Call to Order,Roll Call and Introductions Dennis Koellermeier called to order the Monday,July 2, 2007, Tigard Water District (TWD) Special Meeting at 7:04 p.m. All board members were in attendance with the exception of Kinton Fowler. 2. Administer the Oath of Office to Newly Elected Commissioners -Judge Upton The Honorable Suzanne Upton administered the oath of office individually to newly elected TWD Commissioners Henschel, Russell and Cornick. Kinton Fowler was absent and will be sworn in at a later TWD Board meeting. 3. Selection of officers (Chair,Vice Chair, IWB Representative and Alternate) Mr. Koellermeier opened the nominations for the selection of officers. Charles Radley was elected Chair and the meeting was turned over to him. The election of the Vice Chair was postponed, as the Board felt that Mr. Fowler would be an interested nominee. Julie Russell was elected IWB Representative and Ken Henschel as Alternate. 4. Visitors Comments Helen Honse suggested the seating arrangement for Mr. Cornick should be next to the Chair. 5. Discuss Staffing and Board Support Mr. Koellermeier announced he is removing himself as the City of Tigard staff member liaison to the Board, and that the City of Tigard desires to terminate TWD Board support services. Mr.Koellermeier indicated the Board should prepare a design for a 30 to 60 day transition plan. Tigard Water District 1 July 2,2007 Draft The Board and Mr. Koellermeier discussed various issues with this transition, including: • Future meeting locations. Tigard facilities can still be reserved by the Board. • Headquarters location and changes to TWD mail routing. • Insurance policy revisions are needed to reflect the change, as Tigard is named as the current "business agent" for the Board. • Budget work in the future. • Records that Tigard currently stores and how they would be turned over to the new Board. • Concern with whether or not the City can withdraw support, and how this may be accommodated. Enough questions were raised by Board members such that they decided to have their attorney (Clark Balfour)present at the next meeting to discuss this issue further. 6. Non-Agenda Items Mr. Koellermeier presented the Board with briefing notebooks for reference value. Mr. Koellermeier stated notification of an agent of record for the Tigard Water District needs to be provided to the insurance carrier. This issue will be included in the questions for Attorney Balfour at the next meeting. Mr. Koellermeier and the Board then discussed the proposed agenda for the next meeting. Topics will include: • Discuss Legal Questions with Counsel • Staff Support - Transition Plan • Commissioner Russell inquired about training from the Special Districts Association of Oregon (SDAO) and the Board requested that a representative from the SDAO be present at the next meeting. Mr. Koellermeier said he would try, but this may need to move to a later agenda. In response to Chair Radley's questions regarding records on file and passed resolutions, Mr. Koellermeier indicated he could ask to have a records search for all resolutions of the Tigard Water District from 1990. Records retention will be among the questions the Board will discuss with Attorney Balfour at the next meeting. Board members continued a discussion about bylaws and potential revisions, and will discuss this with legal their counsel at the next meeting. Board members will submit legal questions to Chair Radley by July 16, 2007, who will then submit them to Mr. Balfour on or around July 17, 2007. 7. TIGARD – Being green, recycling and working to protect the environment are current buzzwords, but one idea that hasn't gotten a lot of publicity is the use of reclaimed water. Reclaimed water, or recycled water, is former wastewater that has been treated and purified and can be reused rather than directed into a lake, river or stream. "I do think there needs to be a champion in this," said Marland Henderson, a Tigard business and property owner who has been active in civic affairs, including working on designing a new downtown for Tigard. "I don't think it's necessarily me. It should have been (former Mayor) Jim Nicoli. He had the idea. He was ahead of his time. "When he proposed it, it was too soon. Now it's too late, but Jim brought it to a lot of people's attention." One of the elements in using reclaimed water is providing the infrastructure, which can be as easy and cost-efficient as laying a pipe under a street during construction. "As we tear (Burnham)street up, lay-the purple pipe down it," Henderson said. "We've talked about a green Tigard. Fanno Creek is drying up. The Tualatin River is drying up. Dilution's the solution." With Tigard currently looking for a permanent water source and encouraging,_ conservation among its water-users, finding new ways to reduce the amount flowing into Tigard is becoming a priority. According to Henderson, Jim Nicoll, who died of cancer in 2000 while serving as mayor, supported using reclaimed water from Clean Water Services' Durham Advanced Wastewater Treatment Facility by piping it throughout the city to use for irrigation and for other water needs that didn't involve human consumption. "Today the Tigard High School and surrounding properties are irrigated with the affluent and performing very well," Henderson said. "The success for it is in part because the Durham facility processes that water to near drinking-water quality. "Another attribute to the reuse of this water is that it is used for creating a flow of water in the Tualatin River in conjunction with its sister processing plants upstream of our Tigard facility." Another point Henderson makes is that the city's plan to revitalize the downtown area relies "heavily upon urban green features, and justifiably it should for the selling of the plan and livability that the plan is based on." Henderson argues that the city can more easily produce the green downtown with the water features that have been envisioned by incorporating recycled water into the plan. "Introducing reclamation should solve the majority of the concerns of growth and especially the protection and conservation of the existing systems that become vulnerable," he said. On a more earthy topic, Henderson points out that around the world, toilets are flushed with other than potable water-- sea water on Pacific islands and "gray water, rainwater and even melted snow in colder climates." He added, "The stigma vanishes when you realize the harm is not there, and for generations before, (they) have been doing it that way." As for the future, "Tigard needs water and lots of it to keep up with the next generations to come," Henderson said. "We do not need to look outside of Tigard when we have at least half of what we need right here. Water conservation does not always mean that we need to do without. "Water conservation should mean `water management' in the case of using recycled water for irrigation and flushing toilets. Toilet flushing is the major consumer of household use and could be easily plumbed when connected to an irrigation system that already uses a recycled water source." If you are in need of references, I would be happy to supply them at your request. To answer your questions: 1. Maintaining an office -as stated above, I work out of my home. Unless this would meet the legal requirement for a registered office, other space would be required to meet this need. 2. Storing official records - I have an attic available that could be used, depending on the number of boxes you have, however, I think that if an office is set up, the records would be better kept there. Another option, would be to rent a storage unit. If, however, my attic would be sufficient, we could come to some rental terms that would fit both of our needs. 3. Maintaining a bank account - This is absolutely no problem. I have used DacEasy (a true accounting program for 19 years) but also have Quickbooks Pro for my current clients. A bank account just needs to be set up at a bank you prefer. I also do monthly financials so that an accountant is not needed until the taxes or audit is done at the end of the year. I do not mind writing the checks required but do not sign them. I believe that having two people involved in the process is safer for everyone with no one then having total control of the money. I feel that oversight keeps things clean and honest. 4. Taking minutes/noticing meetings - I have been a secretary under other circumstances, so taking minutes should not be difficult, however, I have never noticed meetings. If this became a part of my responsibilities, I would need instruction so everything could be handled legally and properly. 5. Local government budget process - I have never worked for a government agency but I am used to reading balance sheets, profit and loss statements and figuring out how to look to the future. I believe that looking at the past records, this could be figured out quite easily. 6. Other responsibilities - This would depend on your needs and the time involved. If I can help, I will. In addition to promoting the benefits of annexation,it is important to be up-front about the reasons for Tigard's public policy encouraging annexation. The first, and most important, reason is the need to shape and plan for the future of the City. This effort must involve adjacent unincorporated urban lands. While County government does many good things for its citizens, its structure and organization is not set up to provide the level and intensity of local governance and urban services that are standard within an established city. Two important examples are the lower level of public safety services in unincorporated urban areas and the lack of parks. The City's concerns are based on many Portland metro area and national examples of unincorporated urban areas declining over time as County governments lose the ability to provide adequate services. In many cases the decline of these developed urban lands had negative consequences for adjacent cities. The City wishes to be more active in offering incentives to annex to forestall this possibility. The second reason involves rights and responsibilities of citizenship. In other words, being part of a community also means paying a fair share for services. When unincorporated land annexes to the City, higher property taxes will result. However,we feel the benefits to the property owner are commensurate with the added cost. The appended materials provide an explanation of annexation's property tax impacts. The bottom line is that a house valued at$400,000 would pay slightly more than$500 a year in added property taxes when fully phased in. " • 111111 2 w FREQUENTLY ASKED ANNEXATION QUESTIONS TIGARD 1. Am I eligible to annex? The areas eligible for annexation are those properties within the unincorporated Tigard Urban Services Area (TUSA) designated in an intergovernmental agreement between Tigard and Washington County. However, only properties that are contiguous to the City of Tigard are eligible to annex at this time. You may become eligible if neighbors between your property and the City border also decide to annex. 2. How much does annexation cost? At the March 13,2007 meeting City Council passed Resolution 07-13 that revises the City's policy towards annexation. The city annexation application fee has been waived until July 1,2008. For fiscal year 06-07, the fee is $2,447.Applicants will not be required to pay a Metro Mapping/Filing Fee,which ranges from $100 to $400 dollars depending on lot size. 3. What is the process? Annexation is a Type IV decision approved by City Council. If your property is contiguous to the City, the first step is to schedule a meeting with the City of Tigard's Current Planning Department. The next step will be to work with Current Planning staff to submit an annexation application including a signed consent form and all required documentation. 4. How long does the process take? Completing the City annexation process generally takes 2 / to 3 months. 5. What will be the difference in taxes? Resolution 07-13 phases in property taxes over three years at a rate of 33.3 % the first year, 67% the second, and 100% the third. The eligibility period for phasing-in of property taxes is June 30, 2007 to February 28,2008. You will pay roughly 10% more in taxes as a City resident than as a County resident. This equates to a $538.76 increase based on a home with an assessed value of$400,000. What services will change? In some cases the service provider will change and the level of service will be enhanced. In others, the level of service will remain the same but the provider will change,or both the level of service and the service provider will remain the same. Do residents have to vote in order to approve the annexation of my property? No, residents will not have to vote. Oregon Revised Statutes provide for many methods of annexation. A vote is not required for a property owner initiated annexation (See ORS Section 222.120). 8. When does the City of Tigard typically require annexation? When a property wants to connect to the sewer or storm water system,and the connection is within the City's boundary, annexation is required. Per an agreement with Clean Water Services, se'er lines within City boundaries shall be maintained by the City. "A community is stronger together. " + f f 9. Will I still be part of any special districts? Yes. For example,if your property is within the Metzger Park Local Improvement District or the Tualatin Valley Water District then you will remain in that district after annexation. The exception to this rule is the Enhanced Sheriff Patrol District,as after annexation police services will be provided by the City of Tigard. 10. Will my children have to change schools? No. Annexation does not change school district boundaries. 11. I work out of my home;will I need to apply for a special permit? Yes,but not until your Washington County Home Occupant permit expires (every two years).The City of Tigard Home Occupation permit is different than the Washington County permit in that the Tigard permit does not expire. The City does not regulate businesses, nor does it issue Business Licenses.
