K9 Diesel Ownership Transfer Letter ~ AG244001 AG244001 IN ii TIGARD City of Tigard June 27, 2023 Michael Powers 15869 SE Upman Way Damascus,OR 97089 Re:Transfer of K9 Diesel ownership Dear Ofc Powers, As you are aware,K9 Diesel (male German Shepherd police dog) has reached the end of his useful working life and can no longer function in his official police dog capacity. In April of 2015 the City of Tigard(City) purchased Diesel and he has served the Tigard community admirably since that time. Earlier in May 2023,Diesel developed a medical condition that prevented him from fully performing his duties as a police dog.As a result,he was temporarily suspended from deployments. It has since been determined that he will not recover from this medical condition,and he will be fully retired at the shift rotation in July of 2023.As you have requested, ownership of Diesel will transfer to you on Saturday July 2,2023 at 1200 hours.The City of Tigard will give you a one-time lump sum payment of$3,000 from private donations in order assist in providing for the dog's care during his retirement. On July 2,2023 at 1200 hours you agree to the following: • Relinquish from the City all liability and agree to indemnify and hold harmless the City,its officers,employees and agents for any injury or damage that Diesel might cause to property or persons after the transfer,including the reasonable cost of defending such claims. • Relinquish from the City any financial responsibility for Diesel beyond the$3,000 lump sum payment. • Agree that Diesel will only be a family pet and not used as a service animal,working dog,or other contracted capacity. • Notify the City in writing at the time of Diesel's passing. On July 2,2023 at 1200 the City agrees to the following: • Transfer ownership of Diesel and any identified related equipment that was originally purchased for Diesel's care to you at no cost. • To provide you a check in the amount of$3,000 within 15 business days of the ownership transfer Please indicate your agreement by signing and dating below.
