Mr. Jim Savage, Certified Public Accountant, from Coopers d
Lybrand has requested to appear before the Board to discuss auditing
fees and the hope of continuing to service our account in the future.
I have discussed auditing fees with another accounting firm,
Niemi, Holland d Scott, who audit the books of Wolf Creek Water Dis-
trict and the City of Beaverton. Mr. Scott looked at our audit
report of last year and discussed accounting procedures with our
bookkeeper. He states that usually they accomplish audits on an
hourly basis. Prior to the date of the meeting I should have an
estimated cost for the entire audit.

4. Resolution to approve annexations.
I have written a common letter (copy enclosed) to 90 property
owners who own parcels of land which are eligible for annexation to
the water district. These parcels can logically be served by the
district. The response so far stands at 23 for and 9 against.
The proposed annexations will establish the district boundaries
on the south and east. The Tualatin River is on the south, City
of Durham on the southeast, and Metzger Water District on the east
and northeast.
The large parcel on the west, on Bull Mountain Road near Beef
Bend Road, was not included in the original annexation proposal.
However, Mr. Young and Mr. Upchurch specifically requested that their
property be annexed.
If approved, this will essentially take us out of the annexation
business. Thereafter, annexations can be considered on an annual basis,
as required.

In view of the possibility that Metzger and Tigard Water
Districts may be merged next year it would be beneficial to have
these new areas annexed before a consolidated tax base is established.
It should benefit both the old customers and new customers.
5. Other business.
a. Proposal to waive out-of-district fees for those residential,
home owners who are paying advalorem taxes to other water districts.,
After reviewing how Metzger Water District computes their water
bills it becomes apparent that we are charging those home owners in
the Rolling Hills area at a considerably higher rate, particularly
those residents who use a minimum amount of water. I have received
numerous complaints.
Metzger's minimum monthly rates are not doubled for the 2-month
billing period while we double both the minimum cost and minimum
water consumption. A comparison of the bi-monthly water rates shows
the followings

Most residential homes owners do not consume 6100 cubic feet
during a 2-month period. Therefore, in most cases, Tigard water will
cost more than Metzger water on an out-of-district basis. It is
particularly burdensome on the little old lady who conserves water
and uses only 500 cubic feet for the 2-month period. She now pays
$9.00 instead of $4.00.
In view of the above condition I ask that you reconsider the
proposal to waive the out-of-district fee for those residential home
owners who are paying advalorem taxes to other water districts.
Ken Baines indicates that there is n• statute, as such, which
prohibits the commissioners from waiving this requirement as long
as the decision is not arbitrary or discriminatory. There are two
groups of customers who may feel this is discriminatory: (1) the
industrial and commercial complexes along 72nd Avenue, and (2) our
regular customers within the district. There should be no problem
„ow with the first group as they are benefitting from substantial savings
on fire protection by Tigard serving them. Our regular customers
could complain that outside users are not paying their fair share of
taxes to the Tigard Water District. This may be true and they may
have a valid argument, but it would be a "hollow" case in view of
the fact that Tigard's service was forced upon the Rolling Hills
residents by Metzger (including type of water and cost), Rolling
Hills residents are paying adval•rem taxes to Metzger, the amount
is insignificant compared to the additional profit to the district,
and it would certainly not reduce their water rates.
Without additional capital investment the Tigard Water District
is making a substantial profit from the water sales along 72nd Avenue.
The use of the 12" and 6" parallel mains along 72nd Avenue materially
improves our system, completes an important circulation loop, reduces
pumping costs from Lake Oswego with less friction losses, and increases
the capacity of the Baylor reservoirs by an additional 3 feet.

The material benefits derived by the district far outweigh the
$100 per month that is gained by charging the out-of-district rates.
I would like to keep the little old lady happy even if she is in
the Metzger Water District.

8. Work accomplished during November 1973.
a. TWD installed 2 - 6" Cla-valves on Bull Mountain Read and
Roshak Road, near West Colony Park, to reduce pressures from 160 psi
to 110 psi. (General Fund).
b. TWD installed 470 feet of 6" C.I. plus 1 fire hydrant along
Cherry Street, between 72nd and 74th Avenues, for Mr. Ems.
(Developer's and General Fund).
c. TWD installed 660 feet of 8" C.I. + 1 fire hydrant along
Sattler Road, between 98th and 100th Avenues, to parallel pressurized
system with gravity system and transfer 22 homes to gravity flow.
(General Fund).
4. TWD installed 21 meters. ( 4042 - 4022). District also
serves 120 meters in Metzger Water District.

c. Private contractor install 1520 feet of 6" C.I. + 2 fire

d. Private contractor install 2800 feet of 8" C.I., 2000 feet of
6" C.I., and 1000 feet of 4" C.I. + 10 fire hydrants in the Summerfield
development, Townhouses (Phase II), for Tualatin Development Company.

Please excuse the long do I tty in answering your letter co
October 5, 1973. It was felt that your ; 1 of ter deserved a re-
s-rnnse from the entire hoard as a body, and since \uur letter
arrived after our October ,{ f.h meeting , it could not he consid-
ered until November 12th.
We appreciate your concerns , and hope that services have
improved in the last month. We understand that Tigard has now
completed certain modifications that should result in satisfact-
ory pressures and water duality.
Immw We trust that you have seen earlier correspondence directed
to the Rolling Hills residents and that you attended the meeting
at which our superintendent , Mr . Jesse Lowman, explain of the
problems we faced and the basis for our decisions .
We would like to again apologize for our serious breach of
responsibility in not meotin-i with and advising the affected
residents prior to the transition. both Tigard Water District
and ourselves are guilty in this regard.
We are pleased to answer your questions directly as follows :
1 ) copies of cu r. contract with Tigard Water District are
available for pu',tic examination at either their of; ice
or ours . if you will mike an appointment with our supe=r-
intendent , I 'm sure he will he pleased to he availanle
to answer any cl..res t i ons when you vi s i t our office.

2 ) No "transfer" has been made of your area. Your property
is still ih the Met-,,,ger Water District . We have, how-
ever, elected to contract with Tigard for the delivery
• of water via Metzger owned facilities. This contract
was executed by the two hoards on beha11 of the districts ,
pursuant to the following Oregon Revised Statutes : 2(14.210

3) No lecial notification was made, since none is required
for the kind of intergovernmental agreement that is in-
volved here.
As mentioned abnve, the District Board has expressed] its
regret at not informally notifying property owners of the im-
pendinca channe.
4) The contract may he tesmuinate,1 or changed upon notice
by the Metzger Water District. If you reel you can offer
a viable alternative to the existing situation , please
feel free to present it to our Board. We meet the 2nd
Monday of each month at 7 :30 PM at the District office.
Should you wish to pursue this course, it would he (les i reahie
to contact our superintendent ahead of time and be placed on our
agenda. A written proposal for study by the Board members prior
to the meeting would also be helpful .
5) Your property tax bill will continue to i ncl u le the Metz-
. 116110 cer Water. District, since you are still within that dis-
trict.
You will not , however , he billed for Tigard Water District
property taxes , because they are serving you (at, our pleasure)
as an out-of-district customer .
It is our sincere hope that this problem will be resolved
in the future and that we will be able to again servo you dir-
ectly, hut without jeopardizinn the fire protection of our in-
dustrial customers. Please he assured that we aro continuing
to explore every pososi11l ity of doing so.

Dear Mr. Seegers
We have just heard that you intend to retire as City Manager in
the near future.
On behalf of the Board of Commissioners I would like to express
my appreciation to you for your cooperation and assistance in obtaining
a water purchasing agreement between the City of Lake Oswego and the
Tigard Water District. It is doubtful whether this intra-governmental
agreement would have become a reality without your conscientious efforts

to consummate a fair and reasonable contract.
We feel very fortunate that the connection for the Clackamas River
Niro water was made in timely fashion. It assures the customers of this
district, for the first time, with a reliable, high quality source at
a moderate price.
