The adjustment is requested to provide adequate area for an RV to be placed alongside the house, outside the vision clearance area. Duplexes and attached single-family units are permitted conditionally. Some civic and-institutional uses are also permitted conditionally. LOCATION: 13299 SW 129th Avenue; WCTM 2S104DA, Tax Lot 04600. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.370, 18.390 and 18.510. SECTION II. BACKGROUND INFORMATION Site History: The subject parcel is part of Quail Hollow West, a platted subdivision. The subdivision was created in unincorporated Washington County through a planned development process. This PD process established setbacks that differ from the standard underlying zone setbacks, and supercede the underlying zone standards as described later in this report. No City land use records were found which affect development on this parcel. The property is a corner lot. Vicinity Information: The property is located on the southwest corner SW 129th Avenue and SW Gaarde. Site Information and Proposal Description: The subject property is rectangular in shape and approximately 9,784 square feet in size. The site is required to access SW 129th Avenue, as no direct access to SW Gaarde is allowed. The lot is vacant, and home plans are in for building permit review. The applicant is proposing a new single family residence which will in all other manners comply with the development standards of the zone. The applicant has requested the 2-foot reduction to the north street side setback along SW Gaarde to move the house footprint from the south property line to have adequate room to park an RV. SECTION IV. NOTICE OF TYPE I DECISION VAR2002-00008/ECK SIDE YARD SETBACK ADJUSTMENT PAGE 2 OF 4 DEVELOPMENT ADJUSTMENT - APPROVAL STANDARDS: Section 18.370.020.B.1.b provides that up to a 20% reduction of the dimensional. standards for the side yard setbacks required in the base zone may be' approved as a Type I Development Adjustment. Section 18.370.020.13.2, Approval Criteria, provides that a development adjustment shall be granted if there is a demonstration of compliance with all of the applicable standards: A demonstration that the. adjustment requested is the least required to achieve the desired effect; The applicant has requested a 20% reduction. This would reduce the north side yard setback from 10 feet to 8 feet. The "desired effect" is to allow sufficient area for parking an RV on the side of the house. As no access is available from SW Gaarde the RV cannot be placed in the rear yard, and parking it on the street side yard would require the driveway be placed closer to the street corner than.what is allowed. The site plan indicates that the house will provide 11 feet of room for the RV to park. The rear of the house juts out two feet, so that the total south side yard setback is 9 feet where 5 feet is required. The result is that the house plan has been shifted two feet south in order to accommodate the RV parking space with the reduced setback being adjacent to the public right of way. As a side note, the house across 129th Avenue on the corner also has an 8 foot street side setback from Gaarde, so the continuity of character along the street will not be detrimentally affected by this requested adjustment. The adjustment will result in the preservation of trees, if trees are present in the development area; No trees are impacted by the proposal. Therefore, this standard does not apply. The adjustment will not impede adequate emergency access to the site; and The adjustment will affect the street side yard setback only. Emergency access from the street fronting the property will not be affected. _ There will also be additional separation between the two homes, improving access through the side yard. Therefore, this criterion is satisfied. There is not a reasonable alternative to the adjustment, which achieves the desired effect. The adjustment will have no impact on the applicant's property except by reducing the side yard by 2 feet. There are no abutting properties on this side, and the property across the street has an equal 8 foot setback. The available alternative is to not grant the adjustment and leave the applicant with the option of trying to maneuver the RV into place on the street side yard. This will be difficult as the driveway and garage need to be on the north side of the lot, away from the intersection with SW Gaarde. As discussed before, no vehicle. access is allowed from SW Gaarde, so parking in the rear yard would not be possible. The applicant could alternately park the RV on the street, but this would create vision clearance issues and the municipal code requires that the vehicle not be parked on a public street for longer than 10 days in any calendar year. . As such, the Director's decision is final on the date it is mailed or otherwise provided to the applicant, whichever occurs first. The Director's decision may not be appealed locally and is the final decision of the City. THIS DECISION IS FINAL AS OF MARCH 13, 2002. THE EFFECTIVE DATE OF THIS DECISION SHALL BE MARCH 14, 2002.
