ORDINANCE NO. 11-90
AN ORDINANCE ADOPTING NEW SYSTEMS DEVELOPMENT CHARGES, SEPARATE FROM FEES FOR
COSTS OF METER INSTALLATIONS, DETERMINING THE AMOUNT OF THOSE SYSTEM DEVELOPMENT
CHARGES, AND SETTING AN EFFECTIVE DATE FOR THE NEW SYSTEM DEVELOPMENT CHARGES.
WHEREAS, the District has heretofore charged a "connection fee" which
consisted of a consolidated amount for costs of meter installation, and sums to
partially pay costs associated with capital improvements to be constructed, and
costs for capital improvements already constructed or under construction; and
WHEREAS, in compliance with Chapter 449 Oregon Laws 1989, Tigard Water
District has on July 10 , 1990, adopted Ordinance No.11-90, which
calls for separation of systems development charges as defined therein for meter
installation fees, adopts a methodology for determining systems development
charges, and provides a legal framework for administering, collecting, and
expending system development charges,
NOW, THEREFORE, the Board ordains as follows:
Section 1. The Board of Directors of Tigard Water District finds as follows:
(a) The District has commissioned a study of the District's current
charges capital facilities, existing and proposed, and other factors required by
the methodology set forth in Ordinance No. 11-90 , by Economic and Engineering
`Aft" Services, Inc., the results of said study being set forth in said consultant's
report dated June, 1990, attached as Exhibit A, and hereafter referred to as
"Report".
(b) The Report correctly applies the methodology required by Ordinance No.
12-90 , and the recommendations therein as to SDC's for new connections to the
District's system are hereby approved and adopted as the findings of the Board.
(c) The SDC's for the Tigard Water District should be separately
determined for the Bull Mountain service area, and for the rest of the Tigard
Water District service areas.
Section 2.
(a) The net Systems Development Charge for all of Tigard Water District,
exclusive of the Bull Mountain service area, the boundaries of which
are described on Exhibit B attached hereto and by this reference incorporated
herein, shall be as set forth in Table V-5 of the Report attached as Exhibit A,
$845 per equivalent residential unit which, when converted on the basis of meter
connection size, results in the following System Development Charges to be paid
per new meter connection to the Tigard Water District system in areas other than
the Bull Mountain service area:

(b) The net Systems Development Charge for the Bull Mountain service area,
described in Exhibit B, shall be as set forth in Table V-6 of the Report
attached as Exhibit A, $1,000 per equivalent residential unit which, when
converted on the basis of meter connection size, results in the following System
Development Charges to be paid per new meter connection to the Tigard Water
District system in the Bull Mountain Service Area.

(c) In the event of annexations to the Tigard Water District, the charges
applicable to areas annexed shall be those set forth in Section 2(a) of this
Ordinance, unless the Administrator determines that the annexed area is
appropriately a part of the Bull Mountain Service Area, in which event the
charges for those connections shall be in accordance with Section 2(b) of this
Ordinance.
Section 3. Effective Date.
The Systems Development Charges set by this Ordinance shall be applicable
to all improvements to be connected to the Tigard Water District System for
which application to connect is made after the effective date of this Ordinance.
This Ordinance shall become effective on the 90th day after its adoption by
the Board of Commissioners of Tigard Water District.

Enacted this 10 day of July , 1990 , by the Board of
Commissioners of Tigard Water District after notice and reading as directed by
the Board pursuant to ORS 198.510, et seq., by affi a vote of a majority of
the members of the Board.
