The variance will reduce the setback from 20 feet to 5 feet. The applicant is also requesting a Type I Minor Modification to allow construction of the 560 square foot garage for service vehicles. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. SCOTT GARAGE SETBACK VARIANCE PAGE 1 OF 6 CONDITIONS OF APPROVAL THE FOLLOWING CONDITIONS MUST BE MET'PRIOR TO THE ISSUANCE OF BUILDING PERMITS: 1. Submit a copy of the lighting plan for review and approval by the Police Department (Staff contact: Jim Wolf x220). 2. Submit a landscape plan that shows the landscaping and screening that will be provided between the proposed. structure,and the north property'line. (Staff contact: Julia Hajduk x407). SECTION III. BACKGROUND INFORMATION Site History: Staff has conducted a search of computer records and has not found any previous land use approvals in the City records for the subject address. Vicinity Information: . The site is located on the north side of SW Pacific Highway. To the east and west is property zoned C-G and developed with commercial uses. To the north is property-zoned R-1.2 and developed with an apartment complex. Site'Information and Proposal Description: The subject site is zoned General Commercial (C-G) and developed with an office building. The building is towards the front of the site with parking to the side and rear. The applicant proposes to construct a garage for tenant's service vehicles in an existing landscaped area. The proposed location is closer to the residentially zoned property than the code allows. The applicant has requested a variance to the setback to allow this garage to be constructed in the.desired location. SECTION IV. PUBLIC COMMENTS No comments were received. SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS VARIANCES AND ADJUSTMENTS: Section 18.370.010.C.2.a states that the proposed variance will not be -materially detrimental. to the . purposes of this title, to any other applicable policies and standards, and to other properties in the same zoning district or vicinity. The applicant is requested ,a setback variance only. No other applicable policies or standards will be affected. Because of the layout of the apartment building to the north, the location will not be opposite living quarters in the complex (with the parking lot located between the property line and the structures), thus will not affect existing buffers intended. to provide distance- between uses. There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; VAR2000-000006/MMD1999-00019-JOHN L. This, in combination with the fact that the site is adjacent to a residential zone that requires larger setbacks is unique to this site. In addition, the topography of the site and the desire to minimize the amount of ground disturbance needed to provide a level garage,.makes the proposed location the only logical place. The building location maintains the existing parking lot, vehicular movement patterns. The use proposed will be the same as permitted under this title and City standards will be maintained to the greatest extent that is reasonably possible while permitting reasonable economic use of the land; The proposed use (a garage for service vehicles) is allowed in the zone. The proposal, as evidenced within this decision, will otherwise, fully comply with the development code standards. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were developed as specified in the title; and The existing physical and natural systems will remain unchanged with the exception of landscaping. The proposed structure will remove some existing landscaping, however, the site will continue to have 36% landscaping, thus meeting the standards. The hardship is not self-imposed and the variance requested is the minimum variance, which would alleviate the hardship. The applicant could choose not to construct the garage. Other than this alternative, there are no other locations that would not remove necessary parking, affect circulation, or result in unacceptable amounts of grading to provide a flat surface. In addition, the garage is necessary to provide a secure location for existing vehicles that are parked on the, site over night. ..FINDING: Based on the analysis. above, staff finds that the variance criteria are satisfied. r Minor Modification Section 18.360.050.6 states that the Director shall determine that a major modification(s) will result if one (1) or more of the following changes are proposed: An increase in dwelling unit density, or lot coverage for residential development. The proposal does not include the addition of any dwelling units. A change in the ratio or number of different types of dwelling units. This criterion is not applicable, as this request does not involve the addition of residential dwelling units, as previously indicated. A change that requires additional on-site parking in accordance with Chapter 18.765. The proposal involves the construction of a garage.,. which will free up existing on-site parking that is currently utilized by the service vehicles. Therefore, additional on-site parking is not required and this standard is satisfied. A change in the type of commercial or, industrial structures as defined, by the Uniform Building Code. VAR2000-000006/MMD1999-00019 - JOHN L. SCOTT GARAGE SETBACK VARIANCE PAGE 3 OF 6 No change in the structure of the building is proposed. An increase in the height of the building(s).by more than 20 percent.' No change in the height of any building is proposed. A change in the type and location of accessways and parking areas where off-site traffic would be affected. This request will not move the location of accessways or parking areas where off-site traffic will be affected. An increase in vehicular traffic to and from the site, and the increase can be expected to exceed 100 vehicles per day. Because the addition will provide for a secured parking area for existing vehicles, the proposed modification will not result in an increase in vehicular traffic to or from the site. An increase in the floor area proposed for a non-residential use by more than 10 percent excluding expansions under 5,000 square feet. The expansion is less than 5,000 square feet, therefore, this standard is excluded. A reduction in the area reserved for common open space and/or usable open space which reduces the open space area below,the minimum required by this code or reduces the open space area by more than 10 percent. There is no area reserved for common open space, therefore, this standard does not . apply. A reduction of project amenities (Recreational facilities; Screening; and/or, Landscaping provisions) below the minimum established by this code or by more than 10 percent where specified in the site plan. The proposed garage will remove approximately 3,500 square feet of landscaping, however, the site will continue to have 36% of landscaping after the addition. The property to the northwest (parallel to Pacific Highway) is zoned and developed R-12, therefore, buffering and screening is required. The code requires a 10-20 foot buffer between residential and commercial uses. In addition, a 20-foot setback is required between structures in the C-G zone and residential. uses. The applicant has requested and staff has approved a variance to the setback, however; buffering and screening is still needed to meet the criteria. A condition is warranted to require the applicant to submit a landscaping plan for review and approval that provides .landscaping and screening between the. proposed structure and the property line. A modification to the conditions imposed at the time of Site Development Review approval which are not the subject of B. 1 through 10 above. Staff can find no record of prior SDR approval, therefore, staff can not determine if the modification violates any conditions imposed: The site appears to comply with current standards, however, in relation to the percentage of landscaping and screening. Because the proposal will continue to provide for more landscaping than the underlying zone requires,.staff is comfortable, in determining that the proposal will not violate any relevant conditions imposed at the time of the original Site Development Review. FINDING: Based on the analysis above, staff finds that if.the following conditions are met, the minor modification may be approved. VAR2000-000006/MMD1 999-00019 - JOHN L. OTHER STAFF COMMENTS City of Tigard Engineering Department and the City of Tigard Operations Department have reviewed the proposal and have offered no comments or objections. City of Tigard Building Division has reviewed the proposal and offered the following comments: "The garage comes under the requirements of chapter 11, OSSC, Accessibility, therefore, 'they will be required to provide an accessible entrance, an accessible route to a public, way, accessible route from the parking area to the building, and one stall in the garage must be van accessible. Contact Bob Poskin for information on these comments. The City of Tigard Police Department has. reviewed the proposal and requested a lighting plan be submitted showing the proposed lighting. SECTION VII. AGENCY COMMENTS Unified Sewerage Agency has reviewed the proposal and provided the following comments: Erosion control permit is required and water quality for the new impervious area. AT&T, Tualatin Valley Fire and Rescue, Portland General Electric, Tigard Tualatin School District, NW Natural Gas Company, TCI Cablevision, General Telephone, Tri-met and US West have reviewed the proposal and.have no objections to-it. SECTION VIII. The Director shall approve, approve with conditions, or deny an application for a variance based on finding that the following criteria are satisfied: a. The proposed variance will not be materially detrimental to the purposes of this title, to any other applicable policies and standards, and to other properties in the same zoning district or vicinity; The applicant is only requesting this variance. No other applicable policies or standards will be affected by this request. The buildings' proposed location would not affect the adjacent residences to the west. The parking lot for the apartment complex is opposite the proposed structure, not the living quarters of the complex. The adjacent property to the south (Pool House) has a building along the same property line and relative position. The proposed location would not affect either of the adjacent properties. b. There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has not control, and which are not applicable to other properties in the same zoning district; The tax lot is long and narrow. The only logistical placement of the structure and its' proposed use is at its' proposed location. The site slopes to the west and flattens out along the rear property line. By locating the structure at its' proposed location safe access can be achieved from a fairly flat area and not from an unsafe side slope, which the other locations would present. C. The use proposed will be the same as permitted under this title and City standards will be maintained to the greatest extent that is reasonable possible while permitting reasonable economic use of the land; The proposed use is allowed within this zoning district. The building location maintains the existing parking lot, vehicular movement patterns and other site improvements. By locating the structure at this "flat" portion of the site, it could conceivably be used for other approved uses and/or functions. The sloped portion of the property would require a "stepped" foundation and floor, which would severely, if not entirely, eliminate any adaptive reuse of the structure in the future and possibly create a hazard at the parking lot area adjacent to the building. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were developed as specified in the title; and The majority of the existing physical and natural systems will not be changed or disturbed by this project. The building will be located in an existing landscaped area. The remaining features of the site will not be disturbed. The site still meets the landscaping requirement dictated by the City of Tigard's zoning ordinance. e. The hardship is not self-imposed and the variance requested is the minimum variance, which would alleviate the hardship. The topography of the site limits the placement of the structure. The functionality and feasibility of the project requires the building to be located at its' proposed location. As noted above, the structure does not function- as dictated by the use on a side slope. Also, there are two tax lots on the site. The proposal is to modify the approved site plan by adding a 960 square foot garage for service vehicles. The modification also removes some landscaping. The information utilized, in reviewing this modification was provided in the letter dated November 15, and the plans provided with the same date. This property is zoned General Commercial (C-G). The Tigard Community Development Code Site Development Review Section states that if the requested modification meets any of the major modification criteria, the request shall be reviewed as a new Site Development Review application. Section 18.360.050.B states that the Director shall determine that a major modification(s) will result if one (1) or.more of the following changes are proposed: 1. An increase in dwelling unit density, or. lot coverage for residential development. The proposal does not include the addition of any dwelling units. 2. A change in the ratio or number of different types of dwelling units. This criterion is not applicable,, as this request does note involve the . addition of residential dwelling units, as previously indicated. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The proposal involves the construction of'a garage which will free up existing on-site parking that is currently utilized by the service vehicles. Therefore, additional on-site parking is not required and this standard is satisfied. 4. A change .in the type of commercial or industrial structures as defined by the Uniform Building Code. No change in the structure of the building is proposed. 5. An increase in the height of the building(s) by more than 20 percent. No change in the height of any building is proposed. 6. A change in the type and location of accessways and parking, areas where off-site traffic would be affected. This request will.not move the location of accessways or parking areas where off-site traffic will be affected. Page 1 of 3 • 7. An increase in vehicular traffic to and from'the site, and the. increase can be expected to exceed 100 vehicles per day. Because the addition will provide for a secured parking area for existing vehicles, the proposed modification will not result in an increase in-vehicular traffic to or from the site. 8. An increase in the floor area proposed for a non-residential use by more than 10 percent excluding expansions under 5,000 square feet. The expansion is less than 5,000 square feet, therefore, this standard is excluded. 9. A reduction in the area reserved for common open space and/or usable open space which reduces the -open space. area below the minimum required by this code or reduces the open space area by more than 10 percent. There is no area reserved for common open space, therefore, this standard does not apply. 10. A reduction of project amenities (Recreational facilities; Screening; and/or, Landscaping provisions) below the minimum established by this code or by more than 10 percent where specified in the site plan. The proposed garage will remove approximately 3,500 square feet of landscaping, however, the site will continue to have 32% of landscaping after the addition. The property to the northwest (parallel to Pacific Highway) is zoned and developed R-12, therefore, buffering and screening is required. The code reqiures 11. Staff can find no record of prior SDR approval, therefore staff can not determine if the modification violates any conditions imposed. The site appears to comply with current standards, however, in relation to landscaping percent and screening. Because the proposal will continue to provide for more landscaping than the underlying zone requires, staff is comfortable in determining that the proposal will not violate any relevant conditions imposed at the time of the Site Development Review. This request is determined to be a minor modification to an existing site. The Director's designee has determined thaf the proposed minor modification will promote the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties provided that development which occurs after this decision complies with all applicable local, state, and federal laws. All necessary building permits must still be obtained before construction. This letter will be placed in the land use file and is considered part of the approved plan.'' The Planning -Division requires two sets of architectural elevations, site and landscape plans. Tfie cost for this type of review is $100.
