CONTRACT FOR PERSONAL SERVICES
COMPREHENSIVE PLANNING ASSISTANCE PROJECT
THIS AGREEMENT, entered into. as of this lst day of June
1976, by and between City of Tigard
(herein called the "Contractor") and the State of Oregon,
acting by and through the Executive Department (herein called
the "Planning Agency") , WITNESSETH THAT:
WHEREAS the Planning Agency desires to engage the Con-
tractor to render certain technical or professional services
hereafter described in connection with an undertaking which
is expected to. be partially financed under Section 701 of the
Housing Act of 1954, as mended:
NOW, THEREFORE, the parties hereto do mutually agree as
follows:
1. Employment of Contractor. The Planning Agency hereby
agrees. to 'engage the contractor and the. Contractor hereby
agrees to perform the services hereinafter set forth in
connection with the Project of the Planning Agency. under
Urban Planning Grant Contract No. CPA-OR-10-00-0006 . . This
.Contract shall be known as Contract Number IRD 76- 02 02
2. Area Covered. The Contractor shall perform all the:
necessary services provided under this Contract in connection
with and respecting thefollowingarea or areas, herein called
the "planning area":

3. Scope of Services. The Contractor shall do, perform,
and carry out, in a satisfactory and proper manner, as deter-
mined by the Planning Agency, thefollowing services:

secure at his own expense, all personnel required in performing
the services under this Contract. Such personnel shall not

b. All of the . services required hereunder will . be
performed 'may the Contractor or under his supervision, and
all personnel engaged in the work shall be fully qualified
and shall be authorized under State and local law to perform
such services.
c. None of the work or services covered by this Con-
tract shall .be subcontracted without the prior written
approval of the Planning, Agency. Any subcontract approved
in writing by the Planning Agency shall contain an Equal
Employment 02portunity section identical to section of
this contract.
6 . Time of Performance.
a. Contract Period
(1) The term "Contract Period" as used in this
Contract means the period of time between the beginning date
of this Contract, which is June 1, 1976, and the termination
date of this Contract, which is May 31, . 1977.
(2) The services of the Contractor are to commence
at the beginning of the Contract Period or an soon as practi-
cable thereafter, and shall be undertaken and completed in
such sequence as to assure. their expeditious completion in
light of the purpose of this contract. All of the services
described in this Contract shall be completed to the . satis
faction of the Planning Agency on or before the end of the
Contract Period.
7. Compensation.
a. The Planning Agency agrees to compensate or reim-
burse the Contractor ( City' of Tigard )
the sum of Six thousand one hundred eighty-six dollars
( $6, 186.Ob for the satisfactory performance of services in
the completion of work element(s) which are described in para-
graph three of this . Contract.
b. The Planning. Agency will reimburse the Contractor
for work performed June 1, 1976 through May .31, 1977 .

g. In the event of disagreement between any parties
to this Contract, regarding the justification or eligibility
of any payment, the decision of the Planning Agency shall be
final and binding on all parties.
h. Payments amounting to a sum total of ninety.-percent
(90%) of the Contractor' s. eligible reimbursement will be made
by the Planning Agency upon receipt of documented and .approved
reimbursement requests. The remaining ten percent (10%) of
the sum total will be withheld by the Planning Agency as a
retainer pending satisfactory completion of the total project
and acceptance .of the Project Completion Report by the Planning
Agency.

limited to billings for actual costs incurred in the perform-
ance of its obligations under this Contract. It is expressly
understood and agreed that in no event will the total compen-
sation and reimbursement to be paid under this Contract .

8 . Reimbursement. The Planning' Agency will pay to. the
Contractor the amount or amounts set forth in Section 7.,
which shall constitute full and. complete compensation for
the Contractor' s services hereunder. Actual costs as covered
by Section 7, . paragraph (i) , less the J.0% retainer which will
be .deducted from. the payment as covered by Section 7 , para-
graph (h) , will be paid subject to receipt of a requisition
for payment from the Contractor on appropriate State voucher .

9 . Termination of Contract for Cause. If, through any
cause, the Contractor shall fail to fulfill in timely and
proper manner his obligations under this Contract, or if the
Contractor shall violate any of the covenants, agreements,
or stipulations of this Contract, the Planning; Agency shall
thereupon have the right to terminate this. Contract by giving
written notice to the Contractor of such termination and
specifying the effective date thereof, at least .five days
before the effective date of such termination. In 'that
event, all finished or unfinished documents, -data, studies,
surveys, drawings, maps, models, photographs, and reports
prepared by the Contractor shall, at the option of, the Plan-
ning Agency, become its property, and the Contractor shall
be entitled to receive just and equitable compensation for.
any satisfactory work completed on such documents and other
materials.
Notwithstanding the above, the Contractor shall not be
relieved of liability to the Planning Agency for damages
sustained by the Planning Agency by virtue of any breach of
the Contract by the Contractor, and the Planning Agency may
withhold any payments to the Contractor for the purpose of
set-off until such time as the exact amount of damages due
the Planning Agency from the Contractor is determined.
10. Termination for Convenience of Planning Agency.
The Planning Agency may terminate this. Contract at any time
by giving written notice to the Contractor of such termina-
tion and specifying the effective date thereof, at least 15
days before the effective date of such termination. In that
event, all finished or unfinished documents and other materi.-
als as described, in Section 9 above shall, at the option of
the Planning Agency, become its property. If the Contract

is terminated by the Planning Agency as provided herein, the
Contractor will be paid an amount which bears the . same ratio
to the total compensation as the services actually performed
bear to the total services of the Contractor covered by this
Contract, less payments of compensation previously made:
Provided, however, that if less than 60 percent of the serv-
ices covered by this Contract have been performed upon the
effective date of such termination, the Contractor shall be
reimbursed (in addition to the above payment) for that por-
tion of the actual out-of-pocket expenses (not otherwise
reimbursed under this Contract.) incurred by the Contractor
during the Contract period which are directly attributable
to, and within the Budget of, the uncompleted portion of the
services covered by this Contract. If this Contract is
terminated due to the fault of the Contractor, Section 9
hereof relative to termination shall apply.
11. Equal Employment Opportunity. (a) The Contractor
will not discriminate against any employee or applicant for .
employment because of race, color, religion,' ,sex .or national
origin. The Contractor shall take affirmative action to ensure
that applicants are employed and that employees are treated
during employment, without regard to their race, color,
religion, sex or national origin. Such actions shall include,
but not be limited to the following: employment, upgrading,
demotions, or transfers, recruitment or recruitment adver-
tising; layoffs or terminations; rates of pay or other forms
of compensation; selection for training including apprentice-
ship; and participation in recreational and. educational
activities. The Contractor agrees to post in conspicuous
places available to employees and applicants for employment
notices to be provided setting forth the provisions of this
non-discrimination clause. The Contractor will in all
solicitations or advertisements for employees placed by or
on behalf of the Contractor, state that all qualified appli-
cants will receive consideration for employment without regard
to race, color, religion, sex or national origin. The Con-
tractor will cause the foregoing provisions to be inserted
in all subcontracts for any work covered by this contract so
that such provisions will be binding upon each subcontractor
provided that the foregoing provisions shall not apply to
contracts or subcontracts for standard commercial supplies
or raw materials. (b) .The Contractor shall keep. such records
and submit such reports concerning the racial and ethnic
origin of 'applicants for employment and employees. as the
Secretary may require. (c) The Contractor agrees to comply
with such rules, regulations or guidelines as the Secretary
may issue to implement these requirements.

12 . Interest of Members of Planning Agency and Others.
No officer, member, or employee of the Planning Agency and
no members of its governing body, and no other public official
of the governing body of the locality or localities in which
the project is situated or being carried out who exercises .
any functions or responsibilities in the review of approval
of the undertaking or carrying out of this project, shall
participate in any decision relating to this Contract which
affects his personal interest or have any personal or' pecuniary
interest, direct or indirect, in this Contract or proceeds
thereof.
13. Assignability. The Contractor shall not assign any
interest in th his Contract, and shall not. transfer any interest
in the same (whether by assignment or novation) , without the
prior written .consent of the Planning Agency thereto: Provided,
however, that claims for money due or to become due to the
Contractor from the Planning Agency under this Contract
may be assigned to a bank, trust company, or other financial .
institution without such approval. Notice of any such assign
ment or transfer shall be furnished promptly to the Planning
Agency.
14 . Interest of Contractor. The Contractor covenants
that he presently has no interest and shall not acquire any
interest, direct or indirect, which would conflict in any
manner or degree with the performance of services required
to be performed under this Contract. The Contractor further
covenants that in the performance of this Contract no person
having any such interest shall be employed.. Also, the Con
tractor shall comply with Oregon revised statutes Chapter 279
Section 360. Any person who is a full time employee of a
governmental agency other than the Contractor, shall not
participate in the performance of or receive any personal
benefit from this Contract.
15. Officials Not to Benefit. No Members of. or Delegates
to the .Congress of tFie United States of America, and no Resi-
dent Commissioner, shall be admitted to any share or part
thereof or to any benefit to arise herefrom.
16. Identification of Documents. All reports, maps, and
other documents completed as a part of this Contract, other
than documents exclusively for internal use within the Plan-
ning Agency, shall carry the following notation on the front
cover or a title page (or, in the case of maps, in the same
block) containing the name of the Planning Agency:

"The preparation of this (report, map, document,
etc. , ; was financed in part through a comprehensive
planning grant from the Department of Housing and
Urban Development, under the. provisions of Section
70.1 of the Housing Act. of 1954 , as amended, (to-
gether with the date (month and year) the document
was prepared and the name of the municipality,
metropolitan area; or other planning area concerned) . "
17. Publication, Reproduction and Use of Material. No
material produced in whole or part under this Contract shall
be subject to copyright in the United States or in any .other
country. The Planning Agency and the Department of Housing
and Urban Development shall have unrestricted authority to
publish, disclose, distribute and otherwise use, in whole or
in part, any reports, data, or other materials prepared under
this Contract. Any material produced in whole or in part
under this Contract given to or assembled by the Contractor
under this Contract, which the Planning Agency requests to
be kept as confidential, shall not be made available to any
individual or organization by the Contractor without prior
written approval of the Planning Agency.
18. Audits and Inspections. At any time during the
normal business hours and as often as the Planning Agency,
Department of Housing and Urban Development and/or the
Comptroller General of the United States may deem necessary,
they shall be made available to the Planning Agency, Depart-
ment of Housing and Urban Development and/or representatives
of the Comptroller General for examination of- all of its
records with respect to all matters covered by this Contract
and will permit the Planning Agency, Department of Housing
and Urban Development and/or representatives of the Comptroller
General to audit, examine and .make .excerpts or transcripts
from such records, and to make audits of all contracts,
invoices, materials, payrolls, records of personnel, condi-
tions of employment and other data relating to all matters.

19. Designations and Definitions.
a. Local Planning Unit - The Local Planning Unit for
the purposes of this Contract (see Sections l9e and 20c)
will be: City of Tigard Planning Commission

b. Designated Agencies. - The "Designated Agencies
for the purposes of this. Contract and for the purpose of
local planning coordination (see Sections. 19e and. 20c) will
be each and all of ,the following agencies or 'firms:
c. Planner-in-Charge - The "Planner-in-Charge"will
be Richard Bolen , an employee of
City of Tigard .
This designation may be changed, but only upon written
approval of the Planning Agency.
The Planner-in-Charge shall be responsible for:
(1) General supervision of the entire Comprehen-
sive Planning Assistance project. This responsibility will
extend to all proposals developed in connection with the
subject project, subject to the policy and general guidance
of the Governmental Unit involved.
(2) Reporting regularly to the Local Planning
Unit, and the Designated Agencies to obtain substantial
understanding and .participation in the subject project and
the total planning process. In addition, the Planner-in-
Charge shall deliver to each of the Designated Agencies a
copy of the published reports which are prepared hereunder.
(3) Preparing a written report reviewing the
actions and activities which have been taken with the
Designated Agencies. This written review is to include a
summary of the responses received on the planning proposals
and is to be presented to the Local Planning Unit and the
Planning Agency prior tocomplete review of the project (as
specified in Section 20 (c) herein) .'
(4) Preparing Bibliographic Data Sheets in the
form specified by the Planning Agency for each published
document.
(5) Submitting the completion report in the form
specified by the Planning Agency.

d. Project Representative — The "Project Represents-
tive" will be a District Planner, an employee of the Inter-
governmental Relations Division,
The Project Representative will be responsible for:
(1) The technical services of his employer in
connection with .this Contract.
(2) Consultation with the Planner-in-Charge
regarding the progress of the project at such times and
manner which will permit the Planner-in-Charge to satisfac-
torily discharge his responsibilities for obtaining under-
standing and participation in the total project.
(3) Presenting all planning proposals prepared in
connection with the subject project to the Planner-in-Charge
for review prior to offering such proposals to the public
or to any local agencies or firms for their consideration.
e. Preliminary Drafts .- The Contractor shall submit
preliminary^drafts of planning proposals- 'under this Contract
which are related to the functions of the various Designated
Agencies for their review and recommendations prior to the
finalization of such proposals. It shall be -the duty of the
Contractor to notify the various Designated. Agencies that
they have ten (10) days to review the material and respond
to the Contractor. A Designated Agency shall be permitted
an additional twenty . (20) days for review upon a written
request to the Contractor within. the ten (10) . day period.
If the Contractor receives no response after the Designated
Agency has had at least ten (10) days to review the material,
the Contractor may presume that the Designated Agency has no
objections or suggestions regarding the proposals and may
proceed accordingly.
f. "Published" and "Un ublished" - For the purpose
of this Contract the term "published" shall mean final
materials displayed or made available to the general public;
as distinguished from "unpublished", which shall mean
preliminary materials reproduced for staff review and dis-
cussion purposes prior to being "published. "

20. General Provisions.
a. Changes - The Planning Agency, or Contractor may
from time to time request changes in the scope of the services
of the Contractor to be performed hereunder. Such changes,
including 'any increase. or decrease in the amount of the Con-
tractor' s compensation, which are mutually agreed upon by
and between the Planning Agency and the Consultant, shall be
incorporated in wre
.ittn .amendment to this Contract.
b. Verbal Agreements - It is mutually agreed and
understood that no alteration or variation of the terms of
this contract shall be valid unless made in writing and
signed by the parties hereto and that no oral understanding
or agreements not incorporated in this Contract, and no
alterations or variations of the terms of this Contract,
unless made in writing between the parties to this Contract,
shall be binding.
c. Responsibility_to Local Governments -
(1) The Contractor shall be responsible and
responsive to the Governmental Unit in its requests and
requirements related 'to the scope of this program and shall
confer with and be guided by the directives of the Govern-
mental Unit.
(2) The Contractor shall meet with the . Local
Planning Unit prior to the undertaking of work related to
the scope of this project. The purpose of the meeting shall
be to discuss planned activities. Subsequent meetings shall
occur not less than once every three months.
(3) The Contractor shall make reasonable effort
to obtain agreement between plans prepared under this Contract
and the plans of other public agencies in the area.
(4) The Contractor shall present to the Local
Planning Unit and the Governmental Unit a complete review of
the project including maps, charts, conclusions and recommen-
dations prior to the publication .of final reports not later
than one (1) month prior to the Contract completion. This
presentation is. to contain a discussion of the comments
received from the Designated Agencies.

21 . Contributed .Seryices.
a. Eligible Service Contributions - The service contri-
bution may consist of all costs incurred by the Contractor .
which are necessary for the. satisfactory performance of the
services described in this contract provided,, however, costs .
are not chargeable under this contract which do not
qualify under the Comprehensive Planning Assistance. Grant
Program and provided further that no contributed service
credits may be requested for services which are or have been
the. subject of payment to the Contractor by the Planning
Agency. Their service contribution shall be valued at standard
rates as established by the Contractor and such services shall
be reported to the Planning Agency in the manner which it pre-
scribes.
b. Establishment and Maintenance of Accounts - The
Contractors all establish for the approved activities, in
conformity with requirements provided by the Department of
Housing and Urban Development and outlined in a Comprehensive
Planning Assistance Handbook II - Managing a Grant (CPM 6042) ,
separate accounts to be maintained within its existing account-
ing system or set up independently. Such accounts are referred
to in these conditions collectively as the "program account. "
The Contractor shall appropriately record in the program those
amounts, other than cash, for the values of eligible service
contributions .
All costs charged to the program account shall be
supported by properly executed payrolls, time records, invoices,
and vouchers evidencing in proper detail the nature and .pro
priety of the charges. All accounting records shall readily
provide a breakdown of activity costs in accordance with the
line items shown on the latest approved budget. Such records,
together with supporting documents, shall be kept separately
from other documents and records and shall be maintained for
a period of three years after receipt of the final grant pay-
ment.
22. Reports, Maps, Plans and Documents
a. Preparation and Submission
(1) The Contractor shall prepare and submit to the
Planning Agency all reports, maps, plans and documents (includ-
ing quarterly progress reports and a completion report) as re-
quired by the Planning Agency and the Department of Housing
and Urban Development and as provided in Comprehensive Planning

Assistance Handbook II, Managing a Grant (CPM 6042) , CPM 6042 .1a -
change dated March 19, 1973, . and any changes thereof.
(2) During the Contract Period, the Planning Agency
will notify the Contractor as .to the exact numbers of such
reports, maps, plans and documents to be prepared and submitted.
(3) All maps and, plans transmitted shall be folded
to the size of the reports with the title, the municipality
and the report or study to which it relates indicated on the
outside top fold of such map and plan as. well as containing
the HUD logo on the front page. Multi-colored, odd-sized or
glossy reports are ineligible activities, except when multiple
colors are required on maps to distinguish features, uses or
other differences.
(4) With respect to models and published maps and
plans such as aerial maps, and maps and plans .which are
colored or are too large to fold- compactly, it is required
only that 2 photographs or photostats of each ' (in color or
black and white, whichever is appropriate, and at least
8" x 10" in size) be submitted as a graphic record of the
project. Each such photograph or photostat shall be legibly
identified as to the title and scale of the original document,
the municipality or area covered, and the report or study to
which it relates, and shall contain a notation of . the place
where the original is located.
23. Compliance with Title VI of the Civil Rights Act of
1964.
The Contractor .shall comply with Title VI of the
Civil Rights Act of 1964, and with the regulations and.
requirements imposed by or pursuant to the regulations of the
Department of Housing and Urban Development issued pursuant
thereto.
24 . Compliance with Title VIII of the Civil . Rights Act
of 1968.
The Contractor shall comply with Title VIII of the
Civil Rights Act of 1968 and all requirements imposed by or
pursuant to the regulations of the Department of Housing
and Urban Development issued pursuant to that title.

25 . Training, Employment, and Contracting Opportunities
for Businesses and Lower Income Persons,.
a. The project assisted. under this contract is subject
to the requirements of section 3 of the Housing and Urban
Development Act of- 1968; as amended, 12 U.S.C. 170lu.
Section 3 requires that to the greatest extent feasible..
opportunities for training and employment be given lower
income residents. of the project area and contracts for work
in connection with the project be awarded to business concerns
which are located in or owned in substantial part by persons
residing in the area of the project.
b. Notwithstanding any other provision of this con-
tract, the recipient shall carry out the previsions of said
section 3 and the. regulations issued pursuant thereto by the
Secretary set forth in 24 CFR Part 135 (published in 38 .
Federal Register 29220, October 23, 1973) , and all applicable
rules and orders of the Secretary issued thereunder prior to
the execution of this contract. . The requirements of said
regulations include but are not limited to development and
implementation of an affirmative action plan for utilizing
business concerns located with or owned in substantial part
by persons residing in. the area of the project; the making of
a good faith effort, as defined by the regulations, to provide
training, employment, and business opportunities required by
section 3; and incorporation of the "section 3 clause" speci-
fied by Section 135:20 (b)` of the regulations in all contracts
for work in connection with the project. The -recipient
certifies and agrees that it is under no contractual or other
disability which would prevent it from complying with these
requirements.
c. Compliance with the provisions of section 3, the
regulations set forth in CFR Part 135, and all applicable
rules and orders of the Secretary issued thereunder prior to
approval by the Government of the application for this contract,
shall be a condition of the federal financial assistance pro-
vided to the project, binding upon the recipient, its succes-
sors and assigns. .Failure to fulfill these requirements shall
subject the recipient, its contractors and subcontractors,
its successors, and assigns to the sanctions specified by
this contract, and to such sanctions as are specified by
24 CFR Section 135.135.

26 . Citizen Participation.
The Contractor shall include in .the annual program
completion report, a report which describes: (1) direct
.involvement of residents of the planning area in the planning
process through whatever mechanism the Contractor and Planning
Agency 'agree upon to fulfill the citizen participation require-
ment of HUD Handbook CPM 6041.1A, Chapter 4, paragraphs 13-16 , .
and;. (2) the manner through which views of low income and
minority groups were explicitly solicited and recognized in
the planning process.
27. Environmental Assessment.
The Contractor shall prepare an environmental assess-
ment when the assisted work program will result in develop-
mental plans or policies for land use, major community facili-
ties, major utility systems, major transportation systems or
the protection of natural areas (estuaries, coastal zones,
etc. ) . The assessment must:
a. Include the following:
(1) A summary or abstract of the proposed plan(s)
or policies;
(2) The environmental impact (beneficial as .well
as adverse) of the proposed plan (s) or policies,. if they are
carried out;
(3) Any adverse environmental' effects which. cannot
be avoided should the proposed plan(s) or policies be imple-
mented;
(4) Alternatives to the proposed.plan (s) or poli-
cies and an analysis of those alternatives;
(5) The relationship, under the proposed plan (s)
or policies, between local short-term uses of man' s environ-
ment and the maintenance and enhancement of long-term
productivity,
(6) Any irreversible and irretrievable commitments
of resources which would be involved if the proposed plan(s)
or policies should be implemented; and
(7) A .statement setting forth applicable federal,.
state and local environmental controls..

b. Be appended to the resulting proposed plan and
accompany the plan through all deliberations leading to
approval and subsequent amendment; and
. .c. Be available .to the public on a timely basis,
including availability before public hearings regarding the.
plan.
28. Historic Preservation Assessment.
The Contractor shall prepare an Historic Preservation
Assessment when the assisted work includes the preparation of
plans or policies for development which may impact National
Register properties. The Historic Preservation Assessment
shall be prepared as provided in paragraph 600.66 (d) of
section 701 of the Housing Act of 1954, as amended.

application and by telephone conversation, we have prepared

Enclosed is one full contract and additional
signature pages for insertion into duplicate contracts for
distribution to you, the consultant (if any) , and appro-
priate State agencies.- Included in the contract is a
minority goals certification statement which needs the
signature of the local government agency and/or contractor .
Also, contracts which have consultants need the Federal
I .D. Number where indicated on the signature page. Please
review and execute the contract signature pages.
Following execution, please return the contract

GENERAL DESCRIPTION OF IN-KIND CONTRIBUTIONS
Many federally funded projects require matching
contributions from the agency receiving the grant (grantee) .
The matching share is that portion of costs not paid by the
federal government.
All HUD "701" contracts require a 2/3-1/3 match.
The grantee must supply one dollar of matching funds for every
two federal dollars. This matching share may be cash or
in-kind contributions or both..
An understanding of the difference between cash
contributions and in-kind contributions is essential . One
easy rule-of-thumb distinguishes cash contributions--all cash
contributions are forwarded through Intergovernmental Relations
Division (IRD) for disbursement. For example, a city hires . a
consultant for $15,000. The city is responsible for a cash
contribution of $5,000, the federal government is responsible
for $10,000. The city' s $5, 000 cash share must be sent to
IRD, which adds it to federal dollars to pay the consultant.
In-kind contributions are made in some form other
than money. They may be made by the grantee, by other public
agencies, and by private organizations and individuals. In-kind
contributions ,may include charges for property and equipment.
They may also represent the value of goods and services which
benefit the grant program and are specifically identifiable
to that program.

CRITERIA- FOR IN-KIND CONTRIBUTIONS
To qualify as matching share , in-kind contributions
must meet the following criteria:
1) They must be identifiable from the grantee' s
records;
2) They must not be included as contributions for
any other federally-assisted program;
3) They must be necessary and reasonable for proper
and efficient accomplishment of project objectives;
and
4) They must conform to other provisions in the.
regulations which will be explained here.
ITEMS WHICH QUALIFY AS IN-KIND CONTRIBUTIONS
Those items which qualify as in-kind contributions
include:
1) Regular staff time spent on "701" project;
2) Volunteer services for "701" project;
3) Contributed materials;
4) Donated equipment, buildings , land or use of space;
5) Other charges.
ASSESSING THE-VALUE OF IN-KIND CONTRIBUTIONS
HUD guidelines should be followed in assessing the
value of in-kind contributions.
1) Regular staff time: Time spent by regular public

employee on "701". project may be counted as in-kind conte'
tion. For example a county recorder working part-time on "701"

is not paid specifically for "701" work but contributes to the
project. The in-kind value is equal to the employee ' s normal
hourly rate of pay multiplied by hours spent on the project.
2) Volunteer' Services: Rates for volunteers. such as
citizen advisory committee members should be consistent with
regular rates paid for similar work in state or local govern-
ment. If there is no similar work in state or local government,
the rates should reflect the grantee' s local labor market.
Refer auestions about rates to IRD.
When another employer donates an employee ' s regular
services to the grantee, those services are valued at the
employee' s normal pay rate.
3) Contributed Materials: This includes office
supplies, maintenance supplies or workshop supplies. The price
assessed should be reasonable. It should be based either on
actual cost or current market price, whichever is less, when
charged to project.
4) Donated Equipment, Buildings, Land or Use of Space :
You may include depreciation and use charges for equipment and
buildings and fair rental charges for land.
5) Valuation of Other Charges: other charges may be
accepted as in-kind if they are:
A) Incurred for and of direct benefit to grant
program:
B) Adequately supported and permissible under
law; and
C) Reasonable and properly justifiable.

REQUIRED SUPPORTING RECORDS
In-kind paid for in cash is accounted for by normal
accounting procedures. . However, in-kind for which you estab-
lish value should be accounted for as follows:
l) Services: Maintain records for those attending
meetings, their hours, and date and place of meeting just as
you record employee hours. (Sample attached)
2) Documentation: Document your basis for determin-
ing personal services, material, equipment, buildings and land
charges.
INELIGIBLE ITEMS
Certain items are unallowable as in-kind contributions.

(a) City Administrator stated Department Heads would present a rough draft
of their departmental programs and budget requirements using the program
element budget format.
Administrator further stated the new format was an attempt to provide
more information to budget committee and the opportunity for Department

budget committee.

(b) INFORMATIONAL - Administrator confirmed with Council application for BOR

1. Due to anticipated late .arrival of the Mayor and the excused absence of
Council President, Councilman Cook called meeting to order.
2.. ROLL CALL: Present: Mayor Wilbur A. Bishop; Councilmen John E. Cook,
Kenneth W. Scheckla, Lynn R. Wakem; R. B. Adams, Chief of
Police; J. D. Bailey, Legal Counsel, Bruce P. Clark, City
Administrator; Theron L. Martin, Director of Public Works;
Arline O'Leary, Administrative Aide.
3. STATUS REPORT TO COUNCIL REGARDING T-CAP
(a) Mary Srofe, T-CAP member, reiterated letter to Council from T-CAP
chairman Roy Rogers. Srofe stated T-CAP recommended the following:
(1) disbandment of T-CAP; and
(2) formation of a public safety committee.
(b) Discussion by Council, Srofe and staff regarding need for
formation of safety committee..
Council concurred to direct staff to prepare resolution disbanding
T-CAP. Council further concurred to consider the formation of a
safety committee in the near future.
4. L.C.D.C. & 701 PROGRESS REPORTS r
John Laws and Larry Svart gave presentation on progress of L.C.D.C.
(a) Y -
compliance schedule.
Staff displayed two maps - one identifying wetlands, 100 year flood
plains and topography and one showing all existing land use except

agriculture.
Laws stated a public workshop on housing needs and goals will be conducted
1/19/77, 7:30 P.M. at Twality Junior High.. Laws further stated the
Planning Commission will conduct public workshop 1/25/77 to discuss
policy options"developed at the 1/19 workshop and prepare for formal
gdop.tA.o_n -of housing policies at regular meeting 2/15/77.
Svart stated the data collected has already proven valuable .to planning
staff's efforts.
General discussion by Council and staff regarding time schedule,
availability of data needed and the next year L.C.D.C. funding
request due February 1, 1977.
7:55 P.M. Mayor Bishop arrived and assumed the chairmanship.
(b) Ben Altman presented Park and Open Space Planning progress report.

Altman stated the effort in this portion of the schedule had been
speeded up because of heavy development in area causing a need for
open space planning to be conducted as soon as possible.
Altman further stated a preliminary open space plan is expected
to be completed in March of 1977, followed by public evaluation
and hearings for final adoption.
(c) Mayor, commended staff on their progress.
5. DEVELOPMENT ORDINANCE,
(a) City Administrator stated there was a need to establish policy
guidelines which apply to each and every developer. Administrator
recommended Council adopt proposed resolution and ordinance as an
interim step while further study of problem is conducted.
Legal Counsel recommended Council's adoption of proposed resolution
and ordinance. Legal Counsel further recommended deletion of the
last sentence in section 6 and items a. and b, from proposed
resolution. Legal Counsel stated he would prepare a new resolution for
Council's consideration at 24th meeting.
General discussion by Council and staff followed,
6. EXPLORER SCOUT MEMORANDUM FROM CHIEF
(a) City Administrator stated memo was provided to Council at their
direction.
(b) Discussion by Council and staff regarding importance of all Council
to be present when considering matter.
(c) Motion by Councilman Cook, seconded by Councilman Wakem to consider
item at February 7th study session.
Approved by unanimous vote of Council present.
Discussion by Council and staff as to status of Explorer Post and
Council concurred to direct group to continue activities as usual.
7. JACK PARK LIGHTING PROPOSAL - P.G.E.
(a) Administrator proposed lighting would be similar to Cook Park and Woodard
Park lights. Administrator recommended Council's approval.
(b) Motion''by Councilman Cook, seconded by Councilman Wakem'directing staff
to implement proposal with P.G.E.
Approved by unanimous vote of Council present.
(c) Mayor directed staff to investigate installation of street light near
Gevurtz Furniture Store on Bonita by the Salem Freeway.

Privately Supplied Recreational Opportunities :
An inventory of existing privately supplied recreation has been
completed . Potential sites are being identified at the present
time .
Recreational needs and desires have been identified, at least
preliminarily, through a door to door survey which covered 12 .50
of the total residential units in the plan area . The questionnaire
covered facilities now being used and those which would be used if
available . The survey was conducted by students from Tigard High
School . The students also helped analyze the data collected.
Citizen Involvement in Plan Development _
The City 's Park Board ( 11 members) is serving as the official
park planning body . The J3oard has held a series of publicly notified
workshops to set goals and objectives and are presently conducting
policy formulation workshops . The workshops are publicized each
week in the two local newspapers . Identified interest groups have
been notified by mail .
The questionnaire circulated by the high school students wa.s
also accompanied by a letter explaining the planning process , the
workshops and asking for additional input . The circulation of the .
questionnaire was done in a manner so as to insure coverage of all
income levels , based on property values and rent rates . Property
value and rent rate zones were identified and each questionnaire
was marked according to the zone number so that the data could be
analyzed and compared accordingly .
Develop Site Design Criteria for Open Space and Parks :
Data has been collected on design criteria but additional
information is being sought and researched .

A narrative description of work elements completed as of
November 30, 1976 .
Coordinate Open Space Program with Growth Plan :
An inventory of present conditions-has been completed and mapped.
The mapping was accomplished using a series of transparent overlays
over a base map of the plan area. The overlays through various
colors and shaded patterns reflect the following:
1 . Existing land use , including agriculture and publicly
owned lands .
2 . Hazardous areas, including floodplains, steep slopes,
unstable soils, landslide and fault zones.
- -_ 3 . Na.t;iral areas, including wetlands_ ; vegetation, sub
-- due geology ; and soils .
Ths reformation has been analyzed and calculated to show:
1 . Present population of plan area.
2 . developed land, in acres, by use and zoning.
3. Present public parks and open space in acres .
The potential future development has been calculated by using
the planned land use reflected in the City 's -Community--Plan--.and -
completed neighborhood plans .
Final calculations of future open space needs has not yet been
completed as we are awaiting standards to be issued by State Parks
Department and Columbia Region Association of Governments (CRAG) .
The State report is due out in January but no date has been set
for completion of the CRAG report .
Due to the lack of state and regional standards , to date, our
work on open space has centered on natural and hazards areas where
development will be _ limited .
