DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request.The findings and conclusions on which the decision is based are noted in Section IV. DDR2020-00003 Burnham Business&Storage 1 SECTION III. BACKGROUND INFORMATION Site Information: Burnham Business & Storage is located on the southwest side of SW Burnham Street,northeast of Fanno Creek, and west of SW Hall Boulevard. The site is made up of two (2) tax lots (WCTM 2S102AD,Tax Lot 2200 and WCTM 2S102DB, Tax Lot 200), and contains six (6) buildings that are occupied by existing commercial and industrial uses.The applicant states there are 178 parking spaces on site. The subject site is located in the Tigard Downtown Plan District, the Mixed-Use Central Business District (MU-CBD) Zone, and the Fanno—Burnham Street Sub-Area. Tax Lot 200 is also partially located in the Federal Emergency Management Agency special flood hazard area and the Clean Water Services vegetated corridor. The purpose of this Type I downtown development review is to document the existing tenants and uses at Burnham Business &Storage, and to provide an updated parking count for the site. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.650 Tigard Downtown Plan District: 18.650.020 Applicability A. Applicability. The regulations of this chapter apply to the Tigard Downtown Plan District in addition to all other applicable regulations of this title. The boundaries of the plan district are shown on Map 18.650.A,which is located at the end of this chapter, and on the official zoning map. 2. Pre-existing uses and development.Pre-existing uses and associated development that were lawfully established prior to the effective date of this chapter are treated as lawful or approved uses and developments,subject to the following: a. Modifications associated with lawfully established pre-existing uses and structures are allowed,provided the modifications meet or move the nonconforming use or structure toward compliance with all applicable standards, except that single detached houses used for residential purposes that were lawfully established prior to the effective date of this chapter are exempt from the design standards of this chapter. b. If a structure containing a pre-existing use is accidentally destroyed, or the use is otherwise abandoned,then the use will retain its pre-existing status under this provision provided it is substantially reestablished within 1 year of the date of the loss. Any new structures containing the use must comply with the provisions of this title. Historical aerial photographs show that the subject development has existed in its current location since at least 2001,which is prior to the establishment of the MU-CBD Zone in 2010 (Ordinance No. 10-02); accordingly,the site is considered to be a lawful,pre-existing development in the Tigard Downtown Plan District. The applicant also submitted a list of existing tenants,which shows there are multiple industrial uses on site. These industrial uses are considered to be pre-existing uses in the Tigard Downtown Plan District,and are subject to the standards outlined above. The applicant is not proposing a change of use or any new tenants at this time. The purpose of this Type I downtown development review is to document the existing tenants and uses on site,and to provide an updated parking count for the subject development.These standards are met. 18.650.040 Approval Criteria A. Type I downtown development review. The approval authority will approve or approve with conditions an application for Type I downtown development review when the following are met: 1. The modification does not cause the development to go out of conformance with any applicable standard of this chapter or further out of conformance if already nonconforming, except where an adjustment has been approved; and llllR2020-00003 Burnham Business&Storage 2 The purpose of this Type I downtown development review is to document the existing tenants and uses on site, and to provide an updated parking count for the subject development. The applicant is not proposing a change of use or any new tenants at this time. Additionally, no changes to the existing building footprint, exterior building facades,parking lot,or landscaping are proposed. The subject site is a multi-tenant development, and is therefore subject to the required minimum vehicle parking formula outlined in CDC 18.410.030.D. Additionally, minimum off-street parking requirements in the Tigard Downtown Plan District (outside of the Main Street — Center Street Sub-Area) are 75 percent of the total computed from CDC Table 18.410.3,and fractional space requirements are rounded down to the nearest whole consecutive number (CDC 18.650.050.B). The attached table (Attachment 1) calculates the minimum off-street vehicle parking requirement for the site, based on the standards in CDC 18.410.030.D and 18.650.050.B. Staff finds that a total of 96 parking spaces are required for all existing tenants and uses at the subject development site. The applicant states there are 178 parking spaces available on site; accordingly, staff finds that adequate parking is provided. Therefore, the applicant's proposal does not cause the development to go out of conformance with any applicable standard in CDC Chapter 18.650, or further out of conformance if already nonconforming. This criterion is met. 2. The modification complies with all other applicable standards of this title. Staff reviewed the applicant's materials to confirm that this proposal is in compliance with all other applicable standards of this Title. This criterion is met. CONCLUSION: This proposal has been processed through a Type I downtown development review, and is in compliance with all applicable standards of this Tide.
