APPLICATION SUMMARY FILE NAME: TIGARD OFFICE BUILDING SIGN ADJUSTMENT CASE NO.: Special Adjustment (VAR) VAR2003-00090 PROPOSAL: The applicant is requesting approval of a Special Adjustment to construct a second free-standing sign to adequately identify the second entrance to the subject property, which is oriented toward SW Hampton Street. ZONING DESIGNATION: MUE; Mixed Use Employment. The purpose of the MUE zoning district is to provide a wide range of uses including major retail goods and services, business/professional offices, civic uses and housing. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.370, 18.390, 18.520, 18.620, 18.780, and 18.795. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. VAR2003-00090 -TIGARD OFFICE BUILDING SIGN SPECIAL ADJUSTMENT PAGE 1 OF 5 NOTICE OF TYPE 11 DECISION CONDITION OF APPROVAL THE FOLLOWING CONDITIONS SHALL- BE SATISFIED PRIOR TO ISSUANCE OF BUILDING PERMITS: Submit to the Planning Department (Mathew c ei egger, 639-4171, ex t. or review and approval: 1. Provide an arborist report and protection plan for the 27 and 32 inch sequoias closest to the proposed sign. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION SECTION III. BACKGROUND INFORMATION Site Information and Proposal Description: The subject property is bordered on west by a commercial office building and to the south by a hotel. Both properties are zoned mixed-use employment. The applicant is requesting approval of a Special Adjustment to construct a second free-standing sign to adequately identify the second entrance to the subject property, which is oriented toward SW Hampton Street. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Tigard Development Code Section 18.390 allows the following development Adjustments by means of a Type II procedure: Variances and Adjustments 18.370 Section - bus ments to sign code (Chapter 18.780), states that the Director shall approve, approve with conditions, or deny a request for an adjustment to the sign code based on findings that at least one of the following criteria are satisfied. The applicant is requesting a second free-standing sign at the Hampton Street entrance to the subject site. Based on the requirement above, the applicant must only meet one of the adjustment criteria. The proposed adjustment to the height limits in the sign code is necessary to make the sign visible from the street because of the topography of the site, and/or a conforming building or sign on an adjacent property would limit he view of a sign erected on the site in conformance with Chapter 18.780, Signs; The subject site has an existing sign located on SW 68th Avenue. The applicant is requesting an adjustment in order to construct a second sign that faces SW Hampton Street. No adjustment to sign height limits has been requested. Therefore, this standard does not apply. A second freestanding sign is. necessary to adequately identif a second entrance to a business or premise that is oriented towards a different street rontage. The applicant is requesting a second sign near the Hampton Street entrance to the property to display the building address. A group of very lar a evergreen trees is positioned along the north (Hampton Street) side of the building, preventing visibility of any signage that might be mounted on the building. Since a significant amount of traffic approaches t e building from east bound SW Hampton Street, an address sign in the proposed location would prevent the general public from roaming the neighborhood seeking the building. An address sign in this location would also benefit emergency services to the building. VAR2003-00090 -TIGARD OFFICE BUILDING SIGN SPECIAL ADJUSTMENT PAGE 2 OF 5 NOTICE OF TYPE 11 DECISION Up to an additional 25% of sign area or height may be permitted when it is determined that the increase will not deter from the purpose of Chapter 18.780, Signs. This increase should be udged according to specific needs and circumstances which necessitate additionaj area to make the sign sufficiently legible. The increase(s) shall not conflict with any other non-dimensional standards or restrictions of this chapter; The proposed sign is approximately five square feet, which is an increase to the maximum allowable square footage (64 square feet) of seven percent. Therefore, the maximum 25 percent increase to area limits through the adjustment standard is not needed. FINDING: Based on the analysis above and a site visit, the sign adjustment standards have been satisfied. Tigard Triangle Design Standards 18.620 section - zoning district regulations - Residential only developments within the C-G and MUE zones shall meet the sign requirements for the R-25 zone 18.780.1306; non-residential developments within the C-G zone shall meet the sign requirements for the commercial zones, 18.780.130C; and non-residential development within the MUE zone shall meet the sign requirements of the C-P zone, 18.780.130D. According to the standard above, signs within the MUE zoning designation of the Tigard Triangle are subject to the requirements of the C-P zone, Section 18.780.130.D which is addressed below under Chapter 18.780 (Signs). Sign area limits - The maximum sign area limits found in 18.780.130 shall not be exceeded. No area limit increases will be permitted within the Tigard Triangle. This criterion has been addressed below under Chapter 18.780 (Signs). Height limits - The maximum height limit for all signs except wall signs shall be 10 feet. Wall signs shall not extend above the roof line of the wall on which the sign is located. No height increases will be permitted within the Tigard Triangle. The proposed sign is shown to be approximately two feet in height which includes the one-foot concrete base. Therefore the proposed sign is well within the maximum 10-foot height limitation. Sign location - Freestanding signs within the Tigard Triangle shall not be permitted within required L-1 landscape areas. The proposed sign will be located within landscaping on the east side of the Hampton Street entrance to the site. According to the original approval of the SW Hampton building, Tigard's Design Evaluation Team decided to waive the L-1 landscaping standard along the SW Hampton Street in order to preserve existin trees and provide visibility to the street. The applicant's plan o be located on the east side of the access drive which does shows the placement of the sign ?0' not compromise existing trees or visibility to the street. According to the visual clearance chapter addressed below, Section 18.795.030.6. Obstructions prohibited; "A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure or temporary or permanent obstruction (except for an occasional utility pole or tree), exceeding three feet in height, measured from the top of the curb, or where no curb exists, from the street center line grade, except that trees exceeding this height may be located in this area, provided all branches below eight feet are removed." The proposed sign will not exceed three feet in height. Therefore, visual clearance will not be hindered on the Hampton Street entrance. FINDING: Based on the analysis above, the Tigard Triangle Design standards have been met. Signs 18.780 section 113-780.130.D.(1) - Freestanding signs shall have certain limitations and conditions when permitted on properties zoned C-P including: One multifaced, freestanding sign per premises shall be permitted, subject to conditions and limitations as stated herein; VAR2003-00090 -TIGARD OFFICE BUILDING SIGN SPECIAL ADJUSTMENT PAGE 3 OF 5 NOTICE OF TYPE 11 DECISION The applicant has requested approval through the development adjustment process to construct a second freestanding sign on the subject property. Approval criteria for the adjustment have been addressed above, (Variances and Adjustments (18.370). A reader-board assembly may be an integral part of the freestanding sign; The applicant is requesting a second free-standing sign with no reader-board attached. Therefore, this standard does not apply. The maximum square footage of freestanding signs shall be 32 square feet per face or a total of 64 square feet for all sign faces. No part of any freestanding sign shall extend over a property line into public right-of-way space; The subject site has one existing sign located on the 68th Parkway street frontage that has 32 square feet per side for a total of 64 square feet. The second sign the applicant is proposin is a one-sided 5 square foot sign. The maximum allowable square footage for, signs within he MUE zone is 64 square feet (32 square feet per sign face). The applicant may increase the sign area by one-foot for each lineal foot the sign is moved back from the front property line to which the sign is adjacent. Therefore, this standard is referred to the following criterion. The sign area may be increased one square foot for each lineal foot the sign is moved back from the property line to which the sign is adjacent. If the street is curbed and paved the measurement may be taken from a point which is 15 feet from the pavement. This increase in sign area is limited to a maximum of 52 square feet per face or a total of 104 square feet for all faces; The subject site has one pre-existing sign that has 64 square feet of sign face. This standard allows additional sign square footage to be added with the appropriate setbacks. Therefore, the applicant's proposed 5 square foot sign is required to be setback a minimum of 5 feet from the property line abutting SW Hampton Street. The applicant's site plan shows the proposed sign to be setback 5 feet from the property line. This standard has been satisfied. Freestanding signs located next to the public right-of-way shall not exceed eight feet in height. Height may be increased one foot in height for each 10 feet of setback from the property line or a point 15 feet from the edge of pavement whichever is less to a maximum of 10 feet in height; The proposed sign with its concrete, base is approximately two feet in height. The maximum allowable height is eight feet. Therefore, this standard has been satisfied. FINDING: Based on the analysis above, the Sign standards have been met. Visual Clearance 18.795 S_eC_fion - Arterial streets. On all designated arterial streets the visual clearance area shall not be less than 35 feet on each side of the intersection. Hampton Street is a designated arterial. However, the original approval for the Hampton Street Office Building (SDR2000-00014) states that visual clearance does not apply due to the superseding Tigard Triangle Design Standards. In any case, the proposed sign will be no more than two feet in height, which is allowed within visual clearance triangles. Therefore, this standard has been satisfied. FINDING: Based on the analysis above, the Visual Clearance standards have been satisfied. SECTION VI. OTHER STAFF COMMENTS City of Tigard Water Department has reviewed the proposal and has no objections to it. VAR2003-00090 -TIGARD OFFICE BUILDING SIGN SPECIAL ADJUSTMENT PAGE 4 OF 5 NOTICE OF TYPE 11 DECISION City of Ti? rd's Urban Forester has reviewed the proposal and has offered the following comments: It appears that the sign will impact two large trees based on the enclosed photos. Applicant needs to address impacts to trees by having an arborist assess and evaluate. Staff Response: The sign will be in close proximity of two large sequoia trees. Chapter 18.790 (tree removal) requires a tree removal/protection plan for all development. Therefore, based on the City Arborist's recommendation, the tree removal chapter of Tigard's Development Code, and the placement of the sign, the applicant is required to provide an arborist report and protection plan for the 27 and 32 inch sequoias closest to the proposed sign. SECTION V. PROCEDURE AND APPEAL INFORMATION Notice: otl was mailed to the applicant and owners. Final Decision: THIS DECISION IS FINAL ON FEBRUARY 5, 2004 AND BECOMES EFFECTIVE ON FEBRUARY 21, 2004 UNLESS AN APPEAL IS FILED. Appeal: The decision of the Director (Type II Procedure) or Review Authority (Type II Administrative Appeal or Type III Procedure) Is final for purposes of appeal on the date that it is mailed. Any party with standing as provided in Section 18.390.040.G.1. may appeal this decision in accordance with Section 18.390.040.G.2. of the Tigard Community Development Code which provides that a written appeal together with the required fee shall be filed with the Director within ten (10) business days of the date the notice of the decision was mailed. The appeal fee schedule and forms are available from the Planning Division of Tigard City Hall, 13125 SW Hall Boulevard, Tigard, Oregon 97223. Unless the applicant is the appellant, the hearing on an appeal from the Director's Decision shall be confined to the specific issues identified in the written comments submitted by the parties during the comment period. Additional evidence concerning issues properly raised in the Notice of Appeal may be submitted by any party during the appeal hearing, subject to any additional rules of procedure that may be adopted from time to time by the appellate body. BACKGROUND INFORMATION Site Information and Proposal Description: The subject property is bordered on west by a commercial office building and to the south by a hotel. Both properties are zoned mixed-use employment. The applicant is requesting approval of a Special Adjustment to construct a second free-standing sign to adequately identify the second entrance to the subject property, which is oriented toward SW Hampton Street. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Tigard Development Code Section 18.390 allows the following development Adjustments by means of a Type II procedure: Variances and Adjustments 18.370 Section - bus ments to sign code (Chapter 18.780), states that the Director shall approve, approve with conditions, or deny a request for an adjustment to the sign code based on findings that at least one of the following criteria are satisfied. The applicant is requesting a second free-standing sign at the Hampton Street entrance to the subject site. Based on the requirement above, the applicant must only meet one of the adjustment criteria. The proposed adjustment to the height limits in the sign code is necessary to make the sign visible from the street because of the topography of the site, and/or a conforming building or sign on an adjacent property would limit he view of a sign erected on the site in conformance with Chapter 18.780, Signs; The subject site has an existing sign located on SW 68th Avenue. The applicant is requesting an adjustment in order to construct a second sign that faces SW Hampton Street. No adjustment to sign height limits has been requested. Therefore, this standard does not apply. A second freestanding sign is. necessary to adequately identif a second entrance to a business or premise that is oriented towards a different street rontage. The applicant is requesting a second sign near the Hampton Street entrance to the property to display the building address. A group of very lar a evergreen trees is positioned along the north (Hampton Street) side of the building, preventing visibility of any signage that might be mounted on the building. Since a significant amount of traffic approaches t e building from east bound SW Hampton Street, an address sign in the proposed location would prevent the general public from roaming the neighborhood seeking the building. An address sign in this location would also benefit emergency services to the building. VAR2003-00090 -TIGARD OFFICE BUILDING SIGN SPECIAL ADJUSTMENT PAGE 2 OF 5 NOTICE OF TYPE 11 DECISION Up to an additional 25% of sign area or height may be permitted when it is determined that the increase will not deter from the purpose of Chapter 18.780, Signs. This increase should be udged according to specific needs and circumstances which necessitate additionaj area to make the sign sufficiently legible. The increase(s) shall not conflict with any other non-dimensional standards or restrictions of this chapter; The proposed sign is approximately five square feet, which is an increase to the maximum allowable square footage (64 square feet) of seven percent. Therefore, the maximum 25 percent increase to area limits through the adjustment standard is not needed. FINDING: Based on the analysis above and a site visit, the sign adjustment standards have been satisfied. Tigard Triangle Design Standards 18.620 section - zoning district regulations - Residential only developments within the C-G and MUE zones shall meet the sign requirements for the R-25 zone 18.780.1306; non-residential developments within the C-G zone shall meet the sign requirements for the commercial zones, 18.780.130C; and non-residential development within the MUE zone shall meet the sign requirements of the C-P zone, 18.780.130D. According to the standard above, signs within the MUE zoning designation of the Tigard Triangle are subject to the requirements of the C-P zone, Section 18.780.130.D which is addressed below under Chapter 18.780 (Signs). Sign area limits - The maximum sign area limits found in 18.780.130 shall not be exceeded. No area limit increases will be permitted within the Tigard Triangle. This criterion has been addressed below under Chapter 18.780 (Signs). Height limits - The maximum height limit for all signs except wall signs shall be 10 feet. Wall signs shall not extend above the roof line of the wall on which the sign is located. No height increases will be permitted within the Tigard Triangle. The proposed sign is shown to be approximately two feet in height which includes the one-foot concrete base. Therefore the proposed sign is well within the maximum 10-foot height limitation. Sign location - Freestanding signs within the Tigard Triangle shall not be permitted within required L-1 landscape areas. The proposed sign will be located within landscaping on the east side of the Hampton Street entrance to the site. According to the original approval of the SW Hampton building, Tigard's Design Evaluation Team decided to waive the L-1 landscaping standard along the SW Hampton Street in order to preserve existin trees and provide visibility to the street. The applicant's plan o be located on the east side of the access drive which does shows the placement of the sign ?0' not compromise existing trees or visibility to the street. According to the visual clearance chapter addressed below, Section 18.795.030.6. Obstructions prohibited; "A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure or temporary or permanent obstruction (except for an occasional utility pole or tree), exceeding three feet in height, measured from the top of the curb, or where no curb exists, from the street center line grade, except that trees exceeding this height may be located in this area, provided all branches below eight feet are removed." The proposed sign will not exceed three feet in height. Therefore, visual clearance will not be hindered on the Hampton Street entrance. FINDING: Based on the analysis above, the Tigard Triangle Design standards have been met. Signs 18.780 section 113-780.130.D.(1) - Freestanding signs shall have certain limitations and conditions when permitted on properties zoned C-P including: One multifaced, freestanding sign per premises shall be permitted, subject to conditions and limitations as stated herein; VAR2003-00090 -TIGARD OFFICE BUILDING SIGN SPECIAL ADJUSTMENT PAGE 3 OF 5 NOTICE OF TYPE 11 DECISION The applicant has requested approval through the development adjustment process to construct a second freestanding sign on the subject property. Approval criteria for the adjustment have been addressed above, (Variances and Adjustments (18.370). A reader-board assembly may be an integral part of the freestanding sign; The applicant is requesting a second free-standing sign with no reader-board attached. Therefore, this standard does not apply. The maximum square footage of freestanding signs shall be 32 square feet per face or a total of 64 square feet for all sign faces. No part of any freestanding sign shall extend over a property line into public right-of-way space; The subject site has one existing sign located on the 68th Parkway street frontage that has 32 square feet per side for a total of 64 square feet. The second sign the applicant is proposin is a one-sided 5 square foot sign. The maximum allowable square footage for, signs within he MUE zone is 64 square feet (32 square feet per sign face). The applicant may increase the sign area by one-foot for each lineal foot the sign is moved back from the front property line to which the sign is adjacent. Therefore, this standard is referred to the following criterion. The sign area may be increased one square foot for each lineal foot the sign is moved back from the property line to which the sign is adjacent. If the street is curbed and paved the measurement may be taken from a point which is 15 feet from the pavement. This increase in sign area is limited to a maximum of 52 square feet per face or a total of 104 square feet for all faces; The subject site has one pre-existing sign that has 64 square feet of sign face. This standard allows additional sign square footage to be added with the appropriate setbacks. Therefore, the applicant's proposed 5 square foot sign is required to be setback a minimum of 5 feet from the property line abutting SW Hampton Street. The applicant's site plan shows the proposed sign to be setback 5 feet from the property line. This standard has been satisfied. Freestanding signs located next to the public right-of-way shall not exceed eight feet in height. Height may be increased one foot in height for each 10 feet of setback from the property line or a point 15 feet from the edge of pavement whichever is less to a maximum of 10 feet in height; The proposed sign with its concrete, base is approximately two feet in height. The maximum allowable height is eight feet. Therefore, this standard has been satisfied. FINDING: Based on the analysis above, the Sign standards have been met. Visual Clearance 18.795 S_eC_fion - Arterial streets. On all designated arterial streets the visual clearance area shall not be less than 35 feet on each side of the intersection. Hampton Street is a designated arterial. However, the original approval for the Hampton Street Office Building (SDR2000-00014) states that visual clearance does not apply due to the superseding Tigard Triangle Design Standards. In any case, the proposed sign will be no more than two feet in height, which is allowed within visual clearance triangles. Therefore, this standard has been satisfied. FINDING: Based on the analysis above, the Visual Clearance standards have been satisfied. SECTION VI. OTHER STAFF COMMENTS City of Tigard Water Department has reviewed the proposal and has no objections to it. VAR2003-00090 -TIGARD OFFICE BUILDING SIGN SPECIAL ADJUSTMENT PAGE 4 OF 5 NOTICE OF TYPE 11 DECISION City of Ti? rd's Urban Forester has reviewed the proposal and has offered the following comments: It appears that the sign will impact two large trees based on the enclosed photos. Applicant needs to address impacts to trees by having an arborist assess and evaluate. Staff Response: The sign will be in close proximity of two large sequoia trees. Chapter 18.790 (tree removal) requires a tree removal/protection plan for all development. Therefore, based on the City Arborist's recommendation, the tree removal chapter of Tigard's Development Code, and the placement of the sign, the applicant is required to provide an arborist report and protection plan for the 27 and 32 inch sequoias closest to the proposed sign. SECTION V. PROCEDURE AND APPEAL INFORMATION Notice: otl was mailed to the applicant and owners. Final Decision: THIS DECISION IS FINAL ON FEBRUARY 5, 2004 AND BECOMES EFFECTIVE ON FEBRUARY 21, 2004 UNLESS AN APPEAL IS FILED. In addition to the criteria in Subsection a above, the Director shall review all of the existing or proposed*signage for the development and its relationship to the intent and purpose of Chapter 18.780, Signs. As a condition of approval of the adjustment, the Director may require: (1) Removal or alteration of nonconforming signs to achieve compliance with the standards contained in Chapter 18.780, Signs; (2) Removal or alteration of conforming signs to establish a consistent sign design throughout the development; and _ (3) Application for sign permits for signs erected without permits or removal of such Illegal sue- - 9. Adjustments to setbacks to reduce tree removal (Chapter 18.790). By means of a Type I procedure, as governed by Section 18.390.030, the Director may grant a modification from applicable setback requirements of this Code for the purpose of preserving a tree or trees on tho site of proposed development. Such modification may reduce the required setback by up to 50%, but shall not be more than is necessary for the preservation of trees on the site. The setback modification described in this section shall supersede any special setback requirements or exceptions set out elsewhere in this title, including but not limited to Chapter 18.730, except Section 18.730.040. 10. A group of very large evergreen trees is positioned along the north side of the building, preventing visibility of any signage that might be mounted on the building. We have enclosed several photos showing the existing condition along the south side of eastbound Hampton Street. Since a significant amount of traffic approaches the building from this direction, we would like to identify the address of the building at the Hampton Street driveway access. We feel an address sign in this location would prevent the general public from roaming the neighborhood seeking the building. It would also improve the ability for fire, police and ambulance services to find the building in case of an emergency.
