Specifically, the applicant proposes marijuana processing, which is defined as "the processing, compounding or conversion of marijuana into cannabinoid products, cannabinoid concentrates or cannabinoid extracts," and marijuana wholesale sales, which is defined as the purchasing of marijuana items in the State of Oregon "for resale to a person other than a consumer," (Oregon Administrative Rules Chapter 845, Division 25: Recreational Marijuana). The I-L zone provides appropriate locations for general industrial uses including, but not limited to: industrial services, manufacturing and production, research and development, warehousing and freight movement, and wholesale sales activities with few, if any, nuisance characteristics such as noise,glare, odor, or vibration. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request, subject to certain conditions.The findings and conclusions on which the decision is based are noted in Section 1V. Prior to occupancy, the applicant must submit documentation of approval from the State of Oregon Recreational Marijuana Program. 2. Prior to occupancy,the applicant must submit photometric measurements or other documentation that demonstrates how security lighting will meet the lighting standard in CDC 18.430.050.E. SECTION III. BACKGROUND INFORMATION Site Information: The subject property is located at 14945 SW 72"d Avenue (WCTM 2S112AC,Tax Lot 1900),on the west side of SW 72"d Avenue, north of SW Cardinal Lane, and south of SW Bonita Road. The site contains one (1) existing industrial building, with two (2) tenant spaces. The applicant submitted photographs showing that the eastern portion of the lot is paved and contains 11 existing parking spaces,and that the western portion of the lot is unpaved.The applicant proposes to occupy the eastern tenant space with a new marijuana facility for processing and wholesale sales. The western tenant space is currently vacant, and the future tenant will be required to obtain a separate land use approval prior to occupancy.The site is zoned Light Industrial (I-L). Adjacent properties to the north, south, and west are zoned I-L, and adjacent properties to the east are zoned Industrial Park (I-P). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.130 Industrial Zones: 18.130.030 Land Use Standards A. General Provisions. A list of allowed, restricted, conditional, and prohibited uses in industrial zones is provided in Table 18.130.1. If a use category is not listed, see Section 18.60.030. The applicant proposes a new marijuana facility inside an existing tenant space in the I-L Zone. Specifically, the applicant proposes marijuana processing, which is defined as "the processing, compounding or conversion of marijuana into cannabinoid products,cannabinoid concentrates or cannabinoid extracts,"and marijuana wholesale sales,which is defined as the purchasing of marijuana items in the State of Oregon"for resale to a person other than a consumer," (Oregon Administrative Rules Chapter 845, Division 25: Recreational Marijuana). Under CDC Chapter 18.60 Use Categories,marijuana processing is categorized as a general industrial use,and marijuana wholesale sales is categorized as a wholesale and equipment rental use. Both uses are allowed in the I-L Zone.This standard is met. 18.410 Off-Street Parking and Loading: 18.410.070 Vehicle Parking Quantity Standards A. Off-street parking requirements. The ratios for providing minimum and maximum vehicle parking spaces are provided in Table 18.410.3. If application of the maximum parking standard MAR2020-00001 FD Project,Inc. 2 results in less than 6 parking spaces for a development with less than 1,000 square feet of floor area,the development is allowed up to 6 parking spaces.If application of the maximum parking standard results in less than 10 vehicle parking spaces for a development between 1,000 and 2,000 square feet,the development is allowed up to 10 vehicle parking spaces. The proposed marijuana facility will include both a general industrial use,which has a minimum parking requirement of 1.6 spaces for every 1,000 square feet of floor area, and a wholesale sales use,which has a minimum parking requirement of 0.8 spaces for every 1,000 square feet of floor area.Accordingly,minimum parking for the entire tenant space will be calculated by the general industrial use,because it has the higher parking requirement of the two (2) uses (CDC 18.410.070.B). The tenant space is 4,896 square feet in size; therefore, the minimum parking requirement is 8 spaces. The applicant submitted photographs showing that the property currently contains 11 paved parking spaces on site.This standard is met. 18.430 Marijuana Facilities: 18.430.050 Development Standards A. The proposed development must comply with all applicable state requirements and requirements of this title. The proposed development complies or can be made to comply with all applicable state requirements and requirements of this Title,as demonstrated by the analysis contained within this decision, and through the imposition of conditions of approval. All necessary conditions must be satisfied prior to occupancy. This standard is met. B. The proposed development must meet all of the following site location restrictions. All distances are measured at the closest property lines between the proposed site and nearest lot containing the specified use or characteristic. 1. Marijuana facilities are prohibited within the MU-CBD and TMU zones. The proposed marijuana facility is not located in the MU-CBD or TMU Zones;it is located in the I-L Zone. This standard is met. 2. Marijuana facilities are prohibited within 1,000 feet of a public or private elementary school, secondary school,or career school attended primarily by minors. Staff reviewed citymaps to confirm that the proposed marijuana facilityis not located within 1,000 feet of a p p p 1 public or private elementary school, secondary school, or career school attended primarily by minors. This standard is met. 3. Sale-Oriented Retail and Wholesale Sales uses public opento the are subject to the following restrictions: a. The use must be located on a lot with frontage along Pacific Highway (Oregon Route 99W),and with primary entrances clearly visible from the Pacific Highway right-of-way; b. Marijuana facilities are prohibited within 1,000 feet of another state-licensed retail or wholesale marijuana facility within or outside of city limits; and c. Marijuana facilities are prohibited within 500 feet of a public library or the Parks and Recreation zone. The proposed marijuana facility will not be for a sales-oriented retail use or a wholesale sales use that is open to the public.These standards do not apply. 4. Non-retail uses and Wholesale Sales uses not open to the public are prohibited within 500 M.0.2020-00001 FD Project,Inc. 3 feet of one or more of the following zones or facilities: a. Residential zone; b. Parks and Recreation zone;or c. Public library. The proposed marijuana facility is for processing(a general industrial use) and a wholesale sales use that is not open to the public. Staff reviewed city maps to confirm the proposed facility is not located within 500 feet of a residential zone,the Parks and Recreation (PR) Zone,or a public library.These standards are met. C. Hours of commercial operation are limited to the hours between 7:00 am and 10:00 pm. General Industrial uses with no on-site retail activity are exempt from this restriction. The applicant's proposal is for both a general industrial use and a wholesale sales use that is not open to the public; therefore, the standard outlined above applies to this project. The applicant's narrative states that the proposed facility will comply with the hours of operation outlined above.This standard is met. D. The proposed development must be located inside a building and may not be located within a trailer, shipping container, cargo container, tent, or motor vehicle. Outdoor storage of merchandise,plants, or other materials is prohibited. Staff reviewed the applicant's materials to confirm that the proposed facility will be located inside an existing industrial building, and that it will not be located within a trailer, shipping container, cargo container, tent, or motor vehicle.Additionally,the applicant is not proposing any outdoor storage.This standard is met. E. Parking lots, primary entrances, and exterior walkways must be illuminated with downward facing security lighting to provide after-dark visibility to employees and patrons.Fixtures must be located so that light patterns overlap at a height of 7 feet with a minimum illumination level of 1.0 footcandles at the darkest spot on the ground surface. The applicant did not provide photometric measurements with this application. Accordingly, staff has included a condition of approval for the applicant to submit photometric measurements or other documentation that demonstrates how security lighting will meet the standard outlined above.This condition must be satisfied prior to occupancy.As conditioned,this standard is met. F. Drive-through marijuana facilities are prohibited. The applicant is not proposing a drive-through marijuana facility;this proposal is for a marijuana facility for processing and wholesale sales inside a permanent building.This standard is met. G. The proposed development must confine all marijuana odors and other objectionable odors to levels undetectable at the property line. The applicant's narrative states that the proposed marijuana facility will comply with this standard, and it will also be confirmed at the time of building permit submittal.This standard is met. H. Marijuana or marijuana products must not be visible from the exterior of the building or structure. The applicant's narrative states that the proposed marijuana facility will comply with this standard, and it will also be confirmed at the time of building permit submittal.This standard is met. MAR2020-00001 I'D Project,Inc. 4 18.765 Modifications: 18.765.060 Minor Modifications A. Definition.A minor modification has the following characteristics: 1. It has minimal impacts on surrounding properties,sensitive lands,or public facilities; and The applicant proposes a new marijuana facility for processing and wholesale sales in an existing tenant space located at 14945 SW 72'Avenue. No changes to the existing building footprint, exterior building facades, parking lot, or landscaping are proposed.As demonstrated in the findings above, the proposed uses (general industrial and wholesale sales) are allowed in the I-L Zone, and the applicant's proposal complies with all applicable standards for parking and for marijuana facilities.Accordingly,staff finds this proposal will have minimal impacts on surrounding properties, sensitive lands, or public facilities, and meets the definition of a minor modification. 2. It does not cause the development to go out of conformance with any applicable standard or further out of conformance if already nonconforming, except where an adjustment has been approved. As demonstrated in the findings above, the proposed uses (general industrial and wholesale sales) are allowed in the I-L Zone, and the applicant's proposal complies with all applicable standards for parking and for marijuana facilities. Furthermore, this proposal does not cause the development to go out of conformance with any applicable standard. D. Approval criteria. The approval authority will approve or approve with conditions a minor modification application when all of the following criteria are met: 1. The proposed modification qualifies as a minor modification as defined in Subsection 18.765.060.A; As demonstrated in the findings above, this proposal qualifies as a minor modification as defined in CDC 18.765.060.A.This criterion is met. 2. If the proposal involves the modification of a condition of approval, at least one of the following criteria is met: a. The condition cannot be implemented for reasons outside the control of the applicant or property owner; b. The condition is no longer needed or warranted because circumstances have changed; or c. A new or modified condition better accomplishes the purpose of the original condition. The applicant is not proposing to modify a condition of approval.This criterion does not apply. CONCLUSION: This proposal is for a new marijuana facility for processing (a general industrial use) and wholesale sales,and is in compliance with all applicable requirements of this Title. SECTION V. Can you please send me the following? • A site plan that clearly shows all parking spaces on site o If there are no striped parking spaces,there will be a condition of approval to re-stripe parking spaces on site • A list of all existing and proposed tenants on site,the size of each tenant space (total floor area in square feet), and each tenant's use category(http://gcode.us/codes/tigard/view.php?topic=18-18 00-18 60&frames=on) or a short description of the business/use.You can use the table at the bottom of this e-mail as a template. o How many tenant spaces are in this building, and are there existing demising walls? o Each tenant space is required to have its own suite number or address, so you may be required to obtain new addresses for the spaces ($50 per address).
