APPLICATION SUMMARY FILE NAME: Tigard Distribution Center CASE NO.: Minor Modification(MMD) MMD2020-00004 PROPOSAL: The applicant proposes a minor modification to an existing development at 8005 SW Hunziker Road.Specifically,the applicant proposes to create a new tenant space, with a new storefront entrance. The applicant also proposes minor changes to on- site parking and landscaping,in order to accommodate the new storefront entrance and to comply with the Americans with Disabilities Act(ADA). APPLICANT: Faster Permits Attn: Nathan Arnold 2000 SW First Avenue, Suite 420 Portland, OR 97201 OWNER: Tigard Distribution Center,LLC 4800 SW Macadam Avenue,Suite 120 Portland, OR 97239 LOCATION: 8005 SW Hunziker Road;WCTM 2S101BD,Tax Lot 200 ZONING DESIGNATION: I-L: Light Industrial Zone. The I-L zone provides appropriate locations for general industrial uses including, but not limited to: industrial services, manufacturing and production, research and development, warehousing and freight movement, and wholesale sales activities with few, if any, nuisance characteristics such as noise,glare, odor,or vibration. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.330, 18.410,and 18.765.060.D SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. MMD2020-00004 Tigard Distribution Center 1 SECTION III. BACKGROUND INFORMATION Site Information: The subject property is located at 8001 and 8005 SW Hunziker Road, on the north side of SW Hunziker Road,east of SW Hall Boulevard, and west of SW 72"a Avenue.The development site is made up of one (1) tax lot (WCTM 2S101BD, Tax Lot 200), and contains two (2) industrial buildings, with associated parking and landscaping. The site is zoned Light Industrial (I-L), as are adjacent properties. The site is partially located in the Federal Emergency Management Agency Special Flood Hazard Area;however,the scope of work is located outside these sensitive lands. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.330 Industrial Zone Development Standards: 18.330.040 Development Standards A. Base zone development standards are provided in Table 18.330.1. The applicant proposes to create a new tenant space in the northern portion of an existing industrial building at 8005 SW Hunziker Road.The applicant will create a new storefront entrance on the northern facade of the building,which will include a new canopy,new concrete stairs and a ramp,and new windows and doors.The applicant also proposes to modify the western façade of the building by removing existing stairs and a door,and adding new windows.The proposal also includes minor changes to on-site parking and landscaping,in order to accommodate the new storefront entrance,and for ADA compliance. Staff reviewed the applicant's materials to confirm the proposed new storefront will comply with minimum side and rear setbacks for the I-L Zone (0 feet). The applicant is not proposing any changes to the front setback, or the existing height of the building. The applicant's materials demonstrate that the site will continue to comply with the maximum lot coverage standard (85 percent). Standards for parking and landscaping are addressed in the findings below. These standards are met. B. Landscaping and screening. All required landscaping, including landscaping used to meet screening or tree canopy standards, is subject to the general provisions of Chapter 18.420, Landscaping and Screening. 1. The minimum landscape area standard is provided in Table 18330.1. Landscaping standards are provided in Section 18.420.040.Any landscape area planted to the L-2 standard may count toward meeting the minimum area standard. The applicant proposes to remove and replace on-site landscaping, in order to accommodate a new storefront entrance and ADA site improvements. Staff reviewed the applicant's plans to confirm this proposal will continue to exceed the minimum landscape requirement for the I-L Zone(15 percent),with 15.8 percent provided. The applicant is not proposing to remove any trees as part of this proposal. Additionally, the applicant's plans show the new landscaping will include a combination of trees,plants, or lawn,which complies with the L-1 landscaping standard (Table 18.420.1). This standard is met. E. Pedestrian access. 1. Paths must provide safe and convenient pedestrian access from public sidewalks abutting the site to all required building entrances on the site. A minimum of 1 path is required for every 200 linear feet of street frontage. The site contains an existing pathway that provides a safe and convenient pedestrian access from the public sidewalk on SW Hunziker Road to the existing building on the southern end of the site (8001 SW Hunziker MMD2020-00004 Tigard Distribution Center 2 Road).The applicant is not proposing to modify this southern pathway. This standard is met. 2. Paths must provide safe and convenient pedestrian access within the site between all buildings, uses, and areas designed for use by pedestrians. Paths within parking areas or along drive aisles are subject to additional standards in Subsection 18.410.040.B. The applicant proposes to construct a new storefront entrance on the northern facade of an existing building. The applicant proposes to install ADA-compliant ramps and a pathway extension directly adjacent to this new storefront. The proposed improvements only impact a portion of the overall site. The remainder of the site is legally non-conforming in regard to this standard. Adequate pedestrian access will be provided throughout the proposed improvements, and the remainder of the site will not become further out of conformance with this standard. Therefore, this standard is met. 3. Paths must extend to the perimeter property line to provide access to existing or planned pedestrian facilities on adjacent properties,such as trails or public access easements,where practicable. The site contains an existing pathway from the public sidewalk on SW Hunziker Road to the existing building on the southern end of the site (8001 SW Hunziker Road). The applicant is not proposing to modify this southern pathway.This standard is met. 4. Paths must be constructed with a hard surface material and have a minimum unobstructed width of 5 feet. The applicant's plans illustrate that the proposed pathway extension will be constructed of concrete,and will have an unobstructed width of at least 5 feet. This standard is met. 18.410 Off-Street Parking and Loading) 18.410.070 Vehicle Parking Quantity Standards A. Off-street parking requirements. The ratios for providing minimum and maximum vehicle parking spaces are provided in Table 18.410.3. If application of the maximum parking standard results in less than 6 parking spaces for a development with less than 1,000 square feet of floor area,the development is allowed up to 6 parking spaces.If application of the maximum parking standard results in less than 10 vehicle parking spaces for a development between 1,000 and 2,000 square feet,the development is allowed up to 10 vehicle parking spaces. The development site contains two (2) existing industrial buildings: Building A (8005 SW Hunziker Road), and Building B (8001 SW Hunziker Road). The applicant proposes to create a new tenant space in the northern end of Building A, which will be occupied by a future light industrial use. The southern end of Building A is currently occupied by a warehouse use (Biamp),and Building B is currently occupied by a light industrial use (Performance Contracting, Inc./Charter Mechanical). The applicant proposes to remove two (2) parking spaces, in order to accommodate a new storefront at the northern end of Building A, and for ADA-related site improvements.The table below calculates the minimum off-street parking requirement for the development site,based on requirements in CDC Table 18.410.3: Tenant Space and Size Minimum Parking Total Parking Use Category Requirement Spaces Required Building A (North) —Light 40,050 square 1.6 spaces/1,000 square feet 65 Industrial feet MMD2020-00004 Tigard Distribution Center 3 Building A (South) —Warehouse 41,275 square 0.5 spaces/1,000 square feet 21 feet Building B—Light Industrial 40,140 square 1.6 spaces/1,000 square feet 65 feet TOTAL 151 Staff fords that 151 parking spaces are required for the entire development, taking into consideration the newly-created tenant space discussed above. The applicant's site plan demonstrates that even with the proposed removal of two (2) parking spaces,there will be adequate parking at the development site,with 153 spaces remaining. This standard is met. 18.765 Modifications: 18.765.060 Minor Modifications A. Definition.A minor modification has the following characteristics: 1. It has minimal impacts on surrounding properties,sensitive lands, or public facilities; and The applicant proposes to create a new tenant space and storefront entrance at the northern end of an existing industrial building at 8005 SW Hunziker Road. The applicant also proposes minor changes to on-site parking and landscaping, in order to accommodate the new storefront entrance, and for ADA- related site improvements. As demonstrated in the findings above, the applicant's proposal complies with all applicable development standards for the I-L Zone,as well as the applicable standards for on-site parking and landscaping. Accordingly, staff finds this proposal will have minimal impacts on surrounding properties, sensitive lands, or public facilities, and meets the definition of a minor modification. 2. It does not cause the development to go out of conformance with any applicable standard or further out of conformance if already nonconforming, except where an adjustment has been approved. As demonstrated in the findings above, the applicant's proposal complies with all applicable development standards for the I-L Zone, as well as the applicable standards for on-site parking and landscaping. Accordingly, this proposal does not cause the development to go out of conformance with any applicable standard. D. Approval criteria. The approval authority will approve or approve with conditions a minor modification application when all of the following criteria are met: 1. The proposed modification qualifies as a minor modification as defined in Subsection 18.765.060.A; As demonstrated in the findings above, this proposal qualifies as a minor modification as defined in CDC 18.765.060.A.This criterion is met. 2. If the proposal involves the modification of a condition of approval, at least one of the following criteria is met: a. The condition cannot be implemented for reasons outside the control of the applicant or property owner; b. The condition is no longer needed or warranted because circumstances have changed; or c. A new or modified condition better accomplishes the purpose of the original condition. The applicant is not proposing to modify a condition of approval.This criterion does not apply. MMD2020-00004 Tigard Distribution Center 4 CONCLUSION: This proposal qualifies as a minor modification to an existing development, as defined in CDC 18.765.060.A, and is in compliance with all applicable standards of this Title. It is approximately 6.4 acres. The site has (2) buildings, Building A at the north and Building B at the south. We are proposing to add a 1,552 sft. tenant office at the north end of Building A, within the existing building walls. The site changes as a result of the tenant improvement include revising (2) landscape islands, deleting (4) parking spaces to create a new office entrance at the north side of the building. The site changes will include adding 55-feet of sidewalk and ramp, adding stairs to the new office entry and reconfiguring the parking lot landscape islands and adding (2) ADA accessible parking spaces near the office entry. Our proposed changes to the exterior of Building A will include the addition of (3) storefront openings and a new 12 x 14 overhead door at the north wall and the infill of an existing mandoor and the addition of (2) windows at the west wall. We proposed to add a canopy at the north and west walls over the storefront, windows and entry to match the existing canopies at the west wall of Building A. PROPOSED USES: This project consists of two large existing industrial multi-tenant buildings (A and B). Building B is currently occupied by an industrial user (storage and office). The proposed addition of the Tenant space at the north end will allow the building to be used as a 2-tenant building. The north half of Building A is currently vacant, awaiting the buildout of the proposed office space. The south half of Building A is currently occupied by a warehouse tenant. SITE CONDITION: The subject property is currently zoned I-L (Light Industrial) and is occupied by two industrial buildings. The site is surrounded by I-L zones at the east, west and south. Hwy 217 is to the north of the site. The property north of Hwy 217 is zoned C-G. VEHICLE ACCESS: Vehicle access is accommodated off of SW Hunziker Road through an existing 50.0' wide common driveway and a common access easement located on the adjacent lot to the west. This driveway/access aisle also serves the existing building to the west. There is no work planned for the existing driveway as part of this project. TREE REMOVAL: No trees are proposed to be removed with this proposal. The changes to the parking lot landscape islands will involve only removal and relocation of shrubs and ground cover. A temporary trench is proposed in the vegetated corridor to install the new sanitary line from the new office at the NE corner of the building to the public sanitary line located west of the site. The existing manhole in the public line is located in the vegetated corridor (not in the wetland). There will be minimal disturbance of the vegetated corridor and the disturbed trench area will be replanted with upland plantings after the trench has been backfilled. UTILITIES: All existing utilities are to remain. The only new utilities are noted below. 1. Sanitary: A new sanitary line will be required to serve the new office space at the north end of Building A. This new 4" dia. sanitary line will run west from the north end of the building to the public sanitary line located west of the site. COMPLIANCE WITH CITY CODE SECTIONS: The following will address the code sections that apply to the proposed work for this project. Please note the following: CHAPTER 18: Section 18.410: Off-Street Parking and Loading Parking along the North side of the building is being modified to add Accessible parking spaces. This will require removal of four spaces and the relocation of one landscape island. Two new Accessible parking spaces will be added for a total decrease in parking on the site of two vehicle parking spaces. RESPONSE: The required number of spaces for the site is 134 spaces per SDR 2011-00002. The existing number of parking spaces on the site currently is 155 spaces. This proposal will reduce the parking spaces to 153 spaces, well above the required 134 spaces. Section 18.765.060 Minor Modifications: A. Definition. A minor modification has the following characteristics: 1. It has minimal impacts on surrounding properties, sensitive lands or public facilities; RESPONSE: This proposal has no impact on the surrounding properties. The impact to the sensitive lands will be minimal since the existing Vegetated Corridor will just be disturbed during construction and will be replanted at completion. The public facilities will only be impacted with a new sanitary connection to the existing public sanitary line at the existing manhole. 2. It does not cause the development to go out of conformance with any applicable standard or further out of conformance if already nonconforming, except where and adjustment has been approved. RESPONSE: This proposal meets the current standards. There are no known approved adjustments for this site. B. Examples: 4.
