RESOLUTION NO. 11-91
A RESOLUTION TO APPROVE EASEMENT ACQUISITION
On the motion made by Commissioner Denis Borman , and
seconded by Commissioner Jon Kvistad , and passed by
affirmative action of the Board of Commissioners, on this 11 day of
June 1991 , Tigard Water District adopts the following resolution:
It is hereby resolved as follows: Tigard Water District finds that
the acquisition of a permanent easement to install and maintain water
mains through the portion of the Elmer's Restaurant property on SW
Pacific Highway is a public necessity to enable the District to complete
installation of needed water transmission mains as a part of the
District's water supply system, said property and easement area being
more particularly described on Exhibit A, hereto attached and by this
reference incorporated herein.
The District further finds that said easement area is necessary for
said use, and the use, improvement, and project is planned and located in a
manner which will be most compatible with the greatest public good and
least private injury.
The Board further finds that negotiations to acquire said easement
have been ongoing, but agreement has not been successfully negotiated.
The Administrator is hereby directed to continue negotiation after
passage of this resolution and to immediately make a formal written offer
to pay $5 ,800.00 as compensation therefor. If said offer is not
accepted, or agreement reached on terms of acquisition of said easement
within 20 days of said formal offer being made, the district's attorney and
the Administrator are authorized and directed to proceed to file suit for
condemnation of the easement rights so required, and to deposit such sum
w.., as may be determined appropriate with the Court as an advance deposit in
connection with acquiring immediate possession of the premises which is
hereby determined to be necessary by the District.
