Head COMMISSION SERVICES kkr Enclosure CONSTRUCTION-FINANCE AGREEMENT TRAFFIC SIGNAL INSTALLATION THIS AGREEMENT, made and entered into by 'and between the STATE OF OREGON, by and through its Department of Transportation, Highway Division, hereinafter called "State", and the CITY OF TIGARD,, a municipal corporation, by and through its City officials, hereinafter called "City", and PAY LESS DRUG STORES N.W. , INCORPORATED, hereinafter called "Corporation": W I T N E S S E T H RECITALS.-;- 1. ECITALS;1. Under ORS 366.775, the State, City and Corporation may enter into agreements for the construction, improvement, repair or maintenance of any road or street, and provide for allocation of the cost of the project to the contracting parties, upon terms mutually agreeable to the contracting parties. 2. Under ORS 483.040, State is authorized to determine the type of, erect;and :maintain ,.traffic control signals. 3. State,.: and City in their judgment have deemed it necessary in order to obtain a safer and more expeditious flow of traffic, to install a traffic control signal at the intersection of Main and Scoff ins Streets. Hereinafter, all acts necessary to accomplish said installation shall be referred to as "project". NOW, THEREFORE, the premises being in general as stated in the foregoing RECITALS, it is agreed by and between the parties hereto as follows: THINGS TO BE DONE BY STATE: 1. State approves the RECITALS herein, THINGS TO BE DONE BY CITY, THINGS TO BE DONE BY CORPORATION, and all other provisions of this agreement. 2. State shall prepare the plans and contract documents, advertise for bids, award all contracts, and supervise installation of the traffic control signal. 3. State shall do the work of the project either by its own forces or by contract. State shall, in the first instance pay all of the costs of the project, but the actual total cost of the project shall, upon final itemization by the State be' paid by the Corporation. 4. Upon completion of the project, State shall submit to Corporation an itemized statement of the actual total cost of the project. State shall refund to Corporation that portion of the deposit paid by Corporation under Paragraph 3 of THINGS TO BE DONE BY CORPORATION, which is in excess of the actual total cost of the project. 5. State shall,. at City expense, perform all necessary maintenance of the project upon completion of the installation. PAGE 1 of 3 THINGS TO BE DONE BY CITY: 1. City approves the RECITALS herein, THINGS TO BE DONE BY THE STATE, THINGS TO BE DONE BY' CORPORATION, and all other provisions of this agreement. 2. In the event the low .bid exceeds the engineer's estimate by 10 percent or more, City shall have the right to reject all bids. 3. City shall be responsible for and pay all costs of electrical energy consumed by the traffic signal. 4. City shall reimburse State for the actual cost of necessary maintenance of the traffic signal which is performed by State. THINGS TO BE DONE BY CORPORATION: 1. Corporation approves the RECITALS herein, THINGS TO BE DONE BY STATE, THINGS TO BE DONE BY CITY, and all other provisions of this agreement. 2. Corporation shall be responsible for the total project cost as stated in Paragraph 3 of THINGS TO BE DONE BY STATE. The City forwarded to the State, by letter dated November 9, 1976, a check to be deposited with State from Corporation in the amount of $1,000 to cover State's cost incurred in advancing the project to contract. Following the opening of bids and prior to award of the contract, Corporation shall deposit with State a sum of money equal to 100 percent of the total estimated cost of the project, including contract items, construction engineering and contingencies. 3. Upon completion of the project and receipt from State of an itemized statement of the final total actual cost, Corporation shall pay any costs which,, when added to Corporation's advance deposit, will equal 100 percent of the final total actual cost of the project. Any portion of said advance deposit which is in excess of the final total actual cost of the project shall be refunded to Corporation. IN WITNESS WHEREOF, the parties hereto have set their hands and affixed their seals as of the day and year hereinafter written. The Oregon Transportation Commission, by a duly adopted delegation order, authorized its Chairman or Vice Chairman to act in____its behalf in approving this agreement. Mr., Flynn is to check this .out. doris SITE DEVELOr•.,r-'NT PLAN AND ARCHITECTURAL DESIbN REVIEW APPLICATION PROCEDURE Not less than 14 days prior to a scheduled meeting of the Tigard Design Review Board, the applicant will submit to the Tigard Planning Department: 1 . one copy of the enclosed application form, completed and signed and 2. six copies of a site development plan which includes the following elements: (a) a site plan, drawn to scale, showing topography and final grading, the location of all buildings and structures, signs, uses, driveways, pedestrian walks, landscaped areas, fences, walls, off- street parking and loading areas, and railroad track§. The site plan shall indicate the location of entrances and exits and the direction of traffic flow into and out of off-street parking and loading areas, the location of each parking space and each 1pading berth and areas of turning arid maneuvering vehicles. The site plan shall also indicate how utility service, garbage service and drainage are to be provided; (b) a general site plan showing adjoining properties, streets, buildings, driveways and other improvement$; (c) a landscape plan, drawn to scale, showing the location of existing trees proposed to be removed and to be retained on the site, the location and design of landscaped areas, the varieties and sizes of trees and plant materials to be planted on the site, other perti- nent landscape features, and irrigation systems required to maintain trees and plant materials; (d) architectural drawings or sketches, drawn to scale, includ- ing floor plans, in sufficient detail to permit computation of yard requirements and showing all elevations of the proposed structures and other improvements as they will appear on completion of construction; (e) specifications as to type, color and texture of exterior surfaces of proposed structures. REVIEW PROCEDURE The City Planning Director, or designate, will review all drawings, plans and specifications submitted for design review. if it is found that they meet all other requirements of the ordinances of the City it will then forward to the Design Review Board for their consideration at a public meeting. The applicant should ascertain the time, place and date of the meeting at which this proposal will be considered. Attendance at the meeting is not mandatory; however, failure of the applicant to appear may result in a denial of the applica- tion should the Design Review Board need additional information or interpretation of the submitted materials in order to reach an informed decision.
