APPLICATION SUMMARY FILE NAME: Wright Partition CASE NO.: Urban Forestry Review(UFR) UFR2020-00003 PROPOSAL: The applicant proposes to modify the urban forestry plan approved under the Wright Partition (Case No. MLP2018-00002). In the original urban forestry plan from Case No. MLP2018-00002, the applicant proposed to plant five (5) new trees on Lot 1, and to remove seven (7) trees and plant five (5) new trees on Lot 2. The applicant now proposes to modify this urban forestry plan by planting only one (1) new tree on Lot 1,and retaining all existing trees on Lot 2.Additionally,the applicant no longer proposes to plant new trees on Lot 2. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request.The findings and conclusions on which the decision is based are noted in Section IV. UFR2020-00003 Wright Partition—Urban Forestry Plan Modification 1 SECTION III. BACKGROUND INFORMATION Site Information: The 0.41-acre site is located on the north side of SW Walnut Terrace,west of SW 65th Avenue, and east of SW 69th Avenue. The property is also located south of the City's border with unincorporated Washington County,and west of the City's border with the City of Portland. In September 2018,the City of Tigard Planning Division approved a two-lot partition on the subject site (Case No.MLP2018-00002). The site is zoned R-4.5 (Low-Density Residential),as are adjacent properties. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.420.060.F.Urban forestry plan modification. Except as exempted in Paragraph 18.420.060.F.1, an application to modify the urban forestry plan component of a land use approval is processed through a Type I procedure, as provided in Section 18.710.050, using the approval criteria in Paragraph 18.420.060.F.2. The applicant proposes to modify the urban forestry plan approved under the Wright Partition (Case No. MLP2018-00002). In the original urban forestry plan from Case No. MLP2018-00002, the applicant proposed to plant five (5) new trees on Lot 1, and to remove seven (7) trees and plant five (5) new trees on Lot 2. The applicant now proposes to modify this urban forestry plan by planting only one (1) new tree on Lot 1, and retaining all existing trees on Lot 2. Additionally, the applicant no longer proposes to plant new trees on Lot 2. This proposal results in a lesser amount of total tree canopy from the original urban forestry plan, and is therefore not exempt from a Type I urban forestry plan modification. Accordingly,this application is subject to the approval criteria outlined below. 2. Approval criteria. The approval authority will approve or approve with conditions the modification to the urban forestry plan component of a land use approval when all of the following are met: a. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that led to the proposed modification; The applicant and property owner has submitted a written statement indicating that the previously approved urban forestry plan did not account for the circumstances that led to the proposed modification, and the project arborist (Stephen Phoenix of Tree Care Unlimited, LLC) has provided a revised urban forestry plan supplemental report. During land use review,the applicant originally planned to develop on Lot 2, including constructing a new single detached house, installing landscaping and planting trees, and other on-site improvements. However, due to financial constraints, the applicant is no longer able to develop on Lot 2, and now proposes to sell Lot 2 as a vacant lot. Accordingly, the applicant now proposes to retain all trees that were proposed for removal on Lot 2. Additionally, the applicant no longer proposes to plant new trees on Lot 2.This criterion is met. b. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification; and The applicant and property owner has submitted a written statement indicating that there is no practicable alternative to the proposed modification, and the project arborist has provided a revised urban forestry plan supplemental report.This criterion is met. c. The project arborist or landscape architect demonstrates compliance with Subsection 18.420.060.B through a modified urban forestry plan. (Ord. 18-28 §1) UFR2020-00003 Wright Partition—Urban I orestry Plan Modification 2 The project arborist submitted a revised urban forestry plan and supplemental report that demonstrate compliance with CDC 18.420.060.B,including tree preservation,protection, and canopy standards. This criterion is met. CONCLUSION: As demonstrated in the analysis above, the proposed modification to the urban forestry plan component of the approved Wright Partition meets all applicable approval criteria. SECTION V. Our original documents showed the foot print of the house we were intending to build, which was huge and which required us to remove several trees. Thus we were required to plant 10 new trees to replace the canopy area that we were removing. Since we decided not to remove any trees, we want to get rid of the requirement to add the 10 new trees shown on the approved documents and to get the tree bond back. The attached drawing is a first attempt/draft of the revised tree canopy plan showing NO TREES BEING REMOVED. I need some direction of what all I need to do to make this move forward. I assume there may be a plan revision fee that needs to be paid and maybe some request for revision forms to be filled out. Please review this information and let me know what my next step should be.
