APPLICATION SUMMARY FILE NAME: Porter Lane,LLC CASE NO.: Urban Forestry Review(UFR) UFR2019-00006 PROPOSAL: The applicant proposes to modify the Urban Forestry Plan approved under the Land Partition for Porter Lane, LLC (Case No. MLP2017-00007). Specifically, the applicant proposes to remove four (4) trees on Parcel 1, and 14 trees on Parcel 3 that were originally proposed for preservation,in order to accommodate new single detached houses of a particular design. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request.The findings and conclusions on which the decision is based are noted in Section IV. UFR2019-00006 Porter Lane,LLC—Urban Forestry Plan Modification 1 SECTION III. BACKGROUND INFORMATION Site Information: The subject properties are Parcels 1 and 3 of the Porter Lane,LLC Partition(Case No.MLP2017-00007), which was approved by the City of Tigard Planning Division in November 2017. The properties are located on the north side of SW Errol Street, east of SW 124th Avenue, and west of SW Fonner Street. During land use review for Case No. MLP2017-00007, the applicant proposed to construct half-street improvements,including a sidewalk and planter strip. However, after the land use decision was issued,the applicant was approved to pay a fee in-lieu of street improvements.Accordingly,because the sidewalk and planter strip were no longer being constructed, the applicant proposed to pay a fee in-lieu of planting four (4) street trees that were shown on the original Urban Forestry Plan. In April 2018, the City of Tigard Planning Division approved this modification (Case No. UFR2018-00002). The applicant now proposes a second modification to the original Urban Forestry Plan. Specifically, the applicant proposes to remove four (4) trees on Parcel 1, and 14 trees on Parcel 3 that were originally proposed for preservation, in order to accommodate new single detached houses of a particular design. The subject properties are zoned Low-Density Residential (R-4.5). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.420.060.F. Urban forestry plan modification. Except as exempted in Paragraph 18.420.060.F.1, an application to modify the urban forestry plan component of a land use approval is processed through a Type I procedure, as provided in Section 18.710.050, using the approval criteria in Paragraph 18.420.060.F.2. The applicant proposes to modify the Urban Forestry Plan approved under the Land Partition for Porter Lane,LLC (Case No. MLP2017-00007). Specifically, the applicant proposes to remove four (4) trees on Parcel 1,and 14 trees on Parcel 3 that were originally proposed for preservation,in order to accommodate new single detached houses of a particular design. The removal of these trees is not exempt from the Type I Urban Forestry Plan Modification. Therefore, this application is subject to the approval criteria outlined below. 2. Approval criteria. The approval authority will approve or approve with conditions the modification to the urban forestry plan component of a land use approval when all of the following are met: a. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that led to the proposed modification; The applicant was originally approved for a Type II Land Partition, and was not required to submit an Urban Forestry Plan that was coordinated and approved by an arborist or landscape architect (CDC 18.420.060.B.1). Instead, the applicant has provided a revised report and statement certifying that the previously approved Urban Forestry Plan did not account for the circumstances that led to the proposed modification. During land use review,the applicant did not provide estimated building footprints for the proposed new homes on Parcels 1 and 3. The applicant is now completing final building plans for the proposed new homes, and requests to remove trees that were originally proposed for preservation, in order to accommodate the new building footprints. This criterion is met. b. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification; and UFR2019-00006 Porter Lane,LLC—Urban Forestry Plan Modification 2 The applicant has provided a revised report and statement certifying that there is no practicable alternative to the proposed modification. This criterion is met. c. The project arborist or landscape architect demonstrates compliance with Subsection 18.420.060.B through a modified urban forestry plan. (Ord. 18-28 §1) The applicant submitted a revised Urban Forestry Plan and supplemental report that demonstrate compliance with CDC 18.420.060.B,including tree preservation,protection, and canopy standards. This criterion is met. CONCLUSION: As demonstrated in the analysis above, the proposed modification to the Urban Forestry Plan Component of the approved Porter Lane, LLC Partition meets all applicable approval criteria. They provide significant economic, social and ecological benefits. They are necessary to sustain healthy communities. Purpose of Modification: The subject property referenced above has an Urban Forestry Plan currently approved with the City of Tigard which has been amended once. The purpose of this Application is to amend the plan once again for two reasons: (1)To accommodate development of lots 1 and 3 with single family homes while retaining all significant/healthy trees possible (2) The correct the original classification of existing trees which incorrectly labeled the type, size and/or condition of several existing trees on the site. Narrative: The original Urban Forestry Plan was submitted by Porter Lane LLC as part of a land partition and at the time of the submission and amendment, Porter Lane LLC intended on selling the two lots to a builder. The lots have been listed for sale and have not sold as of the time of this writing. Porter Lane LLC has interviewed several builders and contracted with Juan Munoz to build two new homes, one on Lot 1 and one on Lot 2. Plans have been selected and are being prepped for submission to the City of Tigard for permits. The Urban Forestry Plan must be amended in order to accommodate new construction. The building plans selected and placement of the homes has been designed in such a manner to minimize the impact on the Urban Forestry Plan exists, specifically significant/healthy trees like the Giant Sequoia Grove. During the course of preparing this application, Porter Lane LLC contracted an arborist (Charlie Carrol, ISA Cert#PN-7835AM)with Northwest Tree Specialists 503-707-6793. The original tree survey was not done by an Arborist and therefore many trees were mislabeled in terms of type and/or size. The arborist provided an excel spreadsheet of tree data which has been attached to this application. Tree data was mapped via CAD and shows the proper location of existing trees, trees proposed for removal and canopy coverage calculations on a per lot and entire site basis. Of the 43 trees found on the entire property 18 are scheduled for removal. Of the 18 trees scheduled for removal 6 are considered to be 'Nuisance' or'Dangerous'. Of the 12 trees scheduled for removal that are not considered 'Nuisance' or 'Dangerous', 4 are considered to be of'Low' or'Very Low Preservation Value' leaving 8 trees that are proposed for removal that have some benefit to the community. SW}krrol.: Existing Canopy Standards: It is the intent of this application to comply with Tree Canopy Standards 18.420.060: Chapter 18.420 LANDSCAPING AND SCREENING 18.420.060 Tree Canopy Standards F. Urban forestry plan modification. Except as exempted in Paragraph 18.420.060.F.1, an application to modify the urban forestry plan component of a land use approval is processed through a Type I procedure,as provided in Section 18.710.050, using the approval criteria in Paragraph 18.420.060.F.2. 1. Exemptions.The following are exempt from a Type I modification application to the urban forestry plan component of a land use approval: a. Removal of any tree shown as preserved in the tree canopy site plan and supplemental report of a previously approved urban forestry plan provided that: i. The project arborist or landscape architect provides a written report prior to removal attesting that either the condition rating or suitability of preservation rating,as provided in the city's Urban Forestry Manual,of the tree has changed to a rating of less than 2;and ii. A revised tree canopy site plan and supplemental report are submitted for review and approval prior to removal that reflect the proposed changes to the previously approved urban forestry plan.The revised tree canopy site plan and supplemental report must demonstrate how the effective tree canopy cover requirements will be provided by tree planting, preservation, or payment of a tree canopy fee in lieu of planting or preservation. b. Modification of the quantity, location, or species of trees to be planted in the tree canopy site plan and supplemental report of a previously approved urban forestry plan provided that: i. The modification results in the same or greater amount of future tree canopy through tree planting as the previously approved urban forestry plan for the lot or tract where the modification is proposed; ii. Payment of a tree canopy fee in lieu of planting is not proposed as part of the modification;and iii. A revised tree canopy site plan and supplemental report are submitted for review and approval prior to planting that reflect the proposed changes to the previously approved urban forestry plan. c. Modification of the tree protection fencing location in the tree preservation and removal site plan, tree canopy site plan,and supplemental report of a previously approved urban forestry plan provided that: i. The project arborist or landscape architect provides a written report prior to modification of the tree protection fencing describing how the proposed modification will continue to protect the viability of the trees shown as preserved in the previously approved urban forestry plan;and ii. A revised tree preservation and removal site plan, tree canopy site plan, and supplemental report are submitted for review and approval prior to modification of the tree protection fencing that reflect the proposed modifications to the previously approved urban forestry plan. 2. Approval criteria. The approval authority will approve or approve with conditions the modification to the urban forestry plan component of a land use approval when all of the following are met: a. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that led to the proposed modification; b. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification;and c. The project arborist or landscape architect demonstrates compliance with Subsection 18.420.060.8 through a modified urban forestry plan.(Ord. 18-28§1)■ Urban Forestry Plan Modification: Please see the attached CAD map showing the location of trees to remain and those to be removed. The attached excel table also shows the correct labeling of said trees, status, reason for removal and DBH of all trees. Calculations on the following page break down canopy coverage on a per lot basis as well as for the total site. Second, calculations are shown for the parcels and site after proposed trees are removed. Summary: In summary, the current amendment application has been designed to comply with current code as all information has now been accurately labeled and measured by a licensed arborist. After removal of proposed trees and double credit is given to preserved trees (as per code allowance) the three lots will have 216%, 54%and 98% respectively, well over the 15%canopy coverage requirement in the Urban Forestry Master Plan. The entire property will have 122%canopy coverage, well over the 40%figure required in the Urban Forestry Master Plan.
