SUBJECT: GTE Property
As I mentioned to you a couple of weeks ago, Liz Newton has been negotiating with GTE
regarding the access agreement granted to us by GTE back in 1986. We have found that the
original agreement with GTE allows only for Police vehicles to exit our property through the
GTE site onto Burnham. The original access agreement does not allow for Police vehicles to
enter the GTE property to cross that property to access the rear of the Civic Center.
Although you have been advised by employees of GTE that they feel a sense of security by
having Police vehicles on occasion cross the GTE property, Liz has discussed this with GTE,
and found that GTE management does not agree with those employees. GTE management has
insisted that the City no longer use the GTE Burnham access as an entry to the Civic Center.
As a result, please issue an immediate general order to all Police personnel, directing that use
of the GTE property for access to the Civic Center is not allowed by GTE, nor is it allowed by
the City of Tigard.
I would appreciate your total cooperation to make sure that our personnel do not violate the
access agreement with GTE. GTE has the ability to void the agreement, thus eliminating our
ability to have Police personnel exit the site to Burnham. I recognize that the arrangement
which was negotiated in 1986 is not the same as you and your staff have understood the
arrangement to be. However, it is clear from my review of the file that the City has gone
beyond the arrangement allowed by GTE.
Please provide me with a copy of the order that you issue to employees, and please make sure
that staff fully comply with this request. Thank you for your cooperation.
