WHEREAS, the City of Tigard's Safe Routes to School Program is responsible for education and encouragement activities to support students and families safely walking,bicycling,rolling, and riding the bus to school;and WHEREAS, the Safe Routes to School Program is a comprehensive program designed to increase active transportation and reduce vehicle miles traveled, resulting in safer pedestrians, healthier students, reduced traffic,and improved air quality;and WHEREAS, the City's adopted Transportation System Plan,TSP 2040, Goal 1, requires the City to "provide a safe,comfortable, and connected transportation system for all users,especially pedestrians and other vulnerable users";and WHEREAS, Tigard's adopted Strategic Plan Vision calls for the city to be "An equitable community that is walkable,healthy,and accessible for everyone";and WHEREAS, Goal Four of the adopted 2023-2025 Tigard City Council Goals calls for enhanced community safety and accessibility; NOW,THEREFORE,BE IT RESOLVED by the Tigard City Council that: SECTION 1: The Tigard City Council Approves Signature of the City of Tigard and Tigard-Tualatin School District Safe Routes to School Intergovernmental Agreement(IGA). PASSED: This day of n 1 2023. 4\4a1 — Mayor-City of Tigard ATTEST: a-(A ktee.‘re.t_ City Recorder-City of Tigard RESOLUTION NO. 23- Page 1 INTERGOVERNMENTAL AGREEMENT City of Tigard and Tigard-Tualatin School District Safe Routes to School (SRTS)2023-2026 THIS INTERGOVERNMENTAL AGREEMENT(AGREEMENT) is made and entered into by and between the City of Tigard, hereinafter referred to as the "City," and the Tigard-Tualatin School District, hereinafter referred to as "TTSD."The entities listed above may collectively be referred to as the "Parties." PURPOSE The purpose of this Agreement is to document a framework of cooperation in the Safe Routes to School ("SRTS") Program that is being developed and run by the Parties for the benefit of our youth, their families, and the broader community.The Parties will partner to deliver a SRTS Program ensuring safe pedestrian, scooter, and bike education is provided to students of all backgrounds, delivering a safer environment for youth traveling to and from school, and encouraging the use of transportation options that prioritize community health and shared climate goals. RECITIALS 1. The Parties understand the importance of having safe, accessible routes for students to travel to and from school. 2. The Parties agree that every child who wants to walk, roll, or take school buses or transit to school should know how to do so safely through SRTS education. 3. The Parties recognize the vital importance of SRTS's efforts to increase the number of students who safely walk, bike, roll, take transit, and carpool to school.These efforts yield the following benefits: decreased traffic congestion and improved traffic safety, improved health and fitness, increased physical activity, increased independence, improved neighborhood livability, increased alertness and academic achievement, and improved air quality. 4. The Parties recognize the importance of collaboration in supporting families' ability to choose from a range of transportation options. 5. Strong partnerships and commitments from TTSD are required to develop, promote, and implement effective SRTS programs. 6. The Parties recognize the need for individual school transportation plans. 7. The Parties understand that the way students travel to and from school is connected to the City's and District's climate goals. 8. The Parties acknowledge that the program and administrative support systems impose administrative and infrastructure costs on both Parties. 9. The Parties agree that the responsibilities listed here represent the basic requirements for achieving SRTS Program goals and objectives for the 2023-2026 academic years. OBJECTIVES AND DELIVERABLES 1. Engagement. Communicate regularly with the City's SRTS Coordinator to ensure program goals and deliverables are being met. Provide key information to SRTS Coordinator that is essential for program delivery. TTSD Deliverables: • Develop a TTSD Core SRTS Group, which will include the primary points of contact at the district level for: o Communication o Teaching and Learning o Equity and Inclusion o Transportation o Operations Membership of this Group will be revisited at the beginning of each school year. • Provide SRTS Coordinator with district-wide and individual school administration contact information as needed to facilitate the SRTS program. Information will be updated at the beginning of each school year. • Facilitate district-wide communications around SRTS. Distribute information provided by the SRTS Coordinator to students, parents, and caregivers through school newsletters, mailings, backpack mail, posted flyers/announcements, school email, or other regular channels of communication. City Deliverables: • Create SRTS promotional materials and deliver to TTSD administration and individual schools for distribution to students and families. • Communicate and collaborate directly with schools to deliver SRTS Program services and resources. • SRTS Coordinator will collaborate regionally with program partners and other SRTS Coordinators to learn best practices and share regional resources with TTSD. Parties Shared Deliverables: • Quarterly meetings (Fall, Winter, Spring) between TTSD Core SRTS Group and SRTS Coordinator. 2. Education.The Parties agree that every child who wants to walk, roll, or take transit to school should know how to do so safely through TTSD-led education. TTSD will collaborate with the City's SRTS Coordinator with a goal of formalizing SRTS education as a part of school curriculums. TTSD Deliverables: • TTSD will work with its Teaching and Learning Department,the City's SRTS Coordinator, and individual elementary schools to include 2nd Grade Pedestrian &Scooter Education in school curriculum, with the goal of transitioning lesson plan responsibilities to Physical Education (PE)teachers at each school. • Elementary Schools may provide optional 5th Grade Bike Safety Education. • Elementary Schools may provide optional K-1 Early Bike Education utilizing Metzger's 'All Kids Bike' Strider Fleet. City Deliverables: • The City will support TTSD to formalize 2nd Grade Pedestrian & Scooter Education at all elementary schools: SRTS Coordinator will provide teachers with a lesson plan,training materials, a fleet of scooters to be scheduled in advance, and free helmets for all students receiving education.The SRTS Coordinator will continue to teach 2nd Grade Pedestrian & Scooter Education while working with TTSD towards the goal of transitioning lesson plan responsibilities to a designated teacher at each school. • The City's SRTS Coordinator will teach 5th Grade Bike Safety Education at all elementary schools that opt-in to the program offering. Education will be provided by the SRTS Coordinator, with support from school faculty, which includes a fleet of City bikes for students to use and free helmets for all participants. • The City's SRTS Coordinator supported Metzger Elementary in procuring an 'All Kids Bike' Strider Fleet to provide early bike education to K-1 classes. Dependent on fleet availability and school interest, the SRTS Coordinator can facilitate fleet sharing between elementary schools that opt-in to the program offering. 3. Encouragement. The Parties recognize the vital importance of SRTS's efforts to increase the number of students who safely walk, bike, roll, take transit, and carpool to school. TTSD Deliverables: • Provide information on multimodal transportation options to families before the school year starts, including SRTS Program information and bus education. Include multimodal information on district and school websites. • TTSD Administration will encourage all schools to promote and participate in quarterly Walk+Roll to School Challenges (Fall, Winter, Spring) with flexibility on a school-by-school basis. At a minimum, all school and TTSD newsletters to share a Walk+Roll to School Challenge promotional flyer for each event.TTSD will encourage individual school administrations to work with SRTS Coordinator and parent organizations to plan, deliver, and celebrate Walk+Roll to School Challenges. • TTSD will invite the City's SRTS Coordinator to attend regular TTSD Climate Committee meetings.This will provide an opportunity for the SRTS Program to support and engage high school students. City Deliverables: • The City's SRTS Coordinator will collaborate with schools and parent groups to plan for and promote quarterly Walk+Roll to School Challenges (Fall, Winter, Spring). The SRTS Coordinator will provide TTSD schools with general support including a promotional flyer (digital and paper), posters, maps for walking school buses and bike trains, incentives/goodies, and tally methods. For Tigard schools, the City will provide day-of staff support at participating schools by offering a City Planner to join tabling efforts. • The City's SRTS Coordinator will offer a Washington County Crossing Guard Training to all TTSD schools. Schools can opt-in to the training dependent on need. Parties Shared Deliverables: • The Parties recognize the potential of weekly/monthly Walking School Buses and Bike Trains to decrease traffic congestion around schools and increase the number of students who safely walk, bike,and roll to school.TTSD will work with the City's SRTS Coordinator to develop a clear process for the school's PTA/PSO groups to implement Walking School Buses and Bike Trains. 4. Engineering. The Parties recognize the need to provide a safe, comfortable, and connected transportation system for all users, especially pedestrians and other vulnerable users.The City of Tigard's adopted policies and strategic vision support the provision of infrastructure and facilities that are safe and comfortable to all users regardless of age and ability.The Parties will work together to provide safe transportation options for pedestrians. TTSD Deliverables: • TTSD will develop a School Transportation Plan for each school to manage the flow of non- motorized travel, school buses, and vehicle traffic at drop-off and pick up times. School Transportation Plans will encourage safe pedestrian travel by including SRTS Program components, deliver expedient bus travel, and provide education and direction for car drivers to access the school safely and efficiently. An effective School Transportation Plan will include the following elements: 1) base map, 2) assessment of existing routes and conditions, 3) recommendations for infrastructure improvements,4)circulation plan for all modes including school buses, 5) implementation timeline/strategy, and 6) evaluation. City Deliverables: • The City may attempt to obtain grant funding to make needed infrastructure improvements in school catchment areas. • The City's SRTS Coordinator will support TTSD with guidance and resources as the district develops School Transportation Plans. Parties Shared Deliverables: • When the City decides to pursue grant opportunities for SRTS-related infrastructure projects, the City will ask for input from TTSD to provide letters of support as needed. • City and TTSD share responsibility in development of School Transportation Plans. 5. Evaluation.To evaluate the success of the SRTS Program over time, annual data collection is essential to track transportation changes over time.The Parties will collaborate to develop effective data collection tools that are collected annually. TTSD Deliverables: • Collect annual student travel/modal data via student/parent surveys each Spring and share with the City.The City's SRTS Coordinator will develop the survey. City Deliverables: • The City's SRTS Coordinator will provide TTSD with an annual student/parent survey to collect student travel/modal data in Spring. TTSD to collect data via student/parent communication. GENERAL TERMS 1. Liability and Indemnification. Subject to the limitations of liability for public bodies set forth in the Oregon Tort Claims Act, ORS 30.260 to 30.300, and the Oregon Constitution,each party agrees to hold harmless, defend, and indemnify each other, including its officers, agents, and employees, against all claims, demands, actions and suits (including all attorney fees and costs) arising from the indemnitor's performance of this Agreement where the loss or claim is attributable to the negligent acts or omissions of that party. 2. Termination. Any party herein shall have the right to terminate its participation in this Agreement for any reasons whatsoever upon giving the other party thirty(30) days written notice in advance of the date sought for such termination. 3. Assignment/Subcontracting. No party to this agreement shall transfer or assign, in whole or in part, any right or obligation created under this Agreement. 4. No Third-Party Beneficiary. By execution of this Agreement,the parties do not intend there be any third-party beneficiary of the rights or obligations created herein. 5. Non-Discrimination. In the exercise and enjoyment of authority under this Agreement, no party shall discriminate against any personnel because of age, sex, race, creed, religion, color, national origin, marital status, pregnancy, veteran status, any physical, mental or sensory disability, or actual or perceived sexual orientation or any other discrimination prohibited by federal or state law. 6. Entire Agreement.This Agreement contains all of the agreements of the parties with respect to the subject matter covered or mentioned therein and no other prior agreements shall be effective to the contrary. 7. Amendment.The provisions of this Agreement may be amended with the mutual consent of the parties. However, no additions to, or alterations of,the terms of this Agreement shall be valid unless made in writing and formally approved and executed by the parties. 8. Insurance. Each party agrees to maintain insurance levels or self-insurance in accordance with ORS 30.282,for the duration of the Agreement at levels necessary to protect against public body liability as specified in ORS 30.269 through 30.274.
