02/22/1999 - Minutes TIGARD WATER DISTRICT BOARD OF COMMISSIONERS MEETING r FEBRUARY 22, 1999 Members Present: David Strauss, Gretchen Buehner, Beverly Froude, Norm Penner Members Absent: John Haunsperger Guests Present: Mayor Jim Nicoli and Councilor Paul Hunt Staff Members Present: Mike Miller 1. Call to order Commissioner Norm Penner called the meeting of the Tigard Water Board of Commissioners to order at 7:08 p.m. on February 22, 1999 2. Roll Call/Introductions All present except for John Haunsperger. 3. Ballot Title Discussion - Mayor Nicoli and Paul Hunt Executive Session The Tigard Water District Board went into Executive Session at 7:15 p.m. under the provisions of ORS 192.660(1)(d), (e), & (h)to discuss labor relations, real property transactions, and current and pending litigation issues. Executive Session adjourned at 8:34 p.m. Commissioner Penner noted that Commissioner Strauss would write up the items discussed for review at the February 24 meeting. 4. Visitors Comments There were none. 5. Intergovernmental Water Board Update There was none, as everyone had attended the Board meeting. 6. Utility Manager's Report Tigard Water District Board - February 22, 1999 Page 1 L. Mike Miller, Utility Manager, noted the correspondence and billing provided to the District regarding the Funk case. Commissioner Buehner commented that th9 amount of the attorney's bill seemed high to staff, and she reviewed it. She indicated that she could not tell whether the amount billed for research was valid without seeing the memos documenting the research, which the District has not received. She said that she asked Mr. Miller to get the Board copies of those documents. She recommended not paying the bill until they got copies of those research memos. 7. Non-Agenda Items • Commissioner Froude reported on a phone conversation she had with a gentleman expressing interest in running for the Board until he found out that Board members were unpaid and did not receive benefits. She mentioned this gentleman's report that he saw oil up near the Trask River which he held caused the bad taste of Hillsboro's water. • Commissioner Buehner mentioned that the Citizens for Sensible Development in her area would become a formal CPO. She expressed her concern that the people out there have received information from only the opponents in the water source debate. She spoke to getting engineering facts out in the community. The Board discussed strategies to inform the various homeowners associations in the district of the facts in the water source debate. The Board agreed that it was not ready yet as a Board to take a vote on the two water source options. The Commissioner agreed that they would still hear citizen input. Commissioner Penner suggested adopting an official position by the end of the March Board meeting. Commissioner Penner suggested that the Board meet with Durham and King City. The Board agreed to talk with Bill Scheiderich at the IWB meeting on February 24 to set up an informal meeting between the three agencies. • Commissioner Froude asked for clarification on the properties listed on the City of Tigard Council agenda as withdrawn from the District. Mr. Miller explained that these properties have already developed and gone into Tigard's allotment. The action listed on the Council agenda was just to clean up the paperwork on the City's side. It had no impact on the District, as the annexation occurred in 1996. • The Board discussed the need to conform the Budget Committee term limits to the state statute requirements of three year terms. The Commissioners agreed to write a letter to the Budget Committee citizen members to ask if they were willing to serve for three year terms, as a follow up to a phone call from the Budget Committee chair. 8. Set next meeting date • The Board agreed to decide on the March meeting date at the February 24 IWB meeting. Tigard Water District Board -February 22, 1999 Page 2 • The Board discussed when to hold the Budget Committee meeting. It agreed on a late May meeting with adoption of the budget in June. Commissioner Buehner suggested holding the April Board meeting earlier in the month, as two Commissioners would be out of the country in late April. 9.
