BOARD OF COMMISSIONERS
RESOLUTION NO. 13-90
RE: EASEMENT ACQUISITION
On motion made by Commissioner Castile , and seconded by
Commissioner Kvistad , and passed by affirmative action of the Board of
the Commissioners, on this 11 day of September, 1990, Tigard Water District
adopts the following resolution:
It is hereby resolved as follows: Tigard Water District finds that the
acquisition of a permanent easement to install and maintain water mains through
the portion of the John P. Bagan, Jr. property on Southwest Greenburg Road is a
public necessity to enable the District to complete installation of needed water
transmission mains as a part of the District's water supply system, said
property and easement area being more particularly described on Exhibit A,
hereto attached and by this reference incorporated herein.
The District further finds that said easement area is necessary for said
use, and the use, improvement, and project is planned and located in a manner
which will be most compatible with the greatest public good and least private
injury.
Nur, The Board further finds that negotiations to acquire said easement have
been ongoing, but agreement has not been successfully negotiated. The
Administrator is hereby directed to continue negotiation after passage of this
resolution and to immediately make a formal written offer to pay $900 as
compensation therefor. If said offer is not accepted, or agreement reached on
terms of acquisition of said easement within 20 days of said formal offer being
made, the District's attorney and the Administrator are authorized and directed
to proceed to file suit for condemnation of the easement rights so required, and
to deposit such sum as may be determined appropriate with the Court as an
advance deposit in connection with acquiring immediat ssession of the
premises which is hereby determined to be necessar by a Distr'ct.
