No changes to the building facade, footprint,landscaping,or parking are proposed. The C-G zone is designed to accommodate a full range of retail, office,and civic uses with a city wide and even regional trade area. Except where nonconforming,residential uses are limited to mixed-use developments. A wide range of uses,including but not limited to adult entertainment, automotive equipment repair and storage,mini-warehouses, utilities,heliports,medical centers,major event entertainment, and gasoline stations,are allowed conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code (CDC) Chapter 18.410 and 18.765 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. MMD2019-00014 Angeles Restaurant Page 1 of 4 THIS APPROVAL IS VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The applicant is proposing a change of use at 12957 SW Pacific Highway from a repair-oriented retail use to a fast food eating and drinking establishment. The site is located on the northwest side of Pacific Highway,north of SW Park Street,and south of SW Walnut Street.The subject tenant space is 620 square feet in size and is located within an existing shopping center. The 0.86-acre development is made up of one tax lot (WCTM 2102BD,Tax Lot 2600), and contains an existing commercial building, an existing wireless communication facility (originally approved under Case No. CUP96-00009), and 43 parking spaces.The property is located in the General Commercial (C-G) zone. In November 2016,Bomb Coffee submitted an application for a minor modification and an adjustment (MMD2016-00032 and ADJ2016-00116) at this site for a 200 square foot coffee stand and a reduction in length for the stacking lane. The proposal would eliminate eight (8) approved parking spaces. Bomb Coffee is a food truck and is subject to the standards of the "Mobile Food Carts on Private Property" form.Both MMD2016-00032 and ADJ2016-00116 were withdrawn in March 2017. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.765 Modifications: 18.765.060 Minor Modifications D. Approval criteria.The approval authority will approve or approve with conditions a minor modification application when all of the following criteria are met: 1. The proposed modification qualifies as a minor modification as defined in Subsection 18.765.060.A; The applicant is proposing a change of use at 12957 SW Pacific Highway from a repair-oriented retail use to a fast food eating and drinking establishment. With a change of use, the potential issues are primarily related to the off-street parking requirement. A minor modification is required for this change of use because the application of a higher parking quantity is required according to Table CDC 18.410.3. The proposed fast food eating and drinking establishment use is allowed in the C-G zone. The tenant space is part of a multi-tenant commercial site and is therefore subject to the required minimum vehicle parking formula outlined in CDC 18.410.030.D. There are 43 parking spaces that were approved by a previous land use decision for this site. During the parking count, staff discovered that eight parking stalls were removed for Bomb Coffee and that a stacking lane was painted around the food cart. Thirty-five parking stalls remain after the elimination of the eight parking stalls. Even with 35 parking stalls, the minimum parking requirement is met and nine parking stalls are provided in addition to the minimum required.Upon review of the applicant's plans and narrative,staff finds that this proposal for a change of use at 12957 SW Pacific Highway is in compliance with all other applicable requirements of this title.This criterion is met. 2. If the proposal involves the modification of a condition of approval, at least one of the following criteria is met: a. The condition cannot be implemented for reasons outside the control of the applicant or property owner; b. The condition is no longer needed or warranted because circumstances have changed;or c. A new or modified condition better accomplishes the purpose of the original condition. This criterion is not applicable because the proposal does not modify a condition of approval. CONCLUSION: The proposal for a change of use at 12957 SW Pacific Highway from a repair- oriented retail use to a fast food eating and drinking establishment is a minor modification to an existing development and is in compliance with the applicable requirements of this Tide. MMD2019-00014 Angeles Restaurant Page 3 of 4 SECTION V. PROCEDURE AND APPEAL INFORMATION Final Decision: A minor modification is a Type I procedure. As such, this decision is final for purposes of appeal on the date it is mailed or otherwise provided to the applicant, whichever occurs first. This decision is not appealable locally and is the final decision of the City. THIS DECISION IS FINAL ON MAY 22ND, 2019, AND BECOMES EFFECTIVE ON MAY 23RD, 2019.
