TIGARD WATER DISTRICT
BOARD OF COMMISSIONERS MEETING
AUGUST 2, 1999
Members Present: David Strauss, Gretchen Buehner, Beverly Froude, Norm Penner,
George Rhine
Staff Present: Mike Miller and Ed Wegner
Visitors Present: None
1. Call to order:
David Strauss called the meeting of the Tigard Water District Board of
Commissioners to order at 7:03 PM on August 2, 1999. David Strauss then
proceeded to give the oath of office to Beverly Froude, Norm Penner and George
Rhine.
2. Roll Call/Introductions
All members present.
3. Approval of Minutes
It was noted during the discussion of the minutes that on page 4, bottom
paragraph that the word "not" needed to be inserted after "do" in the first
sentence.
Commissioner Penner moved to approve the March 29, 1999 meeting
minutes as corrected. Commissioner Strauss seconded the motion. All
members present voting AYE, the motion passed unanimously.
At this time the meeting was opened up to nominations of officers. It was
moved by Commissioner Rhine and seconded by Commissioner Buehner
that Norm Penner be nominated as Chair. All members present voting
AYE, the motion passed unanimously.
Selection of Vice Chair. Both David Strauss and George Rhine were nominated
as Vice Chair. A vote was taken, with both Commissioners receiving two votes
each and one member not voting. It was then decided that a flip of the coin
would make the determination. Commissioner Rhine was selected as Vice Chair
from the coin toss.
Selection of IWB Representative. Commissioner Buehner was selected to
represent the Tigard Water District at the Intergovernmental Water Board.
Commissioner Penner moved that officers serve a 12 month term.
Commissioner Strauss seconded the motion. All members present voting
AYE, the motion passed unanimously.
4. Intergovernmental Water Board Update and Utility Manager Report

Commissioner Froude turned over her report on the last IWB meeting Ito staff for
the update.
Wilsonville Property—Ed Wegner informed the Commissioners that city of Tigard
had put on hold the 1/3 interest purchase of the "Young" property due to the
ethics charge of the Wilsonville Mayor. Last week she was cleared by the State
Ethics Board. City attorney is to start the paper work on the transaction in the
next few days.
Raw Water Monitoring Program — Commissioners were informed that a new
contract with Montgomery Watson would be presented to Tigard City Council for
approval on August 24, 1999. The new contract is for a minimum six month
commitment that can be extended on a month by month basis. City of
Wilsonville has been asked to participate in sharing the costs, but no answer has
been received as of yet. Commissioner Penner stated that he had two names for
the review panel for the Raw Water Monitoring program.
Amended Scope of Services contract with MSA is for $140,000. This is to
continue with the pipeline alignment, right-of-way acquisition, endangered
species and the Corp of Engineers 404 permit.
Walnut Island Annexations — Ed Wegner stated that Tigard's Community
Development, Engineering and Public Works department heads are meeting with
USA, Washington County Land Use and Transportation, County Health,
Washington County Sheriff office every two weeks to discuss annexation of the
Island. There will be two open houses, one in September and one in October, to
discuss the issues. A public hearing is slated for November 1999 (no date set).
Commissioner Penner requested that TWD be sent notices about the meetings.
Mr. Wegner asked if Commissioner Rhine lives in the Walnut Island.
Commissioner Rhine stated that he does not. Consensus was that TWD will not
oppose the annexations.
Clute Property — Discussion of the sell of the "excess" property and taking the
. proceeds- to purchase land for a new 550 zone water reservoir ensued.
Commissioner Penner asked if the TWD Representative to the IWB should give
direction to the IWB on what TWD would like to see happen to the property.
Specifically, that the proceeds be used to purchase a portion of the Cach
property for a new 550 zone reservoir. It was the consensus of the Board that
the IWB member make that recommendation at the next IWB meeting.
Rate Study Update — Mike Miller gave a brief history of the current water rates
and the 1996 rate study. Staff has updated a portion of the rate model, but does
need to have CH2M Hill update the model and review the findings.
Low Water Pressure on SW 119th Avenue — Mike Miller discussed the
background and findings of his letter to the homeowners on SW 119th Avenue.

Commissioner Buehner asked about Urban Reserve Area #47. Sorhe of it is
outside of the TWD service area. How will service/annexation be handled? Mike
Miller stated that because the Boundary Commission is no longer in existence,
this is new territory. Staff will have to research what options are available.
Ed Wegner announced that Kevin Hanway has resigned from Tualatin Valley
Water District (TVWD) to pursue an opportunity with Montgomery Watson. The
Oregonian is trying to make an issue of his resignation. In addition to-his regular
duties at TVWD, Mr. Hanway has been the executive director of the Willamette
Water Supply Agency.
The Commissioners then discussed a letter that Commissioner Buehner had
developed. Mr. Wegner stated that the letter can be read into the record at the
August 10, 1999, Tigard City Council meeting, and that the meeting was being
televised live on cable that night. Commissioner Strauss moved to submit the
letter to the Mayor of Tigard and present it to the Tigard City Council on
August 10, 1999. The motion was seconded by Commissioner Buehner.
All members present voting AYE, the motion passed unanimously.
Commissioner Penner asked the Board if they should write to the City Recorder
to find out who contributed to the Citizens for Safe Water campaign.
Commissioner Penner also stated that they could read the list of contributors at a
public meeting. Commissioner Penner also stated that he understood that
approximately 30% of their (Citizens for Safe Water) funding is from outside
Tigard.
Commissioner Penner discussed his latest writing campaign. Commissioner
Penner asked if they should hold a forum to ask Citizens for Safe Water
questions. A general discussion ensued. Commissioners discussed placing an
ad in the Tigard Times to ask Citizens for Safe Water questions — candid
questions about their position. Commissioner Buehner gave an example: "Why
have you (Citizens for Safe Water) led people to believe that Tigard citizens have
been drinking 100% Bull Run water for years?"
Commissioners asked staff if the City of Tigard placed an letter in the voters
pamphlet. Mr. Wegner stated that the City cannot take a position on the issue,
but City Councilors can as individuals. It was also noted that the last day to
submit written arguments on the ballot title had passed.
Commissioner Penner requested comments and or questions about the letter be
submitted to him.
6. Adjournment
The next Tigard Water District Board of Commissioners meeting is scheduled for
Monday, August 30, 1999 at 7:00 PM.
The meeting was adjourned at 8:15 PM.
