APPLICATION SUMMARY FILE NAME: TIGARD ANIMAL HOSPITAL CASE NO.: MINOR MODIFICATION(MMD) MMD2020-00006 PROPOSAL: The applicant is proposing exterior building facade modifications at 15294 SW Royalty Parkway. Specifically, the applicant proposes to replace a street-facing window with two glass doors,remove an existing glass door and fill in to match the facade,and convert an existing solid steel door into a glass door.The Tigard Animal Hospital (office use) will be moving into this tenant space which was last occupied by the OHSU Medical Clinic (office use). No changes to the parking, access, or landscaping are proposed. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request, subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. CONDITIONS OF APPROVAL PRIOR TO BUILDING PERMIT SUBMITTAL THE FOLLOWING CONDITION MUST BE SATISFIED: Unless noted otherwise, the staff contact is Samuel Copelan, Assistant Planner, (503) 718-2450 or SamuelC@tgard-or.gov. 1. Prior to building permit submittal,the applicant must submit for,and receive,a new address to reactivate 15294 SW Royalty Parkway in our system. SECTION III. BACKGROUND INFORMATION Site Information: The subject site is located at 15294 SW Royalty Parkway and is located on a 1.16-acre tax lot (WCTM 2SI10DB,Tax Lot 01300)in the General Commercial(C-G) zone.The subject site is located both south and east of SW Royalty Parkway, west of SW Naeve Street, and north of SW Summerfield Drive. Tax lots to the north, south, and west are located in the C-G zone, and tax lots to the east are located in the Medium-High-Density zone (R-25).The subject site contains one commercial building with three tenant spaces, There are no sensitive lands, special overlay districts, or plan district overlays on this taxlot. The subject site was developed for the OHSU Medical Clinic in 1995 (SDR95-00023), which was an office use as defined by the current version of the CDC.A site plan from the 1995 decision indicates that OHSU Medical clinic occupied the entire building.At the time of this land use submittal,the only active address for the building was 15290 SW Royalty Parkway. A floor plan from 2018 (BUP2018-00020) indicated that the building had three tenant spaces; the tenants in both 15290 and 15298 SW Royalty Parkway were office uses and the space at 15294 was vacant.The applicant has been notified to reactivate the address at 15294 SW Royalty Parkway prior to building permit submittal. Proposal: The applicant is proposing exterior building facade modifications at 15294 SW Royalty Parkway. Specifically, the applicant proposes to replace a street-facing window with two glass doors,remove an existing glass door and fill in to match the facade, and convert an existing solid steel door into a glass door. No change of use is required because the Tigard Animal Hospital (office use)will be moving into this tenant space which was last occupied by the OHSU Medical Clinic (office use). No changes to the parking, access, or landscaping are proposed. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Findings for only the applicable code sections are found below: 18.765 Modifications 18.765.020 Applicability B. This chapter also applies to all proposals to modify an existing development that was not subject to city approval when developed but would be subject to city approval, through one MMD2020-00006 TIGARD ANIMAL HOSPITAL 2 of 4 of the land use applications listed in Paragraph 18.765.020.A.1 through 4, if proposed for development under current city regulations. FINDING: The subject site was developed with a Site Development Review in 1995 (SDR95-00023). Therefore, the proposed modification to the existing development is subject to the standards of this chapter. This criterion is met. 18.765.060 Minor Modifications D. Approval criteria. The approval authority will approve or approve with conditions a minor modification application when all of the following criteria are met: 1. The proposed modification qualifies as a minor modification as defined in Subsection 18.765.060.A; FINDING: The proposed modification qualifies as a minor modification as described in Subsection 18.765.060.A below. A. Definition. A minor modification has the following characteristics: 1. It has minimal impacts on surrounding properties, sensitive lands, or public facilities; and FINDING: The subject site is located at 15294 SW Royalty Parkway and is located on a 1.16-acre tax lot (WCTM 2S110DB, Tax Lot 01300) in the General Commercial (C-G) zone. The applicant's proposed modifications will have minimal impacts on surrounding properties, sensitive lands, or public facilities. This standard is met. 2. It does not cause the development to go out of conformance with any applicable standard or further out of conformance if already nonconforming, except where an adjustment has been approved. FINDING:The applicant is not proposing any changes to the landscaping,parking area,access,or building height.Staff has reviewed all proposed building facade and use changes in order to confine that the applicant will not take the building or the tax lot further out of conformance with any applicable standard.After review, the applicant's proposed modifications will not cause the development to go out of conformance with any applicable standard or further out of conformance if already nonconforming.This criterion is met. 18.320.040 Commercial Zone Development Standards 18.320.050 Design Standards A. Entrances. 1. A minimum of one entrance per building, or tenant space within a building without internal building access, must be visible and accessible from a public street. Additional entrances may face drive aisles,parking areas, or service areas. FINDING: The proposed entrance is visible and accessible from SW Royalty Parkway,which is a public street. This standard is met. 2. A required building entrance must be at an angle that is no more than 45 degrees from the street that it faces. MMD2020-00006 TIGARD ANIMAL HOSPITAL 3 of 4 FINDING:The proposed entrance is parallel to SW Royalty Parkway,which is at an angle no more than 45 degrees from the street that it faces. This standard is met. 3. A required building entrance must be covered, recessed, or treated with a permanent architectural feature that provides weather protection for pedestrians. The required weather protection must be at least as wide as the entrance, a maximum of 6 feet above the top of the entrance, and a minimum of 3 feet in depth. The required weather protection may project into the minimum front setback. FINDING: The applicant's submittal demonstrates that the proposed entrance will be located underneath an existing awning that has a minimum depth of three feet. The lowest part of the existing awning will be located no more than two feet above the top of the proposed door. The existing awning is 14 feet wide and the proposed doors underneath the awning will be six feet wide.This standard is met. B. Windows. Buildings or tenant spaces designed for ground floor use by Eating and Drinking Establishments,Sales-Oriented Retail,Repair-Oriented Retail, Personal Services,and Office uses must include a minimum of 50 percent window area on all ground floor street-facing facades. (Ord. 18-28 §1) FINDING: The multi-tenant building located on WCTM 2S110DB Tax Lot 01300 is currently nonconforming with the window standard;the window area makes up only 22.7 percent of the west facade that faces SW Royalty Parkway. The applicant proposes to replace a street-facing window with two glass doors, remove an existing glass door and fill in to match the facade, and convert an existing solid steel door into a glass door. After all proposed modifications, there will be a window area net increase of 12 square feet. The current window area is at 22.7 percent and the proposed window area will be at 23.2 percent, which brings the existing structure closer to conformance with the 50 percent window area requirement. This standard is met. CONCLUSION: The proposal meets all applicable standards. SECTION V. PROCEDURE AND APPEAL INFORMATION Final Decision: A minor modification is a Type I procedure.As such,this decision is final for purposes of appeal on the date it is mailed or otherwise provided to the applicant, whichever occurs first. The proposed space is classified as office space from previous occupation by Legacy Health. The new tenant is proposing to put new office space by way of Tigard Animal Hospital. This will have minimal impact to the surrounding area, as the space was previously a medical office. We are proposing to change from human to veterinary medicine. The proposed changes will conform with the existing design standards. We are only proposing one exterior elevation change. Removing the current main entrance door which is off to the side and replacing it with a larger all glass entry door in the center of the proposed entry area. The new door will already be covered by an existing metal awning that covers the walkway for a minimum 36"depth and a width of approximately 13'-6". The awning is 8'-6"off of the walkway at its lowest point. The new door is facing the street completely. The new door will only moderately change the window coverage percentage, but our calculations show that we are still within 53% of street faced frontage. There will be no changes to the north side of the building. This use is classified in Code Section 18.42(Use Classifications)as Medical and Dental Services. Code section 18.62.030 allows Medical and Dental Services as a permitted use in the C-G zone. Minimum Lot Area: Section 18.62.050 states that the minimum lot width shall be 50 feet for parcels in the C-G zoning district There is no minimum lot size requirement The site has an average lot width of 180 feet, exceeding the minimum lot width standard. Developments within the C-G zone are required to provide a minimum of 15% landscaping.
