Washington County - Jurisdiction of Metzger Roads INTERGOVERNMENTAL AGREEMENT This AGREEMENT, made and entered into as of the Lday of 6, 1981, by and between the CITY OF TIGARD (hereinafter referred to as "CITY") and' WASHINGTON COUNTY, a home rule political subdivision of the State of Oregon (hereinafter referred to as "COUNTY"). WITNESSETH: . WHEREAS, CITY, is desirous of obtaining jurisdiction of the following described County Roads: 1. County Road No._ 1456 (S.W. 69th Avenue lying between S.W. Pacific Highway and S:W. Pine Street) all of County Road No. 1456 lying between the terminus of said County Road No. 1456 and the North right-of-way of S.W. Pine Street, County Road No. 1758, in the N.E. one-quarter of Section 36, T1S, R1W, W.M. 2. County Road No. 753 (S.W. Locust Street lying between the Oregon Electric Railway right-of-way and S.W. Greenburg Road) all of County Road No. 753, in the North half of Section 35, T1S, R1W, W.M. 3. County Road No. 749 (S.W. Locust Street lysing between S.W. Hall Blvd. and the Oregon Electric Railway right-of-way) that portion of County Road No. 749 lying between. the West .right-of-way of S.W. Hall Blvd. and the terminus of said County Road No. 749 in the N.E. one-quarter of Section 35, T1S, R1W, W.M. PAGE 1 l WHEREAS, COUNTY is considering the surrender of jurisdiction of said roads, either in whole or part, based upon the execution of this agreement by CITY; WHEREAS, COUNTY has adopted policies to guide the surrender of jurisdiction process in the interim period prior to updating COUNTY'S Transportation Plan; and WHEREAS, COUNTY in the transportation plan update process is determining roads which provide countywide circulation. of which the maintenance, improvement or expansion should be funded from countywide revenue sources; and WHEREAS, the COUNTY transportation plan update will be coordinated with adopted CITY transportation plan, thus resolving differences and establishing uniform classifications and standards; NOW, THEREFORE,, pursuant to ORS 190.003 through ORS 190.030 and in consideration of the mutual covenants contained herein, the parties agree as follows: 1. COUNTY shall : A. Diligently pursue the completion of the process of surrendering said County Roads as previously described that are entirely within the corporate limits of the CITY. PAGE 2 2. City shall : A. Sustain the designated functional classification of the COUNTY pursuant to the adopted Metzger-Progress Circulation Study for the roads as previously described. 3. This agreement shall be in effect for one (1) year from the date , that the South Metzger annexation took effect.
