Whereas.Owner owns premise located at 8200 SW Pfaffle Street, Tigard,OR 97223,which is normally used for a school,and Whereas. User desires to use the area of facilities for the purpose of physical agility test and Whereas,Owner has agreed to allow User to use the facilities provided that the following terms and conditions are met. It is Therefore Agreed By and Between the Parties: I. Owner agrees to let User use the above-described premise on-june,20 from Sam to 5pm 2. Robert Casteel is the contact person for the Owner an§gt Thomas Duncan is the contact person(s) for User to coordinate details of usage. 3. ❑ Per fee agreement: User agrees to pay the following amount to the Owner for the use of the Premises: 5 0 per hr. TOTAL: 0 C Non-fee agreement: In consideration for the benefit of using owner's facilities, User agrees to abide by all terms and conditions of use described in this agreement. 4. User agrees that it will not use the premises for any unlawful purposes: 5. User acknowledges that the primary use of the Building is the operation of a Christian high school. Tenant shall ensure that the User's students,employees,and invitees will not harm Owner's students in any way. User shall use appropriate screening techniques to ensure that its students,employees and invitees do not pose any threat to the physical,spiritual,or emotional health of Owner's students. 6. Cooperation: User understands they may be sharing this building and surrounding campus grounds with other Users and will operate in a professional and courteous manner at all times. User will immediately involve Owner in any issue arising with other Users. 8. Organizational Users: User promises and warrants that it carries liability insurance with a minimum liability occurrence limit of$1,000.000 and damage to rented premise for each occurrence of $300,000. User agrees to be responsible for preparing for use and returning to the pre-use condition all areas of the premise which User will use. including entrances and exits. 11. User agrees to conduct a visual inspection of the premises, including entrances and exits,prior to each use.and warrant that the premises will be used only if it is in safe condition.. . as best determined based on a reasonable visual inspection. 12. Either party may cancel this agreement unilaterally with 14 days written notice to the other parry. In the event that the Owner must cancel this agreement. User will be entitled to any deposit User has paid. However, in no event will Owner be liable to User for any lost profits or incidental,indirect. special,or consequential damages arising our of User's inability to use the above described premises. even if Owner has been advised of the possibility of such damages. 13. User agrees that it will not assign any of its rights under this agreement,and any such assignment will void this agreement at the sole option of the Owner. 14. Owner and User agree that any disputes arising under this agreement will be resolved via a mutually acceptable alternative dispute resolution process. If Owner and User cannot mutually agree upon such a process,the dispute will be submitted to a desk arbitration of the American Arbitration Association for final resolution. 15. This document contains the entire agreement of the parties and supersedes all prior written or verbal agreements relating to the subject matter.
