Changes to Procedures
•Rules (HB2001) require same process for middle
housing as applies to single detached houses
-SDH is a plan check –no land use
-Allowed to offer alternative path through land use
•Proposed changes to procedures offer split path
-Applies to Cottage Clusters, Quads, Rowhouses
-Each currently approved through Type I Procedure
-Code changes offer two paths:
-Plan Check –must meet clear and objective stds.
-Type II land use procedure –some discretion

•Path 2
-Retain parking reductions

Rowhouses
City of Tigard
Changes to Procedures
•Housing Options combined ADUs with duplex and
triplex housing types for simplicity
-One or two ADUs allowed per SDH
-No limit on attached ADU size
•Implementation has taught us that this approach
adds complexity
•Changes in state law increase this complexity
-City must allow duplexes and triplexes in all zones
-Allowed through plan check
Single Detached Houses and ADUs
City of Tigard
Changes to Procedures
•Housing type replaces Single Detached House
-Same design and development standards
-One to three attached dwelling units allowed
outright
-Approval at plan check
•Density calculations still assume one unit per lot
•Accessory Dwelling Units again become a different
type
-Remove Type I procedure
-Approval at plan check
Small Form Residential
City of Tigard
Changes to Procedures
•Law (SB458) requires local process for middle
housing land divisions
-Must use expedited procedures –61 days vs. 120
-Must be processed concurrently with permits or
after development is complete
-Applies to housing allowed through HB2001
-Cottage Clusters -Quads
-Rowhouses -Small Form Residential
-Also propose applying to Courtyard Units
Middle Housing Land Divisions
City of Tigard
Changes to Procedures
•Proposed provisions and criteria
-Pseudo “condominium plat” handled locally
-Resultant lots are “sublots”
-Only separable for property transfer purposes
-Retain housing type designations
-Original lot is used for land use compliance
-Must provide individual utilities
-One dwelling unit per lot
-Sublot lines follow building footprint
-All other common areas placed in tract(s)
