1. Resolution to approve minutes of last meeting,.

U. S. National Bank was low bidder at 4.7836% interest. Ken Baines
will present a prepared resolution for the Board's consideration. As a
comparison, last year for the $500,000 bond issue, U. S. National Bank
was low bidder at 4.92%.

5. Resolution to place bond funds in savings account.
The $480,000 will be received this month. Guidance is requested on
where to place these funds until utilized. The remaining $215,000 of the
initial $500,000 bond issue is invested as follows:

6. Resolution to appoint election officer and -judges for the General
Election which shall be held on Monday, December 4, 1972.
Oregon Revised Statutes state that a general election shall be held
in the corporation on the first Monday of December of each year for the
election on one commissioner to succeed the commissioner whose term expires
the following January 1, and to elect commissioners to fill any vacancy
which then may exist.
Expiration dates of the present commissioners are as follows:
Position #1: R. Verne Wheelwright January 1, 1976
Position #2: Hugh A. Brown January 1, 1973
Position #3: Clarence F. Nicoli January 1, 1974
Position #4: John M. Wied January 1, 1974
Position #5: Lester R. Rawls January 1, 1975
Position #2 (Hugh Brown) will be up for reelection this year.
New term will be for 4 years, to expire on January 1, 1977.
Last year the new statute created an officer called the "Elections
Officer". The election officer is selected by the Board of Commissioners
and may be a commissioner or an employee of the district or any other
person. The Administrator was appointed last year.
It is recommended that the following young ladies by appointed as
judges:

Each district must publish a notice to prospective candidates of the
date of the annual election and the latest date on which the candidates
of the office of commissioner may file with the district his nominating
petition or declaration of candidacy. This notice need be published only
once and must be published not later than 35 days before the election.
The appropriate notice will be published in the Tigard Times on October
26th which is 39 days prior to the election.
A notice of annual election will also be published twice on November
16th and 23rd.

7. Resolution to approve rebate contract with School District #23J.
School District #23J via their attorney, Mr. Fred Anderson, has
prepared a rebate agreement for the new main installation to Tigard
High School. Ken Baines has reviewed the contract and anticipates no
problems; however, he recommends that a paragraph be added. (See attached).
Normally, the water district complies with the rebate provisions
of O.R.S. 264.320 without a contract, but such contract can be consum-
mated without difficulty.
2/3's of the job has been completed with only the 700 feet of
6" C.I. plus 2 fire hydrants to be installed behind the school.
Actual rebates are as follows:
12" main along Durham, 79th to 92nd: $9.80/ft. ($4.90 each side)
(TWD paid difference between 8" & 12")
8" main along 92nd (500 feet): $8.80/ft. ($4.40 each side)

6" main behind school to be installed (no rebate)
Our estimate was $49,000 based upon $10 per lineal foot for 8" pipe
and $6 per foot for 6" pipe. This estimate will not be exceeded.
8. Resolution to approve lowest acceptable bid for 1973 3/4-ton pick-up
truck.
Unfortunately, last week the 1968 pick-up truck blew a piston and upon
investigation it was determined that the engine block was cracked. Total
cost of repairs, including a new engine, is estimated at $850. Tires, shock
absorbers, and other parts are also worn out. It appears uneconomical to
make the necessary repairs,and if repaired, the district will still possess
an old truck.
Included in this year's budget is $5,800 for a 1-ton dump truck. How-
ever, the need is now for another pick-up truck. A new pick-up truck would
cost about $3,000, including $700 for the trade-in of the 1968 truck. If
$850 must be spent on repairs of the old pickup, the actual out-of-pocket
extra expense would be about $2,150. A decision on the 1-ton dump can be
deferred until later in the fiscal year.

9. Resolution to approve lowest acceptable bid to bore 36" casings under
I-5 and railroad tracks on Bonita Road.
Boring under I-5 and 2 sets of railroad tracks is necessary for the
Lake Oswego connection. 36" casings are required to accomodate the "bell"
of a 24" main. Although only a 16" main will be installed at this time
it would be wise to ensure that the casing is large enough for the future.
Each casing will be 140 feet long.
Only two firms in this area do this type of work. Bids were received
as follows:
I-5 RR tracks
Gonzales Road Boring: $35.50/ft* $35.50/ft*
Loy Clark Pipeline: $97.50/ft $69.50/ft
*Includes a provision that if rock is encountered during boring, the
'vow charge will be $100 per hour extra.
From information I have received there should be very little, if any,
rock in either boring location. It would appear that we should gamble on
no rock, and accept Gonzales' bid. Total cost would be as follows:
280 feet CO $35.50/ft = $9,940 (with no rock).
10. Resolution to recommend naming of lake behind Scoggins Dam "Henry-
Hagg"
HenryHagg" Lake.
Mr. Harry Menzel, Bureau of Reclamation, Department of Interior (U.S. ),
has requested that the district make a resolution if the Board approves of
"Henry Hagg" as the preferred name for the lake. Such action is deemed
advisable by Wendall Wyatt, U. S. Representative from Oregon. The Board
of Commissioners, Washington County, passed such a resolution recently.
Henry Hagg was one of the initiators of the Scoggins Dam project back
in 1934.

11. Resolution to approve revised contract with the City of Lake Oswego
to purchase surplus water.
On September 19th a letter was forwarded to each commissioner with
the revised contract enclosed. It is hoped that we can obtain an agree-
ment on the contract before too much pipe is installed.
12. Resolution to adopt revised rules, rates, and regulations.
The document has been revised in accordance with the corrections
noted at the last meeting. If approved, plans will be initiated to comply
with statutory procedures.
13. Other business. Resolution to approve audit contract with
Savage & Company. (See attached contract).

14. Hi Tor Reservoir.
All construction work on the Hi Tor reservoir is now complete and the
contractor's equipment has been removed. A permanent cyclone fence has
been installed on the east and north sides of the site while a temporary
wire fence encloses the remainder of the perimeter. Planting of shrubs
will begin next month.
15. Raising elevation of #3 reservoir.
Everette Wiggins has started work on raising this reservoir by 12 feet.
It is hoped that most of the work can be accomplished before the inclement
weather.
16. Painting of old steel reservoir at Baylor Street.
$2200 was budgeted to spot-sandblast, prime and paint with 2 coats of
green enamel the 1-million gallon steel tank at Baylor Street. Bids were
received as follows:

The lowest bid was accepted and implemented so that the job could
be finished before the rainy season. Structural Steel Painters previously
painted the new Baylor tank and #2 reservoir.
After the job was finished, it was totally unsatisfactory to us.
Evidently, some bad paint was used in spraying the tank which resulted in
a shoddy-looking job.
The contractor returned last week and painted 2 more coats of paint
on the tank. This time the paint was rolled on and the finished product
looks much better.
All 3 of the district's steel tanks now look presentable and should
be protected from rust for at least 7 years.
17. Water purchased from Capitol Highway Water District.
The final tabulation on the amount of Bull Run water purchased from
Capitol Highway Water District for the past summer season is as follows:

18. Cooperative project with Hillsboro.
I attended a meeting with representatives of other water purveyors
interested in participating in a joint project with the City of Hillsboro
to obtain a source of water from Scoggins Dam. A newspaper article indi-
cated that everyone had agreed to participate. No such agreement was
reached.
Oregon State Board of Health disclosed the startling news that all
surface water sources would have to be processed through a treatment
plant in the future. This also applies to Portland's Bull Run water
which is not treated. It is one of the reasons Portland is having an
engineering study conducted on other possible sources of water, including
the Columbia and Willamette Rivers. If all water must be treated, there
is little reason to transport it all the way from Mt. Hood.
At a subsequent meeting, the practicality of Tigard Water District
participating in the Hillsboro project was discussed. Since the water
must be treated it would be much cheaper to construct a plant on the
Tualatin River near Tigard than to bear the cost of a major transmission
*""' main to Hillsboro.
It is estimated that this treated water will cost 15¢ per 100 cubic
feet.
19. Washington County in water business?
The Washington County Department of Public Health has been designated
as the authorized representative of the Board of Commissioners in enforcing
Ordinance #89 which requires all proposed construction of water facilities
in Washington County be approved by the Board. Enclosed is the directive.
This adds one more governmental body that must approve plans and
specifications. Others are: (if in their jurisdiction)

City of Tigard
I do not anticipate any problems with this requirement as I see no
reason or justification for the Board of Commissioners, Washington County,
to disapprove construction plans.

During the monthly meeting of the Tigard Water District held on
September 12, 1972 , the question was asked whether or not the
District must follow the procedures of Chapter 279 of the Oregon
Revised Statutes , entitled "Public Contracts and Purchasing. "
In my opinion, the District need not comply with this chapter be-
cause ORS 279 .010 (2) provides as follows :
" 'Public officer' includes public officers , commissions ,
boards, committees , departments or other public represen-
tatives of the state, county, city, town, district or
other public body charged by law with the duty of either
receiving bids for or awarding contracts for the construc-
tion of any public improvements. "
Chapter 264 of the Oregon Revised Statutes, entitled "Domestic
Water Supply Districts," does not impose upon a domestic water
supply district the obligation to seek bids for awarding contracts
for the construction of any improvements; therefore, the District
is not a public officer within the definition of ORS 279 .010 (2) .

Dear Mr. Santee:
Reference is made to your letter of August 11, 1972 and the
accompanying report by Mr. Newcomb regarding prospective well sites
for the City of Tigard Water District. All three sites, as indicated
by Mr. Newcomb on his attached location map show the sites to be
located outside of the Bull Mountain-Cooper Mountain critical ground
water area boundary. This defined boundary is not necessarily a
hydrologic boundary. The proposed well or wells constructed outside
the boundary may develop ground water from the critical ground water
zone. If this is the case, then future controls may be required.
These controls will be based on relative priority dates and will
further require a change of the critical ground water boundary.
At the present time, applications for permits to appropriate
ground water outside the presently defined critical ground water boundary
will be accepted by this office. The application should be specific
about the quantity of ground water to be developed. The well should
be equipped with a totalizing water meter and provisions made to insure
the accurate measurement of both static and pumping water levels in the
well. 1

IT IS AGREED between SCHOOL DISTRICT #23J, Washington and Clackamas
Counties, Oregon, hereinafter termed"School District", and the TIGARD WATER
DISTRICT, hereinafter termed "Water District", that:
WHEREAS, the School District has reserved funds limited to the sum
of $49,000.00 to reimburse the Water District for construction costs equal
to those applicable to an 8-inch water main with respect to the Water
District ' s construction of a 12-inch main from the pre-existing terminus
at S. W. 79th Street to a new terminus at S. W. 92nd Street , a 8-inch main
along 92nd Street to a point immediately beyond the turnstile leading to the
football stands and then a 6-inch line extending across the rear of the build-
ing complex to the Southwest corner of the main class room building whereby
water service will become available to the District's senior high school
site as well as to other properties abutting upon S. W. Hall and S. W. Durham
Road along the new water main; and
WHEREAS, the School District and the Water District desire hereby to
record the entitlement of the School District to reimbursement under the
terms and conditions of Section 26 +.320, Oregon Revised Statutes,
NOW, THEREFORE, in consideration of the foregoing premises, IT IS
HEREBY AGREED as follows:
(I ) That the School District will pay to the Water District a
sum equal to the plater District 's cost of constructing an 8-inch water line ---
from S. W. 79th Street to S. W. 92nd Street, an 8-inch line along 92nd Street
and a 6- inch line across the school property when said line is completed ,
this sum not to exceed the amount stipulated above.
(2) That for a period of ten (10) years from and after the date of
completion of construction, to-wit: October 1 1972, the School
District shall be entitled to reimbursement in a`cmrdanca with ORS 264.320

If any person is required by a district to pay the
cost of extending a water main adjacent to property
other than his own so that water service for domestic
use is provide
for such other property without
further extension of the water main, the district shall
require the owner of the other property, prior to

. the person equired to pay the cost of extending the
water main, a pro rata portion of the cost of the
extension. The right to require such refund shall
not cnntinue for more than 10 years after the date of
installation of the extension `f the water main. The
amount to be refunded shall be determined by the district
and such determination shall be final ."
(3) The School District shall not be entitled to reimbursement for
more than one-half the pro rata cost of that portion of the line which
extends along the frontage of lands of either the Durham School house site

(4) That the Water District shall promptly notify the School District
and remit to the School District such `sums from" time to time as may be
properly due the Schnol District pursuant to the provisions of 264.32O

Dear Bob:
The form of the captioned Contract is acceptable to the Tigard
Water District; however, I want the following paragraph added to
the Contract:
"Water District agrees to make all reasonable effort
to collect for such connections and shall pay over such
amounts collected to School District. No connection
shall be made until payment is received unless Water Dis-
trict is ordered to allow a connection by a court order.
In the event suit or action is filed against Water Dis-
trict which challenges the right of Water District to
make or collect the connection charge or challenges the
reasonableness thereof, School District agrees to assume
the defense of this litigation and to hold Water District
harmless from any loss or expenses resulting therefrom.
Both parties agree to be bound by any court decision
touching on this matter. "
You will note I have mailed a copy of this letter to Mr. Fred
Anderson, the attorney for the School District.

Gentlemen:
The Washington County Board of Commissioners adopted Ordinance #89 on July 6, 1971.
Attached to this correspondence you will find a copy of said Ordinance.
Washington County Ordinance #89 requires that any person purposing construction
of water facilities within the Master Plan boundaries of Washington County shall
""` file with the Board of Commissioners full plans and specifications for approval
and determination that such proposed construction conforms to the Master Plan.
No construction should be commenced until the plans and specifications are approved
by the Board.
The Washington County Department of Public Health has been designated as the
authorized representative to enforce Ordinance #89. Therefore, please submit all
future plans for review to this Department so that we may make a recommendation to
the Board of Commissioners. We would also appreciate a current map of your area
and all major lines within the area.
