ODOT - Signals @ 99W/Bull Mountain and 99W/Johnson A G R E E Iii E N T THIS AGREEMENT, made and entered into on this day of S Cor , 1971 , by. and between the STATE OF OREGON, by and througl its State Highway Commission, hereinafter called '_'State and the CITY OI' TIGARD, a municipal corporation of the State of Oregon, by and through its City officials, here- inafter called "City IV I T N E S S E T H RECITALS : 1 . The Pacific Highway West , State Primary Highway No . 1W is a State highi•;ay under the jurisdiction and. control of State and is routed -through the corporate limits of City. 2 . Under ORS 3.66 . 710 and 366 . 77.5 . State and City may enter into agreements for the construction, reconstruction, improve- ment , repair or maintenance of ' any. State highway, road or street , and provide for all allocation of the, cost. of the project to the contracting parties . 3 . Under ORS 483 . 040 , State is authorized to determine the type of, erect and maintain traffic control signals . Under ORS 366 . 450 , State is authorized to Erect and maintain directional road signs and other signs on . State highways . 4 . State and City in their judgement have deemed it nec essary in order to obtain a safer . and more expeditious flow of traffic to . install pre timed traffic signals at the intersection of the Pacific Highway West and Johnson Street within the cor- porate limits of City . Hereinafter all .acts necessary to accom- plish this installation shall be referred to as the "project" . NOW THEREFORE, the premises being in-, general as stated in the foregoing RECITALS, it is agreed by and :. between the parties hereto as follows THINGS TO BE DONE BY STATE: 1 . State approves the RECITALS herein, THINGS TO BE DONE BY CITY and all .other provisions of this agreement . 2. State shall prepare all plans, let and award all contracts and supervise the work of the project. 3. State shall do the work of the project either by its own forces or by contract. The estimated total cost of the project is . $20,000.00. State shall, In the first in- stance, pay all the cost of the project, but the actual total cost of the project shall upon final itemization by State be shared seventy-five percent by the State and twenty-five per- cent by the City. 4. Upon completion of the project, State shall submit to City an itemized statement of the actual total cost of the project. State shall refund to City that portion of the deposit paid by City under Paragraph 2 of THINGS TO BE DONE BY CITY which is in excess of one-quarter the actual cost of the project. 5. State shall be responsible for all maintenance of said signal including the replacements of any damaged parts or materials during the life of this agreement at its expense. THINGS TO BE DONE BY CITY: 1. City approves the RECITALS herein, THINGS TO BE DONE BY STATE and all other provisions of this agreement. . 2. State and City shall share 75$ and 25% respectively in the total project cost. After the opening of the bids and, prior to the award of the contract the City shall deposit its check with State for ,one-quarter the then total estimated;1project cost. Upon receipt from State of the itemized statement of the final actual total cost of the project, City shall pay State one-quarter the amount of money by which the final actual total cost exceeds the originally submitted amount. 3. City agrees to be responsible for all costs of- power consumption during the life of this agreement. 4. City shall pass an ordinance or resolution, as the case may be, authorizing the Mayor and City Recorder to enter into this agreement on behalf of City, and the same shall be made a part hereof and attached hereto. GENERAL PROVISIONS: 1. If requested by City, a mutual review of the signal design plans shall be conducted to the satisfaction of both parties prior to calling for bids on the project. 2. State shall establish the signal timing program with the knowledge of City. Thereafter, no changes shall be made in the signal timing program without mutual consultation be" tween City and State. 3 . State, upon completion of the project , shall furnish to City manufacturer ' s manuals and "as constructed" plans . IN WITNESS WHEREOF, the parties hereto have set their hands and affixed their seals . This agreementy was a proved by the Oregon State Highway Commission on 1971 , at _which time the Secretary for -cjye Commis.sion was authroized . and directed to sign said agreement for and on behalf of the Commission. We have checked this estimate and find that, for the control equip- ment to be installed, this is the cost quoted by the manufacturer .
