APPLICATION SUMMARY FILE NAME: JABS REAR YARD SETBACK ADJUSTMENT CASE NO: Setback Adjustment (VAR) VAR2001-00018 PROPOSAL: The applicant has requested approval for a Development Adjustment to reduce the minimum rear yard setback from 15 feet to 12 feet. The adjustment is necessary to continue the present fagade alignment of the existing garage structure. APPLICANT: William Jabs OWNER: Same 10970 SW North Dakota St. Tigard, OR 97223 COMPREHENSIVE o PLAN DESIGNATION: Low-Density Residential. ZONING DESIGNATION: R-4.5; The R-4.5 zoning district is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes and attached single-family units are permitted conditionally. Some civic and institutional uses are also permitted conditionally. LOCATION: 10970 SW North Dakota Street; WCTM 1 S134DB, Tax Lot 03700. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.370, 18:390 and 18.510. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision,is based are noted in Section IV of this decision. NOTICE OF TYPE I DECISION VAR2001-00018/JABS REAR YARD SETBACK ADJUSTMENT PAGE 1 OF 3 SECTION III. BACKGROUND INFORMATION Site History: The subject parcel is not part of a platted subdivision. No City land use records were found which may affect development on this parcel. The property is considered a flag lot, as it is accessed via a 25-foot-wide strip of land, approximately 248 feet long. Vicinity Information: The property is located on SW North Dakota Street, which is west of SW Greenburg Road and east of SW 115th Avenue. Site Information and Proposal Description: The subject property is an irregularly shaped 2.75 acre flag lot parcel. The site is accessed via SW North Dakota Street by a long, 25-foot-wide strip of land. The house is situated in the center of the lot and is oriented to the east. The applicant is proposing an addition to the house by extending a breezeway to the existing detached garage and expanding the garage building. By attaching the two structures, the expansion is considered an addition to the primary' residential structure. The present garage is positioned 12 feet from the west property line. The applicant has requested approval for a Development Adjustment to reduce the minimum rear yard setback from 15 to 12 feet in order to accommodate the expansion along the same plane as the existing garage. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS DEVELOPMENT ADJUSTMENT - APPROVAL STANDARDS: Section 18.370.020.B.1.b provides that up to a 20% reduction of the dimensional standards for the rear yard setbacks required in the base zone may be approved as a Type I Development Adjustment. Section 18.370.020.B.2, Approval Criteria, provides that a development adjustment shall be granted if there is a demonstration of compliance with all of the applicable standards: A demonstration that the adjustment requested is the least required to achieve the desired effect; The applicant has requested a 20% reduction. This would reduce the rear yard setback from 15 feet to 12 feet. The "desired effect" is to allow the proposed addition to follow a logical extension of the existing garage wall. In order to accomplish the desired effect, the rear of the new addition will need to extend 3 feet into the rear yard setback. The adjustment would cause the least impact. The adjustment will result in the preservation of trees, if trees are present in the development area; No trees are impacted by the proposal. Therefore, this standard does not apply. NOTICE OF TYPE I DECISION VAR2001-000181JABS REAR YARD SETBACK ADJUSTMENT PAGE 2 OF 3 The adjustment will not impede adequate emergency access to the site; and The adjustment will affect the rear yard setback only. Emergency access from the street fronting the property will not be affected. Therefore, this criterion is satisfied. There is not a reasonable alternative to the adjustment, which achieves the desired effect. The adjustment will have no impact on the applicant's property except by reducing the rear yard by 3 feet. Moreover, should SW Torland be extended and the subject property be further subdivided, the rear yard would become a side yard, which only requires a 5-foot setback. The only alternative to the requested 3-foot adjustment would be to require the addition to comply with current setbacks and stagger the footprint of the building. While this is certainly feasible, it does not achieve the desired effect of maintaining a consistent, uniform facade on the rear of the addition. Further, the presence of the existing garage at 12 feet from the property line largely negates the benefits achieved (separation, light and air circulation) by maintaining a 15-foot setback for the proposed addition. Therefore, staff finds the adjustment to be the most reasonable alternative. SECTION V. PROCEDURE AND APPEAL INFORMATION A rear yard setback adjustment is a Type I procedure. As such, the Director's decision is final on the date it is mailed or otherwise provided to the applicant, whichever occurs first. The Director's decision may not be appealed locally and is the final decision of the City. THIS DECISION IS FINAL AS OF SEPTEMBER 24, 2001.
