The owner of the 16 x 420 foot strip appears to be agreeable to this exchange. Issue Must the city use the procedures of sale specified in ORS 275.120, 275.140, 275.160, 275.180and 275.260 as required by ORS 221.745? Discussion ORS 221.745 was enacted by the 1981 Legislature and it spells out a variety of requirements, including notice, appraisal and procedure for sale of real property owned by a city. It applies "[w]hen any city council deems it to be for the best interests of the city to sell any real property, or any interest therein, acquired in any manner by the city, and such sale would create a parcel for which a building permit could legally be issued ORS 221.745. .11 A building permit could not be issued for the parcel the city will be offering in trade for the strip of land which lies behind the shops. Conclusion The recently-enacted provisions of ORS 221.745 do not apply to this property trade; however, it should be noted that every sale of real property should be carefully examined to be sure that the require- ments for notice, appraisal and sale procedure have been met.
