Resolution 8-93
A RESOLUTION OF TIGARD WATER DISTRICT BOARD OF COMMISSIONERS
RESCINDING PORTIONS OF RESOLUTION 5-93 CONCERNING DISSOLUTION OF
TIGARD WATER DISTRICT.
WHEREAS, the Board of Commissioners of Tigard Water District (the "District") previously
adopted Resolution 5-93 directing the District's staff to initiate proceedings to dissolve the District and
liquidate its assets pursuant to ORS 198.920 et seq.; and
WHEREAS, the District is presently negotiating an intergovernmental agreement with the cities
of Tigard, King City and Durham (the "Cities") for the purpose of providing water service through a joint
water agency after the Cities withdraw their territory from the District; and
WHEREAS, the District has met with representatives of the Cities, Washington County and the
Local Boundary Commission, and has been informed that the interests of those inhabitants of the District
located within the unincorporated areas of Washington County will not be best served by dissolving the
District; and
WHEREAS, the District desires to ensure that high quality water service within the District be
provided in an efficient manner following the July 1, 1993 withdrawal of territory from the District by the
�,., Cities.
NOW, THEREFORE, the Tigard Water District resolves and finds as follows:
1. The Board hereby finds that dissolution of the District and liquidation of its assets is not in
the best interests of the residents of the unincorporated portion of the District.
2. The District staff is hereby directed to terminate all dissolution and liquidation proceedings
previously authorized by Resolution 5-93, and Resolution 5-93 is hereby rescinded to the extent it
conflicts with this Resolution.
3. The District staff is directed to continue negotiations with the Cities regarding the
provisions of an intergovernmental agreement to provide water service through a joint water agency.
4. At the Board's next regularly scheduled meeting the District staff shall report on the status
of negotiations with the Cities and other alternatives being investigated.
