OREGON 97408 NPPND-RF-1 4 December 1974 001732(Tualatin River-Miscellaneous) City of Tigard uL L G 1974 Director of Public Works City Hall CITY, OF TIGARD Tigard, OR 97223 Dear Sir: Referring to written request dated 29 January 1973I have to inform you that upon the recommendation of the Chief of Engineers, and under the pro- visions of Section 10 of the Act of Congress approved March 3, 1899, en- titled, "An act making appropriations for the construction, repair, and preservation of certain public works on rivers and harbors, and for other purposes," you are hereby authorized by the Secretary of the Army to maintain a boat dock and irrigation pump facility and a black-top boat ramp in the Tualatin River mile 10.0 as shown on the attached drawing marked 001732 (Tualatin River-Miscellaneous). The facility was legally constructed prior to the waterway being declared navigable on 8 February 1972. Subject to the following conditions: GENERAL CONDITIONS: a. That all activities identified and authorized herein shall be consistent with the terms and conditions of this permit; and that any activities not specifically identified and authorized herein shall constitute a violation of the terms and conditions of this permit which may result in the modifica- tion, suspension, or revocation of this permit, in whole or in part, and in the institution of such legal proceedings as the United States Government may consider appropriate, whether or not this permit has been previously modified, suspended, or revoked in whole or in part. b. That all activities authorized herein shall, if they involve a dis- charge or deposit into navigable waters or ocean waters, be at all times con- sistent with applicable water quality standards, effluent limitations and standards of performance, prohibitions, and pretreatment standards established pursuant to Sections 301, 302, 306 and 307 of the Federal Water Pollution Control Act of 1972 (P.L. 92-500; 86 Stat. 816) , or pursuant to applicable State and local law. c. That when the activity authorized herein involves a discharge or deposit of dredged or fill material into navigable waters, the authorized activity shall, if applicable water quality standards are revised or modified during the term of this permit, be modified, if necessary, tD conform with such revised or modified water quality standards within six months of the effective date of any revision or modification of water quality standards, or as directed by an implementation plan contained in such revised or modified standards, or within such longer period of time as the District Engineer, in consultation with the Regional Administrator of the Environmental Protection Agency, may determine to be reasonable under the circumstances. d. That the permittee shall permit the District Engineer or his authorized representative(s) or designee(s) to make periodic inspections at any time deemed necessary in order to assure that the activity being performed under authority of this permit is in accordance with the terms and conditions pre- scribed herein. e. That the permittee shall maintain the structure or work authorized herein in good conditions and in accordance with the plans and drawings attached hereto. f. That this permit does not convey any property rights, either in real estate or material, or any exclusive privileges; and that it does not author- ize any injury to property or invasion of rights or any infringement of Federal, State, or local laws or regulations, nor does it obviate the re- quirement to obtain State or local assent required by law for the activity authorized herein. g. That this permit does not authorize the interference with any existing or proposed Federal project and that the permittee shall not be entitled to compensation for damage or injury to the structures or work authorized herein which may be caused by or result from existing or future operations undertaken by the United States in the public interest. h. That this permit may be summarily suspended, in whole or in part, upon a finding by the District Engineer that immediate suspension of the installa- tion authorized herein would be in the general public interest. Such suspension shall be effective upon receipt by the permittee of a written notice thereof which shall indicate (1) the extent of the suspension, (2) the reasons for this action, and (3) any corrective or preventative measures to be taken by the per- mittee which are deemed necessary by the District Engineer to abate imminent hazards to the general public interest. The permittee shall take immediate 2 action to comply with the provisions of this notice. Within ten days follow- ing receipt of this notice of suspension, the permittee may request a hear- ing in order to prevent information relevant to a decision as to whether his permit should be reinstated, modified, or revoked. If a hearing is requested, it shall be conducted pursuant to procedures prescribed by the Chief of Engineers. After completion of the hearing, or within a reasonable time after issuance of the suspension notice to the permittee if no hearing is requested, the permit will either be reinstated, modified, or revoked. i. That this permit may be either modified, suspended, or revoked in whole or in part if the Secretary of the Army or his authorized representative deter- mines that there has been a violation of any of the terms or conditions of this permit or that such action would otherwise be in the public interest. Any such modification, suspension, or revocation shall become effective 30 days after receipt by the permittee of written notice of such action which shall specify the facts or conduct warranting same unless (1) within the 30-day period the permittee is able to satisfactorily demonstrate that (a) the alleged viola- tion of the terms and the conditions of this permit did not, in fact, occur• or (b) the alleged violation was accidental, and the permittee has been operat- ing in compliance with the terms and conditions of the permit and is able to provide satisfactory assurances that future operations shall be in full com- pliance with the terms and conditions of this permit; or (2) within the afore- said 30-day period, the permittee requests that a public hearing be held to prevent oral and written evidence concerning the proposed modification, sus- pension, or revocation. The conduct of this hearing and the procedures for making a final decision either to modify, suspend, or revoke, this permit in whole or in part shall be pursuant to procedures prescribed by the Chief of Engineers.* j. That in issuing this permit, the Government has relied on the informa- tion and data which the permittee has provided in connection with his permit application. If, subsequent to the issuance of this permit, such information and data prove to be false, incomplete or inaccurate, this permit may be modified, suspended, or revoked, in whole or in part, and/or the Government may, in addition, institute appropriate legal proceedings. k. That any modification, suspension, or revocation of this permit shall not be the basis for any claim for damages against the United States. 1. That no attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the activity authorized by this permit. M. That if the display of lights and signals on any structure or work authorized herein is not otherwise provided for by law, such lights and signals as may be prescribed by the United States Coast Guard shall be installed and maintained by and at the expense of the permittee. 3 n. That this permit does not authorize or approve the construction of particular structures, the authorization or approval of which may require authorization by the Congress or other agencies of the Federal Government. o. That if the recording of this permit is possible under applicable state or local law, the permittee shall take such action as may be necessary to record this permit with the Register of Deeds or other appropriate official charged with the responsibility for maintaining records of title to and interests in real property. p. That there shall be no unreasonable interference with navigation by the existence or use of the activity authorized herein. q. That this permit may not be transferred to •a third party without prior written notice to the District Engineer, either by the transferee's written agreement to comply with all terms and conditions of this permit or by the transferee subscribing to this permit in the space provided below and thereby agreeing to comply with all terms and conditions of this permit. In addi- tion, if the permittee transfers the interests authorized herein by conveyance of realty, the deed shall reference this permit and the terms and conditions specified herein and this permit shall be recorded along with the deed with the Register of Deeds or other appropriate official. SPECIAL CONDITIONS: r. All construction debris will be disposed of on land in such a manner that it cannot enter into the waterway. s. All piling and lumber treated with creosote or other protective material will be completely dry before use in or near the waterway. t. Care will be taken to prevent any petroleum products, chemicals or other deleterious materials from entering the water. u. All areas along the bank disturbed or newly created by the construction activity will be seeded, riprapped or given some other equivalent type of protection against subsequent erosion. v. Work in the waterway will be done so as to minimize turbidity increases in the water which tend to degrade water quality and damage aquatic life. w. The attachment of any floats, ramps, walkways or other nonmotorized appur- tenances not specifically authorized by this instrument (and shown on the drawings attached hereto) or the modification of any authorized features will not be permitted without the prior written approval of the District Engineer. 4 *A judgment as to whether or not suspension, modification, or revocation is in the public interest involves a consideration of the impact that any such action or the absence of any such action may have on factors affect- ing the public interest. Such factors include, but are not limited to, navigation, fish and wildlife, water quality, economics, conservation, aesthetics, recreation, water supply, flood damage prevention, ecosystems, and, in general, the needs and welfare of the people. Project 41-00159 Assistant C RUi's E( '--- Audit Report ortrolle� / An audit was conducted June 9, 1970, of the costs incurred by the City of Tigard in developing Cook Park. This is a 36 acre park on the Tualatin River. The development work consisted of preparing the land and putting in a ball field, construction of a boat dock and ramp, installation of an irrigation system, road and parking lot improvement , and installation of underground wiring. Summary of Findings - All costs were incurred within the project period. The project was accomplished by both force account and contract work. Labor and equipment rental costs were compiled from daily time sheets showing dates, hours and project. Invoices for supply and service costs were examined for extensions, discounts, project identification, and signature of person receiving goods. A contract for rocking and paving the road and parking lot was given to Cascade Construction Company of Portland. Cancelled warrants were examined for amounts and endorsements. Washington County awarded a contract to F. G. Scott Construction Company for building the boat dock and installing the boat ramp. Washington County also engaged the Robert E. Meyer Engineers for engineering services on the project. These items, totaling $11,410.60, were donated to the City of Tigard. This makes them non-reimbursable to the City by the Bureau of Outdoor Recreation. Pre- and post-construction certifications were completed in addi- tion to an "Assurance of Compliance", form DI-1350. Pe Page 2 . Conclusion - All costs as billed to the Bureau of Outdoor Rec- reation are in conformance with the Land and Water Conservation Fund Act. List in detail adverse findings and any actions recommended. This project covered the grading, seeding and irrigation of a ball field area, construction of a boat ramp and floating dock, and park road and parking lot construction. All work has now been completed. The grass in the ball field is showing green and there appears to be a good stand. Some siltation has occurred on the boat ramp because of backwater in the area, and this will undoubtedly require cleaning once a year at the beginning of the boating season. The road and parking lot appear to be very well done -- they fit into the landscape. The boat dock appears to be well built, attractive and useful. Contrary to the prior report, the ball field backstops are not a part of this project. They will probably be built later, after the grass is established. Acceptance of the project is recommended. List in detail adverse findings and any actions recommended. At the time of the inspection, a 3-man city crew was checking out the newly installed irrigation system. Some minor difficulty was being experienced with trash in the screens at the sprinkler heads. These screens have a smaller mesh than the one on the pump at the river. Work done since the .last inspection include leveling and seeding the ball field area, completion of the boat ramp and boat dock, and grading and rocking of the road and parking lot. The access road outside the park has been widened to two full lanes and paved (it was a one-lane gravel road). Work remaining to be done includes paving the road and parking lot, cleanup of the whole site and erection of th allfield backstop. � Ile Work done to date is satisfactory. Department of the Interior; and WHEREAS, it is the intent of the parties hereto that City acquire land and perform development work, as set out in Exhibit A. in accordance with the Land and Water Con- servation Fund Act of 1965, any other applicable federal and state statutes, and the requirements of the Bureau of Outdoor Recreation; that County apply to State for federal funds with which to reimburse City for 50% of the latter' s cost of acquiring such land and performing such work; that State apply to the Bureau of Outdoor Recreation for such funds and, upon receipt thereof, pay such funds to County; and that County, in turn, pay such funds to Iity NOW, THEREFORE, the premises being in general as stated in the foregoing recitals, it is agreed by and between the parties hereto as follows: 11:ju 6/5/67 1 . a, having acquired land and will perform the work of the project in accordance with Exhibit A. As hereinafter used, "work of tiie project" shall include both acquisition of land for and development work of the project, and "cost of the project" shall include both costs of acquisition of land for and development work of the project. 2. The estimated total cost of the project is $31,960 City shall, in the first instance, pay all the costs of the project. Upon completion of the project, City shall submit to County and County shall. in turn submit to State an itemized statement of the actual total cost of the project. 3. Upon receipt from County of the itemized statement of t,ie actual_ total cost of the project and completion of the project in accordance with the terms of this agreement, State shall apply to the Bureau of Outdoor Recreation for one-half the estimated total cost of the project or one-half the actual total cost of the project, whichever is the lesser, and, upon receipt thereof from the Bureau of Outdoor Recreation, shall pay such amount to County. County shall in turn pay such amount to City if City has completed the work of the project in accordance with the terms of this agreement. It is understood by the parties hereto that where the actual total cost of the project exceeds the estimated total cost of the project, State shall not be obligated to apply to the Bureau of Outdoor Recreation for, or to pay to County, any amount in excess of one- half such estimated total cost. Count shall not be obligated to pay City any moneys other than those received from State under this agreement. It is further understood that City shall be solely responsible for any excess of the actual total cost over the estimated total cost of the project. State may, where acceptable to the Bureau of Outdoor Recreation, apply for federal funds prior to completion of the project: in such case, State shall pay to County, and County to — City , such amounts from federal funds for completion by City of such portions of the project as may be agreed upon by City County, State and the Bureau of Outdoor Recreation. 4. Upon completion of the project, the following parties shall perform the following duties: The City shall be responsible for operation and maintenance of said facility_ for public outdoor recreation. - 2 - JSI' jw 6/5/67 S. It is understood by the parties hereto that no funds of State or County are, under this agreement, committed to payment of any costs of the project, and that obligations to apply for federal funds as well as the right of ':ity to receive reimbursement for any costs of the project shall extend only to those portions of the project, including the estimated costs thereof, approved tLy the Bureau of Outdoor Recreation. 6 . If City fails to perform the work of the project, County shall perform such work and `;ity shall reimburse County for its costs therein, less federal funds received by County for such work. If both City and County fail to perform any of the work of the project, and State is forced thereby, because of commitments made by State to the Bureau of Outdoor Recreation, to perform any work necessary to bring the project to a useful state of completion (as determined by State and the Bureau of O!itdoor Recreation) , City and County shall be jointly and severally ot}ligated to reimburse State for all State's costs in performing such necessary comple- tion work, less any fe=deral funds received by State for such work. 7. Definitions 1. The term "BOR" as used herein means the Bureau of Outdoor Recreation, United States Department of the Interior. 2. The term "Director" as used herein means the Director of the Bureau of Outdoor Recreation, or any representative lawfully delegated the authority to act for such Director. 3. The term "Manua L" as used herein means the Bureau of Outdoor Recreation Manual. 4. The term "project" as used herein means that project or project stage which is the subject of this agreement. 5. The term "State' as used herein means the State which is a party to this agreement, and, where applicable, the political subdivision or public agency to which funds are to be transferred pursuant to this agreement. Wherever a term, condition, obligation, or requirement refers to the State, such term, condition, obligation, or requirement shall also apply to the recipient political subdivision or public agency, except where it is clear froom the .nature of the term, condition, obligation, or requirement that it is to apply solely to the State. B. Project Execution 1. The State shall execute and complete the approved project :.n accordance with the time schedule set forth in the pr)ject proposal. Failure to render satisfactory progress,or to complete this or any other project oiiiich is the subject of Federal assistance under this program to the satisfaction cf the Director ma.7 be cause for the suspension of all obligations of the United States under this agreement. 2. Construction contracted for by the State shall meet the following requirements: (a) Contracts :'or construction in excess of $10,000 shall be awarded through a process of competitive bidding. (;opies of all bids and a copy of the contract shall be retained for inspection by the Director. (b) The State :shall inform all bidders on contracts for construction in excess of $10,000 that Federal funds are being used to assist in construction. (c) Written change orders to contracts for construction in excess of $10,000 shall be issued foi all necess-try changes in the facility. Such orders shall be made a part of the project file and shall )e kept available for audit. (d) The State ;hall comply with the regulations of the Secretary of Labor contained in 29 CFR 3 (1964), male pursuant to 40 U.S.C. Sec. 276(c) (1964), which require from each contractor oz subcontrac'-or a weekly wage payment statement. Such regulations are hereby ixcorporated into this agreement by reference. (e) The State Shall incorporate, or cause to be incorporated, into all construction contracts the following provisions: "During th(: performance of this contract, the contrac`or agrees as follows: "(1) The c)ntractor will not discriminate against any employee or applicant for employment because of race, creed, color, or national origin. T'te contractor will take affirmative action to -ansure that applicants are employed, and that employees are treated during employment, without regard to their race, creed, color, or national origin. Such action shall include, but not be limited to, the following: employment, upgrading, demotion or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensation: and selection for training, including apprenticeship. Thi contractor agrees to post in conspicuous places, available to employees and applicants for employment, notices to be provided by the contracting officer setting forth the provisions of tris nondiscrimination clause. 11(2) The contractor will, in all solicitations or advertisements for employees placed by or on behalf of the contractor, state that all qualified applicants will receive consideration for employment without regard to race, creed, color, or national origin. 11(3) The contractor will send to each labor union or representative of workers with which he has a collective bargaining agreement or other contract or understanding, a notice, to be Provided by the agency contracting officer, advising the labor union or workers' representative of ':he contractor's commitments under Section 202 of Executive Order No. U246 of September 24, 1)65, and shall post copies of the notice in conspicuous places available to employees and applicants for employment. ' 1 2 "(4) The contractor will comply with all provisions of Executive Order No, 11246 of September 24, 1965, and of the rules, regulations, and relevant orders of the Secretary of Labor. 11(5) The contractor will furnish all information and reports required by Executive Order No, 11246 of September 24, 1965, and by the rules, regulations, and orders of the Secretary of Labor, or pursuant thereto, and will permit access to his books, records, and accounts by the contracting agency and the Secretary of.Labor for purposes of investigation to ascertain compliance with such rules, regulations, and orders. 11(6) In the event of the contractor's noncompliance with the nondiscrimination clauses of this contract or with any of such rules, regulations, or orders, this contract may be canceled, terminated, or suspended in whole or in part and the contractor may be declared ineligible for further Government contracts in accordance with procedures authorized in Executive Order No, 11246 of September 24, 1965; and such other sanctions may be imposed and remedies invoked as provided in Executive Order No, 11246 of September 24, 1965, or by rule, regulation, or order of the Secretary of Labor, or as otherwise provided by law. "(7) The contractor will include the provisions of Paragraphs (1) through (7) in every subcontract or purchase order unless exempted by rules, regulations, or orders of the Secretary of Labor issued pursuant to Section 204 of Executive Order No, 11246 of September 24, 1965, so that such provisions will be binding upon each subcontractor or vendor. The contractor will take such action with respect to any subcontract or purchase order as the contracting agency may direct as a means of enforcing such provisions, including sanctions for noncompliance: Provided, however, that in the event the contractor becomes involved in, or is threatened with, litigation wit a subcontractor or vendor as a result of such direction by the contracting agency, the contractor may request the United States to enter into such litigation to protect the interests of the United States," (f) The State shall (1) comply with the above provisions in construction work carried out by itself, (2) assist and cooperate actively with the"BOR and the Secretary of Labor in obtaining the compliance of contractors and subcontractors with the above contract provisions and with the rules, regulations, and relevant orders of the Secretary of Labor, (3) obtain and furnish to the BOR and to the Secretary of Labor such information as they may require for the supervision of such compliance, (4) enforce the obligation of contractors and subcontractors under such provisions, rules, regulations, and orders, (5) carry out sanctions and penalties for violation of such obligations imposed upon contractors and subcontractors by the Secretary of Labor or the BOR pursuant to Part II, Subpart D, of Executive Order No. 11246 of September 24, 1965, and (6) refrain from entering into any contract with a contractor debarred from Government contracts under Part II, Subpart D, of Executive Order No, 11246 of September 24, 1965. 3. The State shall secure completion of the work in accordance with the approved construction plans and specifications, and shall secure compliance with all applicable Federal, State, and local laws and. regulations, 4. The State shall permit periodic site visits by the Director to insure work progress in accordance with the approved project, including a final inspection upon project completion. 5. In the event funds should not be available for future stages of the project, the State shall bring the project to a point of usefulness agreed upon by the State and the Director, 6, All significant deviations from the project proposal shall be submitted to the Director for prior approval, 7. Development plans and specifications shall be available for review by the Director upon request, 8. The acquisition cost of real property shall be based upon the appraisal of a competent appraiser. The reports of such appraisers shall be available for inspection by the Director, 9, If any tract or parcel of, or interest in, real property subject to being purchased under the provisions of this agreement, but not identified herein, is found by the Director for any reason not to be suitable for Federal assistance, all obligations of the United States hereunder shall cease as to such parcel, tract or interest, C. Project`Costs Project costs eligible for assistance shall be determined upon the basis of the criteria set Forth in the Manual, D. Project Administration 1, The State shall promptly submit such reports as the Director may request, 2. Property and facilities acquired or developed pursuant to this agreement shall be available for inspection by the Director upon request, 3. The State shall use any funds received by way of advance payment from the United States under the terms of this agreement solely for the project or project stage herein described. 4. Interest earned on funds granted pursuant to this agreement shall not be available for expenditure by the State, but shall be disposed of according to instructions issued by the Director. 5. Because one of the basic objectives of the Land and Water Conservation Fund Act is to enhance and increase the Nation's outdoor recreation resources, it is the intent of the parties hereto that recipients of assistance will use moneys granted hereunder for the purposes of this program, and that assistance granted from the Fund will result in a net increase, commensurate at least with tie Federal cost-share, in a participant's outdoor recreation. It is intended by both parties hereto that assistance from the Fund will be added to, rather than replace or be substituted for, State and local. outdoor recreation funds. E. Project Termination 1. The State may unilaterally rescind this agreement at any time prior to the commencement of the project. After project commencement, this agreement may be rescinded, modified, or amended only by mutual agreement. A project shall be deemed commenced when the State makes any expenditure or incurs any obligation with respect to the project. 2. Failure by the State to comply with the terms of this agreement or any similar agreement may be cause for the suspension of all obligations of the United States hereunder. 3. Failure by the State to comply with the terms of this agreement shall not be cause for the suspension of all obligations of the United States hereunder if, in the judgment of the Director, such failure was due to no fault of the State. In such case, any amount required to settle at minimum costs any irrevocable obligations properly incurred shall be eligible for assistance under this agreement. 4. Because the benefit to be derived by the United States from the full compliance by the State with the terms of this agreement is the preservation, protection, and the net increase in the quantity and quality of public outdoor recreation facilities and resources which are available to the people of the State and of the United States, and because such benefit exceeds to an immeasurable and unascertain- able extent the amount of money furnished by the United States by way of assistance under the terms of this agreement, the State agrees that payment by the State to the United States of an amount equal to the amount of assistance extended under this agreement by the United States would be inadequate compensation to the United States for any breach by the State of this agreement. The State further agrees, therefore, that the appropriate remedy in the event of a breach by the State of this agreement shall be the specific performance of this agreement. F. Conflict of Interests 1. No official or employee of the State who is authorized in his official capacity to negotiate, make, accept, or approve, or to take part in such decisions regarding a contract or subcontract in connection with this project shall have any financial or other personal interest in any such contract or subcontract. 2. No person performing services for the State in connection with this project shall have a financial or other personal interest other than his employment or retention by the State, in any contract or subcontract in connection with this project. No officer or employee of such person retained by the State shall have any financial or other personal interest in any real property acquired for this project unless such interest is openly disclosed upon the public records of the State, and such officer, employee or person has not participated in the acquisition for or on behalf of the State. 3. No member of or delegate to Congress shall be admitted to any share or part of this agreement, or to any benefit to arise hereupon, unless such benefit shall be in the form of an agreement made with a corporation for its general benefit. 4. The State shall be responsible for enforcing the above conflict of interest provisions. G. Hatch Act No officer or employee of the State whose principal employment is in connection with any activity which is financed in whole or in part pursuant to this agreement shall take part in any of the political activity proscribed in the Hatch Political Activity Act, 5 U.S.C. Sec. 118k (1964), with the exceptions therein enumerated. H. Financial Records 1. The State shall maintain satisfactory financial accounts, documents, and records, and shall make them available to the BOR, the Department of the Interior, and to the General Accounting Office for auditing at reasonable times. Such accounts, documents, and records shall be retained by the State for three years following project termination. 3 .a.'' , .1.. 4 2. The State may use any generally accepted accounting system, provided such system meets the minimum requirements set forth in the Manual. I. Use of Facilities 1. The State shall not at any time convert'any property acquired or developed pursuant to this agreement to other than the public outdoor recreation uses specified in the project proposal attached hereto without the prior approval of the Director. 2. The State shall operate and maintain, or cause to be operated and maintained, the property or facilities acquired or developed pursuant to this agreement in the manner and according to the standards set forth in the Manual. J. Nondiscrimination 1. The State shall not discriminate against any person on the basis of race, color, or national origin in the use of any property or facility acquired or developed pursuant to this agreement. 2. The State shall comply with the terms and intent of Title VI of the Civil Rights�' Act of 1964, 78 Stat. 241 (1964), and with the regulations promulgated pursuant to such Act by the Secretary of the Interior and contained in 43 CFR 17 (1964). 3. The State shall not discriminate against any person on the basis of residence, except to the extent that reasonable differences in admission or other fees may be maintained on the basis of residence. K. Compliance The State shall be responsible for compliance with the terms of this agreement by any political subdivision or public agency to which funds are transferred pursuant to this agreement. Failure by such political subdivision or public agency to so comply shall be deemed a failure by the State to comply with the terms of this agreement. L. Manual The State shall comply with the policies and procedures set forth in the Bureau of Outdoor Recreation Manual. Said Manual is hereby incorporated into and made a part of this agreement. The Board of Commissioners has asked me to advise your city in writing as to the county's policy concerning both of these matters. Based on the request received from your city for transfer of jurisdiction of the streets, the Department of Public Works is proceeding to arrange for the necessary public hearing which would be held in this manner. Following the conclusion of the public hearing on the transfer of streets, the Board of Commissioners (assuming absence of protests) will adopt a resolution and order officially transferring the streets to the city. Respecting the Cook Park access road, the Public Worts Department has prepared a timetable in which they indicate that the first public reading of the roadviewer's report on this road can be scheduled for May 7. In the intervening time between now and that date the necessary field work , design, preparation of property descriptions, mailing of notices to property owners, publication and posting, etc. , will be carried on. I mention this only so that your city will understand that a delay in presenting this matter to the Board of Commissioners for official action by no means indicates a reluctance or discontinuance of further effort in this matter. We are proceeding with the roadviewer's proceedings and as soon as possible will schedule improvement to the roadway after the road has been established. Project Proposal Cooly Marine Facilities Desirability In the last few years several reports have shown the increasing need for new parks. This increasing need has been brought about by an increase in population, more leisure time , more income per capita and more taaveling per capita. The latest published report for the Tigard area is "Recreation Outlook 1962-1975" by the Metropolitan Planning Commission in which the critical need for parks in the Tigard area was brought out. In a comparison of the communities in the Metropolitan area, it was shown that Tigard has less than one-half the average amount of devel- oped and undeveloped acreage in both Community and Neighborhood Parks. Significantly, four communities were in this same category, and Tigard was the only one in Washington County. History The land now known as Cook Park was set aside for use as a Public Park or Recreation Area by Mr. Melville Eastman. Originally the park was deeded to the County; however, in July, 1962 , after the formation of the Tigard Park Cormiission, the park was relin- quished to the City of Tigard. Data Cook Park is located in Township 2 South, Range 1 West, Section 14 of the Willamette Meridian (see enclosure A) . The park is easily reached from the City of Tigard by 'turn,ing off of S.W. Pacific Highway near MP 1.1.2 onto S.W. Durham Road thence on to S.W. 92nd Avenue which terminates at the park site, a distance of about 4/5 mile. The land is outside -of the city limits of Tigard. The land consists of 36 acres with about 2 ,500' of frontage on the Tualatin River. The river gradient at this point is slight.- Hence, the flow is very tranquil and usable for boating. The site is relatively flat with a change of 15 ' in elevation (see enclosure B) . The true elevation of the highest point is about 120 ' above sea level. During the summer most of the park is above the river about _ 20 feet; near the proposed dock and launching site about 8 feet. . Installations at this paik were not affected by the historic Christ- mas Flood of 1964. The proposed location of the launching ramp and dock does flood under about 5 of 6 feet of water, a few weeks each year during the winter. However, when the Scoggin Reservoir Project is complete, it is not anticipated to flood as much, if at all. Development' �—' During the first few years all of the work done was volunteer labor. The Park Commission in 1964 raisad funds with a chicken barbecue, and since that time have made a profit of about $1,500. 00, which has been spent. on park improvements. The City of Tigard-Is budget for the last few years is as follows . 1964-65 - $516 . , 1965-66 - $2 ,500 , 1966-67 - $5,125. , and proposed for 1967-63 - $10 ,000. Presently about 4 acres -have been cleared and put into grass; another 5 acres have been cleared. Access to the park is via a rock road from S.W. Durham Road, and is presently adequate. Site develop- ment on the 4 acres which have been improved are as follows: pump house, rest rooms, swing and playground equipment, parking area, picnic tables, Ramada, water fountains, and land scaping. Proposed Development The total estimated investment for this park for completion is $65,000. This figure represents only the construction cost. and excludes the planning and engineering cost. The investment is planned in five phases , A through E, and it is expected to take until 1970 to com- plete. Each phase (see enclosure C) is broken down into one area of the. park, and the work expected for each is as follows:. Phase A 1. Build gravel road into park 2. Build -ramp house. 3. Clear Area A 4.
