The I-P zone provides appropriate locations for combining light manufacturing, office, and small-scale commercial uses, such as restaurants,personal services,and fitness centers,in a campus-like setting with no nuisance characteristics such as noise,glare,odor,or vibration. APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.50 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the legal status of a nonconforming use,subject to the findings and conclusions on which the determination is based,noted in Section IV of this decision. DIR2019-00004 I-I&H Auto Nonconforming Use 1 SECTION III. BACKGROUND INFORMATION Site Information: The subject property is located at 11244 SW Tiedeman Avenue, previously addressed 11225 SW Greenburg Road, on the south corner of SW Tiedeman Avenue and SW Greenburg Road.The property is currently occupied by two industrial building,which were approved through a site development review (SDR3-84/VAR4-84) in 1984.The subject property is zoned Industrial Park(I-P). Adjacent properties to the south and east are zoned Medium-Density Residential (R-12), properties to the north are zoned Mixed-Use Commercial (MUC),and properties to the west are zoned I-P. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.730 Director Determinations: 18.730.020 Applicability Director determinations may be issued for the following: A. An interpretation of any term or phrase in this title. B. A determination of a nonconforming use, an unlisted use,modification of certain conditions of approval, reasonable accommodation, zone boundary, or as otherwise provided in this title. The request is for a nonconforming use determination, this chapter applies. 18.730.050 Approval Criteria A Director determination has no specific approval criteria,except in the following cases: A. The criteria for determination of a nonconforming use are provided in Section 18.50.030. B. The criteria for determination of an unlisted use are provided in Subsection 18.60.030.C. C. The criteria for modification of an original condition of approval are provided in Paragraph 18.20.040.E.4. D. The criteria for determination of a zone boundary are provided in Subsection 18.10.050.C. The request is for a nonconforming use determination and the approval criteria are addressed below.The applicant is also requesting a determination of whether the building can be reconstructed as originally approved in 1984 provided that the reconstruction does not exceed 60 percent of its current value as assessed by the Washington County assessor. 18.50 Nonconforming Circumstances: 18.50.030 Determination of Nonconforming Use Status A determination regarding the legal status of a nonconforming circumstance is processed through a Director determination, as provided in Chapter 18.730, Director Determinations. A nonconforming use is determined to be legal when both of the following are met: A. The applicant has provided proof that the use was lawful at the time it was established, by one or more of the following: 1. Copies of issued development permits or land use approvals granted at the time the use was established; 2. Copies of zoning ordinances or maps;or 3. Demonstration that the use was established before the first development code for the City of Tigard was adopted. The two buildings on the site were approved through a Site Development Review(SDR3-84/VAR4-84) on March 28,1984. At the time of approval,the Development Code in effect listed automobile and equipment light and heavy repair as a permitted use. The first tenant, New Look Auto Painting,is listed in permit DIR2 01 9-00004 I I&I I Auto Nonconforming Use 2 records in July 1985. In February 1986, the development code was amended to make automobile and equipment light and heavy repair uses a conditional use. The motor vehicle servicing/repair uses on this property never obtained a conditional use permit because they were established prior to these uses being listed as conditional. Therefore, the motor vehicle servicing/repair use was legally established. This criterion is met. B. The applicant has provided proof that the use has been maintained over time. This proof must include copies of one or more of the following for every other year from the time the use was established until the current year: 1. Utility bills; 2. Income tax records; 3. Business licenses; 4. Listings in telephone,business,or other related directories; 5. Advertisements in dated publications, for example trade magazines; or 6. Land use approvals or development permits. The applicant has demonstrated since 1985 that the motor vehicle servicing/repair use has been maintained over time. As evidence, the applicant has submitted a copy of land use records,building and sign permits, business license records, and a statement from a previous tenant. Staff has reviewed all submitted documentation and concurs that the use has been maintained over time.This criterion is met. 18.50.040 Criteria for Nonconforming Situations C. Nonconforming development. 1. Where a lawful structure or development exists that could not be built under the terms of this title by reason of restrictions on lot area, lot coverage, height, required parking, landscaping, or other requirements, such structure or development may remain and its use continued provided it remains otherwise lawful and complies with the following: a. The nonconforming structure or development may not be enlarged or altered in a way that increases its nonconformity; b. If a nonconforming structure, development, or nonconforming portion of a structure or development is destroyed by any means to an extent of more than 60 percent of its current value as assessed by the Washington County assessor, reconstruction is prohibited except in conformity with this title. This prohibition does not apply to single detached houses destroyed by accident. If a nonconforming single detached house is partially or totally destroyed by accident, such as by fire or earthquake, reconstruction is allowed;and c. If a structure or development is moved any distance for any reason,it must thereafter comply with all applicable development standards. The building located on the west portion of the lot was destroyed by fire and the owner would like to rebuild it as it was originally approved through site development review in 1984. The building and site improvements do not comply with the current development code. The applicant submitted the most current tax statements from Washington County showing the value of the structures as $639,080. The valuation includes both structures as they are considered one development on one parcel by Washington County for tax purposes. The applicant also submitted an estimate of labor and materials, a total of $66,697, from Garco Building Systems and Superior Building Erectors. The cost of reconstruction is less than 60 percent of the current value. According to the information submitted, the building can be reconstructed as originally approved through site development review in 1984.This criterion is met. CONCLUSION: The motor vehicle servicing/repair use at 11244 SW Greenburg Road (WCTM 1S135CA,Tax Lot 700) is a legal, nonconforming use that has been maintained DIR2019-00004 H&H Auto Nonconforming Use 3 over time. I have had multiple conversations with Washington County regarding the tax statements and the assessed value of the property at 11225 SW Greenburg Rd, Tigard, OR The property is ONE tax lot with one assessed value to include the land and the improvements (2 buildings). The property is .88 acres, but lies on two separate tax districts, so the county allocates approximately 12.5% value for the .11 triangle on the North end of the code line split and approximately 87.5%for the remainder of the property to the South of the code line split. The code line split is the heavy dashed and dotted line just above where it says 401' East. The code line split lies on the North corner of the larger building. The attached aerial map also shows the tax code line split in red. Neither tax statement or assessed value can be attributed to a specific building. It was explained to me that the property is considered as one tax lot that includes both buildings. Private utility facilities, such as transformers or control valves, that serve a single development must be located below ground unless the functional properties of the facility require above-ground placement.If located above ground,all facilities 1 cubic foot or greater in volume,or with any one dimension greater than 2 feet,must meet the following standards where not wall-or roof-mounted or located inside a building: a. The facility may not be located within 20 feet of any street property line; and 3 b. The facility must be dark in color and painted or wrapped with a non-reflective material. 2. Service areas,such as waste and recycling containers,outdoor storage,and mechanical equipment, may not be located within 20 feet of any street property line,except where located inside a building. 18.410 OFF-STREET PARKING AND LOADING Vehicle and Bicycle Parking: Proposed Use: Motor Vehicle Servicing/Repair Vehicle Parking Requirement: 2.0/1,000 SF but not less than 4 spaces plus what is required for other uses. Maximum Vehicle Parking Allowed: 2.3/1.000 SF but not less than 4 spaces Bicycle Parking Requirement: 0.2/1,000 SF but not less than 2 spaces o See Subsection 18.410.040.I for parking dimensional standards o See Section 18.410.050 for bicycle parking standards. Loading Spaces o All off-street loading spaces must have sufficient area for turning and maneuvering of vehicles on site.At a minimum, the maneuvering length may not be less than twice the overall length of the longest vehicle using the site. 18.420 LANDSCAPING AND SCREENING Required Landscaping (Section 18.420.040) Minimum Landscape Area: 25% The minimum landscape area standard and may be met by any combination of the following: 1. Landscaping,including parking lot landscaping,that meets the L-2 landscaping standard (see below); 2. Landscaping that meets the S-2, S-3, or S-4 screening standard where required by the applicable development standards chapter(see 18.420.050); or 3. Other areas as specified by the applicable development standards chapter. L-2 Landscaping Standard • A minimum of 50%of the total required landscape area must include small,medium,or large shrubs; • A maximum of 50% of the total required landscape area may include any combination of mulch, groundcover,lawn,or hardscape,except that hardscape areas may not cover more than 25%of the total required landscape area;and • If tree canopy standards do not apply as provided in Subsection 18.420.020.C,then 1 tree must be provided for every 600 square feet of total required landscape area. 4 Required Screening (Section 18.420.050) Utilities/Service Areas (S-1 Standard): If any are proposed. With a new CUP, the site is required to come into conformance with all standards. In review of the historical code, motor vehicle servicing/repair uses became conditional uses in the I-P zone in 1986. The narrative states that the building has been used for motor vehicle servicing/repair since 1985. If the applicant can provide evidence and prove through a director's determination that a motor vehicle servicing/repair use was in place prior to 1986 a new CUP will not be required. A modification to the approved Site Development Review(SDR)1984-00003,which would require the building to meet current development standards (height, setbacks, etc.). If other uses on the site are also conditional uses, they should be included in the CUP. The City will start working on re-doing the current commercial and industrial standards late summer this year. This will be a 1-2 year process.
