CITY OF TIGARD
INSPECTION AND ISSUANCE OF PERMITS FOR INSTALLATION
OF MOBILE HOMES AND MOBILE HOME ACCESSORY BUILDINGS
AND STRUCTURES
Pursuant to authority granted by Oregon Revised Statutes 446.250,
this contract in duplicate is made and entered as of this 0 3 TA day of

1976 , by and between the Department of Commerce, acting
by and through its Director, hereinafter called the "Department"., and
the Ct*+�, off' �cGta2Z? eiV-e , hereinafter called the
"Local Government", and shall continue in full force and effect until termin-
ated by either party.
RECITALS
WHEREAS, The Department and the Local Government are mutually desirous
of maintaining high quality inspection of mobile home installations and
cooperation with each other for that purpose; and
WHEREAS, Oregon Administrative Rules 814-23-005 to 814-23-9.00 contain
standards for the installation of mobile homes and mobile home accessory
buildings and structures; and
WHEREAS, ORS 446.250 authorizes the Director of the Department of
Commerce to contract with local governments for issuance of permits for
installation of mobile homes and mobile home accessory buildings and structures
subject to certain conditions; and
' WHEREAS, the Local Government is currently performing some code enforce-
ment under the provisions of ORS 456.800; and
WHEREAS, in order to use effectively and efficiently the resources of
the Department and the Local Government;
NOW, THEREFORE, the Department and the Local Government hereby agree
as follows:
THE LOCAL GOVERNMENT SHALL. .
(1) Process all applications for permits for the installation of
mobile homes and mobile home accessory buildings and structures within their
jurisdiction.
(2) Issue permits for the installation of mobile homes and mobile
home accessory buildings and structures when satisfied that the proposed
_ installation described in the application conforms to the rules of the
Department and is not in violation of other laws and ordinances.
(3) Collect from the applicant the appropriate fee for issuance of
the permit which fee shall not exceed those fees approved by the Department.
(4) Enforce compliance with the rules of the Department, inspect each
mobile home installation and mobile home accessory buildings and structures
installation. However, inspection for compliance shall be made using the
manufacturer's installation instructions when such instructions do not con-
flict with the rules of the Department.
(5) Employ inspectors certified by the Director of the Department
to inspect and issue permits for the installation of mobile homes and mobile
home accessory buildings and structures.

(6) After final inspection submit quarterly a copy of each permit
for the installation of mobile homes..
(7) Submit to the Department its fee schedule for approval.
(8) Transmit to the Department quarterly 15% of the_ fees collected
pursuant to this contract.
THE DEPARTMENT SHALL:
(1) Provide the Local Government with a general mobile home installa-
tion manual for use in the inspection for compliance with the rules of the
Department.

(2) Provide a training program for the Local Government personnel
who will inspect and issue permits for installation of mobile homes and
mobile home accessory buildings "or structures.
(3) Monitor the Local Government program for issuing permits and
inspection of mobile homes and mobile home accessory buildings or structures
to promote uniformity of installation procedures and to assure compliance
with the rules of the Department.
TERMINATION
(1) The Local Government may terminate this contract on June 30 of
any year provided written notice is given to Department prior to May 1.
(2) The Department may terminate this contract upon 30 days written
notice to the Local Government for failure of the Local Government to comply
with this contract or rules of the Department.
(3) Upon termination of this contract, the Local Government shall
remit all monies due the Department and shall also remit permit fees held by
the Local Government for inspections not yet performed.
