BOARD OF COMMISSIONER'S MEETING
Thursday, December 19, 2002

1. Call to Order
Commissioner George Rhine called the meeting to order at 9:00 a.m.
2. Roll Call and Introductions
Commissioner Rhine called roll and all members were present.
3. Approval of Minutes—June 24, 2002
Commissioner Norm Penner motioned to approve the minutes of the last meeting held
on June 24, 2002, and Commissioner Beverly Froude seconded the motion. A
unanimous vote was made to accept the minutes.

5. General Update— Dennis Koellermeier
Dennis Koellermeier thanked the members for attending the meeting that was called on
short notice.
Lona Term Water Supply Options Update
• Regional effort being reviewed by the suburb agencies and the City of Portland for
review and consideration to proceed. There are several more meetings with the IWB
and Tigard City council with the end of February as the anticipated time for final
determination.
• The purchase price or buy in costs for Tigard have still not been determined.
• Mr. Koellermeier anticipates the City of Portland proposal will be less expensive than
the Joint Water Commission proposal, but not by much. There are still too many
variables to pinpoint the amounts.
• Still about a year away from knowing whether a permit to raise Haag Lake is
possible.

ASR—The ASR project is going well. A draft of the final report should be ready the first
part of January 2003. Injection of water again into the ASR will begin after the first of the
year.
Rate increase (SDC) review process is underway. This process substantiates the
financial model in order to secure the sale of revenue bonds for financing the Bull
Mountain reservoir, pump station and associated plumbing. The Rider School is
scheduled to open in 2004 and involves approximately $9 million of capital improvement
funds. The decision has been made to divide the project into three packages and will
include the reservoir and preliminary engineering for the pump station and piping. The
project will be supervised by a City Engineering Manager.
Commissioner Froude requested information about summer water usage. Dennis
Koellermeier said the weather patterns were somewhat different than usual in that it was
not very hot, but had long and dry periods. There were several days when the water
level dropped below the comfort zone. Through the intertie with the City of Tualatin
several million gallons per day were pumped in to bring the water level back up. We
were able to test parts of the system that had not been tested before.
The ASR water was pumped down and was not replenished because of the long dry
conditions.
6. Cooperative Agreement Between TWD & Washington County-Julia
Hajduk
Dennis Koellermeier introduced Julia Hajduk, Associate Planner from the City of Tigard's
Planning Department and then he presented some background about the agreements
that were being reviewed. He explained that there has been confusion in the past as to
who is to sign the two regional agreements and one of the agreements is required for the
foundation of the other agreement.
Julia explained that Washington County has coordinated these agreements for ORS.
The ten-year process to date has included cooperative agreements, getting some
principles in place, getting urban service agreements signed and defining who the
ultimate service providers within the current urban service areas will be, i.e., fire, water
districts, parks and recreation, transit, etc. The agreement defines that the City of Tigard
will be the ultimate water service provider once the urban service area is annexed. The
Tigard City Council has signed their part of the agreement.
Commissioner Froude asked how the further development of the Bull Mountain area,
including the recent addition of 600 acres, would affect the Tigard Water System.
Dennis Koellermeier explained that those areas were built into the master plan. The
new pieces that have been added for annexation will be paid through SDC's and a
special SDC district (surcharge)will be created to cover those expenses. The SDC
structure law in Oregon is very clear and preliminary work on the methodology is being
reviewed by Tigard's consultant. All infrastructure costs, reservoirs, planning, and pipe
lines are 100% SDC eligible or developer financed. There will be more everyday users
paying rates to cover operational costs. There is a defined boundary, which makes it
easy to trace and distinguish the construction costs.

Commissioner Froude stated that the agreements solidify what is in existence and
eliminates arguing about boundaries. The agreements formalize what is already in place
Dennis Koellermeier referred to Section 4-C, which refers to the relationship with
Tualatin Valley Water District (TVWD)and the City of Tigard. There have been several
meetings with TVWD and a gentlemen's agreement was created making Highway 217
the dividing point; everything south of Hwy. 217 is to be operated by the City of Tigard
and north of that point, including Metzger and Washington Square, will be TVWD's
operational area. The agreement with TVWD will ensure their support for Tigard to join
the Joint Water Commission, which is a huge plus for Tigard. Hillsboro has already
signed a letter of agreement that they want us to be a partner in the JWC. If Tigard is
not admitted into the JWC, the agreement will not be effective and Tigard will take over
that area, but for now, our service area will stop at Hwy. 217.
Julia Hajduk stated that these documents could be modified at any time if issues arise
and discussions or adjustments between jurisdictions create changes.
Commissioner Norm Penner made a motion to approve the signing of the cooperative
agreement and Commissioner Froude seconded the motion. There was a unanimous
vote to approve the signing and Commissioner Rhine, as Chairman of the Board of
Commissioners, signed the cooperative agreement.
There was a brief discussion about the planning process for the new area and the
possible financial impact.
Commissioner Froude made a motion to approve and sign the Tigard Urban Services
Agreement dated November 26, 2002, and the vote was unanimous. Commissioner
Rhine signed the agreement on behalf of the Tigard Water Board.
7. Non-Agenda Items
Mr. Koellermeier informed the board about the renewal of their insurance. The
insurance renewal process is out of sequence with the budget process and board
meetings so Mr. Koellermeier approved the negotiations for renewal which included a
minor increase in premium of approximately$30.00.
8. Set next meeting date
Commissioner Rhine stated it would be advantageous to have a meeting in February to
bring them up to date and the next meeting was scheduled for February 24, 2003.
9. Adjournment
Commissioner Penner motion to adjourn the Tigard Water District meeting and
Commissioner Froude seconded the motion. All voted in favor of adjournment.
