system in the street. More information on the stormwater system is available in the Preliminary Stormwater Report for the Atlanta Building. PARKS SYSTEM: This development is not proposing to donate any land to the City of Tigard for open space or parks. WATER SYSTEM: The commercial building will be served from the existing 8" water main flowing north of the site. This adjustment will not affect the existing or proposed water system. SEWER SYSTEM: The commercial building will be connected to the 8" sanitary main in SW 68th Parkway. This adjustment will not affect the existing or proposed sewer system. 1 c ~ • NOISE IMPACTS: This proposed development is a commercial office building in a mixed commercial/residential area. This development should not generate any out of the ordinary noise impacts to the surrounding neighborhood.
