Thank you Ron Bunch file://C:\Documents and Settings\greer\Local Settings\Temp\GW}0000LHTM _ __12/20/2006 MEMORANDUM lig II • TO: Steve Kelly,Senior Planner TIG ARD FROM: Ron Bunch,Long Range Planning Manager RE: Memorandum of Understanding (MOU)regarding"Extensions of Public Water and Sewer Services to "Measure 37-Related Urban Developments in Rural Washington County DATE: December 18,2006 INTRODUCTION On November 21,2006,the City Council considered the Memorandum of Understanding (MOU)regarding"Extensions of Public Water and Sewer Services to Measure 37-Related Urban Developments in Rural Washington County." Staff was asked to convey Council's viewpoints and questions regarding the proposal.After receipt of the County's response the Council will reconsider the MOU. Background/Discussion The principles underlying the proposed agreement are good ones.Urban services from Portland area jurisdictions and service districts should not be extended outside the Portland Metropolitan Area Urban Growth Boundary(UGB). As has been proven,controlling how, where, and when public services are provided is important to manage urban development. Also,urban service capacities are not inexhaustible. Wise management of urban service resources requires keeping them within the UGB. The City's perspective is that there is no urgency to sign the MOU because it is unlikely that Tigard services would be extended to Measure 37 development on "resource lands" outside the UGB.For example the City is surrounded by non-resource lands. Furthermore,it seems that Metro rules and state laws would prevent Tigard and other jurisdictions from extending services outside the UGB to resource lands. However,the City still wishes to lend its voice to the principle that urban services should not be extended outside the UGB to urban development brought about by Measure 37 or any other cause. Therefore,before signing the agreement Tigard wishes to pose the following questions: • Have there been Measure 37 applications for waiver of land use regulations within the vicinity of Tigard that would need urban services? • Does the proposed MOU address issues not otherwise covered by Metro's or the state's prohibition against extending urban services outside an Urban Growth Boundary?For example,does the MOU serve as a policy back-stop to prevent proponents of Measure 37 development from darning rights to urban services by requesting waivers of land use policy related to Public Facilities? • Some special districts that provide water are not on the signatory list including the Tigard Water District. Is there a reason water districts are excluded? Could Measure 37 development force water districts to provide service outside their current service boundaries? • The agreement focuses on not extending services to "resource lands" outside the UGB. It seems,from the standpoint of good growth management policy,that the agreement should also address not extending urban services to "exception lands" outside the UGB. Is there a reason "exception lands"were not included in the agreement? • The MOU proposes that services not be extended to resource lands beyond the UGB except as allowed by the County's Comprehensive Plan. In what instances does the County's Plan allow services to be extended? Is there the possibility that the County's Plan would ever be amended to increase the opportunity to extend services? • The agreement references Metro's "New Look at Regional Choices / Shape of the Region" effort as a basis to plan for future extension of urban services. Metro's project might target specific areas for UGB expansion that could contain resource lands. Is this clause necessary since the Metro Functional Plan requires several things to happen, such as development of Concept Plans,adoption of land use designations,public facility planning etc. before urbanization can take place? Rather than including this in the MOU,would it be better for Metro to first complete its work,have it publicly reviewed, agreed with by stakeholders and then adopted by Metro Council?
