The findings and conclusions on which the decision is based are noted in Section IV.
THIS APPROVAL IS VALID FOR 13 MONTHS (ONE YEAR AND ONE MONTH)
FROM THE EFFECTIVE DATE OF THIS DECISION.

SECTION III. BACKGROUND INFORMATION
Site Information:
The subject property is Lot 1 of the Summerbrook Subdivision, which was approved on June 4th, 2018
by City of Tigard Staff and on June 25`h, 2018 by the Hearings Officer (CUP2017-00007, SUB2017-
00009, LLA2017-00013, and ADJ2018-00006). The granted approval was for a 15-lot subdivision,
Conditional Use Permit, Lot Line Adjustment, and an Adjustment. A Public Facilities Improvement
Permit (PFI2018-00179) for this subdivision was submitted on July 12`h, 2018 and issued on October
15`h,2018. The subdivision is located east of SW 121"Avenue,south of SW Springwood Drive,north of
SW Manzanita Court,and west of SW 118`h Court.All lots are zoned R-4.5.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
CHAPTER 18.440 TEMPORARY USES:
18.440.030 Types of Temporary Uses
C. Temporary sales office or model home. This type of use includes a temporary sales office or
offices either in a housing unit or in another temporary building for the purpose of facilitating
the sale of real property in any subdivision or property within this city.This includes the use
of one unit in a subdivision as a "model home" for purposes of showing prospective buyers.
The applicant is proposing a temporary sales office on Lot 1 of the approved Summerbrook Subdivision.
The proposed temporary sales office will be located within a 12 ft. x 46 ft. temporary trailer,and will be
removed from the lot when the space is no longer needed as a temporary sales office. As indicated from
a site plan, the trailer will be placed 30 ft. back from the front property line, 33 ft. back from the street-
side property line, 10 ft. back feet from the side property line, and 55.5 ft. back from the rear property
line. Using the scaled site plan, staff determined that the temporary trailer will not be located within the
vision clearance triangle.This is the first Temporary Use Permit for the Summerbrook Subdivision.
18.440.050 Approval Criteria
C. Temporary sales office or model home.The approval authority will approve or approve with
conditions a temporary sales office or model home when all of the following are met:
1. Temporary sales office.
a. The temporary sales office must be located within the boundaries of the subdivision
or property in which the real property is to be sold; and
The proposed temporary sales office is to be located within the boundaries of the Summerbrook Subdivision
on Lot 1.The real property to be sold includes the subject property.This criterion is met.
b. Sales offices approved through the provision of this chapter may not be permanent.
The applicant proposes to utilize one temporary trailer as a temporary sales office. Once the temporary
use expires, the temporary trailer will be removed for the construction of a single detached house. The
applicant has requested that the approval of the temporary sales office be valid for thirteen (13) months.
A thirteen (13) month approval for the temporary sales office is appropriate as it meets the applicant's
timeline for sale of the homes. This criterion is met.

SECTION V. PROCEDURE AND APPEAL INFORMATION
Final Decision:
A Temporary Use Permit is a Type I procedure. As such, the Director's decision is final on the date it is
mailed or otherwise provided to the applicant,whichever occurs first. The Director's decision may not
be appealed locally and is the final decision of the City.
THIS DECISION IS FINAL ON JUNE 10TH, 2019
AND BECOMES EFFECTIVE ON JUNE 11TH, 2019
