APPLICATION SUMMARY FILE NAME: ADAMS CARPET AND UPHOLSTERY CLEANING CASE NO.: Home Occupation Permit HOP2019-00035 REQUEST: The applicant requests a Type II Home Occupation Permit for a carpet, upholstery, and tile cleaning business. A majority of the business will be conducted off site, in clients' homes or businesses. However,the applicant proposes to have a maximum of five (5)customers visit the premises in a six (6)month period. Customer visits will only occur between the hours of 9 a.m. to 4 p.m. The applicant also proposes to have one (1) outside employee who is not a member of the household visit the premises. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request, subject to a condition of approval.The findings and conclusions on which this decision is based are noted in Section V of this decision. NOTICE OF DECISION PAGE 1 OF 6 HOP2019-00035 ADAMS CARPET AND UPHOLSTERY CLEANING CONDITION OF APPROVAL THE FOLLOWING CONDITION MUST BE SATISFIED: Unless noted otherwise,the staff contact is Lina Smith,Assistant Planner; (503) 718-2438 or LinaCS@tigard- or.gov. 1. With the exception of parking and access, all on-site activities related to this home occupation must be operated entirely indoors,within the existing house and attached garage. SECTION III. BACKGROUND INFORMATION Site Information and Proposal Description: The 0.58-acre site is located at 15900 SW Stratford Loop,north of Tigard High School and SW Durham Road,east of SW Alderbrook Drive,and west of SW 88th Avenue. City records indicate the property was originally approved as Lot 58 of the Stratford Subdivision in 1977. The property is currently occupied by an existing single detached house,with an attached garage,paved driveway, and associated landscaping. According to the Washington County Assessment and Taxation Report, the existing dwelling measures 1,469 square feet in size,and the attached garage measures 492 square feet in size. The property is zoned Low-Density Residential (R-4.5), as are surrounding properties. In 1996,the applicant obtained a Type I Home Occupation Permit for a carpet,upholstery,and tile cleaning business at this location (Case No. HOP96-0046). The applicant is now applying for a Type II Home Occupation Permit,in order to continue the carpet,upholstery, and tile cleaning business,and to also have customers and one (1) outside employee visit the premises. SECTION IV. COMMENTS FROM PROPERTY OWNERS WITHIN 500 FEET The Community Development Code of the City of Tigard requires that all property owners of record within 500 feet of the subject site be notified of the proposal, and be given an opportunity to submit written comments prior to issuance of the decision. Staff mailed notices of this Type II application to affected parties on November 18, 2019. Staff received six (6) letters from neighbors regarding this application: two (2) neighbors supported the application, two (2) neighbors opposed the application, one (1) neighbor stated she had no objection to the application,and one (1) neighbor requested more information about the application. The neighbors who opposed this application expressed multiple concerns, including concerns about on-street parking, and the number of deliveries, employees,and customers associated with this home occupation.The full text of letters from neighbors can be viewed in the land use case file (Case No. HOP2019-00035). RESPONSE: As demonstrated through the findings in this administrative decision, the applicant's proposal complies with all applicable standards in Chapter 18.760 Home Occupations, or can be made to comply through the imposition of a condition of approval. SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.760 Home Occupations 18.760.040 Approval Criteria The approval authority will approve or approve with conditions a home occupation application when all of the applicable general provisions in Section 18.760.050 and approval standards in Section 18.760.060 are NOTICE OF DECISION PAGE 2 OF 6 HOP2019-00035 ADAMS CARPET AND UPHOLSTERY CLEANING met. 18.760.050 General Provisions All home occupations except legal nonconforming home occupations must comply with all of the following in addition to the standards for Type I and Type II home occupations provided in Section 18.760.050. A. Home occupations may be undertaken only by a principal occupant of a dwelling unit. The applicants are the property owners and the principal occupants of the dwelling unit in which the home occupation is proposed to take place. This standard is met. B. Deliveries to the residence by suppliers are limited to 3 per week. The applicant's narrative states there will be a maximum of two (2) deliveries per week to the residence by suppliers that are directly associated with this home occupation. This standard is met. C. The home occupation must comply with all provisions of Title 6 of the Tigard Municipal Code. The applicant's proposal is for a Type II Home Occupation that staff has conditioned to be operated entirely within the existing house and attached garage. As conditioned,it is not anticipated that this home occupation will violate any provisions in Title 6 Nuisance Violations of the Tigard Municipal Code. Additionally, the applicant's narrative states that this proposal will comply with all provisions of Title 6.Any violations to the provisions in Title 6 will be subject to Code Enforcement regulations, and will result in the home occupation approval being revoked. This standard is met. D. The home occupation must be operated entirely within the dwelling unit or a conforming accessory structure. The maximum square footage used for the home occupation and associated storage of materials and products is 25 percent of the combined residence and accessory structure floor area or 528 feet, whichever is smaller. All indoor storage of materials or products must meet the provisions of the building, fire, health, and housing codes. The property is currently occupied by an existing single detached house with an attached garage. According to the Washington County Assessment and Taxation Report, the existing house measures 1,469 square feet in size, and the attached garage measures 492 square feet in size;therefore the combined residence and accessory structure floor area is 1,961 square feet.The applicant proposes to utilize 450 square feet of this floor area for the home occupation and associated storage of materials and products. Accordingly, this proposal does not exceed the floor area maximums stated above (528 square feet, or 25 percent of the combined residence and accessory structure floor area). Additionally, staff has included a condition of approval that requires all on-site activities related to the home occupation (with the exception of parking and access) to be operated entirely indoors,within the existing house and attached garage.This standard is met. E. A home occupation may not necessitate a change in the state building code use classification of a dwelling unit. Any accessory building that is used must meet building code requirements. The applicant is not proposing to change the State Building Code use classification of the existing dwelling unit. The home occupation will be operated entirely within the existing house and attached garage.This standard is met. F. A dwelling unit may have more than one home occupation,provided that the combined floor space used for the home occupations does not exceed the square footage limitation imposed in Paragraph 18.760.040.A.4. Each home occupation must apply for a separate home occupation permit, if NOTICE OF DECISION PAGE 3 OP 6 HOP2019-00035 ADAMS CARPET AND UPHOLSTERY CLEANING required by this chapter. In 1996,the applicant obtained a Type I Home Occupation Permit for a carpet,upholstery,and tile cleaning business at this location (Case No. HOP96-0046). The applicant is now applying for a Type II Home Occupation Permit,in order to continue the carpet, upholstery, and tile cleaning business, and to also have customers and one (1) outside employee visit the premises. Both home occupations, and associated storage of materials and products, will be contained within the same 450 square feet of the existing house and attached garage, and do not exceed the space limitations in CDC 18.760.050.D. This standard is met. G. The following activities are prohibited as part of a home occupation: 1. Storage or distribution of toxic, flammable, or explosive materials, and 2. Spray painting or spray finishing operations that involve toxic or flammable materials that in the judgment of the fire marshal pose a dangerous risk to the residence, its occupants, or surrounding properties. The applicant's narrative states there will be no storage or distribution of toxic, flammable, or explosive materials as part of this home occupation. Additionally, the applicant is not proposing any spray painting or spray finishing operations as part of this home occupation. This standard is met. H. Additional parking is not required for home occupations. The applicant is not required to provide additional parking for this home occupation. This standard is met. I. The following activities are not allowed as home occupations: 1. Motor vehicle repair and painting; 2. Mechanical repair conducted outside of an entirely-enclosed building; 3. Junk and salvage operations; and 4. Storage or sale of fireworks. The applicant's proposal for a home occupation does not involve any of the activities listed above. This standard is met. J. Exterior storage of commercial vehicles, as defined in the Oregon Vehicle Code, is prohibited, except that 1 commercially licensed vehicle of not more than 0.75 ton gross vehicle weight (GVW) may be parked outside of a structure. The applicant's narrative states there are two (2) business vehicles that are used for the home occupation. Staff conducted a site visit to the subject property, and reviewed photographs of these vehicles, to confirm they do not meet the Oregon Vehicle Code definitions for a "commercial motor vehicle" or a "commercial vehicle," and that these vehicles are not commercially licensed. Accordingly, staff finds the applicant's proposal complies with the vehicles standard outlined above. This standard is met. 18.760.060 Approval Standards B. Type II home occupations. Type II home occupations must comply with the following: 1. One non-illuminated sign not exceeding 1.5 square feet is allowed. The sign may be attached to the residence or an accessory structure, or be placed in a window; The applicant is not proposing any signs related to this home occupation. This standard does not apply. 2. Only 1 outside volunteer or employee who is not a member of the household is allowed on NOTICE OF DECISION PAGE 4 OF 6 HOP2019-00035 ADAMS CARPET ANI)UPI IOLSFERY CLEANING the premises; The applicant proposes to have one (1) outside employee who is not a member of the household visit the premises. This standard is met. 3. Type II home occupations are not allowed on lots with cottage cluster, courtyard unit, or quad development, or on a lot with more than one accessory dwelling unit. The subject property is occupied by an existing single detached house, and is not occupied by a cottage cluster, courtyard unit,or quad development.Additionally,the property does not contain any accessory dwelling units. This standard is met. 4. Up to 6 daily customers or clients are allowed. Customers and clients are prohibited from visiting the business between the hours of 10 p.m. and 8 a.m.; and The applicant proposes to have a maximum of five (5) customers visit the premises in a six (6) month period. The applicant states that customer visits will only occur between the hours of 9 a.m. to 4 p.m. This standard is met. 5. Storage areas for materials, goods, and equipment must be screened entirely from view by a solid fence. Storage must not exceed 5 percent of the total lot area and is prohibited within front or side setbacks. The applicant is not proposing any outdoor storage of materials,goods, or equipment.This standard does not apply. SECTION VI. I too have a business permit for my home-based business, and live a few doors down from the Adams. Your letter stated that comments were to be limited to the nature of the application and applicable rules, all of which looks great. But there is another reason I am noting my support: Home based businesses encourage residents to be in the neighborhood during the day. This is extremely important given the amount of non-resident foot traffic that moves through our streets on a daily basis, basically due to students leaving Tigard High School campus throughout the day, and parents who flood our streets in the morning and afternoon to drop off and pick up their kids. Crime,vandalism, and trash are common problems we face, and it helps significantly when residents are home during the day, discouraging further abuse of our neighborhood. I know this reason for support is not part of Tigard approval criteria, but I think considerations to the livability of a neighborhood include the neighborhood benefits of residents working at home - not just benefits to the home business owner. I am happy to see more neighbors choosing this option as it benefits the neighborhood as well. You have my permission to share this note with the Adams. I've been neighbors with Alec and Julie Adams for that entire time,as their home is at 15900 SW Stratford Loop. While we have had disagreements in the past as neighbors(mostly about the fences), I was surprised that there was any controversy about their carpet-cleaning business being based out of their home. I walk my dogs every night past their home and will sometimes see them working in their garage. They aren't loud and the runoff from their carpet cleaning projects doesn't seem to go anywhere other than the sewer. They keep their home maintained appropriately and (now that their teenagers are gone) are generally very quiet as neighbors. There are a number of construction contractors who live in the neighborhood and will park their vehicles in their driveways and along the street. While Julie and Alec may have more vehicles than the other construction businesses, they aren't any more disruptive and contain their vehicles to the area on or immediately adjacent to their property. A number of the vehicles are their personal vehicles/boats/etc. I'm kind of at a loss as to why, after my living next to them for the last 16 and a half years this is the first time we've received a letter like this. They are far from the most obnoxious household in the neighborhood. The neighbor about six houses down who has late night games involving a glass-topped table and dice is a lot louder in the summer. The neighbor between me and the street who has shrieking children bouncing on a trampoline all weekend for approximately 28 hours/day is a lot more obnoxious. I suspect, having talked with other neighbors of mine,that one of the newer residents is venting his personal dislike of Alec,Julie, and their son by way of an attack on their business. I think that's unfair, petty, and mean-spirited. t I strongly encourage the planning division and city to renew their permit to operate their business. It left out and understated a number of facts. IE: number of employees,(up to 5), number of trucks(2), Hours of operation, ( up to 11pm in summer),equipment operation area and parking of trucks in driveway. This business has NOT been a good Neighbor. We would like to respond. Neighbor Ann Fackler: This neighbor does not live "right behind" us. In fact, she lives 2 streets away. She also states "the owners of that property wants to make a business out of their home...", when in fact we have been running our home business from the above location for over 23 years. Her biggest concern seems to be traffic congestion due to the students and parents of Tigard High School. That in no way should effect our situation since our business is completed in the personal homes of our clients, thus we do not create any traffic issues. Neighbor Jo Arkane: Many of her concerns were already addressed in the application explanation that we filled out. We will try to clarify some of her bullet points. *The mechanical repairs we believe she is referring to was when our son lived and worked with us. He was doing mechanical repairs on his personal autos. He has since moved out of our home and has moved on professional. All mechanical repairs done on business vehicles is completed at an off-site auto mechanic facility. *Deliveries & employees & hours: already addressed. We are a small family owned business. 99% of our work is not on site, it is in customer's person homes or business. My small business can not afford to move out of my low overhead storage & parking site. • There are NO toxic materials stored in garage or on premises. All the product we use are harmless to the environment, persons, pets. My "home" products, ie bleach and comet, are the most toxic products I have on premises. * No illegal parking of employee. The parking is done in driveway or if on the street in front of our home with a Parking Permit in use. We keep both work vans in drive way or our RV space . Personal vehicles are never used professionally. Our work vans are of "normal" size and weigh. Our work vans are smaller in size and weight that the neighbor across the street that was allowed to park his "semi or oversized" trucks in his driveway. * Use of our driveway is used to park our business vehicles and our personal vehicles. We never block the side walk. If during the hot summer days we might only clean a very few rugs where we might leave them on the drive way to dry for the day. 99% of all rug cleaning is done in our garage when we bring them back to shop otherwise we clean area rugs in our client's homes. When the van mounted equipment that is in use to clean the area rugs, it is no louder than gas leaf blower, a gas lawn mower, a gas power washer. Alec uses his leaf blower and mows the lawn more than he cleans rugs on site. I have attached pictures so you can see where our business and personal vehicles are parked and you can see they are all below the weight restrictions. Please cease and desist operating a business at your residential property or obtain the appropriate license and permit and adhere to conditions of approval. We have not yet verified these violations nor have we assessed any penalties. If you can confirm that no violation exists or if you correct it voluntarily within 20 days as discussed below. we will not assess penalties and there will be no court record. Each violation described above constitutes a Class One Civil Infraction under the code and is subject to a penalty of up to $250 per day per violation and/or abatement by the city at the property owner's expense. Exterior storage of materials. 18.760.040 Approval Standards C. Type II home occupations. Type II home occupations shall comply with the following: 1. One non-illuminated sign not exceeding 1.5 square feet may be permitted. The sign may be attached to the residence, an accessory structure, or placed in a window; 2. No more than 1 outside volunteer or employee who is not a principal resident of the premises; 3. No more than 6 daily customers or clients. Customers and clients may not visit the business between the hours of 10 p.m. and 8 a.m. and shall not generate excessive traffic or monopolize on-street parking; and 4. Storage of materials, goods, and equipment that is screened entirely from view by a solid fence. Storage shall not exceed 5 percent of the total lot area and shall not occur within the front yard or the required side yard setback. Inoperable or partially dismantled automobiles, trucks, bus, trailers or other vehicle equipment or parts thereof in a state of disrepair, for more than 10 days as to any one automobile, truck, bus, trailer or piece of vehicular equipment. 18.110.030 Uses A. Types of uses. For the purposes of this chapter, there are four kinds of use: 1. A permitted (P) use is a use that is permitted outright, but subject to all of the applicable provisions of this title. If a use is not listed as a permitted use, it may be held to be a similar unlisted use as provided in Chapter 18.60, Use Categories. 2. A restricted (R) use is permitted outright providing it is in compliance with special requirements, exceptions, or restrictions. 3. A conditional use (C) is a use the approval of which is discretionary with the hearings officer. The approval process and criteria are provided in Chapter 18.740, Conditional Use. If a use is not listed as a conditional use, it may be held to be a similar unlisted use as provided in Chapter 18.60, Use Categories. 4. A prohibited (N) use is a use that is not permitted under any circumstance. B. Use table. Hobbies that do not result in payment to those engaged in such activity; 4. Proven nonconforming home occupations as provided in Section 18.760.070. The approval authority may impose conditions upon the approval of a Type II home occupation permit to ensure compliance with the requirements of this chapter. These conditions may include, but are not limited to, the following: 1. Further limiting the hours, days, place, and manner of operation; 2. Requiring site and building design features that minimize environmental impacts such as noise, vibration, air pollution, glare, odor, and dust; 3. Requiring additional building setbacks, or increased lot area, depth, or width; 4. Further limiting the building area and outdoor storage used by the home occupation and restricting the location of the use on the site in relationship to adjoining uses; 5. Designating the size, number, location, and design of vehicle access points; 6. Requiring street right-of-way to be free at all times of vehicles associated with the home occupation; 7. Requiring landscaping, buffering, or screening, of the home occupation from adjoining uses and establishing standards for the continued maintenance of these improvements; 8. Requiring storm drainage improvements and surfacing of parking and loading areas; 9. Limiting the extent and type of interior or exterior building remodeling necessary to accommodate the home occupation; 10. Limiting or setting standards for the location and intensity of outdoor lighting; 11. Requiring and designating the size, height, and location of fences and materials used for their construction; 12. Requiring the protection and preservation of existing trees, and other vegetation, watercourses, slopes, wildlife habitat areas, and drainage areas; 13. Limiting the type and number of vehicles or equipment to be parked or stored on the site; and 14.Any other limitations that the approval authority considers to be necessary or desirable to make the use comply with the purposes stated in Sections 18.320.040 and 18.760.040. (Ord. 17-22 §2) 18.760.060 Revocation and Expiration of Home Occupation Permits A. Grounds for revocation. Revoke a home occupation approval if the conditions of approval have not been or are not being complied with and the home occupation is otherwise being conducted in a manner contrary to this chapter. 2. The director shall approve the use as it exists, revoke the home occupation permit, or compel measures to be taken to ensure compatibility with the neighborhood and conformance with this chapter after reviewing a complaint. Complaints may be originated by the City of Tigard or the public. Complaints from the public shall clearly state the objection to the home occupation, such as: a. Generation of excessive traffic; b. Exclusive use of on-street parking spaces; and c. Other offensive activities not compatible with a residential neighborhood. B. Cessation of home occupation pending review. If it is determined by the director in exercise of reasonable discretion, that the home occupation in question will affect public health and safety, the use may be ordered to cease pending hearings officer review or exhaustion of all appeals. C. Waiting period for re-application. When a home occupation permit has been revoked due to violation of these standards, a minimum period of 1 year shall elapse before another application for a home occupation on the subject parcel will be considered. D. Invalidation of permit. A home occupation permit shall become invalid if the applicant moves his or her residence. (Ord. 17-22 §2) 18.760.040 Approval Standards (General Standards For Home Occupations) A. General. All home occupations except those that have proven nonconforming status shall comply with all of the following in addition to the standards for Type I and Type II home occupations provided in Subsections 18.760.040.B and C. 1. Home occupations may be undertaken only by the principal occupant(s) of a dwelling unit. 2. There shall be no more than 3 deliveries per week to the residence by suppliers. 3. There shall be no offensive noise, vibration, smoke, dust, odors, heat, or glare noticeable at or beyond the property line resulting from the operation. 4. The home occupation shall be operated entirely within the dwelling unit and a conforming accessory structure. The total area that may be used in the accessory building for either material product storage or the business activity shall not exceed 528 square feet. Otherwise, the home occupation and associated storage of materials and products shall not occupy more than 25 percent of the combined residence and accessory structure gross floor area, but in no case shall the portion of the home occupation occupying the accessory use exceed 528 feet. The indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the building, fire, health, and housing codes. 5. A home occupation shall not make necessary a change in the state building code use classification of a dwelling unit. More than one business activity constituting two or more home occupations shall be allowed on one property only if the combined floor space of the business activities does not exceed the limitation of space imposed in Paragraph 18.760.040.A.4. Each home occupation shall apply for a separate home occupation permit, if required by this chapter. 7. There shall be no storage or distribution of toxic or flammable materials, and spray painting or spray finishing operations that involve toxic or flammable materials that in the judgment of the fire marshal pose a dangerous risk to the residence, its occupants, or surrounding properties. Those individuals that are engaged in home occupations shall make available to the fire marshal for review the material safety data sheets that pertain to all potentially toxic or flammable materials associated with the use. 8. No home occupation shall require any on- or off-street parking other than that normally required for a residence. 9. The following uses are not allowed as home occupations: a. Auto-body repair and painting; b. Ongoing mechanical repair conducted outside of an entirely-enclosed building; c. Junk and salvage operations; and d. Storage and/or sale of fireworks. 10.There shall be no exterior storage of vehicles of any kind used for the business except that 1 commercially licensed vehicle of not more than 0.75 ton gross vehicle weight (GVW) may be parked outside of a structure or screened area. You have 20 calendar days from the date of this letter to respond to this compliance request. Provide a total count of vehicles that will be associated with this property and this home occupation. This includes business vehicles associated with the home occupation, any personal vehicle utilized by the one (1) outside employee for the home occupation, and any personal vehicles utilized by the applicants. Specify the proposed parking location(s) for all vehicles (CDC 18.760.050.H). 7. Your narrative states there is one (1) outside employee who is not a member of the household for this home occupation (CDC 18.760.060.B.2). However, in a letter to Ken Ross, Code Enforcement Officer (dated October 2, 2019), you stated, “The home occupations that work for the business are three and they all live on the premises.” Address this discrepancy. 8. In the Type I Home Occupation Permit application you submitted on April 15, 2019, you stated there will be no customers or clients visiting the subject property; however, in your narrative for this Type II Home Occupation Permit, you state, “the business might have 1 customer come [to the] home office once in a 6 month period.” Additionally, in a letter to Ken Ross, Code Enforcement Officer (dated October 2, 2019), you stated, “On average there are no more than 1-2 customers that come to business site in a 6 month period of time.” a. Please cease and desist operating a business at your residential property or obtain the appropriate license and permit and adhere to conditions of approval. We have not yet verified these violations nor have we assessed any penalties. If you can confirm that no violation exists or if you correct it voluntarily within 20 days as discussed below, we will not assess penalties and there will be no court record. Each violation described above constitutes a Class One Civil Infraction under the code and is subject to a penalty of up to $250 per day per violation and/or abatement by the city at the property owner’s expense. Selling any goods or service; 2. Soliciting business or offering goods or services for sale, hire, trade or barter; 3. Acquiring or using any vehicle or any premises for business purposes in the City. B. Residential property shall be free of dangerous levels of hazardous materials, contamination by toxic chemicals, or other circumstances that would render the property unsafe. C. No residential property shall be used as a place for the storage and handling of highly combustible or explosive materials or any articles which may be dangerous or detrimental to life or health. The following characteristics of a Type I home occupation shall be prohibited: 1.Outside volunteers or employees to be engaged in the business activity other than the persons principally residing on the premises; 2.Exterior signs that identifies the property as a business location; 3.Clients or customers to visit the premises for any reason; and 4.Exterior storage of materials. 18.760.040 Approval Standards C.Type II home occupations. Type II home occupations shall comply with the following: 1.One non-illuminated sign not exceeding 1.5 square feet may be permitted. The sign may be attached to the residence, an accessory structure, or placed in a window; 2.No more than 1 outside volunteer or employee who is not a principal resident of the premises; 3.No more than 6 daily customers or clients. Customers and clients may not visit the business between the hours of 10 p.m. and 8 a.m. and shall not generate excessive traffic or monopolize on-street parking; and 4.Storage of materials, goods, and equipment that is screened entirely from view by a solid fence. Storage shall not exceed 5 percent of the total lot area and shall not occur within the front yard or the required side yard setback. Inoperable or partially dismantled automobiles, trucks, bus, trailers or other vehicle equipment or parts thereof in a state of disrepair, for more than 10 days as to any one automobile, truck, bus, trailer or piece of vehicular equipment. 18.110.030 Uses A.Types of uses. For the purposes of this chapter, there are four kinds of use: 1.A permitted (P) use is a use that is permitted outright, but subject to all of the applicable provisions of this title. If a use is not listed as a permitted use, it may be held to be a similar unlisted use as provided in Chapter 18.60, Use Categories. 2.A restricted (R) use is permitted outright providing it is in compliance with special requirements, exceptions, or restrictions. 3.A conditional use (C) is a use the approval of which is discretionary with the hearings officer. The approval process and criteria are provided in Chapter 18.740, Conditional Use. If a use is not listed as a conditional use, it may be held to be a similar unlisted use as provided in Chapter 18.60, Use Categories. 4.A prohibited (N) use is a use that is not permitted under any circumstance. Farming activities shall be consistent with the definition of Agriculture/Horticulture provided in Chapter 18.60, Use Categories; 3.Hobbies that do not result in payment to those engaged in such activity; 4.Proven nonconforming home occupations as provided in Section 18.760.070. (Ord. 17-22 §2) 18.760.050 Conditions of Approval (Home Occupations) A.Conditions of approval. The approval authority may impose conditions upon the approval of a Type II home occupation permit to ensure compliance with the requirements of this chapter. These conditions may include, but are not limited to, the following: 1.Further limiting the hours, days, place, and manner of operation; 2.Requiring site and building design features that minimize environmental impacts such as noise, vibration, air pollution, glare, odor, and dust; 3.Requiring additional building setbacks, or increased lot area, depth, or width; 4.Further limiting the building area and outdoor storage used by the home occupation and restricting the location of the use on the site in relationship to adjoining uses; 5.Designating the size, number, location, and design of vehicle access points; 6.Requiring street right-of-way to be free at all times of vehicles associated with the home occupation; 7.Requiring landscaping, buffering, or screening, of the home occupation from adjoining uses and establishing standards for the continued maintenance of these improvements; 8.Requiring storm drainage improvements and surfacing of parking and loading areas; 9.Limiting the extent and type of interior or exterior building remodeling necessary to accommodate the home occupation; 10.Limiting or setting standards for the location and intensity of outdoor lighting; 11.Requiring and designating the size, height, and location of fences and materials used for their construction; 12.Requiring the protection and preservation of existing trees, and other vegetation, watercourses, slopes, wildlife habitat areas, and drainage areas; 13.Limiting the type and number of vehicles or equipment to be parked or stored on the site; and 14.Any other limitations that the approval authority considers to be necessary or desirable to make the use comply with the purposes stated in Sections 18.320.040 and 18.760.040. (Ord. 17-22 §2) 18.760.060 Revocation and Expiration of Home Occupation Permits A.Grounds for revocation. The director may: 13125 SW Hall Blvd. • Tigard, Oregon 97223 • 503.639.4171 TTY Relay: 503.684.2772 • www.tigard-or.gov 1.Revoke a home occupation approval if the conditions of approval have not been or are not being complied with and the home occupation is otherwise being conducted in a manner contrary to this chapter. 2.The director shall approve the use as it exists, revoke the home occupation permit, or compel measures to be taken to ensure compatibility with the neighborhood and conformance with this chapter after reviewing a complaint. Complaints may be originated by the City of Tigard or the public. Complaints from the public shall clearly state the objection to the home occupation, such as: a.Generation of excessive traffic; b.Exclusive use of on-street parking spaces; and c.Other offensive activities not compatible with a residential neighborhood. B.Cessation of home occupation pending review. If it is determined by the director in exercise of reasonable discretion, that the home occupation in question will affect public health and safety, the use may be ordered to cease pending hearings officer review or exhaustion of all appeals. C.Waiting period for re-application. When a home occupation permit has been revoked due to violation of these standards, a minimum period of 1 year shall elapse before another application for a home occupation on the subject parcel will be considered. D.Invalidation of permit. A home occupation permit shall become invalid if the applicant moves his or her residence. (Ord. 17-22 §2) 18.760.040 Approval Standards (General Standards For Home Occupations) A.General. All home occupations except those that have proven nonconforming status shall comply with all of the following in addition to the standards for Type I and Type II home occupations provided in Subsections 18.760.040.B and C. 1.Home occupations may be undertaken only by the principal occupant(s) of a dwelling unit. 2.There shall be no more than 3 deliveries per week to the residence by suppliers. 3.There shall be no offensive noise, vibration, smoke, dust, odors, heat, or glare noticeable at or beyond the property line resulting from the operation. 4.The home occupation shall be operated entirely within the dwelling unit and a conforming accessory structure. The total area that may be used in the accessory building for either material product storage or the business activity shall not exceed 528 square feet. Otherwise, the home occupation and associated storage of materials and products shall not occupy more than 25 percent of the combined residence and accessory structure gross floor area, but in no case shall the portion of the home occupation occupying the accessory use exceed 528 feet. The indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the building, fire, health, and housing codes. 5.A home occupation shall not make necessary a change in the state building code use classification of a dwelling unit. Each home occupation shall apply for a separate home occupation permit, if required by this chapter. 7.There shall be no storage or distribution of toxic or flammable materials, and spray painting or spray finishing operations that involve toxic or flammable materials that in the judgment of the fire marshal pose a dangerous risk to the residence, its occupants, or surrounding properties. Those individuals that are engaged in home occupations shall make available to the fire marshal for review the material safety data sheets that pertain to all potentially toxic or flammable materials associated with the use. 8.No home occupation shall require any on- or off-street parking other than that normally required for a residence. 9.The following uses are not allowed as home occupations: a.Auto-body repair and painting; b.Ongoing mechanical repair conducted outside of an entirely-enclosed building; c.Junk and salvage operations; and d.Storage and/or sale of fireworks. 10.There shall be no exterior storage of vehicles of any kind used for the business except that 1 commercially licensed vehicle of not more than 0.75 ton gross vehicle weight (GVW) may be parked outside of a structure or screened area. You have 20 calendar days from the date of this letter to respond to this compliance request. The city requires confirmation that your property is in compliance with all regulations cited above in one of two ways: ·If your property is not currently in compliance, please take appropriate action to bring your property into compliance and notify the city of this action. ·If you believe you have received this letter in error or you believe your property is not out of compliance, please contact us so we can discuss this further.
