A RESOLUTION TO AMEND THE CITY FEE SCHEDULE AND ADOPT FEES FOR MUNICIPAL
COURT
WHEREAS,in some cases when a defendant fails to pay a court ordered obligation it is necessary to
forward their case to an outside collection agency;and
WHEREAS, Oregon Revised Statute 137.118 sets the maximum fee for collections at 25%and the City
wishes to adopt that amount;and
WHEREAS,fees should be consistent while also allowing for judicial discretion;and
WHEREAS,codifying Municipal Court fees in the fee schedule promotes transparency and equity.
NOW,THEREFORE,BE IT RESOLVED by the Tigard City Council that:
SECTION 1: The Tigard City Council amends the City's Fee Schedule,as attached,to add a
25%collection rate.
SECTION 2 The Tigard City Council adopts the presumptive fees set forth in Exhibit A
and grants discretion to the court to waive or reduce the fees based on judicial
discretion.
SECTION 3: This resolution is effective immediately upon passage.
