BACKGROUND INFORMATION Site Information: The subject property is Lot 8 of the Brightwood Subdivision, which was approved on July 2"`', 2018 (SUB2018-00004).The granted approval was for an 8-lot subdivision.The address for Lot 8 is 11194 SW 114`''Place.A Public Facilities Improvement Permit (PFI2018-00272) for this subdivision was submitted on October 9th, 2018 and issued on April 4th, 2019. The inspection for PFI2018-00272 has not yet occurred. The subdivision is located east of SW 114t Place, south of SW Cottonwood Lane, north of SW North Dakota Street, and west of SW 113`'' Terrace. This is the first Temporary Use Permit for the Brightwood Subdivision. All lots are zoned R-4.5. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS CHAPTER 18.440 TEMPORARY USES: 18.440.030 Types of Temporary Uses C. Temporary sales office or model home. This type of use includes a temporary sales office or offices either in a housing unit or in another temporary building for the purpose of facilitating the sale of real property in any subdivision or property within this city. This includes the use of one unit in a subdivision as a "model home" for purposes of showing prospective buyers. The applicant is proposing a temporary sales office and model home on Lot 8 of the approved Brightwood Subdivision. The proposed model home will be located within the single-family residential structure. The proposed temporary sales office will be located in a first-floor room located near the primary entrance. As indicated from the site plan,the single-family residential structure will have a front setback of 20 feet,a garage setback of 23 feet,a street side setback of over 16 feet, and a rear setback of over 15 feet,and a side setback of five (5) feet. Using the scaled site plan, staff determined that the single- family residential structure will not be located within the vision clearance triangle. This is the first Temporary Use Permit for the Brightwood Subdivision. 18.440.050 Approval Criteria C. Temporary sales office or model home. The approval authority will approve or approve with conditions a temporary sales office or model home when all of the following are met: 1. Temporary sales office. a. The temporary sales office must be located within the boundaries of the subdivision or property in which the real property is to be sold; and The proposed temporary sales office is to be located within the boundaries of the Brightwood Subdivision on Lot 8.The real property to be sold includes the subject property.This standard is met. b. Sales offices approved through the provision of this chapter may not be permanent. The applicant proposes to utilize a first-floor room located near the primary entrance of a single-family residential structure for the temporary sales office. As stated in the applicant's narrative, the temporary sales office will be closed upon the completion of all subdivision house sales. A twelve (12) month approval period for the temporary sales office is appropriate as it meets the applicant's timeline for sale of the homes. This standard is met. The model home must be located within the boundaries of the subdivision or property where the real property to be sold is situated; and The proposed model home is to be located within the boundaries of the Brightwood Subdivision on Lot 8. The real property to be sold includes the subject property.This standard is met. b. The property to be used for a model house must be a permanently designed dwelling structure. The single-family residential structure will be a permanently designed structure. As stated in the applicant's narrative, the model home will be sold and remain as a permanent home in the Brightwood Subdivision upon completion of its purpose as a model home.This standard is met. SECTION V. PROCEDURE AND APPEAL INFORMATION Final Decision: A Temporary Use Permit is a Type I procedure. As such,the Director's decision is final on the date it is mailed or otherwise provided to the applicant,whichever occurs first. The Director's decision may not be appealed locally and is the final decision of the City. Under Section 18.440.050.C: 1. Temporary sales office. a. The temporary sales office must be located within the boundaries of the subdivision or property in which the real property is to be sold; and b. Sales office approved through the provision of this chapter may not be permanent. Following your direction, this email is the applicant's response to the identified completeness items in Section I of your letter: a) Time Period for Temporary Use. As noted in the application, we are requesting the temporary use permit for a sales office to be located within a model home.The sales office will be needed only until all homes are sold or before. In this instance, the subdivision consists of only eight lots. We would expect to have all homes sold within the maximum permit duration of 12 months. We request the permit for the full 12-month period. b) Location of Temporary sales Office. The sales office will be located within one room on the first floor of the home, typically near the front door. One or two adjacent rooms may be used for waiting areas or the presentation of sales exhibits and materials if additional space is needed. 4 c) Sales Office Furnishings and Equipment.The main sales office will consist of a desk, phone, computer, file cabinets, guest seating, and related office accoutrements.The kitchen may be used for coffee and snack preparation and cold drink storage, depending on the size and layout of the main office. The waiting area and sales exhibition area would include a sofa, coffee table, additional chairs and one or two small tables for displaying sales materials. d) Commercial Modifications. We do not anticipate doing any commercial modifications to the home other than basic company and directional signs. We believe these responses address the incompleteness items from you letter and request that you deem the application complete.Thank you.
