APPLICATION SUMMARY FILE NAME: OAK TREE II APARTMENTS VARIANCE CASE NO.: Variance (VAR) VAR2004-00074 PROPOSAL: The applicant received Site Development Review approval (SDR2004- 00007) to construct a 108-unit multi-family development complex containing five, three-story buildings including a clubhouse, management office, garages, and carports on an approximately 6.12 acre site. Condition of Approval (#19) required the applicant to apply for a Variance to the driveway access spacing standard (18.750.030.H) to allow Building "E" of Oak Tree II (OT2) Apartments to utilize the existing Oak Tree I (OT 1) Apartments driveway access on Durham Road. A variance to the spacing standard is required because it cannot be met, even with the joint access required by Condition of Approval 19. This review addresses the required variance request. APPLICANT: OT2, LLC OWNER: Same c/o Ossey Development Corp. Attn: Richard B. Ossey 5437 Rosalia Way, Suite 100 Lake Oswego, OR 97035 LOCATION: Corner of SW 108th Avenue and SW Durham Road; WCTM 2S115AA, Tax Lots 700, 1000, 1100 and 1200. ZONE: R-25; Medium High-Density Residential. The R-25 zoning district is designed to accommodate existing housing of all types and new attached single-family and multi-family housing units at a minimum lot size of 1,480 square feet. A range of civic and institutional uses are permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.370, 18.390, 18.705, 18.795. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. BACKGROUND INFORMATION Site Histor e su 1ec 6.12-acre property is forested vacant land bisected by a ravine. There is no record of previous land use activity prior to the current approved plan to construct a 108-unit multifamily development (SDR2004-00007). The subject variance request is required as a condition of this approval. Vicinit Information: The subject site is located south of SW Durham Road and west of SW 108~h Avenue. The subject property and adjacent properties east and west are zoned R-25. Across Durham to the north properties are zoned R-7. South of the proposed development properties are zoned R-4.5. Site Information and Proposal Description: The applicant receive bite Development Review approval (SDR2004-00007) to construct a 108-unit multi-family development complex containing five, three-story buildings including a clubhouse, management office, garages, and carports on an approximately 6.12 acre. Condition of Approval #19 requires the applicant to apply for a variance to the driveway access spacing standard (18.705.030.H(3) to allow Building E of Oak Tree II Apartments to utilize the existing Oak Tree I Apartments driveway access on Durham Road. The joint access would avoid a new access onto Durham Road that would be closer to the intersection than the existing access. However; the existing access does not meet the 600-foot spacing standard. Therefore, a variance is required. SECTION IV. COMMENTS FROM PROPERTY OWNERS WITHIN 500 FEET No comments were received from property owners within 500 feet. SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS VARIANCES AND ADJUSTMENTS: Section 18.370.010 states that the Director shall approve, approve with conditions, or deny an application for a variance based on finding that the following criteria are satisfied: The applicant has requested a variance to 18.705.030.H: Access Management. Section 18.705.030.H(3) states: ...The minimum spacing of driveway and streets along an arterial shall be 600 feet. Durham Road is identified as an arterial in TI ard's Transportation System Plan. The proposed access would utilize an existing driveway that serves the Oak Tree I Apartments that is 482 feet (from centerline to centerline) from the intersection of Durham Road and 1081 Avenue to serve the proposed Building E of the approved Oak Tree II Apartments. The proposed variance will not be materially detrimental to the purposes of this title, to any other applicable policies and standards, and to other properties in the same zoning district or vicinity; Proposed Building E has been reviewed (SDR2004-00007) for it's consistency with other applicable policies and standards includin those relating to the neighboring property to the west and the vegetated corridor 15 feet tohe east. SW durham Road was also addressed in SDR2004-00007 to ensure no negative impacts resulted. The proposed adjustment will not be materially detrimental to the purpose of this title, any other policies and standards, or other properties in the same zoning district or vicinity. NOTICE OF TYPE 11 DECISION VAR2004-00074/ OAK TREE 11 APARTMENTS DRIVEWAY VARIANCE PAGE 2 OF 5 There are special circulostances that exist which are pectar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; The subject property is bisected by a ravine. The ravine contains a vegetated corridor with steep slopes and a stream. Because of the topography and sensitive land features, it is impractical to cross the ravine with a road to serve the proposed Building E, especially with alternative access available through the existing Oak Tree (1) access to Durham Road. These special circumstances are beyond the applicant's control and are not applicable to other properties in the same zoning district. Therefore, this standard has been satisf ed. The use proposed will be the same as permitted under this title and City standards will be maintained to the greatest extent that is reasonably possible while permitting reasonable economic use of the land; The proposed project is within the R-25 zone, which allows multi-family dwelling units. The requested variance will not result in a change of use that is not allowed within the zone. The use of the existing access will not add an additional access to Durham Road in violation of the access spacing standard. Therefore, this standard has been satisfied. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were developed as specified in the title; and The applicant is requesting the variance in order to protect natural features to the greatest extent possible: Building E Is oriented and located on the site to be compatible with the existing grades, minimize fill around existing trees, avoid removal of existing trees, maintain the sensitive areas setback and vegetative buffers. The proposed development will result in increased traffic onto Durham Road from the existing driveway but no more than would otherwise occur if the development could be developed as specified in the title. Therefore, this standard is satisfied. The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. The subject site is confined by existing topography which does not allow access to 108th street from Building E. The requested variance is the least needed to provide alternative access, which is allowing the use of an existing access road onto SW Durham Road. Therefore, this standard has been satisfied. FINDING: Based on the analysis above, the Variance criteria have been met. Section 18.370.020.C.5.a provides that in all zoning districts where access and egress drives cannot be readily designed to conform to Code standards within a particular parcel, access with an adjoining property shall be considered. If access in conjunction with another parcel cannot reasonably be achieved, the Director may grant an adjustment to the access requirements of Chapter 18.705 through a Type Il procedure, as governed in Section 18.390.030, using approval criteria contained in Subsection 5.b below. The existing driveway serving the Oak Tree I Apartments is approximately 480 feet from the intersection of Durham Road and 108 h Avenue. Due to the topography of the sub1'ect development site, the existing driveway is the only access available to the proposed Building E. Condition of Approval 29 of SDR2004-00007 requires the applicant to provide a joint access and maintenance agreement for the proposed Oak Tree II Apartments and the existing Oak Tree I Apartments complexes. The applicant proposes joint access for Building E from the existing driveway on SW Durham Road. Therefore, this standard has been met. The Director may approve, approve with condition, or deny a request for an adjustment from he access requirement contained in Chapter 18.705, based on the f5owing criteria: NOTICE OF TYPE 11 DECISION VAR2004-00074/ OAK TREE 11 APARTMENTS DRIVEWAY VARIANCE PAGE 3 OF 5 It is not possible to sh• access. is It is possible, and it is proposed, to share access, as described above. However, the shared access still falls within the 600 foot spacing standard for arterials. Therefore, the variance is required. There are no other alternative access points on the street in question or from another street. Access to 108th Avenue is not available because of the presence of the ravine and its vegetated corridor south and east of the proposed Building E. Durham Road is due nrth of the proposed Building E, but access there would be closer to the intersection with 108... than is the existing access serving Oak Tree I. No other alternative access is available to the proposed site. The access separation requirements cannot be met. Given the constraints of the site and proximity of the subject parcel to the intersection of 108 Avenue and Durham Road as described above, the access requirements cannot be met. The request is the minimum adjustment required to provide adequate access. Given the forgoing analysis, the request is the minimum adjustment required to provide the access. The approved access or access approved with conditions will result in a safe access; and The applicant submitted a Memorandum dated September 16, 2004, from Kittelson Associates, Traffic Engineers, which concluded that the SW Durham Road/Existing Phase I Driveway intersection can operate acceptably and safely at its current location with the traffic from the proposed [Oak Tree II] development. The analysis supporting this conclusion is documented in the May 2004 Transportation Impact Analysis submitted for the approved Oak Tree II Apartments. The visual clearance requirement of Chapter 18.795 will be met. The applicant has shown on the submitted plans that the required 30-foot visual clearance areas will be maintained at the intersection of the Oak Tree I Apartments driveway with Durham Road. Therefore, this standard has been satisfied. FINDING: Based on the analysis above, Staff finds that the development adjustment criteria are satisfied. SECTION VI. OTHER STAFF COMMENTS No other staff comments were received. SECTION VII. AGENCY COMMENTS Tri-Met Transit Development was notified of the variance request and did not comment. Tualatin Valley Fire and Rescue reviewed the proposal and finds no objection to it. SECTION VIII. Appeal: The decision of the Director (Tye II Procedure) or Review Authority (Type II Administrative Appeal or Type III Procedure) is final for purposes of appeal on the date that it is mailed. Any party with standing as provided in Section 18.390.040.G.1. may appeal this decision in accordance with Section 18.390.040.G.2. Of the Tigard Community Development Code which provides that a written appeal together with the required fee shall be filed with the Director within ten (10) business days of the date the notice of the decision was mailed. The appeal fee schedule and forms are available from the Planning Division of Tigard City Hall, 13125 SW Hall Boulevard, Tigard, Oregon 97223. Unless the applicant is the appellant, the hearing on an appeal from the Director's Decision shall be confined to the specific issues identified in the written comments submitted by the parties during the comment period. (A) Code Requirements: The minimum spacing of driveways and streets along a collector shall be 200 feet. The minimum spacing of driveways and streets along an arterial shall be 600feet. (18.705.030.H.) (B) Request: (1) Allow Building `E' of Oak Tree II (OT2) Apartments to utilize the existing Oak Tree Apartments (OT1) driveway access on Durham Rd. (C) Background: (1) The existing OT I access is 482 feet (center line to center line) from the intersection of Durham Rd. and 108"' Avenue. (2) When the OT1 access was originally constructed, Durham Rd. was classified as a Collector and the access conformed to the driveway and streets spacing code requirement of 200 feet. (3) Subsequently on February 7, 2002 the classification of Durham Rd. was changed to an arterial, and as a result the spacing standard was increased to 600 feet. (4) Oak Tree II received Design Review Approval (SDR2004-00007) on September 2, 2004 (the "Approval") subject to certain conditions. (5) Condition 19 of the Approval states: "Prior to issuance of the site permit the applicant shall apply for a Type 2 Adjustment to the driveway spacing standards of 18.705.030.H.3 for the existing driveway on Durham Road. " (6) Variances are to be processed under the provisions of 18.370.010 of the Code. (D) Justification: (1) (18.370.010.C.1.) Variances shall be processed by means of a Type II procedure, as governed by Section 18.390.040, using standards of approval contained in Subsection 2 below. (2) (18.370.010.C.2.) The Director shall approve, approve with conditions, or deny an application for a variance based on finding that the following criteria are satisfied: (a) The proposed variance will not be materially detrimental to the purposes of this title, to any other applicable policies and standards, and to other properties in the same zoning district or vicinity; i. The subject access driveway is existing. It will not be altered in any way and will therefore not have any materially detrimental effect to the purposes of this title, to any other policies or standards, nor to any other properties in the same zoning district or vicinity. (b) There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; i. There is no other reasonable access to parcel 2S115AA00700 on which building E of OT2 is sited. Code section 18.370.020.C.5.a. provides: In all zoning districts where access and egress drives cannot be readily designed to conform to Code standards within a particular parcel, access with an adjoining property shall be considered. ii. Parcel 00700 is bounded to the east by a natural drainage way and sensitive lands. Use of the existing OT1 access is being proposed in order to avoid vehicle access across or through the drainage way and sensitive lands area. (c) The use proposed will be the same as permitted under this title and City standards will be maintained to the greatest extent that is reasonably possible while permitting reasonable economic use of the land i. The proposed use is fully compliant with the underlying zoning for both OT1 and OT2, R-25 Multi-High Density Residential. This variance will not change the previously approved uses on either property and all other City standards are unaffected by this variance. (d) Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were developed as specified in the title; and i. The purpose of this variance request is to avoid any impacts whatsoever to the sensitive lands to the east of the subject building by sharing the existing OT1 driveway access as would be directed by Code section 18.370.020.C.5.a. As a result, the granting of this variance will serve to prevent the need to adversely affect the existing physical and natural systems. (e) The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. i. This hardship is imposed by the location of a drainage way and sensitive lands corridor which effectively block ingress-egress from the east. Project: Oak Tree Apartment Phase II Subject: Transportation Impact Statement for Variance Request This memorandum provides the transportation impact assessment in support of the variance request for the Oak Tree Apartment Phase II project in Tigard, Oregon. The project was submitted for design review in May 2004. In addition to development of the parcels to the east of the drainageway, the development application included a 24 unit building to the west of the drainageway, which is proposed to use the existing Phase I driveway on SW Durham Road. Upon completion of the Phase II development, the management and leasing office for Phase I will be moved to the Phase II office which is located on the east side of the drainageway. All management office traffic will thereby be removed from the existing driveway on Durham Road. Ingress/egress for all such traffic will then be from the two driveway accesses on 108th Avenue. The existing Phase I driveway is approximately 480 feet from the SW Durham Road/SW 1081h Avenue intersection. Based on the County's recent designation of SW Durham Road as an Arterial, an access spacing standard of 600 feet is now applicable. As such, the existing Phase I driveway is in non-compliance with City standard. Hence, this memorandum quantifies the transportation impact of the variance request. Intersection Operation The intersection of SW Durham Road/Oak Tree Phase I Driveway was analyzed in detail in the original transportation impact analysis report prepared for the Oak Tree Apartments Phase II development application. The report analyzed the intersection during weekday a.m. and p.m. peak hour period for existing, background and total traffic conditions. Table 1 shows the Oak Tree Apartment Phase II Project 6541 September 16, 2004 Page 2 operation of the intersection based on the analysis conducted in the original TIA. As shown in the table, the intersection is anticipated to operate at LOS "C" and v/c well below 1.0 threshold during all the analysis periods. Since the distance between SW Durham Road/SW 108th Avenue and SW Durham Road/Existing Phase I Driveway intersections is approximately 480 feet, it can be concluded that there is adequate distance to accommodate the westbound left-turn queue at the SW Durham Road/Existing Phase I Driveway intersection.
