CONDITION OF APPROVAL
THE FOLLOWING CONDITION MUST BE SATISFIED:

1. Prior to building permit submittal,the applicant must apply for, and receive,a new address for
each proposed tenant space. If the applicant is unfamiliar with addressing process, the applicant
should contact the project planner for more information.
SECTION III. BACKGROUND INFORMATION
Site Information:
The subject site is located at 16505 72nd Avenue (WCTM 2S113AB,Tax Lot 01201),which is located in
the Industrial Park (I-P) zone.All adjacent properties to the north,west, and south are located in the I-P
zone,and properties to the east are located in the Light Industrial(I-L) zone.The site is not located within
any sensitive lands or any other overlay zones.
The site obtained approval for a minor modification in 2015 to update the onsite landscaping in order to
prepare for a new tenant,the Oregon State Treasury (MMD2015-00031).The site obtained approval for
a minor modification in 2017 which included the addition of 1,412 square feet of landscaping
(MMD2017-00042).
Proposal:
The applicant is proposing to convert one vacant tenant space at 16505 SW 72nd Avenue into two tenant
spaces for future businesses. Specifically, the applicant is proposing to: (1) add a building entrance where
windows currently exist to serve the proposed new tenant space in PBC196/Building F,and(2) remove 77
square feet of landscaping for the new tenant space's entry walkway. No changes to the building footprint
or site improvements,such as parking areas and access,are proposed.
The applicant has been informed that this minor modification approval does not consider the future
occupancy of the proposed new tenant spaces. All prospective tenants are expected to call the City of
Tigard to confirm that the business is allowed in the zone and that no land use approval is required prior
to occupying the tenant space.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
Findings for only the applicable code sections arc found below:
18.765 Modifications
18.765.020 Applicability
B. This chapter also applies to all proposals to modify an existing development that was not
subject to city approval when developed but would be subject to city approval, through one
of the land use applications listed in Paragraph 18.765.020.A.1 through 4, if proposed for
development under current city regulations.
FINDING: The existing development was not subject to city approval when developed. The applicant is
proposing to modify an existing development that would have required Site Development Review(SDR)

approval.Therefore,the proposal is subject to land use review through the Modification process.
18.765.060 Minor Modifications
D. Approval criteria. The approval authority will approve or approve with conditions a minor
modification application when all of the following criteria are met:
1. The proposed modification qualifies as a minor modification as defined in Subsection
18.765.060.A;
FINDING: The applicant is proposing to remove 77 square feet of landscaping south of the primary
building in order to install a new walkway to a new building entrance.No other changes to the site or the
building are proposed.The proposed modification qualifies as a minor modification as defined in Subsection
18.765.060.A,as discussed below:
A. Definition.A minor modification has the following characteristics:
1. It has minimal impacts on surrounding properties, sensitive lands, or public
facilities; and
FINDING: The applicant is proposing to remove 77 square feet of landscaping in order to install a new
walkway entrance for the new tenant. The removed landscaping will not be visible from any public
sidewalks and no sensitive lands exist on the site.Therefore,the applicant's proposal to remove 77 square
feet of landscaping has minimal impacts on surrounding properties, sensitive lands, or public facilities.
This criterion is met.
2. It does not cause the development to go out of conformance with any applicable
standard or further out of conformance if already nonconforming, except where
an adjustment has been approved.
FINDING: The applicant's proposal to remove 77 square feet of landscaping does not cause the
development to go out of conformance with any applicable standard, as described in the following
section.This criterion is met.
18.330 Industrial Zone Development Standards
18.330.040.Development Standards
B. Landscaping and screening. All required landscaping, including landscaping used to meet
screening or tree canopy standards, is subject to the general provisions of Chapter 18.420,
Landscaping and Screening.
1. The minimum landscape area standard is provided in Table 18.330.1.
Landscaping standards are provided in Section 18.420.040. Any landscape area
planted to the L-2 standard may count toward meeting the minimum area
standard.
FINDING:The proposed landscaping that will be removed is not required for screening.No trees are
proposed to be removed onsite.The applicant has stated that only 77 square feet of a grass lawn will be
removed for the new entrance walkway.The minimum landscape area standard for nonresidential
development in the Industrial Park(I-P) Zone is 25%.The 267,023 square foot site currently contains
67,837 square feet of landscaping.After the it,noval of 77 square feet of landscaping for the proposed new
walkway,there will be 67,760 square feet of landscaping,which is 25.38%of the site.This exceeds the
minimum standard for non-residential development in the I-P Zone.This standard is met.

E. Pedestrian access.
4. Paths must be constructed with a hard surface material and have a minimum
unobstructed width of 5 feet. (Ord. 18-28 §1)
FINDING: The proposed new walkway will be made of concrete and have a minimum unobstructed
width of 5 feet.This standard is met.
CONCLUSION: The proposal is a minor modification to an existing development and is in
compliance with the applicable requirements of this Tide.
SECTION V. PROCEDURE AND APPEAL INFORMATION
Final Decision:
A minor modification is a Type I procedure.As such,this decision is final for purposes of appeal on the
date it is mailed or otherwise provided to the applicant, whichever occurs first. This decision is not
appealable locally and is the final decision of the City.
THIS DECISION IS FINAL ON NOVEMBER 6TH, 2019,
AND BECOMES EFFECTIVE ON NOVEMBER 71'", 2019.

property deed is Peter Bechen. A letter signed by Peter Bechen was also provided at
intake and it states that Ryan McGuire, among many others, is authorized to sign on
behalf of PacTrust(Owner). I'm not sure where N. Piven came from because her
name was not written on any of the documents that were provided.
2. Revised Narrative
• Please respond to CDC 18.330.040.B.1 and CDC 18.330.040.E.4 that is attached to
this letter— This park has previously performed a site development review and was
shown to comply with subsection 18.330.040.D allowing the reduction of landscape
area from 25% to 20% according to landscape area exception #2 on table 18.330.1.
Parking has not been affected by this alteration. The path being constructed is
minimum of 5 ft. wide and made of concrete. See attached plan.

The proposal is to remove 40sf of landscaping, therefore we need to ensure that the
site still meets the minimum landscaping coverage of 25%
