SECTION III. BACKGROUND INFORMATION Site History.: The site is currently undeveloped. A pre-application conference was held on February 9, 1999 to construct a 3-story, 50,109 square'foot office building. On November 23, 1999, Sprint PCS received approval SDR1999-00011) to build a wireless communication tower at the southwest corner of the subject property. To date, no other land use applications have been filed with the City for this site. Vicinity Information:' The property abuts the easterly property line of the GM Training Center located on SW Pacific Highway and is across SW Pfaffle Street from a residential zone on the sub11'ect property's own northern property line. Properties to the east and west are zoned C-P (Professional CommercialSite Information and Proposal Description: The site is currently undeveloped. Sprint PCS has been granted approval from the City of Tigard to build a wireless communication tower. Sprint is now asking for a Variance to the access requirement of 30 feet wide with a 'minimum of 24-feet of pavement, to a 12-foot- wide graveled access along the west property line of the site. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Approval Process and Standards: Section 18.370.010.A states a Variance may be granted from the. applicable zonin~ requirements of this title where it can be shown that, owing to special and -unusua circumstances related to a. specific property, the literal interpretation of the provisions of the applicable zone would cause an undue or unnecessary hardship, except that no use variances shall be granted. Section 18.370.010.C.2 states the Director shall approve, approve with conditions, or deny an application for a variance based on finding that the following criteria are satisfied: The proposed variance will not be materially detrimental to the purposes of this title, to any other applicable policies and standards, and to other properties in the same zoning district or vicinity. In this situation, the .requirement of a 30-foot-wide access drive with 24 feet of paving is excessive to the need for the approved Monopole facility. The only purpose the access drive will serve is to allow a maintenance vehicle to visit the site one or two times per month for maintenance and possible emergency purposes. There are special circumstances that exist which. are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control and which are not applicable to other properties in the same zoning district or vicinity. NOTICE OF TYPE 11 DECISION VAR2000-00003/SPRINT PCS WIRELESS MONOPOLE TOWER VARIANCE PAGE 2 OF 4 The' property in question is zoned C-P; Professional Commercial.. The use involved with the Variance is an unmanned. monopole tower which is not necessarily a typical use for this zone. The applicant contends that the requirement to the paved access drive is excessive for the use because of the amount of usage the access drive will have. It is interpreted that the drive will only be used once or twice a month as opposed to daily use such as that of a commercial development. Given the usage vs, the impact of a paved drive, staff finds that this is a special circumstance that is not typical for all similar zoned properties. The use proposed will be the same as permitted under this title and City standards will be maintained to the greatest extent that is reasonably possible while permitting reasonable economic use of the land. The requested Variance does not propose a change of use and .does not affect future economic use of the land. The Variance to move the access drive closer to the property line and allowing the drive to be gravel instead of pavement will be conditioned to be paved 20 feet back from SW Pfaffle Street in order to minimize gravel being spread on a City street. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were developed as specified in the title. The proposed Variance to the paved access associated with the approved monopole tower will not affect physical or natural systems associated with development. The development of a 12-f6ot-wide gravel access will have less- of an impact then a 24-foot-wide paved access, due to the permanent nature and physical impact of pavement. Full pavement would add to the amount of impervious surface, thereby decreasing infiltration into the ground. The hardship is not self-imposed and the variance requested is the minimum variance, which would alleviate the hardship. The hardship is not self-imposed. The applicant is subject to the procedures set forth in the Tigard Development Code, which calls for a 30-foot-wide access drive with a minimum of 24 feet of paving. This standard was developed to cover more conventional uses, which would develop either the whole parcel or larger parts of the parcel. SECTION V. OTHER STAFF COMMENTS The City of Tigard Building Division has reviewed the proposal and has no objections to it. The City of Tigard. Operations Department has reviewed the proposal and has no objections to it. SECTION VI. AGENCY & CITIZEN COMMENTS GTE has had an opportunity to review the application and has no objection to it.
