ZONING DESIGNATION: The subject property is within the R-7 Medium-Density Residential zoning district. The R-7 zoning district is designed to accommodate attached single-family homes, detached single-family homes with or without accessory residential units, at a minimum lot size of 5,000 square feet, and duplexes, at a minimum lot size of 10,000 square feet. All construction must be completed in compliance with the conditions of approval of the Daffodil Hill Subdivision (SUB2001-00004). THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION l SECTION III. BACKGROUND INFORMATION Site Information and Proposal Description: The property is bordered on all sides by single-family residences. The proposal is to intrude into the 15-foot rear yard setback by 2 feet 6 inches to accommodate construction of the proposed home. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Tigard Development Code Section 18.390 allows the following development Adjustments by means of a Type I procedure: Front yard setbacks. Up to a 25% reduction of the dimensional standards for the front yard setback required in the base zone. Setback of garages may not be reduced by this provision. Interior setbacks. Up to a 20% reduction of the dimensional standards for the side and rear yard setbacks required in the base zone. Lot coverage. Up to 5% increase of the maximum lot coverage required in the base zone. The applicant has requested an Adjustment to the rear yard setback to. allow the placement of the.house. The required rear yard setback is 15 feet therefore, a 2-foot 6-inch reduction of this setback may be allowed provided the following criteria are addressed. A development Adjustment shall be granted if there is a demonstration of compliance with all of the applicable standards: A demonstration that the Adjustment requested is the least required to achieve the desired affect; The adjustment is being requested to allow the structure to protrude into the rear yard setback by 2 feet 6 inches. According to the applicant this is the minimum relief needed to allow placement of the home. The Adjustment will result in the preservation of trees, if trees are present in the development area; VAR2002-00027 -SETBACK ADJUSTMENT PAGE 2 OF 3 NOTICE OF TYPE I DECISION All trees on the site were removed during construction of the subdivision. There are no trees to preserve, therefore, this criterion is inapplicable. The Adjustment will not impede adequate emergency access to the site; The Adjustment will not impede emergency access. Emergency service can still access this dwelling and adjacent dwellings. There is not a reasonable alternative to the Adjustment which achieves the desired affect. Because of the size of the home, there are no other reasonable alternatives to the placement or orientation of the home that would achieve the desired affect. FINDING: Based on the analysis above, the adjustment criteria have been satisfied. SECTION V. PROCEDURE AND APPEAL INFORMATION Notice: Notice was mailed to the applicant and owners. Final Decision: A set ack Adjustment is a Type I procedure. As such, the Director's decision is final on the date it is mailed or otherwise provided to the applicant, whichever occurs first. Leah Terrace & S.W. Alpine View City of Tigard Summary of Adjustment request(s): 1. This application is for an adjustment to reduce the required rear yard setback by 20%. In the proposed plan, we are considering the rear yard to be the southern most portion of the site, which abuts lot 18. The current required minimum set back is 15'-0", the 20% reduction would reduce this to 12'-0". Overview of site and existing conditions: • The site is a corner lot facing onto S.W. Leah Terrace and S.W. Alpine Drive. In the proposed plan for this site the garage would front onto S.W. Alpine, the front would face onto S.W. Leah, the rear yard would be the southern most portion which abuts lot 18 and the westerly portion, which abuts lot 12 would be.a standard side yard with a required setback of 5'-0". Applicant's Response to Approval Criteria (A through D) of section 18.370.020 (adjustments) item B(2). Section 19370.020 Adjustments - 2(B) Approval Criteria. A development adjustment shall be granted if there is a demonstration of compliance with all of the applicable standards: a) A demonstration that the adjustment requested is the least required to achieve the desired effect, b) The adjustment will result in a preservation of trees, if trees are present in the development area, c) The adjustment will not impede adequate emergency access to the site; d) There is not a reasonable alternative to the adjustment, which achieves the desired effect. Response to approval criteria A through D a) This proposal meets criteria A because: • A review of the proposed floor plans to determine if the overall length of the home could be reduced to meet the standard showed that a reduction of 2 '/2' - 3' required would be a detriment to the proposed interior living space of the plan. Since the site is a corner • Lot 11, Daffodil Hill - Adjustment Application 8/12/2002 . Page 2 lot and therefore sits prominently as an entry feature to the project, the owner is working diligently to not only create functional floor plan but also an exterior which is pleasing and proportional in terms of width to height, window configurations & sizes, columns sizes; roof pitches, eave details, etc. • The proposed floor plan also places the primary outdoor living space to the westerly side of the site rather than the southerly side. As seen on the proposed site plan the house has been shifted to the east, toward Leah Terrace, as far as possible to create a larger side yard for the outdoor living space. This does two things: first, it reduces the need for the larger space on the southern side for outdoor living area, second it provides more outdoor privacy for the homeowner from Leah Terrace. b) This proposal meets criteria B because: • There are no existing trees on site. c) This proposal meets criteria C because: • There are no foreseen impediments to emergency access to the site as a result of this adjustment. d) This proposal meets criteria D because: • To the best of the applicant's knowledge there are no alternatives to the proposed adjusted setback that would better suit the intended purpose. The only alternative that we see is to classify the westerly side yard as the rear yard and the southerly line as the side yard. Two issues arise with this: 1) the applicant is trying to preserve as large a front yard space as possible for landscaping 2) shifting the house closer to Leah Terrace further than what is shown makes access into the third car garage virtually impossible due to the constraints to keep the driveway edge out of the required site triangle.
