Washington County - Jurisdiction of Oak and Pine Streets INTERGOVERNMENTAL AGREEMENT This AGREEMENT, made and entered into as of the 1,61 day of , 198 (8, by and between the CITY OF TIGARD ('hereinafter referred to as "CITY") and WASHINGTON COUNTY, a home rule political subdivision of the State of Oregon (hereinafter referred to as "COUNTY") . WITNESSETH: WHEREAS, CITY, is desirous of obtaining jurisdiction of the following described County Roads: 1. County Road No. 1758 (S.W. Pine Street lying between S.W. 69th Avenue and S.W. 71st Avenue) All of County Road No. 1758 in Section 36, 171S, R1W, W.M. 2. County Road No. 1080 (S.W. 71st Avenue lying between S.W. Pine Street and S.W. Oak Street.; and S.W. Oak Street lying between. S.W. 71st Ave and S.W. 72nd Avenue) That portion of County Road No. 1080 lying between S.W. 72nd Avenue (County ,Road No. 459) and the south right-of-way line of S.W. Pine Street (County Road No. 1335) in Section 36, T1S, R1W, W.M. PAGE 1 WHEREAS, COUNTY is considering the surrender of jurisdiction of said roads, either in whole or part, based upon the execution of this agreement by CITY; WHEREAS, COUNTY has adopted policies to guide the surrender of jurisdiction process in the interim period prior to updating COUNTY'S Transportation Plan; and WHEREAS, COUNTY in the transportation plan update process is determining roads which provide countywide circulation of which the maintenance, improvement or expansion should be funded from countywide revenue sources; and WHEREAS, the COUNTY transportation plan update will be coordinated with adopted CITY transportation plan, thus resolving differences and establishing _ uniform classifications and standards; NOW, THEREFORE, pursuant to ORS 190.003 through ORS 190.030 and in consideration of the mutual covenants contained herein, the parties agree as follows: 1. COUNTY shall : A. Diligently pursue the completion of the process of surrendering said County Roads as described on Exhibit "A" that are entirely within the corporate limits of the CITY. PAGE 2 2. CITY shall : A. Sustain the designated functional classification of the COUNTY pursuant to the adopted Metzger-Progress Circulation Study for the roads as previously described. 3. RICHARDSON D.L.C. 55 +�$ 3 N 4 2 n zwr 16 Q 9 HOLLOW it �l 10 � y I W t- of > v n a m 3S N a 2 6 BC 2344 Y 2 Y' 2 i -l3ALE ® 3 43 6 I v J 34 6 I A - m \ n ` . �� I ,3 I IN THE BOARD OF COUNTY COMMISSIONERS FOR WASHINGTON COUNTY, OREGON In the Matter of Surrender of ) RESOLUTION AND ORDER Jurisdiction ofPortions of ) Certain County Roads to the City ) NO. - of Tigard, Oregon. ) County oa o. 2702 T/J This matter having been considered by the Board of County Commissioners at its regular meeting of March 1, 1988; and It appearing to the Board that the City of Tigard, Oregon has requested of this Board its surrender of jurisdiction of portions of certain County Roads as described and depicted in attached Exhibits "A" and "B", attached hereto and by this reference incorporated herein, now under the jurisdiction of Washington .County, Oregon; and It appeari.ng to the Board that said roads lie within the boundaries of the City of Tigard and that jurisdiction over and across said roads should be transferred properly to the City of Tigard; and It appearing to the Board that by its Resolution and order No. 88-24 dated January 19, 1988, it duly required the setting of a time and place of public hearing on said request and required that notice of said hearing be posted pursuant to law;: and It appearing to the Board that in accordance with said Resolution and Order, notice was duly given and a public hearing was held on this matter on the 1st day of March, 1988, at the hour of 10:00 A.M. in Room 402 of the Washington County Administration Building, Hillsboro, Oregon; and It appearing to the Board that at said public hearing the Board heard the matter and considered objections and testimony offered by all persons interested in the proposed surrender of the jurisdiction, and the Board having considered this matter found that the best interests of Washington County would be served by granting said request; the Board hereby FINDS AND DETERMINES that it is necessary, expedient and in the best interests of Washington County to surrender jurisdiction to the City of Tigard, Oregon, those certain roads as hereinabove described, and it is hereby RESOLVED AND ORDERED that the jurisdiction of the County over said roads as hereinabove described and responsibility for the maintenance, construction and repair and the full and absolute jurisdiction over said road for all purposes of repair, construction, improvement and levy and collection of assessments thereof shall vest in the City of Tigard, Oregon, and the City shall have the same control, power and jurisdictionof the road or portions thereof as are by its Charter and the laws of the State of Oregon given or granted over any of the public streets and alleys of said City; and it is further RESOLVED AND ORDERED that the County Surveyor of Washington County, Oregon, be and hereby is ordered to amend as necessary the official records of Washington County, Oregon, to indicate the surrender of jurisdiction as herein above described; and it is further RESOLVED AND ORDERED that the County Surveyor be, and 'hereby is authorized and directed to forward a certified copy of this Resolution and Order to the City of Tigard, Oregon, as due notice of the surrender of jurisdiction.
