Tigard-Tualatin School District - Phil Lewis Elementary School Sewer ANk WHEREAS, the City of Tigard , hereinafter termed "City" and School District #23 (Tigard) , Washington County, Oregon, here- inafter termed "District" executed a certain contract under date of July ,1967 , with respect to the construction of a sewer trunk line to provide service to the District's Phil Lewis School on Southwest 72nd Avenue, Tigard, Oregon, and to other lands in the general area , and . WHEREAS, paragraph (6) thereof readsas follows : "(6) The foregoing item of $1,500.00 hereinabove stated to be non-reimbursable to the. District, shall be subject to increase or decrease according to the following formula: a . If the total cost of construction of said line as hereinabove estimated under Items "a" and "b" of Paragraph (5) shall exceed or be less than the total amount of 10a" and "b" by ten (10%) per cent or more thereof, the non-reimbursable item of $1,500.00 shall be increased or decreased in direct propor- tion as the cost of construction under "a" and "b" of Paragraph (5) shall be greater or less than 10% thereof." WHEREAS, it is desired hereby to record the final deter- mination of the basis for reimbursement to the District pursuant * " to the terms of said contract, NOW, THEREFORE, in consideration of the mutual benefits to be derived hereunder , the City and the District do hereby compute the basis for reimbursable amount to the District pursuant to the above quoted Section 6 , as follows: (a) Total actual cost of 1075 feet of 8-inch line to be constructed by the City $7 ,325.00 (b) Total actual cost of 550 feet of 8-inch line to be constructed by the District 3 ,189 .00 Total actual cost $10,514.00 (10% of such cost = $1 ,051.40) Amount not reimbursable under said contract $1 ,500 .1,500.00 Total $ 9,014.00 The parties agree that pursuant to the provisions of Section 5aa , bb and cc of said contract the District 's reimburse- ment from sewer connection charges within the purview of said agreement shall be based upon the above net computed sum of $9,014.00. W. 79th Avenue and the new Beaverton-Tigard Highway right-of-way, to manhole 16+20 within the " grounds of the school site, NOW, THEREFORE; in consideration of the foregoing premises, the ,agreemezits herein contained,. the mutual benefits to. be derived by the parties., and the payments to be made as . hereinafter set forth, THE- DISTRICT AND THE CITY AGREE AS FOLLOWS: (1') That the City shall directly 'contract- "pursuant to pend- ing bid for the construction of that portion of the "l.ine .extending from"-manhole 0+00 to manhole 10+75 in accordance with plans and specifications, and the District shall directly contract pursuant to pending bid. for ,-the construction of that portion of. the. line• . . extending from manhole 10+75 to manhole 16+20. In addition, the District At Its sole expense shall construct such lateral line as it deems necessary to connect its buildings to the trunk line at station 16+20 The City shall•, obtain ne.ces,sary. easementor right of •ways, and :shall. furnish inspection services •for 911 construction activities,on both :segments..,of the line, and all such construction i shall be performed in accordance with City standards and specifi cations heretofore agreed upon between the parties.. The total line herein described, .from :manhole 0+00 to manhole 16+20� shall upon completion become, the property of the C3ity, and the City shall maintain the same. You will note that we have designed the sewer ' to extend.completely across the school property to S. W. 72nd Avenue. We suggest that the easements be forwarded to your City Attorney for .preparation in final form. It might be well to contact the involved private property owners with regard to ,these easements before the project progresses much farther. Water usage would be caiculated during the January•March period and an average monthly charge determined. 2. Connection fees; We would request that connection fees be waived. First, we feel that .one tax supported governmental unit should not charge another a fee of this type. It would appaar• we-are just chang- ing funds'. from one pocket to another! There are two methods of approach; however, the sewer will be needed by September 1967 and the School Board will need an estimate of cost by their February meeting. The two approaches to the problem as I see it, would be as follows: 1. The School District pay for the extension of the sewer of suffic- ient size to take care of the school needs, plus the adjoining intervening.property needs, with the right of recovery of part of the cost when future connections are made from the inter- vening properties. This would be the quicker method of approach. Form a §ewer district for this area and install a sewer under Bancroft financing procedures. would appreciate very much your immediate attention to this problem order that we may know what funds are to be allocated for this work. i The School Board will meet on February 8th to decide this matter and if we could have this information in our hands by the 6th, this should � be satisfactory.
