APPLICATION SUMMARY FILE NAME: PacTrust CASE NO.: Minor Modification (MMD) MMD2019-00021 PROPOSAL: The applicant is proposing a minor modification to an existing development at 15800 SW Upper Boones Ferry Road. Specifically, the applicant proposes to reconfigure the existing parking lot, extend an existing on-site pedestrian path, and redesign the on-site landscaping.The applicant also proposes to remove eight (8) parking lot trees, and replant 10 parking lot trees as part of this modification. The I-P zone provides appropriate locations for combining light manufacturing, office, and small-scale commercial uses, such as restaurants,personal services,and fitness centers,in a campus-like setting with no nuisance characteristics such as noise,glare, odor, or vibration. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.330, 18.410, 18.420,and 18.765.060.D SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request,subject to a condition of approval.The findings and conclusions on which the decision is based are noted in Section IV. MMD2019-00021 PacTrust 1 CONDITION OF APPROVAL THE FOLLOWING CONDITION MUST BE SATISFIED: Unless noted otherwise, the staff contact shall be Lina Smith,Assistant Planner; (503) 718-2438 or LinaCS@tigard-or.gov. 1. At the time of building permit submittal, the applicant must provide a revised site plan that shows pavement markings or contrasting pavement materials where the on-site pedestrian path crosses the drive aisle,in compliance with CDC 18.410.040.B.1. SECTION III. BACKGROUND INFORMATION Site Information: The subject property is located at 15800 SW Upper Boones Ferry Road, on the south side of SW Upper Boones Ferry Road, east of SW 72nd Avenue, and west of Interstate 5. The 5.26-acre development site is made up of two (2) tax lots (WCTM 2S112DD,Tax Lots 700 and 701), and contains four (4) commercial buildings,with associated parking and landscaping.The subject site is zoned Industrial Park(I-P). In 1987, the City of Tigard Planning Division approved a reduction to the minimum landscape area for the subject site from 25 percent to 22.5 percent (Case Nos. SDR 87-18 and V 87-18). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.330 Industrial Zone Development Standards: 18.330.040 Development Standards B. Landscaping and screening. All required landscaping, including landscaping used to meet screening or tree canopy standards, is subject to the general provisions of Chapter 18.420, Landscaping and Screening. 1. The minimum landscape area standard is provided in Table 18.330.1. Landscaping standards are provided in Section 18.420.040.Any landscape area planted to the L-2 standard may count toward meeting the minimum area standard. The applicant proposes to redesign the on-site landscaping at 15800 SW Upper Boones Ferry Road(WCTM 2S112DD,Tax Lots 700 and 701). In 1987, the City of Tigard Planning Division approved a reduction to the minimum landscape area for the subject site from 25 percent(the minimum required in the I-P Zone) to 22.5 percent (Case Nos. SDR 87-18 and V 87-18). Although the applicant's materials show there is currently less than 22.5 percent of landscaping on the subject site,this proposal will result in a net increase of 143 square feet of on-site landscaping. Accordingly, staff finds this proposed modification is approvable,as it will not increase the development's nonconformity(CDC 18.50.040.C.1.a).Additionally, the applicant submitted a landscaping plan that demonstrates how this proposal will meet the L-1 standard (CDC Table 18.420.1). These standards are met. 2. Screening standards are provided in Section 18.420.050. Screening is required as follows: c. Surface vehicle parking areas, loading areas, drive aisles, and stacking lanes for drive- through services within 20 feet of a street property line must be screened to the S-4 standard.Screening must be provided directly adjacent to the street property line,except where access is taken. The applicant is not proposing to modify the locations of existing parking areas,loading areas,or drive aisles. Additionally,the applicant is not proposing to modify the existing landscaping and screening located directly adjacent to the street property line,abutting SW Upper Boones Ferry Road. These standards do not apply. MMD2019-00021 PacTrust 2 E. Pedestrian access. 1. Paths must provide safe and convenient pedestrian access from public sidewalks abutting the site to all required building entrances on the site.A minimum of 1 path is required for every 200 linear feet of street frontage. The subject property has approximately 235 feet of street frontage on SW Upper Boones Ferry Road; therefore, the applicant is required to provide a minimum of one (1) path. The site contains an existing pedestrian path that surrounds the building at 15800 SW Upper Boones Ferry Road. The applicant proposes to extend this path so it provides a safe and convenient pedestrian access to the public sidewalk. This standard is met. 2. Paths must provide safe and convenient pedestrian access within the site between all buildings, uses, and areas designed for use by pedestrians. Paths within parking areas or along drive aisles are subject to additional standards in Subsection 18.410.040.B. This standard is addressed under CDC Section 18.410.040.B of this decision. 3. Paths must extend to the perimeter property line to provide access to existing or planned pedestrian facilities on adjacent properties, such as trails or public access easements, where practicable. The proposed path extension will provide a safe and convenient pedestrian access from the public sidewalk on SW Upper Boones Ferry Road to the existing building. This standard is met. 4. Paths must be constructed with a hard surface material and have a minimum unobstructed width of 5 feet. The applicant's site plan shows that the proposed path extension will be constructed with a hard surface material,and will have an unobstructed width of five feet. This standard is met. 18.410 Off-Street Parking and Loading: 18.410.040 General Design Standards B. Pedestrian access. Paths that cross access driveways or parking areas are subject to the following: 1. Paths must be physically separated from motor vehicle traffic and parking by either a minimum 6-inch vertical separation (curbed) or a minimum 3-foot horizontal separation, except that pedestrian crossings of traffic aisles are allowed for distances no greater than 36 feet if appropriate landscaping,pavement markings, or contrasting pavement materials are used; The applicant proposes to extend an existing on-site path, so it will provide a connection from the existing building to the public sidewalk on SW Upper Boones Ferry Road. This proposed path crosses an existing drive aisle for a distance no greater than 36 feet. The applicant's site plan does not show any proposed landscaping,pavement markings,or contrasting pavement materials for this portion of the path;accordingly, staff has included a condition of approval for the applicant to provide a revised site plan that demonstrates compliance with this standard,at the time of building permit submittal.As conditioned,this standard will be met. 2. Paths must be a minimum of 4 feet in width,exclusive of vehicle overhangs and obstructions such as mailboxes,benches,bicycle racks,and sign posts; and MMD2019-00021 PacTrust 3 The applicant's site plan and detail drawing show the path extension will be more than four feet wide, exclusive of vehicle overhangs and obstructions.This standard is met. 3. Paths must be in compliance with applicable federal and state accessibility standards. The Building Official will review the path extension for compliance with all applicable federal and state accessibility standards at the time of building permit submittal.This standard will be met. E. Surfacing. Off-street parking areas must be paved with an asphalt,concrete,or pervious paving surface,with the following exceptions: 1. Off-street parking areas associated with a temporary use application,as provided in Chapter 18.440,Temporary Uses,provided the approval authority determines that unpaved parking will not create adverse conditions. 2. Off-street overflow parking areas in the Parks and Recreation zone. The applicant's site plan shows that the modified parking lot will be paved with an asphalt, concrete, or pervious paving surface.These standards are met. F. Striping. 1. Except for parking required for single detached houses and accessory dwelling units, and individual spaces for rowhouses,all off-street parking spaces must be clearly and separately identified with pavement markings or contrasting paving materials; and 2. All interior drives and access aisles must be clearly marked and signed to show direction of flow. The applicant's site plan shows that all parking spaces will be clearly and separately identified with pavement markings or contrasting paving materials. The applicant is not proposing to modify the existing drive aisles. These standards are met. I. Space and aisle dimensions. The minimum dimensional standards for surface parking spaces and drive aisles are provided in Figure 18.410.1 and Table 18.410.2. The applicant proposes to reconfigure the existing on-site parking lot.The proposed modification meets the minimum parking space and aisle dimensions in CDC Figure 18.410.1 and CDC Table 18.410.2 because each space will be at least eight(8) feet,six (6)inches wide,and 18 feet deep.The applicant is not proposing to modify the existing drive aisles. These standards are met. 18.410.070 Vehicle Parking Quantity Standards A. Off-street parking requirements. The ratios for providing minimum and maximum vehicle parking spaces are provided in Table 18.410.3. If application of the maximum parking standard results in less than 6 parking spaces for a development with less than 1,000 square feet of floor area,the development is allowed up to 6 parking spaces.If application of the maximum parking standard results in less than 10 vehicle parking spaces for a development between 1,000 and 2,000 square feet,the development is allowed up to 10 vehicle parking spaces. The applicant proposes to reconfigure the existing on-site parking lot,but will not change the total quantity of parking spaces provided. There will be no net loss in parking, with 23 spaces existing, and 23 spaces proposed.This standard is met. 18.420 Landscaping and Screening: 18.420.060 Tree Canopy Standards MMD2019-00021 PacTrust 4 A. Site tree canopy standards,which are stated as a percentage of effective tree canopy cover for an entire site,are provided in UFM Section 10,Part 3,Subparts N and O.Parking lot tree canopy standards are provided below. B. An urban forestry plan is required to demonstrate compliance with site and parking lot tree canopy standards and must meet the requirements of UFM Sections 10 through 13. An urban forestry plan must: 4. Demonstrate compliance with parking lot tree canopy standards, where applicable, by providing the minimum effective tree canopy cover of 30 percent for all parking areas, including parking spaces and drive aisles. Only the percentage of tree canopy directly above parking areas may count toward meeting this standard; The applicant proposes to remove eight(8) existing parking lot trees.The applicant submitted a tree removal permit application with this minor modification. The applicant states the reasons for removal are because the trees are in an advanced state of decline,the trees are infested with pests or diseases,or the tree roots are causing damage to paved surfaces.The applicant has also submitted sufficient documentation (such as a site plan and photographs) to support the reasons for removal. Staff finds the applicant's tree removal permit is approvable, as the application meets the development tree removal standards in Section 7, Part 1 of the Urban Forestry Manual.Additionally,the applicant has submitted a proposed landscaping plan,which shows that 10 replacement parking lot trees will be planted.Accordingly,staff finds this modification is approvable because the planting of replacement trees will ensure there will be no net loss in tree canopy cover for the parking lot.These standards are met. 18.765 Modifications: 18.765.060 Minor Modifications A. Definition.A minor modification has the following characteristics: 1. It has minimal impacts on surrounding properties,sensitive lands,or public facilities;and The applicant proposes to reconfigure the existing parking lot, extend an existing on-site pedestrian path, and redesign on-site landscaping at the subject site.The applicant also proposes to remove eight(8) parking lot trees,and replant 10 parking lot trees as part of this modification.As demonstrated in the findings above, the applicant's proposal complies with the applicable standards for pedestrian access, off-street parking and loading, and tree canopy cover. Accordingly, staff finds this proposal will have minimal impacts on surrounding properties, sensitive lands, or public facilities, and meets the definition of a minor modification. 2. It does not cause the development to go out of conformance with any applicable standard or further out of conformance if already nonconforming, except where an adjustment has been approved. The existing development does not comply with the 22.5 percent minimum landscape requirement for this site, as approved under Case Nos. SDR 87-18 and V 87-18. However, as demonstrated in the findings above, staff finds the applicant's proposal does not cause the development to go further out of conformance with this requirement, and is therefore approvable. This standard is met. D. Approval criteria. The approval authority will approve or approve with conditions a minor modification application when all of the following criteria are met: 1. The proposed modification qualifies as a minor modification as defined in Subsection 18.765.060.A; As demonstrated in the findings above, this proposal qualifies as a minor modification as defined in CDC 18.765.060.A. MMD2019-00021 PacTrust 5 2. If the proposal involves the modification of a condition of approval, at least one of the following criteria is met: a. The condition cannot be implemented for reasons outside the control of the applicant or property owner; b. The condition is no longer needed or warranted because circumstances have changed; or c. A new or modified condition better accomplishes the purpose of the original condition. The applicant is not proposing to modify a condition of approval.This criterion does not apply. CONCLUSION: This proposal qualifies as a minor modification to an existing development, as defined in CDC 18.765.060.A, and is in compliance with all applicable standards of this Title. SECTION V. Removal of existing obtrusive landscaping and tree roots that are damaging existing pedestrian walkway facilities at building entries. Project also includes the installation of new landscaping around building 171 with enhanced landscaping at building entries. The proposed project meets the definition of a Minor Modification per section 18.765.060 based on the following criteria: 1. The proposed project has minimal impacts on surrounding properties, sensitive lands, or public facilities; and 2. It does not cause the development to go out of conformance with any applicable standard or further out of conformance if already nonconforming.
