The Phase I Environmental Site Assessment consisted of a site survey, an historical and physical features evaluation of the subject property, an examination of the surrounding land uses, and an environmental database review of the property and of the surrounding land uses. The 3-acre subject property was occupied by an approximate 1,000-square foot residence (the John Tigard House), which was utilized as a museum. The residence was built in 1880 and moved onto the property in 1979. A replica of an outhouse was also located near the residence. The remainder of the property was undeveloped and covered with fir trees and native vegetation. A small central portion of the property was utilized as a dog park. According to historical information, by the 1940s the eastern portion of the subject property was utilized for agricultural use, possibly for the growing of hay or grain, and the southwestern portion of the property was forested, which remains today. By 1979, the John Tigard House had been moved onto the northeastern portion of the property, and the southeastern portion of the property was under cultivation. By 1991, the cultivated area on the southeastern portion of the property had been planted with fir trees, and four fruit trees had been planted within the fenced John Tigard House area, all of which were observed at the time of the site inspection. Pesticide residues may be present in the near-surface soils of the subject property as a result of the historic usage of pesticides for agricultural purposes. There was no available evidence that indicated that concentrated spills have occurred on the property. In summary, while pesticides may be present in the near-surface soils at the property, their presence is not likely to pose an environmental concern at the property. Phase I Environmental Site Assessment Page I of 40 3.0-Acre Canterbury Property May 31,2007 10310 SW Canterbury Ln.,Tigard,Oregon HAHN AND ASSOCIATES, INC, 7259 Ph I Report,doo Privileged, Confidential, and Distribution Use Restricted While agricultural use appears to be the first developed use of the property, the historical resources reviewed, specifically aerial photographs, extended only to 1940 (Data Failure), and thus it is possible that other developed uses may have been located on the property prior to this time. Aerial photographs for the 1960s were not available (Data Gap). Previous owners of the property were not available for an interview (Data Gap). However, based upon the known usage of the property, on-site observations, and the review of the available maps and aerial photographs obtained for this Phase I Environmental Site Assessment, these Data Failure and Data Gaps do not appear to be significant. The adjacent and nearby surrounding properties were historically forested and undeveloped or used for rural residential and agricultural purposes. From at least the 1940s through the early 1950s, an orchard was located immediately adjacent to the west of the property. By 1953, the first water tank had been constructed and marked the beginning of the municipal water facility that was still in operation at the time of the site inspection. By the 1970s, the first water tank had been replaced with two larger water tanks and a shop building, all of which remained at the time of the site inspection. Increased residential development was seen to the southwest of the property during the 1970s, and by the late 1970s, a church was constructed across SW Canterbury Lane to the northwest. In 2006, a cellular tower was constructed on the southern portion of the adjacent municipal water facility. A limited visual assessment for suspect asbestos-containing materials was conducted during the course of the site inspection. This visual assessment does not constitute an asbestos survey, which was beyond the scope of this Phase I Environmental Site Assessment, and was not intended to identify every suspect asbestos-containing material at the subject property. Suspect asbestos-containing materials were not noted on the property. However, based on the date of construction of the John Tigard House (1880), it is possible that materials used in its construction contain asbestos. Evidence of underground storage tanks was not observed on the subject property, nor was the presence of underground storage tanks indicated from historical research. Similarly, aboveground storage tanks were not noted at the property. A review of state and Federal environmental records disclosed several sites located within a 1.0-mile radius of the property that are currently or have previously been under review for environmental issues. The adjacent Phase I Environmental Site Assessment Page 2 of 40 3.0-Acre Canterbury Property May 31,2007 10310 SW Canterbury Ln.,Tigard, Oregon HAHN AND ASSOCIATES,INC. 7259 Ph I Report.doc Privileged, Confidential, and Distribution Use Restricted municipal water facility was listed on the underground storage tank list and leaking underground storage tank list and is discussed below. However, these sites do not appear to represent a Recognized Environmental Condition for the property at this time. According to the Oregon Department of Environmental Quality Leaking Underground Storage Tank file information, in 1994 a 1,000-gallon diesel fuel tank of unknown age was removed from the adjacent municipal water facility property. Petroleum-contaminated soil was excavated and disposed of off-site. Although low-level petroleum contamination remains at the location of the former underground storage tank, this release was conferred a No Further Action designation by the Oregon Department of Environmental Quality. Based on this information and due to the distance and the topographic location of the former tank in reference to the subject property, the remaining contamination does not appear to represent a Recognized Environmental Condition for the subject property. According to Oregon Department of Environmental Quality Underground Storage Tank file, in January 1990 four underground storage tanks containing gasoline and waste oil were removed from the adjacent municipal water facility. Two of the tanks were topographically crossgradient, and two were topographically upgradient to crossgradient of the subject property. Sampling documentation was not on file with the agency. Soil contamination was reportedly encountered beneath the waste oil tank and was indicated to have ultimately have been removed from the site. Groundwater was not reported to have been encountered during the removals. Based on the distance of the former tanks in relation to the subject property, and the fact that the tanks have been removed, along with the depth of groundwater (as reported at the adjacent water facility), the historical presence of these tanks do not appear to represent a Recognized Environmental Condition for the subject property. Evidence of hazardous materials storage, including 55-gallon drums, were not observed on the property. Electrical transformers were not observed on the subject property. Three fluid-filled electrical transformers located on three poles were located in the right-of-way of SW 103`d Avenue. The transformers had blue labels indicating that they did not contain polychlorinated biphenyls. Phase I Environmental Site Assessment Page 3 of 40 3.0-Acre Canterbury Property May 31,2007 10310 SW Canterbury Ln.,Tigard, Oregon HAHN AND ASSOCIATES, INC. 7259 Ph I Report.doc Privileged, Confidential, and Distribution Use Restricted Conclusions and Recommendations Hahn and Associates, Inc. has performed this Phase I Environmental Site Assessment in conformance with the scope and limitations of American Society for Testing and Materials Practice E1527-05 of the 3-Acre Canterbury Property located at 10310 Canterbury Lane, Tigard, Washington County, Oregon. Any exceptions to, or deletions from, this practice are described in Section 8.0 of this report. This Phase I Environmental Site Assessment has not revealed evidence o Recognized Environmental Conditions in connection with the property. From the data that has been assembled during the course of this investigation, it is the professional opinion of Hahn and Associates, Inc. that further investigatory work in the form of a Phase 11 Environmental Site Assessment appears does not appear to be necessary for the subject property at this time. However, while not a Recognized Environmental Condition under E1527-05, the following recommendation is presented: 1. Pesticide residues may be present in the near-surface soils of the subject property as a result of the historic usage of pesticides for agricultural purposes. There was no available evidence that indicated that concentrated spills have occurred on the subject property. In summary, while pesticides may be present in the near-surface soils at the property, their presence is not likely to pose an environmental concern at the property. Recommendation: Soil sampling, at the discretion of the property owner, may be prudent where former agricultural property may be developed or otherwise used for non-agricultural purposes (e.g. residential, parks, etc.) and where populations may come into direct contact with soil. 2. Based upon the age of the property structure (built in 1880), materials used in its construction may contain asbestos. Recommendation: It is recommended that an asbestos survey be performed for the property structure. Areas found to contain asbestos which are in a deteriorated condition should undergo abatement or be repaired by a licensed asbestos contractor. Additionally, prior to any renovation or demolition of the structures, any asbestos-containing Phase I Environmental Site Assessment Page 4 of 40 3.0-Acre Canterbury Property May 31,2007 10310 SW Canterbury Ln.,Tigard,Oregon HAHN AND ASSOCIATES, INC. 7259 Ph I Report.doc Privileged, Confidential, and Distribution Use Restricted materials should be removed by a licensed asbestos contractor and/or managed in accordance with the applicable regulations. Phase I Environmental Site Assessment Page 5 of 40 3.0-Acre Canterbury Property May 31,2007 10310 SW Canterbury Ln.,Tigard, Oregon HAHN AND ASSOCIATES, INC. 7259 Ph I Report.doc Privileged, Confidential, and Distribution Use Restricted 2.0 INTRODUCTION Ramis Crew Corrigan, LLP has retained the environmental consulting firm of Hahn and Associates, Inc. (HAI) to perform a Phase I Environmental Site _ Assessment (ESA) of the 3-acre Canterbury Property located at 10310 SW Canterbury Lane, Tigard, Washington County, Oregon. This Phase I ESA was undertaken by Ramis Crew Corrigan, LLP (Client) for the purpose of identifying Recognized Environmental Conditions (RECs) at the property, that is, the presence or likely presence of any hazardous substance or petroleum product on the property under conditions that indicate an existing or an historic release, or a material threat of a release into structures on the property or into the ground, groundwater, or surface water of the property resulting from the current or historical usage of the property or sites located in the vicinity of the property. This report is intended to constitute All Appropriate Inquiry(AAI) for purposes of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA). Information on the property under consideration was gathered through a physical inspection (site survey) of the subject property, through interviews of knowledgeable persons including past and present owners, operators, and occupants, and others, by a review of the available historical documents including recorded environmental cleanup liens, by noting the physical features of the property, by a survey of the surrounding land uses, through reviews of Federal, tribal, state, and local government records, and from the examination of other pertinent documents including photographs and maps. The scope of work for this project followed the American Society for Testing and Materials (ASTM) guideline (E1527-05) entitled Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process. The U.S. Environmental Protection Agency (EPA) has stated that ASTM El 527-05 may be used to comply with meeting the objectives and performance factors of 40 Code of Federal Regulations (CFR) Part 312 Standards for All Appropriate Inquiries, Final Rule (40 CRF 312.11). Any deviations to or from ASTM El 527-05 are described in Section 8.0 Additional Services, Deviations, or Data Gaps. In accordance with the HAI Services Agreement and unless specifically noted herein, the Phase 1 ESA review and inspection activities will not include items that are outside the scope of ASTM E1527-05 such as issues related to lead-based paint, lead in drinking water, electromagnetic radiation, cultural and/or historic resources, indoor air quality (e.g. vapor intrusion, Phase I Environmental Site Assessment Page 6 of 40 3.0-Acre Canterbury Property May 31,2007 10310 SW Canterbury Ln.,Tigard, Oregon HAHN AND ASSOCIATES, INC. 7259 Ph I Report.doc Privileged, Confidential, and Distribution Use Restricted radon, etc.), fungi (e.g. mold), wetlands and other ecological resources, and endangered species. Similarly, the review and inspection activities will also not include surveys for asbestos, health and safety, regulatory compliance, or a determination of the suitability of a property or its structures for any purpose. This report is divided into twelve additional sections: Site Background, Physical Setting Sources, Site Investigation, Interviews and Site History, Regulatory Review, Additional Services or Deviations, Signatures of Environmental Professionals, Limitations, Glossary of Abbreviations, Definition of Terms, and Professional Qualifications. This report is not intended to be an exhaustive investigation of environmental conditions or a characterization of any contamination discovered. 3.0 SITE BACKGROUND 3.1 Site Location and Description The approximately 3-acre subject property is located at 10310 SW Canterbury Lane, Tigard, Washington County, Oregon. The property consists of Tax Lot 2600, located in the SW 1/4 of the NW 1/4 of Section 11, Township 2 South, Range 1 West of the Willamette Meridian (W.M.). The property included an approximately 13,600-square foot fenced area on the northeastern corner that was leased to the Tigard Area Historical & Preservation Association (TAHPA). The leased portion of the property was occupied by an approximate 1,000-square foot historical residence, the John Tigard House and Museum. The residence, now museum, was built in 1880 and moved onto the property in 1979. A replica of an outhouse was also observed near the historic residence. The remainder of the property was undeveloped, forested or covered with native vegetation. A small central portion of the property was utilized as a dog park (Figures 1 and 2). The subject property was located in a residentially-developed area. The property was bounded to the north and northwest by the Tigard Water District water facility and a residence, and to the northeast by SW Canterbury Lane. It was bounded to the east by SW 103rd Avenue followed further by residential development. The Tigard Water District water facility = included a shop, water tanks, and a leased cellular tower. Residential property bounded the property to the south. Phase I Environmental Site Assessment Page 7 of 40 3.0-Acre Canterbury Property May 31,2007 10310 SW Canterbury Ln.,Tigard,Oregon HAHN AND ASSOCIATES, INC. 7259 Ph I Report.doc Privileged, Confidential, and Distribution Use Restricted 4.0 PHYSICAL SETTING SOURCES 4.1 Topography The subject property is located on the U.S. Geological Survey 7.5-Minute Quadrangle, Beaverton, Oregon, 1981 (Figure 1). It was situated on northeastern-sloping terrain at an elevation of approximately 400 feet above mean sea level (msl). 4.2 Geology and Hydrogeology According to the Oregon Department of Geology and Mineral Industries Earthquake-Hazard Geology Map of the Beaverton, Oregon Quadrangle, 1990, the soils in the vicinity of the subject property are underlain by Pleistocene fine-grained facies, described as coarse sand to silt deposited by catastrophic floods. Monitoring wells were not observed on the subject property or indicated by OWRD records to be located on the property. An OWRD well log report for all registered wells in Section 11 of Township 2 South, Range 1 West, W.M. contained groundwater level data for wells utilized by the Tigard Water District in the deep aquifers, and indicated that the depth to first groundwater in the vicinity of the property was over 200 feet below ground surface (bgs) (Appendix A). Groundwater may be found at more shallow depths in the - area, however, no data was available in the immediate vicinity of the property. HAI has not field-checked any of the site geological or hydrogeological information for accuracy as a part of this environmental site assessment. 5.0 SITE RECONNAISSANCE A site survey of the subject property was conducted on May 4, 2007 by Ms. Shelley Fenton, R.E.A., a representative of HAI. The property was inspected for visual evidence of contamination, for improper waste disposal and for the 1 possible presence of asbestos, polychlorinated biphenyls (PCBs), and underground storage tanks (USTs). Access to the property was granted by Mr. John Goodrich of the City of Tigard Public Works, the property owner, who accompanied Ms. Fenton on a portion of the site inspection. Ms. Ruth Croft of TAHPA accompanied Ms. Fenton through the residence/museum located on the property. In addition, a visual inspection was conducted of the adjoining properties from the subject property boundary, public rights-of-way, or other vantage points (e.g., aerial photography). The visual inspection of the subject and adjoining properties endeavored to identify areas where hazardous substances, petroleum and petroleum products may be or may have been stored, treated, handled or disposed. 5.1 Existing Site and Surrounding Site Conditions The subject property was occupied by an approximate 1,000-square foot historical residence, built in 1880, which was used as a museum. A replica of an outhouse was also observed near the historic home. The residence and outhouse were within a 13,600-square foot fenced area on the northeastern corner of the property that was leased by TAHPA for the John Tigard House and Museum. Four fruit trees had been planted within the fenced area. The remainder of the property was undeveloped and either covered with trees or native vegetation. A small central portion of the property was utilized as a dog park (Photograph 1). A trail running east to west was observed along the southern property boundary. Evidence of the usage, storage, or disposal of hazardous materials or Recognized Environmental Conditions (RECs) on the adjoining parcels and right-of-way areas was not observed from the property boundary or from the public right-of-way. Phase I Environmental Site Assessment Page 9 of 40 3.0-Acre Canterbury Property May 31,2007 10310 SW Canterbury Ln.,Tigard, Oregon HAHN AND ASSOCIATES,INC. 7259 Ph I Report.doc Privileged, Confidential, and Distribution Use Restricted 5.2 Asbestos Asbestos is a U. S. Environmental Protection Agency (EPA)-regulated toxic substance and a human carcinogen. By EPA standards, asbestos- containing materials (ACMs) are any materials that contain more than one percent asbestos. ACMs were typically used in insulation materials, ceiling tiles, and linoleum manufactured prior to the mid-1970s. However, certain types of ACMs, including roofing felt and coatings, among others, may continue to legally be imported or produced, sold, and installed in structures today. An asbestos survey was not within the scope of this Phase I Environmental Site Assessment and was not performed for the property. However, a visual assessment for suspect ACMs was conducted during the course of the Phase I ESA site inspection. This visual assessment does not constitute an asbestos survey and is not intended to identify every suspect asbestos-containing material at the property. The Oregon Department of Environmental Quality (ODEQ) requires that ACM surveys be performed prior to any demolition (including intentional burning) or renovation activities of structures other than residential buildings with four or fewer dwelling units and single private residences. If ACMs are identified, they must be removed from a site prior to demolition, dismantling or renovation to prevent the release of asbestos fibers to the air(Oregon Administrative Rule (OAR) 340-248-0270) regardless if the material is friable. Friable asbestos material is defined as any material with more than one percent asbestos by weight that hand pressure can crumble, pulverize or reduce to powder when dry. In addition, the Oregon Occupational Safety and Health Administration (OR- OSHA) requires that commercial and industrial building and facility owners perform surveys to identify ACMs in their buildings. Further, for buildings that contain ACMs, notification of the presence of ACMs and asbestos training must be provided to tenants, employees, and maintenance personnel that work in the buildings. Suspect ACMs were not noted at the subject property. Based upon the age of the residence (built in 1880 with renovations in the late 1970s), it may contain asbestos. Since ACMs may continue to legally be imported or produced, sold, and installed in structures today, a building owner and/or contractor may find it prudent to conduct an asbestos survey prior to the renovation or demolition of any structure. Phase I Environmental Site Assessment Page 10 of 40 3.0-Acre Canterbury Property May 31,2007 10310 SW Canterbury Ln.,Tigard,Oregon HAHN AND ASSOCIATES, INC. 7259 Ph I Report.doc Privileged, Confidential, and Distribution Use Restricted 5.3 Underground Storage Tanks and Aboveground Storage Tanks During the assessment activities, visual evidence of underground storage tanks (USTs) was not noted on the subject property. Visual evidence would include fill caps, vent pipes, pump islands, and tanks, all of which were - absent. According to Mr. Goodrich, the subject property was undeveloped prior to the residence being moved onto the property. Ms. Ruth Croft of TAHPA indicated that no water or sewer services are connected to the historic residence and the only source of heating was a wood-burning stove. Aboveground storage tanks (ASTs) were not observed on the subject property. Tualatin Valley Fire and Rescue indicated that they do not maintain residential UST records. The property did not appear on the ODEQ Registered UST or LUST facility lists. Through information obtained through interviews with City of Tigard employees and from documentation provided by ODEA, five USTs were removed from the adjacent City of Tigard Water District facility during 1990 and 1994. The USTs are discussed further in Section 7.0 Regulatory Review Oregon Department of Environmental Quality UST Database List. 5.4 Polychlorinated Biphenyls Polychlorinated biphenyls (PCBs), EPA-regulated hazardous substances, are commonly found in electrical equipment manufactured prior to 1980, the year PCBs above 50 parts per million (ppm) were banned from commerce for most applications. Pole and pad-mounted fluid-filled electrical transformers, ballasts associated with fluorescent light fixtures and some hydraulic fluids are typical of electrical equipment that would be suspected to contain PCBs. Electrical transformers were not observed on the subject property. Three fluid-filled electrical transformers on three poles were located in the right-of- way of SW 103rd Avenue. The transformers had blue labels indicating that they did not contain PCBs. Fluorescent light ballasts (used in light fixtures) manufactured prior to 1979 typically contained PCBs. Ballasts manufactured since approximately 1979 typically do not contain PCBs. Fluorescent lights were not observed within the subject property structure. Water supply wells were not observed on the subject property, or indicated by OWRD records or through interviews to be located on the property 5.5 Other Site Features The John Tigard House on the subject property was served by municipal water(to the exterior hose bib only) and had no sanitary sewer services. The leased area was enclosed by a fence. A replica of an outhouse was observed within the fenced enclosure, along with four fruit trees. According to Ms. Croft, the trees were planted at approximately the same time the John Tigard residence was moved to the property in 1979. A small amount of litter, aluminum cans, and food containers were observed along the subject property boundaries. However, nothing of a hazardous nature was observed. A trail traversing from east to west across the southern boundary of the subject property was inspected during the site visit. According to Mr. Goodrich, the trail appears to be used by area residents visiting the dog park which was located centrally in a meadow on the property. Two stormwater grates were observed along the center portion of the subject property. According to Mr. Goodrich, a stormwater easement crosses the property from east to west. Evidence of imported fill was not observed on the subject property (e.g. stockpiles, mounds, hummocks, depressions, etc.) or identified by interviews or the historical records review performed for the property. However, the possibility exists that undocumented fill could be located on the property. Further, the presence of undocumented fill at a property could present environmental concerns. In addition, to the extent that they have been identified, past owners, operators, and occupants likely to have information regarding the potential for contamination at the property were also interviewed. Further, a reasonable attempt has been made to interview a state and/or local government agency. Additional personnel may also be interviewed as deemed necessary. Data Gaps with regard to the referenced interviews are discussed below and in Section 8.0 Additional Services, Deviations, and Data Gaps. Current Property Owner, Key Site Manager, and Occupant Ms. Ruth Croft, as a representative of TAHPA, the current tenants on the subject property, was interviewed on May 7, 2007. Ms. Croft indicated that the John Tigard House was constructed in 1880 and moved to the present site in 1979. She further indicated that there was no interior plumbing in the residence and water was only available at the hose bib on the side of the house. Ms. Croft indicated that the residence was open as a museum once a month and otherwise was utilized only for special events. On May 16, 2007, HAI interviewed Mr. Sam Morrison of the City of Tigard Water Operations. In 1990, Mr. Morrison was present when the four USTs - were removed from the water district facility, under oversight of an environmental firm. Mr. Morrison indicated that the tanks were over 100 feet from the nearest subject property boundary. According to Mr. Morrison, the tanks were first emptied, purged with dry ice, and had the ends removed, prior to their removal from the facility. Mr. Morrison recalled that no indication of a petroleum release was encountered in the soil beneath the three gasoline USTs, and that groundwater was not encountered during the removals. He indicated however, that the soil beneath the waste oil tank showed visual signs of a petroleum release. Mr. Morrison recalled that the impacted soils were tested by the environmental firm prior to being stockpiled for aeration, due to petroleum contamination. He indicated that the soil was eventually removed from the facility at a later date. However, there was no information or reports on the removal activities. Mr. John Goodrich of the City of Tigard Public Works, as a representative of the current owner of the subject property, was interviewed on May 7, 2007. Mr. Goodrich indicated that the City of Tigard Public Works took over the former Tigard Water District and did not have any equipment on, or utilize the surplus property (subject property). Mr. Goodrich was unaware of any hazardous material storage or usage on the property. Mr. Goodrich was not aware of any existing or former ASTs, drywells, pits, sumps, or fill material on the subject property. He also indicated that he was not aware of environmental permits, notices, significantly lower property purchase price (lower than comparable), environmental liens or activity and use limitations, or RECs in association with the subject property. Further, Mr. Goodrich was not aware of any pending, threatened or past litigation or administrative proceedings relevant to hazardous substances or petroleum products in, on, or from the property. He was similarly not aware of any notices from any government entity regarding possible violation of environmental laws or possible liability relating to hazardous substances or petroleum products. In addition, Mr. Goodrich indicated that he was not aware of environmental conditions that have affected or may affect the purchase or lease price of the property. He had no specialized knowledge of the property or surrounding sites, and knows of no commonly known Phase I Environmental Site Assessment Page 15 of 40 3.0-Acre Canterbury Property May 31,2007 10310 SW Canterbury Ln.,Tigard,Oregon HAHN AND ASSOCIATES, INC. 7259 Ph I Report.doc Privileged, Confidential, and Distribution Use Restricted information about the property that would help in identifying conditions indicative of releases or threatened releases, including RECs at the property or beyond the issues detailed herein (refer to Section 5.4 Other Site Features and Section 6.1 Interviews). Mr. Goodrich had no knowledge of any obvious indicators that point to the presence or likely presence of contamination at the property. Past Property Owner(s), Operator(s) and Occupant(s) According to information provided by Mr. Goodrich, the Tigard Water District (now the City of Tigard Public Works) has owned the subject property since the 1950s. He also informed HAI that the Tigard Water District shop building on the adjacent property contains an area where four 55-gallon drums of sodium hypochlorite were stored (within a secondary containment). He also indicated that the shop contained an approximate 100-gallon diesel fuel AST that was utilized for emergency back-up power in the case of power failure at the water facility. He was not aware of any hazardous materials spills or releases regarding the sodium hypochlorite or diesel fuel AST on the adjacent municipal water facility property. State and/or Local Government Agency On May 2, 2007, HAI contacted the City of Tigard regarding building permits for the subject property, and Tualatin Valley Fire and Rescue regarding UST permits for the property. Building permits were not located. On May 2, 2007, HAI contacted Ms. Greer Gaston regarding historical information regarding the subject property. Ms. Gaston provided information as to contacts at TAHPA and a brief history of the property as the site of the John Tigard House. Ms. Gaston also provided information as to a possible ... stormwater easement located on the property. On May 4, 2007, HAI contacted a representative at the Washington County Development Center regarding building permits on the property. Building permits were not found in their files. HAI reviewed the available building permits at the City of Tigard regarding the subject property. Permits for the for the entire Tigard Water District parcel included a water pump house and pump station. A 1979 permit for a new foundation was also found for the John Tigard House. The representative informed HAI that the property was owned by Tigard Water District. On May 9, 2007, HAI interviewed Mr. Steve Paiko of the ODEQ UST program for information regarding the former USTs on the adjacent property. Mr. Paiko indicated that in January 1990, the Tigard Water District removed four USTs from the adjacent municipal water facility. Mr. Paiko provided HAI with available documentation regarding their removal. Additional Interviews On May 4, 2007, HAI interviewed Mr. Paul Miller, owner and occupant of the nearby residence at 10380 SW Canterbury Lane. Mr. Miller was not aware of any hazardous materials incidents at the municipal water facility to the west of his home. He also stated that his residence was the former pastor's residence for the Presbyterian Church located to the north of SW Canterbury Lane. On May 4, 2007, HAI interviewed Ms. Ruth Croft of TAHPA. Ms. Croft informed HAI that the John Tigard House was built in 1880 and moved to its current location in 1979. Ms. Croft provided information regarding the utilities that were connected to the house. She was not aware of RECs associated with the residence. 602 Specialized Knowledge and Commonly Known Information Persons (e.g. the User/Client) seeking to qualify for the innocent landowner defense, prospective purchaser or contiguous property owner liability protection under CERCLA must provide any specialized knowledge of the subject property or surrounding sites, commonly known or reasonably ascertainable information within the community regarding the subject property, and any other experience relevant to this inquiry, for the purpose of identifying conditions indicative of releases or threatened releases at the subject property. The User/Client must also consider the degree of obviousness of the presence or likely presence of contamination on the property. At the request of HAI, Ms. Jennifer DeGregorio, a representative of Ramis Crew Corrigan, LLP (the Client), and Mr. John Goodrich, a representative of the City of Tigard Public Works (the Owner), completed Phase I Environmental Site Assessment Client-Furnished Information Checklists (Appendix C). Ms. DeGregorio and Mr. Goodrich indicated that they were Phase I Environmental Site Assessment Page 17 of 40 3.0-Acre Canterbury Property May 31,2007 10310 SW Canterbury Ln.,Tigard, Oregon HAHN AND ASSOCIATES, INC. 7259 Ph I Report.doc Privileged, Confidential, and Distribution Use Restricted not aware of environmental notices, significantly lower property purchase price (lower than fair market value), or Federal, tribal, state, or local environmental liens or activity and use limitations (AULs, such as engineering or institutional controls) in association with the subject property (as borne out by the Lot Book Service Report provided by Ramis Crew Corrigan, LLP and reviewed by HAI, Appendix B). They had no specialized knowledge of the property or surrounding sites, beyond the issues detailed herein, and knew of no commonly known information about the property that would help in identifying conditions indicative of releases or threatened releases, including RECs at the property. Ms. DeGregorio and Mr. Goodrich further indicated that they were not aware of any pending, threatened, or past litigation or administrative proceedings concerning hazardous substances or petroleum products in relation to the property, and that they were not aware of any notices from any government entity regarding possible violation of environmental laws or possible liability relating to _ hazardous substances or petroleum products. In addition, they indicated that they were not aware of environmental conditions that have affected or may affect the purchase or lease price of the property. Mr. Goodrich and Ms. De Gregorio had no prior knowledge of RECs at the property or of any obvious indicators that point to the presence or likely presence of contamination at the property. 6.3 Site History A combination of practically reviewable information (available within reasonable cost and time constraints), obtained from publicly available records, aerial photographs, city directories, and interviews, was used to determine the prior uses of the subject property and of the surrounding properties. Based upon the interviews and the resources that were reviewed, the history of the subject property and of the surrounding land use was determined. In the 1940 aerial photograph, the western portion of the property was forested and the eastern portion of the subject property was utilized for agricultural use, possibly the growing of hay or grain. By the time of the 1977 aerial photograph, the eastern portion of the property did not appear to be under cultivation and appeared to be unused. The western portion of the property was forested. By 1983, the John Tigard residence had been moved onto the northeastern portion of the property and was fenced. The property immediately to the south of the residence was under cultivation while the western portion of the property remained forested. By 1991, the cultivated area on the southeastern portion of the property had also been planted with fir trees and four fruit trees had also been planted within the fenced John Tigard House lease area. The eastern portion remained forested. The property has changed little from the 1990s until the time of the site inspection. Surrounding Properties _ The surrounding properties were historically undeveloped and forested (to the south of the subject property) or used for rural residential purposes (to the east of the property) and agricultural purposes (to the north and west of the property) by 1940. A small orchard was located immediately adjacent to the west of the property and beyond SW Walnut Street until at least the 1950s. Increased residential development was seen to the west of the property during the 1960s. By the late 1970s, the church was constructed across SW Canterbury Lane to the northwest and the residence had been constructed to the north and west of the property. The first water tank was r constructed to the west of the property in the early 1950s, and by the 1970s had been replaced with two larger water tanks and a shop building, all of which remained at the time of the site inspection. Ms. DeGregorio of Ramis Crew Corrigan, LLP (the Client) and Mr. John Goodrich of the City of Tigard (the Owner) were not aware of previous ESAs - having been performed for the property. 7.0 REGULATORY REVIEW As a part of this Phase I ESA of the subject property and as deemed necessary, inquiries were made to governmental agencies with jurisdiction over current and prior activities conducted at the subject property that could have affected the environment. When available and as necessary, files on nearby properties were also reviewed and agency personnel knowledgeable about activities conducted in the area of the subject property were interviewed. Federal and state databases were reviewed as part of this Phase I ESA. For databases organized by zip code, the 97223 and 97224 zip codes were reviewed for both the 0.5-mile and 1.0-mile radii. The following lists satisfy the requirements of ASTM E1527-05. The lists reviewed by HAI were the most recent lists available. Federal NPL Site List(1.0-mile radius) The EPA National Priority List (NPL) details the locations of hazardous substance sites that present a potential for imminent and substantial harm to the environment. As of February 23, 2007, the subject property and the properties located within a 1.0-mile radius of the property did not appear on the NPL list. Federal CORRACTS List(1.0-mile radius) The Corrective Action Report (CORRACTS) list identifies hazardous waste handlers with RCRA corrective action activity. As of March 12, 2007, the subject property or sites located within a 1.0-mile radius of the property did not appear on the CORRACTS list. Either no contamination was found at the CERCLIS NFRAP sites, the _ contamination has been remediated, or the contamination has been deemed to not be significant enough to require consideration under CERCLIS or NPL. The listing of a site on the CERCLIS NFRAP does not necessarily imply that contamination has been deemed insignificant or remediated based upon ODEQ standards. As of January 10, 2007, the subject property or sites located within a 0.5-mile radius of the property did not appear on the CERCLIS NFRAP list. Federal RCRA TSD Facilities List(0.5-mile radius) The Resource Conservation and Recovery Act (RCRA) Treatment, Storage and Disposal (TSD) facilities list identifies sites which manage hazardous waste for the purpose of on-site treatment, interim storage, or on-site disposal. The subject property or sites located within a 0.5-mile radius of the property did not appear on the RCRA TSD list dated March 12, 2007. Institutional controls include administrative measures, such as groundwater use restrictions, construction restrictions, property use restrictions, and post remediation care requirements intended to prevent exposure to contaminants remaining on site. Deed restrictions are generally required as part of the institutional controls. The subject property did not appear on the Federal Institutional Controls list, January 10, 2006 (the most recent list provided by EPA). Federal RCRA Handlers List(Property and Adjoining Properties) The EPA RCRA Handlers list identifies facilities that have given notification as hazardous waste generators, including Large Quantity Generators (LQG), Small Quantity Generators (SQG), or Conditionally Exempt Generators (CEGs). The subject property or adjoining properties did not appear on the RCRA Handlers list reviewed for this report, dated March 12, 2007. Federal ERNS List(Subject Property) The subject property did not appear on the EPA Emergency Response Notification System (ERNS) list as of April 3, 2007. Federal Brownfields Program Sites List(0.5-mile radius) EPA's Brownfields Program empowers states, communities, and other stakeholders in economic development to work together to prevent, assess, _ safely clean up, and sustainably reuse brownfields. As of February 23, 2007, the subject property or sites located within an approximately 1.0-mile radius of the property, did not appear on the ODEQ ECSI list reviewed for this report. Oregon Department of Environmental Quality SWDS and SWDF List (0.5-mile radius) The ODEQ list of actively permitted open and closed Solid Waste Disposal Facilities (SWDF), dated October 2, 2006, and the State of Oregon Closed Solid Waste Disposal Sites (SWDS) list, dated April 12, 2000 (the most recent lists available), were reviewed. The subject property or sites located within a 0.5-mile radius of the property did not appear on either of these lists. METRO Landfill Report (0.5-mile radius) The subject property or sites within a 0.5-mile radius did not appear within the METRO Landfill Report dated March 2004. Oregon Department of Environmental Quality LUST Database List (0.5-mile radius) Twenty-nine sites located within an approximately 0.5-mile radius of the property appeared on the ODEA Leaking Underground Storage Tank (LUST) Database list of April 1, 2007 (Appendix D). However, twenty-eight —' of the listings do not appear to represent a REC for the property based upon their distance from the property or the fact that the sites have been conferred ODEQ NFA status. The remaining site is discussed due to its close proximity to the property. • Tigard Water District (LUST Log Number 34-94-0109), 10490 SW Canterbury Lane, Tigard, Oregon, adjacent and to the west of the subject property. The tank was located over 100 feet from the nearest subject property boundary. The UST, rinse water, and residual fuel were removed from the property for off-site recycling. Approximately 14.77 tons of petroleum-contaminated soil (PCS) were excavated and disposed off-site. Groundwater was not encountered. Four confirmation soil samples were collected by EMCON from the base of the excavation, at either end of the former UST and to the north of the tank basin. Diesel fuel, below the ODEQ cleanup level, was detected in the sample collected from north of the tank basin. Cleanup documentation was not submitted to ODEQ until 2002, at which time the site was conferred a No Further Action (NFA) designation, and the _ release was closed. A copy of the closure letter is included in Appendix E. ... Low-level petroleum contamination may remain at the location of the former UST at the subject property. Based on this information and due to the distance of the former tank in reference to the subject property, the remaining contamination does not appear to represent a REC for the subject property. Oregon Department of Environmental Quality UST Database List (Property and Adjoining Properties) The subject property did not appear on the ODEQ UST Database list of April 1, 2007. However, the immediately adjacent Tigard Water District property was listed and is discussed below. • Tigard Water District (Facility Number 8336) 10490 SW Canterbury Lane, Tigard, Oregon, adjacent and to the west of the subject property. HAI contacted Mr. Steve Paiko of the ODEQ UST program for information regarding the former USTs. Mr. Paiko indicated that in January 1990, the Tigard Water District removed four LISTS from the adjacent municipal water facility (Appendix F). The tanks, a 1,000-gallon gasoline{Tank No. 1), a 1,000-gallon gasoline(Tank No. 2), a 2,000- gallon gasoline (Tank No. 3), and 350-gallon waste oil tank (Tank No. 5) Phase I Environmental Site Assessment Page 25 of 40 3.0-Acre Canterbury Property May 31,2007 ... 10310 SW Canterbury Ln.,Tigard, Oregon HAHN AND ASSOCIATES, INC. 7259 Ph I Report.doc Privileged, Confidential, and Distribution Use Restricted were removed and sent for recycling. At the time of their removal, the tanks were between thirteen to nineteen years old and were located over 100 feet from the nearest subject property boundary. Two of the tanks were topographically crossgraident and two were upgradient to crossgradient in relation to the subject property. Sampling documentation was not on file with ODEQ or the Tigard Water District. _ HAI interviewed Mr. Sam Morrison of The City of Tigard Water Operations. In 1990, Mr. Morrison was present when the four USTs were removed from the Tigard Water District facility under the oversight of an environmental firm. According to Mr. Morrison, the USTs were first emptied, purged with dry ice, and had the ends cut off prior to removal from the facility. Mr. Morrison recalled that no indications of a petroleum release were encountered in the soils beneath the three gasoline USTs, and groundwater was not encountered during the removals. He indicated however, that the soil beneath the waste oil tank showed signs of a petroleum release. Mr. Morrison recalled that the impacted soil was tested by the environmental firm prior to being stockpiled for aeration, due to petroleum contamination. He indicated that the soil was eventually removed from the facility at a later date. Mr. Morrison did not recall the name of the environmental firm and the City of Tigard has been unable to provide documentation regarding the analytical results regarding the UST removals. Based on the distance of the former tanks in relation to the subject property, and the fact that the tanks have been removed, along with the depth of groundwater(as reported at the adjacent water facility), these tanks do not appear to represent a REC for the subject property. One additional UST listed, Tank No. 4, a 1,000-gallon diesel tank was still in service at the time of the removal of the other tanks. This tank was subsequently removed in 1994 and is discussed in the LUST section and is not considered a REC for the subject property. Oregon Emergency Response Information System (ERIS) Spills List (Subject Property) The Oregon ERIS list identifies reported releases of petroleum and/or hazardous materials to land or water since 1995. The subject property did not appear on the ERIS list as of May 8, 2007. The properties are considered unfit for habitation until they are certified clean in accordance with the Oregon Department of Human Services' Clandestine Drug Lab Cleanup Program, at which time they are removed from the list. The subject property did not appear on the Drug Lab Cleanup Program list of uninhabitable properties as of April 16, 2007. Oregon Engineering Controls List(Subject Property) The Oregon Engineering Controls List identifies sites with engineering controls in place. Engineering controls include various forms of caps, _ building foundations, liners, and treatment methods to create pathway elimination for regulated substances to enter environmental media or effect human health. The subject property did not appear on the Oregon Engineering Controls List as of April 18, 2007. Oregon Institutional Controls List(Subject Property) The Oregon Institutional Controls List 'identifies sites with institutional controls in place. Institutional controls include administrative measures, such as groundwater use restrictions, construction restrictions, property use restrictions, and post remediation care requirements intended to prevent exposure to contaminants remaining on site. Deed restrictions are generally required as part of the institutional controls. The subject property did not appear on the Oregon Institutional Controls List as of April 18, 2007. Oregon State Fire Marshal's Office HSIS list(Subject Property) _ The Oregon State Fire Marshal's Office Hazardous Substance Information Survey identifies companies in Oregon submitting the Hazardous Substance Information Survey and either reporting or not reporting hazardous substances. As of April 18, 2007, the subject property did not appear on the Oregon HSIS list. As of February 5, 2004 (the most recent list provided by EPA), the subject property or adjoining sites did not appear on the Indian UST list. In performing an environmental assessment, a balance must be struck between the desire to conduct a complete inquiry into environmental matters and the limits of time, cost and technology. This report sets forth HAI's evaluation of the possibility of RECs based on the scope of work agreed to by the client and within the client's schedule and budget. No investigation is thorough enough to ensure that no hazardous substances are present on a particular property. To qualify for the first type of innocent landowner LLP, such person must have made all appropriate inquiry on or before the date of purchase. Furthermore, the all appropriate inquiry must not have resulted in knowledge of the contamination. No. 8336 To Whom It May Concern The Department of Environmental Quality has completed its review of the information submitted to date concerning the underground storage tank(UST) decommissioning and cleanup conducted at 10490 SW Canterbury Lane in Tigard, Oregon. The Department has determined that the cleanup appears to have met the requirements of Oregon Administrative Rules (OAR) 340-122- 0205 through 340-122-0360 and that no further action is required at this time. This determination is a result of our evaluation and judgment based on the regulations and facts as we now understand them: 1. A release of diesel from an UST was reported to DEQ on June 6, 1994 by Brian Kier of EMCON. The release was discovered during tank decommissioning work at this location. 2: A 1,000-gallon diesel UST was decommissioned by removal in June 1994. The UST was taken to Schnitzer Steel for scrap metal recycling. 3. Some 134 gallons of triple rinse water was pumped out of the UST and taken off-site for treatment and disposal by Spencer, Inc. of Oregon City, Oregon. 4.- Some 14.77 tons of petroleum-contaminated soil (PCS) was excavated and taken to Hillsboro Landfill near Hillsboro, Oregon. 5. Four soil confirmation samples were collected from the pit excavation with results ranging from non-detect to 173 parts per million(ppm) by EPA Method 418.1 Modified. These levels are below DEQ's Level II Soil Matrix cleanup standard for diesel-contaminated soil of 500 ppm. 6. No groundwater was encountered during the tank.and PCS removal. The Department's determination also does not apply to any conditions at the site other than the release of the petroleum product specifically addressed in the report(s).
