APPLICATION SUMMARY FILE NAME: Brookside CASE NO.: Urban Forestry Review(UFR) UFR2020-00002 PROPOSAL: The applicant proposes to modify the Urban Forestry Plan approved under the Brookside Subdivision (Case No. SUB2018-00006). Specifically, the applicant proposes to change the quantity, location, and species of trees to be planted. The proposed canopy is less than what was previously approved for the overall site. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request.The findings and conclusions on which the decision is based are noted in Section IV. UFR2020-00002 Brookside—Urban Forestry Plan Modification 1 SECTION III. BACKGROUND INFORMATION Site Information: The Brookside Subdivision (Case No. SUB2018-00006) was approved by the City of Tigard on January 9,2018.This approval was for a 19-lot subdivision,located on the east side of SW 79th Avenue, south of SW Ashford Street and north of SW Bond Street. The properties are zoned R-12 (Medium-Density Residential). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS F. Urban forestry plan modification. Except as exempted in Paragraph 18.420.060.F.1, an application to modify the urban forestry plan component of a land use approval is processed through a Type I procedure, as provided in Section 18.710.050, using the approval criteria in Paragraph 18.420.060.F.2. The applicant proposes to modify the Urban Forestry Plan approved under the Brookside Subdivision application (Case No. SUB2018-00006).The previously approved Urban Forestry Plan specified 70 street trees to be planted along the project's frontage. The street trees include 35 Paperback Maples, 23 Japanese Stewartia, and 14 Japanese Snowbell. In addition,two Paperback Maples were proposed on Lots 7 and 8. During the site improvement phase of construction, the applicant contracted another arborist to reevaluate the number of street trees that were originally approved. Morgan Holen;Morgan Holen&Associates,LLC, a certified arborist and tree risk assessor,provided a written report that due to the locations of driveways and utilities the site would not allow for planting of 70 street trees. The proposal is to plant 38 street trees that result in less canopy than was originally approved,but still meet the minimum effective canopy requirements. 18.420.060.F 2. Approval criteria. The approval authority will approve or approve with conditions the modification to the urban forestry plan component of a land use approval when all of the following are met: a. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that led to the proposed modification; The project arborist has provided a revised report and statement certifying that the previously approved Urban Forestry Plan did not account for the circumstances that led to the proposed modification. The previous plan did not account for locations of driveways and utilities as well as proposed trees in locations that the trees would not thrive in due to inadequate sunlight.The modified Tree Canopy Site Plan depicts the locations of the proposed street trees. The proposed plan meets the minimum effective tree canopy cover for the overall development site.This criterion is met b. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification; and The project arborist has provided a revised report and statement certifying that there is no practicable alternative to the proposed modification.This criterion is met. c. The project arborist or landscape architect demonstrates compliance with Subsection 18.420.060.B through a modified urban forestry plan. UF122020-00002 Brookside—Urban Forestry Plan Modification 2 The project arborist submitted a revised Urban Forestry Plan and supplemental report that demonstrates compliance with CDC 18.420.060.B,including tree preservation,protection,and canopy standards.The Modified Effective Tree Canopy Cover Summary demonstrates that the canopy cover for the total development is met at 33.2 percent.This criterion is met. CONCLUSION: As demonstrated in the analysis above, the proposed modification to the Urban Forestry Plan Component of the approved Brookside Subdivision meets all applicable approval criteria. CONDITIONs: 1. The applicant must provide a fee to cover the city's cost of collecting and processing the inventory data for the entire urban forestry plan.The fee is based on 38 planted trees. 2. The applicant must provide a tree establishment bond that meets the requirements of the Urban Forestry Manual,Section 11,Part 2.This bond amount will be for 38 newly planted open grown trees. I have not visited the site.This report proposes a modification of the quantity, location and species of trees to be planted in the Tree Canopy Site Plan. No modifications to the previously approved Tree Preservation and Removal Site Plan are proposed and no payment of a tree canopy fee in lieu of planting is required. A minimum of 33%effective tree canopy cover is required in the R-12 zoning district.The previously approved UFP noted that the overall development site was 73,834 square feet in size with 1,600 lineal feet of street frontage abutting the site. Based on the street frontage,40 street trees were required, but 70 trees were proposed to be planted.These 70 trees provided 35,352 square feet of effective tree canopy cover,or 48%of the overall development site. Thus,the canopy requirement was satisfied.The previously approved UFP did include a caveat in regard to the proposed planting locations: "Note that the final street tree locations will need to be adjusted as needed to avoid the final driveway locations while ensuring adequate soil volumes, infrastructure setbacks,and other planting requirements." In reviewing the plan set, it was obvious that the locations of driveways and utilities would not allow for 70 trees to be planted. Furthermore,the proposed trees were generally spaced too densely and not suitable along alleyway tracts and the eastern property boundary where sunlight is expected to be inadequate. Attachment A provides a mark-up of the preliminary plat as documentation of the size of the overall development site and total lineal length of street frontage that I used as the basis for modifying the Effective Tree Canopy Cover Summary.The overall development site is 73,824 square feet and the lineal length of street frontage abutting the project site is 1,494.08. Based on the actual street frontage, 38 street trees are required. Attachment B provides the modified Planted Tree Inventory.The minimum required quantity of street trees is now proposed, including: 12 small statured trees providing 491 square feet of effective tree canopy cover each; 25 medium statured trees providing 707 square feet of effective tree canopy cover each;and, one other medium statured tree providing 963 square feet of effective tree canopy cover. Several suitable species options providing equivalent canopy cover are listed in order to provide the landscape contractor with flexibility at the time of planting, depending on what is readily available at the nursery. Attachment C provides the modified Effective Tree Canopy Cover Summary.The 38 trees now proposed to be planted provide a total of 24,530 square feet of effective tree canopy cover, or 33.2%of the overall development site.The minimum required canopy cover continues to be satisfied. Brookside Subdivision—Urban Forestry Plan Modification April 19, 2020 Page 2 of 2 Attachment D provides the modified Tree Canopy Site Plan, showing the proposed tree locations by species and including tree planting specifications in accordance with Sections 2 and 10 of the Tigard Urban Forestry Manual. The approval criteria for modifications to the Urban Forestry Plan components of an approved land use permit are addressed below. a. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; The previously approved UFP did not account for the circumstances that led to the proposed modification because it assumed that the locations of driveways and utilities would accommodate the proposed plantings.The plan also unduly planted the site and trees would not have thrived in the alleyways or along the eastern boundary where sunlight is expected to be inadequate. b. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification;and There is no practicable alternative to the proposed modification because the site cannot accommodate 70 trees. Finding locations for the 38 required street trees was challenging enough considering all the various spacing requirements. Where soil volume is inadequate in planting strips, street trees are specified within 6-feet of public rights of way.The proposed trees provide the closest and best spacing possible and species were selected based on suitability for their proposed locations while also achieving the minimum 33%canopy cover requirement. c. The project arborist or landscape architect demonstrates compliance with the Urban Forestry Plan Requirements through a modified urban forestry plan. This memorandum and the enclosed attachments demonstrate that the proposed modification is in compliance with the City's Urban Forestry Plan requirements. The client may choose to accept or disregard the recommendations contained herein, or seek additional advice.
